Authority. 2.1. The City of East Wenatchee is a non-charter code City duly incorporated and operating under the laws of the State of Washington. 2.2. ROW 35.11.020 and ROW 35A. 12.190 authorize the City of East Wenatchee ("City Council") to organize and regulate its internal affairs. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO RESOLVE AS FOLLOWS: Section 1: Purpose. To authorize the Mayor to execute a amendment to the Consultant Services Agreement with SCJ Alliance for work related to the 2026 periodic update as set forth in Exhibit A. Section 2: Severability. If a court of competent jurisdiction declares any provision in this resolution to be contrary to law, such declaration shall not affect the validity of the other provisions of this Resolution. Section 3: Effective Date. This resolution becomes effective immediately. Page 2 of 2 AMENDMENT 1 TO CONSULTANT SERVICE AGREEMENT This Amendment to Consultant Service Agreement is made, effective as of the date of signatures below, by and between the City of East Wenatchee ("City") and Shea, Carr & Jewell, Inc. (dba SCJ Alliance) ("Consultant"). RECITALS 1.1 The City and Consultant are parties to a Consultant Service Agreement entered into between the parties on January 29,2025; 1.2 Section 6 of the Consultant Service Agreement prohibits the assignment or transfer of the rights or obligations under that Agreement without the prior written consent of the other party; 1.3 Consultant desires to retain a subcontractor to perform a limited portion of the services to be provided under the Consultant Service Agreement without a change to the not to exceed compensation of $125,000; 1.4 The City has no objection to Contractor using a subcontractor for purposes of fulfilling a portion of the obligations of Consultant under the Consultant Service Agreement. AMENDMENT Based on the recitals set forth above, and based upon mutual execution of this Amendment to Consultant Service Agreement, the City and Consultant agree as follows: 2.1 Consultant shall be allowed to engage Leland Consulting Group to perform those services described in the attached Leland Consultant Group Scope of Work, Attachment "A," at the cost as designated in Attachment "A."?5 2.2 The January 29, 2025 Consultant Service Agreement shall remain in place and all terms and conditions, rights and obligations shall remain except as specifically amended through this Amendment. 2.3 This Amendment shall constitute the entire Agreement between the parties for amendment of the Consultant Service Agreement. The undersigned represent that they each are authorized to execute this agreement respectively on behalf of City and Consultant. The descriptions below represent the work that Leland Consulting Group, specifically, will perform or support, based on the Department of Commerce GMA Comprehensive Plan Checklist. The scope below matches SCJs scope of work with the city and the Department of Commerce. Work will be billed at the phase level, however, tasks are included to breakdown the steps within the work. Phase D3 Draft Comprehensive Plan Amendments to Date Task 1: Project Management 1.1 Meetings: Leland will attend coordination and/or check-in meetings with SCJ and the city as needed throughout the project. Task 1 Deliverables: Meeting attendance Task 2: Land Use Element 2.1 Population Densities and Building Intensities: Leland will review the assumptions of population and building densities used in Douglas County's updated Land Capacity Analysis (currently underway) and integrate as needed in the Land Use element. Task 2 Deliverables: Population density and building intensity memo/report (Word) and associated spreadsheets (Excel) Task 3: Housing Element 3.1 Goals, Policies, and Objectives: Leland will support SCJ in the development of goals and policies for the Housing Element update, specifically relating to Task 3 subtasks led by Leland. 3.2 Housing Needs: Leland will provide a technical memo with updates to housing background data as including analysis of housing needs by income band, and conforming with the Housing Needs Analysis required items described in the Department of Commerce's "Guidance for Updating Your Housing Element." SCJ will integrate this data and analysis into the Housing Element. AMENDMENT TO CONSULTANT SERVICE AGREEMENT - SCJ Alliance Page 3 Exhibit A 3.3 Land Capacity Analysis: Leland will provide support as needed in ensuring the County's updated Land Capacity Analysis meets requirements to show capacity for all housing types by income band, as required by RCW 36.70A.070(2)(c). 3.4 Adequate Provisions: Leland will draft Department of Commerce Adequate Provisions Checklists (contained in the appendix to Commerce's "Guidance for Updating Your Housing Element") which document barriers and actions needed to achieve housing availability. 3.5 Identify Racially Disparate Impacts: Leland will identify local policies and regulations that may result in racially disparate impacts, displacement, and exclusion in housing, following recommended analyses found in the Department of Commerce's "Guidance to Address Racially Disparate Impacts." 3.6 Undo Racially Disparate Impacts: Leland will support SCJ on developing policies and regulations to begin to undo racially disparate impacts, displacement, and exclusion in housing caused by local policies, plans, and actions, using the data and analysis conducted in Task 3.5 3.7 Displacement Risk: Leland will identify areas that may be at higher risk of displacement from market forces and identify appropriate anti-displacement policies, using Department of Commerce resources. Census data, and input from community-based organizations, as appropriate. Task 3 Deliverables: Review and comment on Housing Goals, Policies, and Objectives (Word) Updated Housing Needs Assessment (Word) Review and comment on Land Capacity Analysis and provide guidance on capacity by income band (Word/Excel) Adequate Provisions checklists (Word) Racially Disparate Impacts background analysis and policy/regulatory review (Word) Displacement Risk maps/memo (Word) Budget: $13,330.00 •• • Assumptions • Hours not fully used for one task or expense may be reallocated to other tasks requiring additional time to complete. The client will provide one set of clear and nonconflicting comments on all LCG deliverables, and these comments will be the basis for LCG's edits to deliverables.
