COUNCIL MEETING
MAY 15, 1989
Council Members present: Dawn Collings, Tery McKee, Les Young,
Paul Cassel and Dennis Hendricks. Attorney, Charles Zimmerman
and Treasurer/Clerk, Peggy McArthur.
Meeting was called to Order by Mayor, Richard McGraw.
Minutes of the previous meeting were approved as presented. Motion
was made by Les Young, seconded by Dennis Hendricks and passed by
vote of the Council.
Bills and Accounts were approved as submitted. Motion was made by
Dawn Collings, seconded by Les Young and passed by vote of the
Council.
Police Chief John Flinner stated that the 1986 Chevrolet was vouchered
and would be paid for with K-9 funds. Motion was made by Tery McKee,
seconded by Paul Cassel and passed by vote of the Council that travel
for Randy Wesley to attend K-9 training come out of the police travel
budget.
ta Bob Goodman stated that he had talked with people involved in
disaster relief and a contract needs to be executed with the City,
dictating the terms of how the money will be used. Bob said it is not
significant amount as far as his budget is concerned but for future
mitigation, to prevent reoccurrence of the flood situations,it might
be well worth becoming a part of the disaster assistance program. Bob
said he felt the City would recover approximately $2,500.00 for
damages of City streets and side streets. Bob said the Council could
appoint a contact person and he would gladly be that person.
Motion was made by Paul Cassel to Adopt Resolution No. 89-1
(Designation of Applicant's Agent) authorizing Bob Goodman to
represent the City in obtaining federal and or state emergency or
disaster assistance funds, and also to allow Bob Goodman to execute
State of Washington, Department of Community Development Division
of Emergency Management Contract. Motion was seconded by Dennis
Hendricks and passed by vote of the Council.
Bob Goodman said there had been a slight change in the project on
Valley Mall Parkway which would require a Change Order and because of
the time element, it would be beneficial if the Mayor was authorized
to execute the Change Order. Bob said he expected the change to cost
an additional 2,000.00. The Council agreed that there could be future
change orders that would require immediate attention, so therefore,
Tery Mckee made a motion to allow Mayor McGraw to execute change

rders during the project life on Valley Mall Parkway, with a lid of
,000.00. Motion was seconded by Dennis Hendricks and passed by vote

Dawn Collings spoke to the Council about a letter she wrote and sent
to them, April 2, 1989, recommending that the position of Clerk/
Treasurer be changed from elected to appointed. Dawn said it was
t
erely a housekeeping function and not intended in any way to
erminate the present clerk's position. Dawn Collings stated that
ad she realized that the Clerk intended to fill out the remainder
f her term, prior to the passage of Ordinance 89-3, the issue would
have been addressed at that time. Dawn said when she voted for the
Ordinance, she thought the Clerk was going to leave at that time.
Dawn said she since had asked Chuck Zimmerman if he would clarify the
points in question so all could understand what is going on.
Chuck Zimmerman said a memo had been sent out with another Ordinance,
but that is not the Ordinance that the Council will be referring to
tonight he stated. The latest Ordinance Chuck said was passed out
prior to the Council meeting. The Ordinance reads that the current
elected incumbent City Clerk/Treasurer of the City of East Wenatchee,
shall serve as City Clerk/Treasurer for the remainder of her unexpired
term. Chuck said it does not affect Ordinance No. 89-3. Chuck said
it is not an amendment to Ord. No. 89-3 so the effective date of
Ordinance No. 89-3 is already in effect, but does not affect the
present Clerk/Treasurer's position. The New Ordinance, 89-4 states
that, if the Mayor/Council appoint a person, Peggy will serve as the
Clerk/Treasurer through Dec. 31, 1989. Tery McKee made a motion to
adopt Ordinance 89-4, Seconded by Les Young and passed by vote of the
Council.
Attorney, William Monnette representing Peggy McArthur stated that he
handed out a letter prior to the meeting. Chuck Zimmerman said the
ouncil should hear Mr. Monnette and then vote on the Ordinance again
s the public was not asked for input. Mr. Monnette asked that a
larification be added to Ordinance No. 89-4 stating that no provision
of Ordinance No. 89-3 shall apply to the current elected incumbent
city clerk/treasurer, Peggy McArthur, while she is serving the
remainder of her unexpired term.
The Council agreed that there should be no salary change for the
present Clerk or any job description, other than what is set out by
State Statute for the position now held by the Clerk/treasurer until
Dec. 31, 1989. If the Mayor/Council should decide to hire an
appointed person, the Ordinance would then apply to the appointed
position.
Tery McKee made a motion, to add language to Ordinance No. 89-4,
stating that no provision of Ordinance No. 89-3 shall apply to the
current incumbent city clerk/treasurer, Peggy McArthur, while she is
serving the remainder of her unexpired term. Motion seconded by Paul
Cassel and passed by vote of the Council.
Tery McKee stated that he had sent out a Salary Survey Memo to each
Council member. The figures he stated are for what is paid other
clerk/treasures in cities with a population between 2,000 an 5,000.
and stated that he would like to set a range from 1,900 a month to
2,600 a month. The Council authorized the Mayor to look into how the
ob position would be advertised.

Tery McKee made a motion to set the salary range for an appointed
Clerk/Treasurer position between 1,900 and 2,600 based upon
ualifications as compared to any job description that is set forth
for that position. Motion was seconded by Paul Cassel and passed by
vote of the Council.
Fran Glessner provided the Council with a Grant of Right of First
Refusal drafted by Attorney, Chuck Zimmerman. Ms. Glessner stated
that the document takes care of legal expenses for drafting said
document as well as a termination date of one year from the date the
document is executed. Tery McKee made a motion, authorizing the Mayor
to execute a Contract of the First Right of Refusal regarding real
property adjacent to City Hall after River City Enterprises has
granted the authorization. Motion was seconded by Paul Cassel and
passed by vote of the Council.
After some discussion, Paul Cassel made a motion that the City's
Retreat be set for the 2nd weekend in September with a dinner -
meeting at Lake Wenatchee's Cougar Inn for Friday evening. All to
return Saturday Morning at the Edelweiss for breakfast at 7:30,
and continued meeting, with authorization of a deposit if required.
Motion was seconded by Dawn Collings and passed by vote of the
Council.
Authorization was given by the Council to allow a third fireworks
stand permit to Rev. Larry Potts, United Pentecostal Church, to be
located at Top Foods.
ick Wiltz read the Finding and Conclusions of the Planning Commission
for a planned unit development designation of the existing townhouses
to be converted to condominiums in the area located on the Southwest
corner of Baker and 15th. The Planning Commission approved the
application by a unanimous vote.
Tery McKee made a motion to accept the recommendation of the Planning
Commission and to adopt Ordinance 89-5 (Grant Final Approval and
Designation of the Planned Unit Development of the Existing Townhouses
to be converted to Condominiums) Motion was seconded by Les Young and
passed by vote of the Council.
Motion was made by Tery McKee to adopt Resolution No. 89-2 requesting
the Washington State Department of Transportation to dedicate funding
to design and implement a new highway system for the greater East
Wenatchee Area. Motion was seconded by Les Young and passed by vote
of the Council.
Carole Estes asked to address the Council concerning rumors she had
heard concerning property known as Allen Street that was vacated by
the City and deeded to her. Carole said she was told the City was
trying to retrieve the property. The Council assured her that she
now owns the property and she will have no problem from either the
-Mayor or Council concerning that property.

ery McKee referred to a draft report he had sent out from consultants
orton Dennis & Associates and they have some recommendations in -their
raft that he felt needed to be addressed at a joint City/County
meeting. Tery said a meeting had been set for May 18, 1989 at
7:00 P.M. in the Douglas County Annex Building. After further
discussion, Paul Cassel made a motion that Tery McKee attend the
joint meeting May 18, 1989 to represent the City. Motion was
seconded by Les Young and passed by vote of the Council.
Mayor McGraw called for an executive meeting to discuss a potential
litigation that would take approximately 25 minutes.
Mayor McGraw called the meeting back into regular session and there
being no further business, Tery McKee made a motion that the meeting
be adjourned, seconded by Paul Cassel and passed by vote of the
Council.
