a.Ordinance 2023-07, amending Chapter 2.04 of the East Wenatchee Municipal Code
(EWMC) changing the City council meeting dates and times, containing a severability
clause, and establishing an effective date – Sean Lewis, Assistant City Attorney.
Motion by City Council to approve Ordinance 2023-07 amending Chapter 2.04 of
the East Wenatchee Municipal Code (EWMC) changing the City council meeting
dates and times, containing a severability clause, and establishing an effective

b.Resolution 2023-21, Changing Chapter 2.1 of the East Wenatchee City Council Rules
of Procedure to reflect either or both of a new time and a new date of City Council
Meetings – Sean Lewis, Assistant City Attorney.
Motion by the City Council to approve Resolution 2023-21 changing Chapter 2.1 of
the East Wenatchee City Council Rules of Procedure to reflect either or both of a
new time and a new date of City Council Meetings.
c.Resolution 2023-22, Interlocal Agreement between the City of East Wenatchee and
Link Transit for Intersection Improvements and Park and Ride Upgrades at 3rd Street
SE & Rock Island Road Project #: 2021-11 – Garren Melton, Public Works Manager.
Motion by the City Council to approve Resolution 2023-22 authorizing the Mayor
to enter a Sidewalk, Access, and Utility Easement with Link Transit associated with
the 3rd St SE & Rock Island Road Intersection Improvements and Park and Ride
Upgrades.
d.Resolution 2023-23, authorizing the Mayor to execute Change Order Number Two
(#2) between the City of East Wenatchee and Selland Construction Inc. for the 9th St
NE & Valley Mall Parkway Intersection Improvement Project – Garren Melton, Public
Works Manager.
Motion by the City Council to approve Resolution 2023-23, authorizing the Mayor
to execute a change order between the City of East Wenatchee and Selland
Construction Inc. for the 9th St NE & Valley Mall Parkway Intersection
Improvements Project #: 2019-07.

1. Dr. Patrick Jones Presentation.
Councilmember Magdoff introduced Dr. Patrick Jones. Dr. Jones accessed the
Chelan Douglas Trends website (www.chelandouglastrends.com) and presented
a demographic outlook of our region and East Wenatchee to Council including
education, economic factors, and housing. He explained the source of the data
on the website and how to manipulate the results to show comparisons with other
jurisdictions. This presentation was audio recorded.
Comments provided by Councilmember Raab, Councilmember Magdoff,
Councilmember Sterk, and Councilmember Tidd.
No action was taken by the Council.

17, adopting the City of East Wenatchee 2021 Consolidated Annual
Performance and Evaluation Report in accordance with the requirements of
the U.S. Department of Housing and Urban Development (HUD) regulations
at 24 CFR Part 91 and establishing an effective date.
Comments provided by Councilmember Tidd.
Motion by Councilmember Magdoff to approve Resolution 2023-17
adopting the City of East Wenatchee 2021 Consolidated Annual
Performance and Evaluation Report and authorizing the Mayor to sign all
required HUD certifications. Councilmember Tidd seconded the motion.
Motion carried (6-0).
5. Presentations.
a. Executive Director James Humphrey provided the council with an annual report on
the Wenatchee Valley Humane Society and the work completed in East Wenatchee
in 2022.

a. Events Director/PIO Trina Elmes presented Resolution 2023-18, appointing
members to the East Wenatchee Events Board.

Councilmember Sleiman seconded the motion. Motion carried (6-0).
b. Public Works Manager Garren Melton presented Resolution 2023-19, Interlocal
Agreement with Douglas County PUD and the City of East Wenatchee for the 19th
Street NW & NW Cascade Ave Improvements Project #2019-02.
Motion by Councilmember Tidd to approve Resolution 2023-19, authorizing the
Mayor to execute an Interlocal Agreement with Douglas County PUD for the 19th
Street NW & NW Cascade Ave Improvements Project #: 2019-02. Councilmember
Magdoff seconded the motion. Motion carried (6-0).
c. Public Works Manager Garren Melton presented Resolution 2023-20, Grant Road Oil
Treatment and Bioretention Fund Agreement (WQC-2023-Ewena-00168).

Mayor to execute a Combined Financial Assistance Agreement with the State of

7. Mayor’s Report.
a. The East Wenatchee City Council was invited to attend and participate, as
dignitaries, in the annual Classy Chassis event by Events Director/PIO Trina Elmes.
b. Mayor Crawford shared information on the experience of an eighth-grade student,
from Pinnacles Prep Charter School, who volunteered as an intern for four days to
learn more about City Government.
c. Mayor Crawford provided an update on work completed by the Regional Sportsplex
Committee and shared the status of Legislation Bill 5001 in the Washington State
Senate.
8. Council Reports & Announcements.
a. Councilmember Magdoff shared information on the change of date and time of the
Wenatchee Valley Museum and Cultural Center Board of Directors meetings. The
Board will now meet every 2nd Wednesday of the month from 4:30-6:30pm.
b. Councilmember Tidd, city representative for Link Transit provided an update on the
organization’s upcoming projects and invited the Council to attend a Workshop
where the discussion would focus on the January 2024 Sales Tax Options.
Councilmember Tidd share he would be attending the American Public
Transportation Association (APTA) Conference in October.

Subject: Ordinance 2023-07, An Ordinance of the City of East Wenatchee
amending Chapter 2.04 of the East Wenatchee Municipal Code (EWMC)
changing the City Council meeting dates and times.

I. Summary Title: An Ordinance of the City of East Wenatchee amending Chapter
2.04 of the East Wenatchee Municipal Code (EWMC) changing the City Council
meeting dates and times, containing a severability clause, and establishing an
effective date.
II. Background/History: Chapter 2.04 of the East Wenatchee Municipal Code
(EWMC) presently requires that City Council meetings are on the first and third
Tuesday of each month beginning at 6pm.
An internal inquiry was undertaken by the City Clerk regarding times and dates that
are unavailable for various reasons, including staff attendance, Court use of the
room, etc. Those times and dates are reflected in the attached calendar.
Should a Council Member wish to make a motion to change City Council meeting
times or meeting dates, a motion of the form below would be proper, filling in the
respective new desired time and date.
Resolution 2023-21 is also proposed as an action item. Both Ordinance 2023-07 and
Resolution 2023-21 would have to be changed accordingly.
III. Recommended Action: Motion to approve Ordinance 2023-07 amending Chapter
2.04 of the East Wenatchee Municipal Code (EWMC) changing the City Council
meeting dates and times to reflect that regular meetings of the City Council are on
(insert the desired dates here) (e.g. every first and third Tuesday of each month)
at (insert the desired start time here) (e.g. 5 pm).

2. Recitals.
2.1. The City of East Wenatchee (“City”) is a non-charter code city, duly incorporated and operating under the laws of the State of Washington.
3. Authority.
3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City.
4. Purpose. The purpose of this ordinance is to amend Chapter 2.04 of the East Wenatchee Municipal Code (EWMC) changing either or both of the City Council meeting dates and times.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS:
5. Amendment. The City Council amends EWMC Section Chapter 2.04 as set forth in Exhibit A.
6. Findings of Fact. The City Council adopts as its findings of fact the recitals set forth above.
7. Repeal. The City Council repeals those provisions of any ordinance that are in conflict with the language of this Ordinance.

8. Severability. If a court of competent jurisdiction declares any provision in this Ordinance to be contrary to law, such declaration shall not affect the validity of the other provisions of this Ordinance.
9. Publication. The City Council directs the City Clerk to publish a summary of this Ordinance. The summary shall consist of the title of this Ordinance. The City Council directs the City Clerk to publish a copy of this Ordinance on the City’s website.
10. Effective Date. This Ordinance becomes effective _________________________.

The city council holds its regular meetings on the first and third
Tuesdays__________________________ of each month. A regular meeting of the city council is
subject to the State Open Public Meetings Act, Chapter 42.30 RCW (as enacted or as amended).

Background/History: Chapter 2.1 of the East Wenatchee City Council Rules of
Procedure adopted by Resolution 2022-46 require:
2.1 Regular Council Meetings: In accordance with RCW 35A.12.110 and EWMC
2.04.010, regular meetings of the City Council are on the first and third Tuesday
of each month beginning at 6:00 p.m.
An internal inquiry was undertaken by the City Clerk regarding times and dates that
are unavailable for staff attendance. Those times and dates are reflected in the attached
calendar.
Should a Council Member wish to make a motion to change City Council meeting times
or meeting dates, a motion of the form below would be proper, filling in the respective
desired time and date.
This change should directly coincide with any changes made in Ord. 2023-07.
Recommended Action: Motion to approve Resolution 2023-21 changing the East
Wenatchee City Council Rules of Procedure Section 2.1 to reflect that regular meetings
of the City Council are on (insert the desired dates here) (e.g. every first and third
Tuesday of each month) at (insert the desired start time here) (e.g. 5 pm).

I. Summary Title:

II. Background/History:
During the design phase of the intersection improvements the City and Link Transit
identified an opportunity to combine the project with Links planned Park and Ride
improvements. The City often partners with other local agencies on projects to
reduce costs to taxpayers by combining projects to reduce administrative costs and
capitalize economies of scale. Part of the partnership includes Link donating this
Easement that captures the area that the sidewalk, illumination system, and future
signal pole will occupy. The City will be responsible for maintaining its
infrastructure within the Easement area.
III. Recommended Action:
Approve Resolution 2023-22 authorizing the Mayor to enter a Sidewalk, Access, and
Utility Easement with Link Transit associated with the 3rd St SE & Rock Island Road
Intersection Improvements and Park and Ride Upgrades .

THIS PUBLIC SIDEWALK, ACCESS AND UTILITY EASEMENT (“Easement”) is
hereby granted effective ________________ ____, 2023, by CHELAN – DOUGLAS PUBLIC
TRANSPORTATION BENEFIT AREA (LINK TRANSIT), a political subdivision of the State
of Washington (“Link” or “Grantor”), as owner of that certain parcel located at 3rd St. SE and
Rock Island Road, East Wenatchee, WA 98801 and identified as APN #40300003101 (the
“Property”), to the CITY OF EAST WENATCHEE, a municipal corporation (“City” or
“Grantee”), to establish a permanent non-exclusive easement over the Property legally described
on Exhibits A and as generally depicted on Exhibit B (“Easement Area”) for access by the public
over a sidewalk and the right of ingress and egress to install and maintain sidewalk
improvements, landscaping, and electrical utilities and lighting.
1. Grant of Easement. Grantor hereby grants and conveys to the City a permanent, non-
exclusive easement for the purposes of public access limited to pedestrian travel and right
of ingress and egress to construct, reconstruct, install, repair, replace, operate and
maintain sidewalk improvements, landscaping and electrical utilities over and across the

Easement Area on the terms provided herein. The rights granted herein for public use are
granted to the City as an entity and not to any individual member of the general public,
and no member of the general public shall have any real property interest in, or right to
enforce, this Easement.
2. Use and Maintenance of Easement Area. Grantee shall have the right to install,
operate, repair, maintain and replace sidewalk improvements, stormwater drain facilities,
landscaping and electrical lighting and facilities in the Easement Area, together with the
right of access and entry onto the Easement Area at all reasonable times for the purposes
stated herein. All pipes, lines and other facilities within the Easement Area shall be
placed underground. No fences, rockeries, walls, above-ground structures, buildings or
other permanent structures (other than improvements related to public access, sidewalk
improvements, landscaping, or electrical lighting and facilities) shall be constructed or
installed over, upon or within the Easement Area by the City. The City shall have the
authority to enforce city rules and regulations relating to public areas for use by the
public within the Easement Area. Any person using the Easement Area in violation of
the rules and regulations may be removed from the Easement Area by the City.
Additionally, public access may be temporarily restricted for repairs or emergencies.
Grantor reserves the right to use or cross the Easement Area so long as it does not
unreasonably interfere with the uses granted to Grantee, and Grantor shall comply with
any City of East Wenatchee regulations regarding the placement of structures or trees
within the Easement Area. All construction and installation of improvements within the
Easement Area and the operation, maintenance and repair thereof shall be performed
(a) in accordance with applicable permits, (b) in a safe, clean and operable manner (c) in
a lien-free and professional manner, and (d) in a reasonable manner to minimize
interference with other uses to the extent reasonably practical. Upon completion of any
work within the Easement Area undertaken by Grantee, Grantee shall restore any
disturbed area and shall repair any damage outside of such easement area to substantially
the same condition as existing before the work.
3. Mutual Indemnification. The Grantor and the Grantee shall each indemnify and hold
the the other, and their agents, employees, and/or officers, harmless from and shall
process and defend at their own expense any and all claims, demands, suits, at law or
equity, actions, penalties, loss, damages, fees (including attorney fees), or costs, of
whatsoever kind or nature, brought against either arising out of, or in connection with, or
incident to the performance or failure to perform any of their respective obligations
under this Easement and by any negligent act or omission of their officers, agents, and
employees. However, if such claims are caused by or result from the concurrent
negligence of the Grantor and Grantee, their agents, employees, and/or officers, then this
provision shall be valid and enforceable only to the extent of the respective negligence of
the Grantor or Grantee. Further, nothing herein shall require the Grantor or Grantee to
hold harmless or defend the other, their agents, employees, and/or officers for damages or
loss caused by the Grantor or Grantees’ sole negligence. The City specifically
acknowledges that the obligations set forth in paragraph 2 above are the sole obligation of
the City and that the City shall indemnify and hold harmless Link Transit from any claim

arising out of the performance or lack of performance of the City’s obligations in
paragraph 2.
4. Successors and Assigns. The burdens of this Easement shall be binding upon the owner
of the Easement Area and its successors and assigns as owner of the Easement Area, and
shall run as covenants with the land. The benefits of this Easement shall inure to the
Grantor and the Grantee as provided herein, and their successors..
5. General. This Easement shall be governed by the laws of the State of Washington. This
Easement shall not be modified, amended, or terminated except by written instrument
signed by Grantor and Grantee. If any legal action is brought to enforce any part of this
Easement, then the substantially prevailing part shall be entitled to recover its reasonable
attorney’s fees and costs incurred, including any costs and fees upon appeal.

I. Summary Title:
A Resolution of the City of East Wenatchee, Washington authorizing the Mayor to
execute Change Order 2 between the City of East Wenatchee and Selland
Construction Inc. for the 9th St NE & Valley Mall Parkway Intersection Improvement
Project.
II. Background/History:
At the July 19, 2022 City Council meeting the City entered into an agreement with
Selland Construction Inc. for proposed improvements at 9th Street NE and Valley
Mall Parkway. The City had bid this project once before but had to reject bids due to
the lowest bid exceeding the City’s available funds. Before re-biding the project, the
City removed a number of proposed improvements to reduce the cost of the project.
The main cost saving measure was leaving the existing asphalt in place, and
trenching utilities as needed rather than repaving the project area.
The bid received from Selland Construction Inc. was approximately $145,000 under
the federal funding amount received by the City. This allowed the City to add back in
the original paving, while not exceeding its federal funding allocation. This first
change order was approved at the November 22nd, 2022 Council meeting, and
included the additional paving and subgrade preparation. This first change order
added $124,358 to Sellands contract.
After progressing further in the project staff have identified another potential change
regarding the asphalt path on the north side of 9th Street NE. This change order
proposes removing a portion of the asphalt path and replacing it with concrete
sidewalk. Concrete has a much longer life than asphalt and would require less
maintenance. It would also match the aesthetic of the Gateway park on the other side
of the road. The sidewalk would transition to asphalt near the Espresso stand. The
remaining asphalt would be removed once the pedestrian overcrossing was
constructed to dissuade at grade crossings of SR-28.

The sidewalk would remove elements of the path that have not been constructed,
including plastic striping, some curbing, and additional HMA that has not been
placed. This offsets the cost of the sidewalk by approximately $20,000. The total
estimated cost to remove the temporary HMA path and install the sidewalk is
$28,798. If the City wished to complete this work at a later date the cost would likely
exceed $50,000.
III. Recommended Action:
Approve Resolution 2023-23 authorizing the Mayor to execute a change order
between the City of East Wenatchee and Selland Construction Inc. for the 9th St NE
& Valley Mall Parkway Intersection Improvements project.

9th St and Valley Mall Parkway Intersection Improvements
Change Order 2 Memo
The City desires a concrete sidewalk in lieu of the asphalt walkway shown in the Plans.
The asphalt walkway that was initially installed was needed to keep pedestrian moving
during the winter project shutdown. The City will pay for the temporary walkway with
their own funds. This change order does not require FHWA to pay for any item more
than once. The final product will be a concrete walkway along 9th St. NE. instead of an
asphalt walkway.
The cost for the change order was determined using unit costs from Selland’s bid and
costs proposed by Selland. The original unit price cost for Cement Conc. Driveway Type
4 was high due to the originally low quantity. The revised proposed cost is for all work
associated with this change order.RH2’s estimate of quantities is summarized in
Appendix A.
There shall be no change to Contract Time as a result of this Change Order.The
proposed work will occur during the same time as other planned work.
Bid items for Traffic Control (A-29, B-29) will not be affected as a result of this Change
Order.This is because work is still planned to be completed during the same planned
traffic control setups.
Bid items for Mobilization (A-1, B-1) will not be affected as a result of this Change
Order.Selland and their subs still have work to complete and can do this work and the
same time.
The Contractor confirmed via email (see attachment)that the work associated with this
change order does not require any changes to work being completed by a DBE sub-
contractor as part of the condition of award. The only DBE subcontractor planned for
use on the project is TBMM, who is performing traffic control.
