CITY OF EAST WENATCHEE, WASHINGTON
ORDINANCE NO. 2025-10
An Ordinance of the City of East Wenatchee, Washington, repealing Ordinance
2025-05, which amended Chapter 4.38 of the East Wenatchee Municipal Code to
add a gambling tax on pull tabs.

2.Recitals.
2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and
operating under the laws of the State of Washington.
2.2. On May 20, 2025, the City Council of East Wenatchee adopted Ordinance 2025-05
amending East Wenatchee Municipal Code 4.38 establishing a gambling tax on pull tabs
effective July 1, 2025.
2.3. On June 3, 2025, the City Council of East Wenatchee placed a three-month moratorium
on the gambling pull tab tax allowing for the impacted businesses to meet with the
council to discuss its impacts moving the effective date of the tax to October 1, 2025.
2.4. On July 17, 2025, and August 21, 2025, the City Council held workshops with the
businesses to discuss the impacts of the gambling tax on their pull tab operations.
2.5. The City Council now finds that it is in the best interest of the city and its citizens to
repeal the gambling tax on pull tabs.
3.Authority.
3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances
of all kinds to regulate its municipal affairs and appropriate to the good government of
the City.
3.2. Chapter 9.46 RCW authorizes the city to provide for taxation of any gambling activity
authorized by said chapter within its jurisdiction.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS:
4.Purpose. The purpose of this ordinance is to repeal Ordinance 2025-05 and amend Chapter
4.38 of the East Wenatchee Municipal Code to remove a gambling tax on pull tabs.
5.Superseding Provisions. The provisions of this ordinance, once adopted, shall supersede
any previous ordinance to the extent that said ordinance may conflict with the provisions of
this ordinance.
6.Corrections. Upon approval by the City Attorney, the City Clerk and the code reviser may
correct this Ordinance if it contains a clerical error; an incorrect reference to other local,
state, or federal laws, codes, rules, or regulations; or an error in ordinance numbering, section
number, or subsection numbering.
7. Severability. If a court of competent jurisdiction declares any provision in this Ordinance to
be contrary to law, such declaration shall not affect the validity of the other provisions of this
Ordinance.
8. Publication. The City Council directs the City Clerk to publish a summary of this
Ordinance. The summary shall consist of the title of this Ordinance. The City Council
directs the City Clerk to publish a copy of this Ordinance on the City’s website.
9.Effective Date. This Ordinance becomes effective October 1, 2025.
