Oct. 15, 1984
Councilmen present: Ed Rich, Bill Tarver, Ray Duncan, Fred Ross and Less Young.
Attorney, Neil Fuller and City Clerk, Peggy McArthur.
Meeting was called to Order by Mayor, Don Crain.
Minutes of the previous meeting were approved as presented. Motion was made by
Ray Duncan, seconded by Bill Tarver and passed unanimously.
Bills and accounts were approved as submitted. Motion was made by Bill Tarver,
seconded by Ed Rich and passed unanimously.
Mayor Crain asked what progress was made on Third Street with the Cashmere Valley
Bank. Ed Rich and Les Young said they looked at the project and survey stakes are
out on the street. If an easement is not granted, they said, Third Street would
be one lane only.
John Hotchkiss and Bill Scaife representing the Bank stated the permit was issued
as submitted and they are willing to Grant an easement, leaving the corner the same
but would not grant an additional five feet for sidewalk. The five foot easement
they agreed to grant to the City is the existing pavement and the additional footage
at the corner of Third and Valley Mall Parkway. Bob Goodman and Chief Brooks said
a sidewalk is necessary as people walking, will have to walk in the street and could
create a hazard.
Neil Fuller said the City's only recourse would be to condemn the property and buy
the land required for a sidewalk at the appraised value and also stated, the City
could still loose the suit.
Bill Scaife said they are going to continue building and the City will have to
condemn as they are giving up any additional property.
Ed Rich said the problem should have been caught and looked into before the permit
was issued, stating, it was a real foul-up.
Fred Ross made a motion that the City accept the Bank's proposal as the street now
exists. Seconded by Ed Rich and passed unanimously.
The Council directed Neil Fuller and the Bank's attorney to draft the necessary
easement.
Mayor Crain stated the City Hall and Shop roofs have been repaired; demolition
has been started on the school and Bob Goodman added that he is putting in posts
at this time for the 15 minute parking signs.
An amended Notice of Intent to Commence Annexation Proceedings was received by
attorneys for Gackstetter and Thomas Kincaid.
The Council scheduled the meeting of Nov 5th to meet with the property owners.
Motion was made by Bill Tarver, seconded by Fred Ross and passed unanimously.
