Authority. 2.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to organize and regulate its internal affairs and to define the powers, functions and duties of its officers and employees. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO RESOLVE AS FOLLOWS: 3. Authorization. The City Council authorizes the Mayor to execute a contract supplement that conforms to the language set forth in Exhibit A. 4. Severability. If a court of competent jurisdiction declares any provision in this resolution to be contrary to law, such declaration shall not affect the validity of the other provisions of this Resolution. 5. Effective date. This Resolution becomes effective immediately. Scope of Work November 13, 2025 A detailed Scope of Work follows: INTRODUCTION/BACKGROUND Supplemental Agreement No. 4 was executed on June 12, 2023, for the Consultant to provide Construction Management Services to the City of East Wenatchee. The agreement provided for Consultant staff to support the project through the following roles: Project Manager, Resident Engineer, Documentation Specialist, and Construction Observer. Each role had an allocation of hours per week, and the total number of hours was based on 170 contract working days, with an additional 4 weeks for project startup and 8 weeks of closeout. Supplemental Agreement No. 5 was executed on December 19, 2024 and extended the time of the agreement. No supplemental scope or payment was contemplated by Supplemental Agreement No. 5. The number of actual working days spent by the construction contractor on the project was approximately 272.5, which exceeds the original number of working days by 102.5 days. There were several contributing factors to the added number of working days, including slow progress by the contractor due to providing insufficient crew labor to complete the work, and changes to the work requested by other agencies, such as Link Transit and East Wenatchee Water District. The Consultant provided continuous construction management services to the City throughout the working days, and on-going office support during an unplanned winter shutdown period. To compensate the Consultant for construction management services provided during the additional 92 working days, Supplemental Agreement No. 6 increases the budget for the tasks listed below, which were added by Supplemental Agreement No. 4. The amount of increase is as identified in the attached consultant fee cost computation.
