CITY COUNCIL SPECIAL ANNEXATION MEETING
October 23, 1989
Council Members Present: Dawn Collings, Les Young, Tery McKee, Paul Cassel and Dennis
Hendricks. City Attorney, Charles Zimmerman and Deputy City
Clerk, Dannie Kinzel.
Meeting was called to order by Mayor Richard McGraw.
Charles Zimmerman made the following comments for the record. The purpose of this
public hearing is for annexation as set forth in Resolution 89-9.
Affidavits of publication in the Wenatchee World were October 5, 1989 and October 12,
1989. Public notice of special hearing was received by Council members, Charles
Zimmerman's office and Nick Wiltz as prescribed by law.
Nick Wiltz was then asked to point out the property in question an a map. Before
doing so he stated he had received a letter from the engineering firm of Forsgren
Associates, PA, and signed by Norm Nelson that the area to be annexed was 84%
surrounded by City property.
Charles Zimmerman said the procedure being followed is set forth in RCA 35A.14.295 and
.297; the annexation of a unincorporated territory contiguous to the City and 80%
surrounded by City property.
Using the map Nick Wiltz said "the area is located South of 15th street and West of
the Wenatchee Reclamation Irrigation Ditch, it runs on up along the irrigation
boundary then along the South City limits to the South, then back North on Colorado
Street, takes in part of llth Street, follows llth Street back up and then goes North
again on Devon and back on 12th Street to Baker, and that is the area." This area is
less than 100 acres.
The purpose of the public meeting is to give the people who reside in this area an
opportunity to comment on this resolution of the City.
If the Council decides they would like to follow through with the annexation, as set
forth in the Resolution and described by Mr. Wiltz, then there would be an Ordinance
subsequent to the meeting passed by the City council annexing that property. The
effective date of the Ordinance would be no sooner than 45 days after the passage of
the Ordinance.
At this time Charles Zimmerman stated any property coming into the City at this time
would be zoned R-1 or R-L (residential light). Any thing that differed from that
zoning classification at the time of annexation would come in as a nonconforming use.
In other words, if you have a business in the area it would come in and would be
allowed to continue, but if it terminated or if the use of the property changed, it
would revert back to R-L zoning classification. And of course, at any time you could
apply for a different zone change.

Mayor McGraw asked if there were any questions for the staff. There were none. He
then asked if there were any questions from the proponents, anyone in the audience
that was for the annexation. Being no response, he asked to hear from those against
the annexation.
Emma Barkhauff of 1125 North Devon asked for a definition of light residential (R-L).
Nick Wiltz gave a brief answer. She asked about mobile homes, and Mr. Wiltz said they
were not allowed. Also businesses are not allowed in R-L.
Mr. Zimmerman briefly went through the sections under R-L Residential, Chapter 17.16
of the East Wenatchee Municipal Code stating what was allowed and what was not
allowed.
Sylvia Akins stated the reason for the odd boundaries surrounding the City was due to
developers who built and then annexed into the City, and should have been stopped.
Edna Brown felt the people residing in the area to be annexed should have been
notified. She did not feel a short item in the paper was sufficient.
The question was asked if the 6% surcharge would be imposed on the citizens if
annexed. Mayor McGraw said no. Asked if there were plans of a utility tax like they
have in Wenatchee. Mayor McGraw said at this time the Council had no such plans. He
also stated the Library service would not change.
Elisa Clarity spoke next stating they lived on 13th Street which is in the County and
have more than a acre of land. They wished to remain in the County so their three
year old son as he grows up can raise animals. Nick Wiltz said if they were raising
the animals right now, they could continue till such time they stopped. She said they
were not raising animals at this time, but when her son got older she would like him
to have the opportunity and the responsibility. It was pointed out that if annexed
and they did not have a horse on the property at this time, they would not be allowed
to do it later.
Larry Akins addressed the Council saying he owns and operates six acres of orchard in
the area. He stated he does all his own maintenance, does not need the services of
the County and could not foresee in the future needing any services from the City.
Edna Broom asked if sidewalks were in the plans going up filth Street. Mayor McGraw
said he thought the City's Comprehensive Plan did call for those types of improvement,
as we can make them. Mrs. Brown said it would cost them a fortune. She then went on
to ask if the City supported the County Pool. She was assured by the Mayor and
Council that the City of East Wenatchee did support the pool.
Mayor McGraw asked if there were any further comments. There were none.
Mayor McGraw declared the hearing closed at this time and asked the Council to
deliberate the issue and make a determination.
Paul Cassel said the question is, do we go forward with the annexation at this time.

Charles Zimmerman said the next step in the procedure would be to direct his office to
draft the appropriate ordinance with an effective date of when they would like the
area to be annexed in, and that date could not be any sooner than 45 days from the
date of passage of the Ordinance. The next possible date of passage would be the
November sixth meeting.
Next the Boundary Review Board needs to review the Ordinance and make the
determination if they want to invoke jurisdiction or not. Given the irregular
boundaries situation, it is unlikely the Boundary Review Board would be concerned, but
this only speculation on my part, remarked Charles Zimmerman.
Paul Cassel made a motion to go forward with the annexation of the resolution area
that was being considered at this hearing, and to instruct the city's attorney to go
forward with the preparations of the ordinance for passage.
Motion was seconded by Les Young and passed by vote of the Council.
It was decided to continue this special meeting for passage of the Ordinance to
Thursday, October 26, at 5:30 P.M.
The Council adjourned until October 26, 1989.
