The Council is providing opportunities for public comment in person, remotely, or by submitting written comment. The Mayor will ask if there are any citizens
wishing to address the Council. When recognized, please step up to the microphone (or unmute your screen), state your name and if you live within the East
Wenatchee city limits. Citizen comments will be limited to three minutes.
6.PRESENTATIONS
a.Certificate of Recognition to Jeremy Lovold for 15 Years of Public Service to the City of East Wenatchee
Streets Department – Mayor Crawford.
7.PUBLIC HEARINGS
The Mayor will call the Public Hearing to order and state the ground rules, the purpose of the hearing, and will state the manner in which the hearing will
proceed. Staff will first give a report, followed by public testimony. All speakers must speak into the microphone and clearly state their name and address.
All comments should be addressed to the City Council, should be relevant to the topic, and should not be of a personal nature. Public testimony may be
limited to three minutes, unless further time is granted by the Mayor. If there are a large number of speakers, a representative may be appointed to speak
on behalf of the group.
a.A Public Hearing for the purpose of receiving public comment and to consider a final decision regarding
CPAZC-2023-01, an application to redesignate/rezone 842 N Devon Ave from Residential Low Density to
Residential High Density/Office. – Community Development Director, Curtis Lillquist.

2.Pedestrian Bridge.
Public Works Manager Garren Melton indicated that the primary goal of building
a Pedestrian Bridge over State Route 28 was to make downtown East
Wenatchee more accessible to pedestrians in the region. Councilmembers
indicated preferences on the bridge’s design structure.

4.Presentations.
a.Mayor Crawford read Proclamation 2023-07, Constitution Week. The National
Society Daughters of the American Revolution were not present to receive the
proclamation. Arrangements were made for the organization to receive the
proclamation.
b.Mayor Crawford recognized Frederick Schott for his 15 Years of Public Service to the
City of East Wenatchee Streets Department. Frederick Schott was not present for his
recognition.
c.Al Murphy, Washington State Master Gardener, provided the annual WSU Master
Gardeners report updating the Council on the work undergone to maintain the
Bridge of Friendship Garden. Mr. Murphy expressed how responsive and helpful the
City’s Street Department was to work with, and how he is looking forward to the
continued collaboration between the two organizations.

Wenatchee Valley Misawa Sister City Association was hosting for the Misawa
Delegation arriving on September 27, 2023.
b.Mayor Crawford announced the rescheduling of the Budget Workshop, originally
scheduled for Thursday September 28th, would now take place on Thursday October
5, 2023, at 5:30pm in the Council Chambers.

a.Councilmember Tidd, City Representative for Link Transit, announced he would be
attending the American Public Transportation Association Expo Conference in
Orlando, Florida, October 6-11, 2023.
b.Councilmember Sleiman, City Representative for the Wenatchee Valley Chamber of
Commerce, provided an update on the organization and its upcoming events.
c.Councilmember Johnson, City Representative for the Solid Waste Programs,
provided an update on the organization’s Household Hazardous Waste Materials
Facility, where all Douglas County residents will be able to dispose of materials twice
a week at no charge. The program is expected to begin by Summer of 2024.
d.Councilmember Magdoff, City Representative for the Wenatchee Valley Museum
and Cultural Center provided an update on the organization and its upcoming
events, including the Salmon Festival taking place on September 21-23rd, 9-3pm at
Rocky Reach Dam.

Subject: A public hearing to take public comment and consider a final decision
regarding CPAZC-2023-01 an application to redesignate/rezone 842 N Devon
from Residential Low Density to Residential High Density/Office.

I.Summary Title:
A.Final decision regarding CPAzc-2023-01 an application to redesignate/rezone
842 N Devon from Residential Low Densit to Residential High Density/Office.
II.Background/History:
On August 23, 2023 the planning commission forwarded a recommendation of
approval for CPAZC-2023-01 after holding a public hearing, taking public comment
and deliberating the merits of the application. Votes in favor of the recommendation
for approval – Commissioners Brown, Hewitt, Birks, and Larsen. Votes opposed –
Commissioner Jessup. The recommendation included findings of fact and
conclusions found within the staff report.
On September 5, 2023, the council rejected the planning commission
recommendation of approval for CPAZC-2023-01 and set their own public hearing in
order to consider other options for a final decision.
The city council has four options regarding this application. First, approve CPAZC
2023-01 and adopt Ordinances 2023-11 and 2023-12. Second, deny the application
and adopt Resolution 2023-51. Third, remand the application back to the planning
commission for further consideration. Fourth, to continue the public hearing for
further consideration by the council.
If council decides to approve the application, Ordinances 2023-11 and 2023-12 in
your packet have been amended to include the recitals that council rejected the
planning commission recommendation and set their own hearing. If the council
decides to deny the application the resolution in your packet includes the basic
findings regarding the application, property, and the procedure to date. The council
will have to decide on what additional findings of fact and conclusions are applicable
to support the decision of denial (blank lines are included in the resolution as a place
holder for these findings). The information included in the resolution must be
factual. The number of lines provided in the draft resolution are only a place holder.

2.Recitals.
2.1. The City of East Wenatchee (“City”) is a non-charter code City duly
incorporated and operating under the laws of the State of Washington; and
2.2. The East Wenatchee Planning Commission held a public hearing on August
23, 2023 to consider a proposed comprehensive plan map amendment to
change the designation of subject property from Residential Low to
Residential High/Office (City File CPA/ZC 2023-01). The proposed map
amendment received a recommendation of approval from the East
Wenatchee Planning Commission. Votes in favor Commissioners Brown,
Hewitt, Birks, and Larsen. Opposed – Commissioner Jessup.
2.3. On September 5, 2023, the East Wenatchee City Council rejected the
Planning Commission’s recommendation for approval to amend the Land
Use Designation Map of the Greater East Wenatchee Area Comprehensive
Plan and the Official Zoning Map of the City of East Wenatchee to change
the zoning of certain property from Residential Low to Residential High
Density/Office.
2.4. The City Council held a public hearing on October 3, 2023, to take public
comment, further deliberate and consider other options for a final decision.

3.Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to
adopt ordinances of all kinds to regulate its municipal affairs and appropriate to
the good government of the City.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS
FOLLOWS:
4.Purpose. The purpose of this ordinance is to amend the Land Use Designation
Map of the Greater East Wenatchee Area Comprehensive Plan to change from
Residential Low to Residential High Density/Office.
5.Property Identification. One Parcel located at 842 N. Devon Ave.; 44100000800.
6.Amendment. The City Council accepts the recommendation of the East
Wenatchee Planning Commission and adopts the amendment to the Greater
East Wenatchee Area Comprehensive Plan Land Use Designation Map as
depicted on Exhibit A to this Ordinance and incorporated by this reference.
7.Findings of Fact and Conclusions of Law. The City Council adopts the Recitals
stated above as well as the findings of fact and conclusion of law as set forth
below:

7.1.1. An application for an amendment to the Greater East Wenatchee Area
Comprehensive Plan land use designation map and the official zoning
map to change the designation of 1 parcel totaling 0.52 acres from
Residential Low to Residential High Density/Office. The subject

Density/Office.

of Commerce – Growth Management Services and other state and local
agencies for a 60-day review. The proposal was submitted to Commerce

his property and why he was against the parcel zone change. The

and cultural displacement within the neighborhood.
Tonee Jackson, 874 N Devon, gave testimony speaking on the history of
her property and why she was against the parcel zone change. The
property owner stated that the value of the surrounding properties could

3.Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to
adopt ordinances of all kinds to regulate its municipal affairs and appropriate to
the good government of the City.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS
FOLLOWS:
4.Purpose. The purpose of this ordinance is to amend the Official Zoning Map of
the City of East Wenatchee to change zoning from Residential Low to
Residential High Density/Office.
5.Property Identification. The One Parcel located at 842 N. Devon Ave.;
44100000800.
6.Amendment. The City Council accepts the recommendation of the East
Wenatchee Planning Commission and adopts the amendment to the City of East
Wenatchee Area Zoning Map as depicted on Exhibit A to this Ordinance and
incorporated by this reference.
7.Findings of Fact and Conclusions of Law. The City Council adopts the Recitals
stated above as well as the findings of fact and conclusion of law as set forth

III.DESCRIPTION OF PROPOSAL
A.Design: The proposal under consideration is a non-project action to change the
land use classification and zoning of the subject property from Residential Low
Density (R-L) to Residential High Density/Office (R-H). A zoning map showing the
proposal is attached as Exhibit B.
B.Circulation: The subject property fronts on N Devon Ave and 8th Pl. NE as a
corner lot. N Devon Ave. and 8th Pl. NE are partially improved streets with paved
roads and no sidewalks. The road for 8th Pl. NE ends in a cul-de-sac. Entrance to N
Devon Ave. starts from 9th St. NE and ends in a dead end near the subject property.
IV.ANALYSIS OF PROPOSAL
A.Comprehensive Plan: The subject properties are within the study area of the
Greater East Wenatchee Comprehensive Plan and are designated as suitable for
Residential Low (R-L) density development. The subject property is adjacent to an
existing Residential High Density/Office (R-H) land use classification and zoning
district.
The comprehensive plan contains the following language regarding the purpose of the
R-H designation and locational criteria.
The Residential High/Office designation is a land use category that would allow a range
of housing choices and a limited range of office style commercial opportunities for low

providing a buffer between lower density land uses and higher intensity uses such as
between residential and commercial uses or areas along major transportation routes
where the intensity of activities on adjacent land make it less attractive for low density
residential uses.
The Residential High/Office designation should be applied in areas along existing or
planned arterial/collector transportation corridors and areas adjacent to commercial nodes.
The comprehensive plan contains the following language regarding the purpose of the
R-L designation and locational criteria.
It is envisioned that this designation would permit a range of housing options and
densities to provide areas desirable for single-family residential use. The primary and
preferred land use is residential.
Residential densities allowed in the low residential land use category should be up to 8
dwelling units per acre or up to 10 dwelling units per acre if developed adjacent to
commercial or mixed uses designations or as part of an infill project.
The following goals and policies from the comprehensive plan pertain to housing:
GOAL: To provide for a variety of housing types and densities to ensure a range of
affordable housing options for all segments of the community.
H-8 Provide for multi-family densities near major activity centers, parks, commercial
and business centers, that are adequately serviced by transportation systems and
utilities.

H-21 Residential development must meet the net density targets of 8 dwelling units per
acre for single-family and 12 dwelling units per acre for multi-family. Net density
does not include land.
The subject property is served with a full-range of urban services.
The comprehensive plan provides criteria for locating R-H zoning along existing

C. Environmental Review: A threshold determination and environmental review
pursuant to RCW 43.21C the State Environmental Policy Act was completed and a
Determination of Non-significance (DNS) was issued on June 22, 2023 with a 14-
day comment period. No comments were received indicating that the proposal would
have a probable significant adverse impact on the environment.
D. State Review: RCW 36.70A.106 requires submittal of amendments to
comprehensive plans and development regulations to the Washington State
Department of Commerce – Growth Management Services and other state and local
agencies for a 60-day review. The proposal was submitted to Commerce on June
20, 2023. No comment was received from WSDOT during the 60 day comment
period.
V. PUBLIC AND AGENCY COMMENT
Agency Comments: A Notice of Availability of the proposed amendments was published
in the paper and transmitted to Washington State Department of Commerce – Growth
Management Services and other state agencies for a 60-day review. The proposal was
submitted to Commerce on June 20, 2023.
VI. RECOMMENDATION
Staff recommends approval of the proposed comprehensive plan map and zoning map
amendment and offers the following findings of fact and conclusions for consideration
by the Planning Commission. The statements in this section may be modified by the
Planning Commission as appropriate to support the decision.
A. FINDINGS OF FACT
1. An application for an amendment to the Greater East Wenatchee Area
Comprehensive Plan land use designation map and the official zoning map to
change the designation of one parcel totaling 0.52 acres from Residential Low to
Residential High Density/Office. The subject property is adjacent to property
already zoned Residential High Density/Office.

Comprehensive Plan and is designated as suitable for Residential Low (R-L)
density development. The subject property is adjacent to an existing Residential
High Density/Office land use classification and zoning district.
5. The subject property is served with a full-range of urban services.
6. The predominant land use pattern in the area is high density residential zoning.
This proposal will follow that existing pattern.
7. The proposed change in the zoning and comprehensive plan land use
designation for the subject properties is consistent with and implements the goals
and policies in the comprehensive plan.
8. A Notice of Availability was issued on June 22, 2023. Notice was placed with the
Wenatchee World. No comments were received.
9. A threshold determination and environmental review pursuant to RCW 43.21C the
State Environmental Policy Act was completed and a Determination of Non-

10. The City of East Wenatchee has adopted a Comprehensive Plan pursuant to the
Growth Management Act (GMA), RCW Chapter 36.70A, which is a generalized,
coordinated land use policy statement of the City.
11. RCW 36.70A.106 requires submittal of amendments to com prehensive plans and
development regulations to the Washington State Department of Commerce –
Growth Management Services and other state and local agencies for a 60-day
review. The proposal was submitted to Commerce on June 20, 2023.
12. No comment was received from the WA State Department of Transportation
during the 60-day review period.
13. Advertisement of the Planning Commission’s public hearing was published in the
Wenatchee World on August 10, 2023.
14. Notice of Public Hearing was mailed to all property owners within 300 feet of the
proposed rezone area on August 10, 2023.
15. The City of East Wenatchee Planning Commission conducted an advertised
public hearing on August 23, 2023. The planning commission entered into the
record the files on this amendment, accepted public testimony, and deliberated
the merits of the proposal.

CONCLUSIONS
1.It is the determination of the responsible lead agency that no more than a
moderate effect on the environment is a reasonable probability as a result of the
proposed action. The proper exercise of the threshold determination process as
required by WAC 197-11 is than an environmental impact statement is not
required to be prepared for this project.
2.Proper legal requirements of RCW 36.70A.106 and Chapter 17.100 EWMC were
met and the community was given the opportunity to comment on the proposal at
a duly noticed open record public hearing.
3.The proposed amendment is consistent with the requirements of the Revised
Code of Washington and the Washington Administrative Code.
4.The proposed amendment is consistent with the Greater East Wenatchee Area
Comprehensive Plan, East Wenatchee Municipal Code and the Growth
Management Act.
5.Any Finding of Fact that is more correctly a Conclusion of Law is hereby
incorporated by this reference.
