CITY COUNCIL MEETING
AUGUST 7, 1989
Council Members present: Dawn Collings, Les Young, Tery McKee, Paul
Cassel and Dennis Hendricks. City Attorney Chuck Zimmerman and
City Clerk, Peggy McArthur.
Meeting was called to order by Mayor Richard McGraw.
Minutes of the previous meeting were approved as presented. Motion
was made by Paul Cassel, seconded by Dennis Hendricks and passed by
vote of the Council.
Bills and accounts were approved as submitted. Motion was made by
Dawn Collings, seconded by Tery McKee and passed by vote of the
Council.
Chief Flinner gave a short synopsis of the department's monthly
activities which included, training, public relations and
significant accomplishments.
Nick Wiltz said both the Board of Adjustment and Planning Commission
had met in July. He said Rod Towell had resigned from the Board of
Adjustment and Larry Johnson had been appointed by Mayor McGraw to
fill that position.
• The Council granted Nick Wiltz permission to attend a seminar in
Bellevue September 27, 28, and 29 pertaining to mechanical codes.
Attorney Chuck Zimmerman referred to a memo from their office dated
July 19, 1989 in reference to PUD/Valley Mall Parkway Agreement and
stated that an amended agreement had been drafted with the
recommended changes. Chuck said the P.U.D. Commissioners are
comfortable with the terms of the agreement and that he had prepared
Resolution authorizing the Mayor to execute the Contract.
Dennis Hendricks said he was disturbed by the Agreement and felt it
was one-sided and not above board. Hendricks said he felt the City
was not getting anything out of the agreement and felt the public
did not know what was going on. Dennis said the P.U.D. has known
about the underground requirement since 1971 and made no attempt to
try to get it changed. Dennis said the P.U.D. put their vaults in
on their own and then turn around and charge the rate payers.
Chuck Zimmerman said he was of the opinion that the City did not
have to enter into an agreement and the P.U.D. could charge the rate
payer without the Council entering into an agreement. Chuck said
the P.U.D. had agreed to reduce the amount from $572,000. down to
$350,000.
Mayor McGraw said the Council had been working with the P.U.D. for
several months trying to get a reasonable rate established and feels
• the Council has saved the citizens a considerable amount of money.

Annexation by Petitioners on property bordered by 15th Street N.E.,
Eastmont, 8th Street N.E. and Iowa Streets was discussed. Bob Burke
advised the Council that the 245 acre addition would include
dwelling units and 1,036 people. Bob said it was also recommended
by City staff that two additional parcels of land on the North and
South of the current City limits be included in the annexation.
Those areas include an area between the irrigation canal on the
West, Eastmont Ave. on the East, 15th Street on the North and the
existing City Limits on he South and a small parcel nearly
surrounded by the City shown on the map as Parcel A. Ninth street
N.E. to the property line behind 7th street N.E. from Baker to
Eastmont also was recommended to included in the Petition area.
It would require four additional employees to maintain services in
the proposed areas and he stated that the City would gain enough
additional revenues over the next three years to offset all costs
according to Staff reports.
Jerry Chapton told the Council he was not in favor of annexation
East of Eastmont unless the City formed a joint committee with
Douglas County and work out problems prior to annexation. Mr.
Chapton was also concerned that more than 50 percent of the people
living in the proposed annexation area were not contacted and he
would like to see it become a ballot issue.
Paul Cassel and Tery McKee assured Mr. Chapton that the City has
developed a plan and set priorities for annexation and now are
following through the goals of the City's Comprehensive Plan.
Bruce Nash said it has taken a month and one half to collect the
signatures he did get. Bruce said the reason he chose the petition
method was because many of the people in the area are not registered
voters as they do not want to serve on a jury.
Following more discussion, Paul Cassel made a motion that the City
accept the Nash Petition., geographically modified to include the
Resolution area south of 15th Street N.E. and West of the irrigation
canal. Also to include in the petition area a small parcel nearly
surrounded by the City indicated on the map as Parcel A and 9th St.
N.E. to the property line behind 7th st. N.E. from Baker to Eastmont
indicated as Parcel B on the map. Motion subject to the City
Council entering into an acceptable Inter Local Agreement with the
County, arranging with the County to continue to provide services
over the next year from revenue received by the county from the
annexed area. Motion was seconded by Dawn Collings and passed by
vote of the Council.
Paul Cassel made a motion to adopt Ordinance No. 89-7 adding a new
section 6.04.045 to the municipal code to waive license fees for
guide and service dogs. Motion was seconded by Tery McKee and
passed
by vote of the Council.
Tery McKee said the project was originally tied in with plans for
the proposed Riverfront Highway. Opponents stopped the highway
project, thus leaving concrete vaults for the underground lines
several inches above street level, creating a safety hazard. Tery
said it was not the City's fault and it wasn't the P.U.D.'s fault
and that the P.U.D. had absorbed much of the project cost.
After more discussion, Tery McKee made a motion to adopt Resolution
No. 89-5 authorizing the Mayor to execute an agreement with Douglas
County P.U.D. #I concerning the P.U.D.'s improvements on Valley mall
Parkway. Motion was seconded by Paul Cassel and passed by vote of
the Council.
Bob Burke with McConnell/Burke spoke with the Council about funding
for Outdoor Recreation and said that the and Mayor McGraw had met
with Don Clark concerning the application and funding. Bob stated
650,000 is available and requests for over 14 million dollars have
been received.
Burke also mentioned the staff and council retreat coming up the 8th
and 9th of September. Bob suggested the Council review last
year's goals and drive around East Wenatchee and look around before
this year's retreat and get ideas of what the Council would like to
achieve in the future.
Les Young said the fireworks ordinance review would not be discussed
until the next meeting as he had copies of ordinances from other
Cities that he would like the Council to review. Mayor McGraw
suggested that the Council may want to hold off and the subject
could be discussed at the upcoming retreat.
Mayor McGraw called for a Public Hearing to discuss an Ordinance
amending Section 17.64.010 of the East Wenatchee Municipal Code,
requiring all property annexed into the City to be zoned R-L
Residential unless a proposed zoning regulation has been adopted for
the area proposed for annexation.
The City Planning Commission at its Public Hearing on July 24th
considered the proposed zoning and unanimously made its recommend-
ation to the Council that all property annexed into the City be
zoned R-L Residential.
Property owners still can petition for a different zoning change
before or after annexation takes place the public was advised.
Public input came from Jerry Chapton and Gene Lubking pertaining to
zoning. There being no further public input, Mayor McGraw declared
the Public Hearing closed. Dawn Collings made a motion to adopt
Ordinance No. 89-6 requiring all property annexed into the City be
zoned R-L, unless a proposed zoning regulation has been adopted for
the area. Motion was seconded by Dennis Hendricks and passed by
vote of the Council.

Motion was made by Tery McKee to adopt Ordinance No. 89-8,
• prescribing additional penalties for controlled substances
violations as required by State Law. Motion was seconded by Les
Young and passed by vote of the Council.

There being no further business, Dawn Collings made a motion that
the meeting be adjourned. Seconded by Paul Cassel and passed by
vote of the Council.
