CITY OF EAST WENATCHEE
COUNCIL MEETING
April 17, 1989
Council Members present: Dawn Collings, Tery McKee, Paul
Les Young, and Dennis Hendricks.
Attorney, Charles Zimmerman and
Treasurer/Clerk, Peggy McArthur.
Meeting was called to Order by Mayor, Richard McGraw.

Minutes of the previous meeting were approved as presented. Motion
was made by Dennis Hendricks, seconded by Tery McKee and passed by
vote of the Council.
Bills and accounts were approved as submitted. Motion was made by
Paul Cassel, seconded by Dawn Collings and passed by vote of the
Council.
Charles Zimmerman spoke with the Council on change orders for a site
retaining wall in a building owned by Bob Feil. Zimmerman explained
that their office had prepared the necessary easements as requested by
the Engineers. One for egress and ingress for construction purposes
and one for because the city will need permanent easement for two
feet of the property because the City will need two feet of the
property to support the retaining wall. Charles stated the Council
if they approved, would need to authorize the Mayor to execute the
documents. Tery McKee made a motion to approve the change orders and
authorized the Mayor to sign the necessary documents. Motion was
seconded by Dawn Collings and passed by vote of the Council.
Chief Flinner said Randy Webley will be leaving May 29th to start
training with the K-9 and he said they have received donations to
date to cover most of the expenses for the K-9 Unit.
Permission was granted by the Council to allow Bob Goodman to
receive quotes for replacement of a roof on one of the buildings
at the shop. He said he expected the cost to be between 3,000
and 4,000.
Nick Wiltz said he had attended a meeting at the Country Inn with
other entities and discussed coordination between all entities when
there is a subdivision going on or any type of development.
Nick stated that it was very beneficial and that they would be
meeting again. Nick also stated that he had attended a meeting
at the Wenatchee Valley College regarding Fire Safety, put on by
I.C.B.O. Nick announced that there would be in planning Short
Course at the Douglas County Courthouse Annex at 7:00 P.M. Wed.
Night. He said he had contacted all of the Planning Board Members
and asked that they attend if at all possible.
A letter from Douglas County Commissioners relating to a Joint
Resolution seeking full funding to deal with traffic through
the East Wenatchee area was addressed by Tery McKee. Tery said the
County was in favor of joining with the City in such a Resolution
requesting action from the Department of Transportation to get the
funding to get a corridor through on the Douglas County side.
Tery made a motion requesting the City Attorney to draft a Resolution
to enable the City and County to go ahead with the project. Motion
was seconded by Les Young and passed by vote of the Council.
Mayor McGraw said the next item under old business is an Ordinance
of the City of East Wenatchee providing for the appointment of the
City Clerk/Treasurer, establishing powers, duties and responsibilities
of the City Clerk/Treasurer and requested to be on the agenda by Dawn
Collings.
Dawn Collings said she had been researching the matter for the past
two months and presented the issue in a form of a motion that the
position of Clerk/Treasurer become an appointive position rather
than an elective position. Motion was seconded by Les Young.
Paul Cassel said he had read the opinions that had been received
and said it had been a real tough issue for him. Paul said the
matter involves legal issues, personal issues and practical issues.
Paul said he asked for an opinion several months ago from the City
Attorneys as to if the Council was required to amend the present
law, requiring that the present position be appointed, opposed to
being an elective position. Paul said, what he has seen is
reiterations of State Statue. Paul said nobody has given him the
opinion that he has been looking for as to whether or not the Council
had to change the position. He said the only opinion he has seen is
that the position Shall Be an appointed position. Paul said the word
Shall and May has come under scrutiny in case he has seen. He said
does shall mean, you have to, or that you maybe can or that you have
the authority. Paul said he has not received the answers to those
questions.
Paul said with his discussions with Chuck Zimmerman he doesn't think
as City Attorney, he gives an unqualified Yes that the Council has to
change that position. Paul said the issue had come before the Council
several years ago. Paul said he would hope the question was not
brought about by anything other than good motives. Motives to bring
the City in line with other Cities. Paul said that might be one
reason to justify the change and he said as far as he knows, that is
the only reason to change the position.
Paul said it would be real easy for him if he had received an opinion
from the City Attorneys, Attorney General's Office or the Association
of Washington Cities saying that the position has to changed. Paul
said that since he had not received a definite opinion, he was taking
that to be, that the City is not going to have the Auditor or some-
body else in authority in the State of Washington stating that the
Council is in violation because the City has an elective position for
Clerk/Treasurer. Paul said if the position is changed, the City is
faced with the present Clerk/Treasurer resigning from the position and
that could create some additional costs to the City.
Paul Cassel said as a Council Member he has had the good opportunity
of getting out in the Community and receiving some input from his
constituents. Paul said the overwhelming feeling of the people in the
City that he has talked to are suspicious of the motives of the
proposed resolution. Paul said the overwhelming opinion is that the
city is not mandated by law, and if the City is, nothing is going to
happen to the Council if the position remains the same. Paul said
from a personal point of view, until the City Attorney, or somebody
from the State tells him that the position has to be changed, he
said he is going to take the position that it does have to be and
because of the burdens and problems that would be created, it is
his position to keep the position elective at this point. Paul said
he thinks the City owes something to Peggy McArthur and his vote is
to keep the position elective.
Chuck Zimmerman said from all of the research, and letters he has
received from the State, he would recommend that the City strongly
consider making the position into an appointed one.
Mayor McGraw then asked for the vote on Ordinance No. 89-3.
(Providing for the appointment of the City Clerk/Treasurer) Dawn
Collings, Les Young and Tery McKee voted yes. Paul Cassel and
Dennis Hendricks voted no. Motion carried.
Warren Hills requested City participation in upgrading the main
waterline located on llth Street. Warren explained that he has
property located on the corner of llth and Baker. He said he has
one-half acre and he is trying to develop the property. Warren
said it may require a sub -division and that he is not asking for
variances or special permits. He said he has been working with
Code Compliance Officer Nick Wiltz, and he has run up against the
problem that he needs to have fire protection. He said he has
no problem with that as he feels fire hydrants are needed in the
vicinity. He has met with the Water District Manager and
Commissioners and it appears the lines that are in at this time
are not adequate. Warren said the Water District does not feel
legally they can become involved in putting in the lines.
Warren said for domestic water, the lines are fine but the lines
are not adequate for fire protection. Mr. Hills said he is prepared
to pay 10,000.00 towards fire protection.
After further discussion, Warren said the Water District is working
on two options and also costs but he was unable at this time to
have that information available. The Council asked Mayor McGraw to
work with Warren Hills, the Water District and Bob Goodman and see
if something can be worked out and put the matter back on the agenda
when more information is available.

There being no further business, Paul Cassel made a motion to adjourn.
Seconded by Dennis Hendricks and passed by vote of the Council.
