Recitals. 2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington. 2.2. Chapter 35.90 RCW requires all cities with general business licensing requirements to adopt a uniform “model ordinance” identifying what types of commercial activity are and are not subject to business licensing requirements. 2.3. The City of East Wenatchee previously adopted the model ordinance, which is reflected in Title 5.04 Of the East Wenatchee City Code. 2.4. RCW 35.90.080 creates a model ordinance development committee, whose mission, in part, is to provide updates to the model ordinance. City of East Wenatchee Ordinance 2025-09 Page | 2 2.5 The Committee updated the model ordinance as reflected in Exhibit A. 3.Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize theCity Council to adopt ordinances of all kinds to regulate itsmunicipal affairs and appropriate to the good government of theCity. 4.Purpose. The purpose of this ordinance is to amend EWMCSection 5.04.060, Business License Exemptions. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: 5.Amendment. The City Council amends EWMC Section 5.04.060Exemptions as set forth in Exhibit A. 6.Corrections. Upon approval by the City Attorney, the City Clerk andthe code reviser may correct this Ordinance if it contains a clericalerror; an incorrect reference to other local, state, or federal laws,codes, rules, or regulations; or an error in ordinance numbering,section number, or subsection numbering. 7.Severability. If a court of competent jurisdiction declares anyprovision in this Ordinance to be contrary to law, such declarationshall not affect the validity of the other provisions of thisOrdinance. 8.Publication. The City Council directs the City Clerk to publish asummary of this Ordinance. The summary shall consist of thetitle of this Ordinance. The City Council directs the City Clerk topublish a copy of this Ordinance on the City's website. 9.Effective Date. This Ordinance becomes effective five daysafter the date its summary is published. The license and license fee provisions of this chapter do not apply to the following persons, sales, or services, unless otherwise indicated: A.A governmental entity including public and private elementary, secondary, high schools, and universities; B.A person who delivers newspapers or periodicals; C.A person soliciting orders from retail establishments for the delivery and sale of goods, wares and merchandise to retailers for resale unless located within the city; D.A person or organization conducting a nonprofit enterprise when the enterprise is operated without private profit, for a public, charitable, educational, literary, fraternal or religious purpose, is exempt only from the city license fee required by this chapter, but must comply with the business licensing requirement as outlined in EWMC 5.04.120; E.A person under the age of 18 engaged in babysitting; F.A person selling his or her own produce; G.A person that the city is forbidden to tax by law; H.A person engaged in the casual sale of items of personal property where the person conducting such sale is not regularly engaged in the business of selling items of personal property (for example, garage sales and bake sales); I.A landlord; and J.A person or business whose annual value of products, gross proceeds of sales, or gross income of the busine ss in the city is equal to or less than $4,000 and who does not maintain a place of business within the city. However, a person or business who qualifies for this exemption must still submit a business license registration to the dire ctor or designee. The fee for this submission is $0.00. The threshold does not apply to regulatory license requirements or activities that require a specialized permit. (Ord. 18-09 § 6, 2018; Ord. 17-13 § 5, 2017; Ord. 15-04 § 5 (Exh. A), 2015; Ord. 99-12 § 1, 1999; Ord. 305 § 5, 1980. Formerly 5.04.050) Beginning January 1, 2026, the threshold amount is $4000. The threshold amount will be adjusted every forty-eight months on January 1, by an amount equal to the increase in the Consumer Price Index ("CPI") for "West Urban, All Urban Consumers" (CPI-U) for each 12-month period ending on June 30 as published by the United States Department of Labor Bureau of Labor Statistics or successor agency. To calculate this adjustment, the current rate will be multiplied by one plus the cumulative four-year (forty-eight month) CPI increase using each 12-month period ending on June 30 of each prior year, and rounded to the nearest $100. However, if any of the annual CPI increases are more than five (5) percent, a five (5) percent increase will be used in computing the annual basis and if any of the annual CPI decreased during the forty-eight-month period, a zero (0) percent increase will be used in computing the annual basis.
