Feb. 23, 1983
Councilmen present: John Pflugrath, Ray Duncan, Ed Rich and Hartley Beeler.
Attorney, Neil Fuller and Peggy McArthur, City Clerk.
Meeting was called to order by Mayor Forrest Lannoye.
Minutes of the previous meeting were approved as presented. Motion was made by
John Pflugrath, seconded by Ray Duncan and passed unanimously.
Bills and accounts were approved as submitted. Motion was made by Ray Duncan,
seconded by Hartley Beeler and passed unanimously.
Hartley Beeler stated the three lights that are out should be repaired soon.
Admission taxes were again discussed. Neil Fuller said he could not find any case
law as far as putting a ceiling on the taxes. He said everyone must be treated the
same. Neil said lowering the tax would probably be the simplest and cleanest way
to lower the tax and the potential of a challange would be less likely. Under the
amended ordinance, it was suggested that no charge would be imposed upon establishments
with lounges. Only a cabaret license would be required where dancing is permitted.
' Authorization was given by the Council to have an amended ordinance drafted for the
March 21st meeting leaving a blank amount for the percentage figure which will be
decided by the Council at said meeting. Motion was made by Ray Duncan, seconded by
John Pflugrath and passed unanimously.
The City owned lots were again discussed. Mayor Lannoye said he met with orie of
the business men and his attorney. It was suggested the City lease the lots and
improvements of leveling and surfacing would be done. The business would make
improvements on the lots with option to purchase within two or three years. They
would carry the insurance and assume responsibility until date of purchase. If
they could not come up with the appraised value, the lots would revert back to the
City.
John Pflugrath said he wanted time to think about it and review other options.
Mayor Lannoye said this was the first time he had negotiated with them and did not
have time to brief each council member before the meeting.
Neil Fuller said he would talk to Ernie Elder and his Attorney and draft some
kind of a proposal for the Council's review. No action was taken at this time.
Authorization was given by the Council to appoint Richard Baker as a member of
the Planning Commission. Motion was made by Hartley Beeler, seconded by Ed Rich
and passed unanimously.
After some discussion and addition to the specifications to open the bidding
to all interested dealers, authorization was given by the Council to call for bids
for a 1983 police car. Said bids to opened March 21st. Motion was made by Ray
Duncan, seconded by Hartley Beeler and passed unanimously.
