Recitals. 2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington; and 2.2. An adequately funded public safety system is necessary to maintain safe and livable communities. 2.3. Under Washington state law, cities provide many regional and local services advancing community health and public safety through the criminal justice system. 2.4. The projected budget deficit within the city’s general fund threatens the city’s ability to provide these services. 2.5. The city’s general fund currently anticipates reductions of up to one million dollars for 2026, with further reductions in future budgets, absent new revenues. Through Section 201, Chapter 350, Laws of Washington 2025, the Washington state legislature has allowed a qualified city or county to authorize, by resolution or ordinance, a new sales and use tax of one-tenth of a percent for criminal justice purposes. 2.7. Under Section 201, Chapter 350, Laws of Washington 2025, the ordinance authorizing the sales and use tax must include a finding that the city has met the requirements to receive a grant from the Local Law Enforcement Grant Program created through Section 101, Chapter 350, Laws of Washington 2025. 2.8. The city has verified through the East Wenatchee Police Department that it meets the requirements to receive a grant from the Local Law Enforcement Grant Program created through Section 101, Chapter 350 Laws of Washington, or will submit compliance documents to meet the requirements, as authorized under Section 201, Chapter 350, Laws of Washington. 3.Authority. 3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City. 3.2. Section 201, Chapter 350, Laws of Washington 2025 authorizes a sales and use tax of one-tenth of one percent for criminal justice purposes as well as the grant funding provided from the Local Law Enforcement Program. 3.3. RCW 82.14.020 defines “taxable event.” 3.4. Chapters 82.08 and 8.12 RCW defines persons subject to the tax. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: 4.Purpose. The purpose of this ordinance is to add Chapter 4.14 of the East Wenatchee Municipal Code to impose an additional sales and use tax of one-tenth of one percent for criminal justice purposes. 5.Amendment. The City Council adopts Chapter 4.14 of the East Wenatchee Municipal Code to read as set forth in Exhibit A. 6.Superseding Provisions. The provisions of this ordinance, once adopted, shall supersede any previous ordinance to the extent that said ordinance may conflict with the provisions of this ordinance. 7.Corrections. Upon approval by the City Attorney, the City Clerk and the code reviser may correct this Ordinance if it contains a clerical error; an incorrect reference to other local, state, or federal laws, codes, rules, or regulations; or an error in ordinance numbering, section number, or subsection numbering. If a court of competent jurisdiction declares any provision in this Ordinance to be contrary to law, such declaration shall not affect the validity of the other provisions of this Ordinance. 9.Publication. The City Council directs the City Clerk to publish a summary of this Ordinance. The summary shall consist of the title of this Ordinance. The City Council directs the City Clerk to publish a copy of this Ordinance on the City’s website. 10.Effective Date. This Ordinance becomes effective on October 1, 2025. Effective January 1, 2026, there is hereby imposed an additional sales and use tax, separate and apart from any other sales and use tax imposed by this title, upon every taxable event occurring in the city, for criminal justice purposes as authorized in Section 201, Chapter 350, Laws of Washington 2025. (Ord. 2025-08) 4.14.020 Taxable event. As used in this chapter, the term “taxable event” has the meaning set forth in RCW 82.14.020. (Ord. 2025-08) 4.14.030 Rate. The rate of the sales and use tax imposed by this chapter shall be one-tenth of one percent of the selling price in the case of a sales tax, or the value of the article used, in the case of a use tax. The tax shall be imposed upon and collected from those persons from whom the state sales tax or use tax is collected pursuant to Chapters 82.08 and 82.12 RCW. Moneys collected from the tax shall be used solely for those criminal justice purposes authorized in Section 201, Chapter 350, Laws of Washington 2025, as the same now exists or as is hereafter amended.
