HomeMy WebLinkAbout10-03-2023 City Council MinutesMINUTES CITY COUNCIL REGULAR MEETING Tuesday October 03, 2023 Zoom and City Hall, 271 9th St NE, East Wenatchee, WA 1.CALL TO ORDER Mayor Crawford called the East Wenatchee City Council meeting to order at 6:00 p.m. 2.PLEDGE OF ALLEGIANCE Councilmember Hepner led the Pledge of Allegiance. 3.ROLL CALL Councilmembers Present: Councilmembers Absent: Mayor Crawford Councilmember Rob Tidd Councilmember Shayne Magdoff Councilmember Harry Raab Councilmember Sasha Sleiman Councilmember Christine Johnson Councilmember Mathew Hepner Motion by Councilmember Johnson to excuse Councilmember Tidd from the meeting. Councilmember Magdoff seconded the motion. Motion passed unanimously. 4.CONSENT AGENDA a.Approval of Voucher Report, Checks: 59146-59193, in the amount of $244,446.95. b.Approval of Minutes of the September 14, 2023, City Council Workshop Meeting. c.Approval of Minutes of the September 19, 2023, City Council. Motion by Councilmember Johnson to approve consent items as presented. Councilmember Sleiman seconded the motion. Motion passed unanimously. 5.CITIZEN COMMENTS None provided. 6.PRESENTATIONS a.Mayor Crawford recognized Jeremy Lovold for 15 Years of Public Service to the City of East Wenatchee Streets Department. Lovold was not present for the recognition. 7. PUBLIC HEARING / QUASI JUDICIAL PROCEEDING Presented by the Community Development Director Curits Lillquist. Application: CPA-ZC 2023-01; an application to change the comprehensive plan land use and zoning designation from R-L Residential Low-Density District to R-H Residential High-Density District Applicant: Braden and Jessica Draggoo Subject Property: 0.52-acre parcel located at 842 N Devon Avenue Mayor Crawford Opened the Public hearing at 6:04pm. Mayor Crawford read the Appearance of Fairness Doctrine and asked Councilmembers to disclose any ex-parte communications regarding the application. All Councilmembers present stated their communications and/or relation(s) that could appear as a conflict of interest. No Challenges were made as part of the Appearance of Fairness or Conflict of Interest doctrine. Mayor Crawford stated the quasi-judicial Public Hearing Procedures and Rules of Order. Community Development Director Curtis Lillquist provided an overview of the application and submitted Exhibit A. Please see the attached. Lillquist reviewed the action(s) available to City Council regarding the application and answered questions from the Council. Comments were made by all Councilmembers present. Braden Dragoo, resident at 432 Anna Lane in Wenatchee, applicant and property owner, presented his application and answered questions from the Council. Comments were made by: Councilmember Sterk, Councilmember Hepner, Councilmember Raab, Councilmember Magdoff, Councilmember Johnson. Community Development Director Curtis Lillquist answered questions regarding East Wenatchee Municipal Code(s) and requirements regarding permits, and general building regulations. Mayor Crawford opened the floor for public comment at 6:57pm. • Karen Peele, Complete Design, 353 Malaga Alcoa Highway, Wenatchee, spoke in favor of the application request. • Micah Cawdery, 860 N. Devon Ave, spoke in opposition of the application request, and submitted Exhibit B and C. Please see the attached. • Thomas Owens, 879 N. Devon Ave, spoke in opposition of the application request. • Andy Melsness, 869 N. Devon Ave, spoke in opposition of the application request. • Jenn Cawdery, 870 N. Devon Ave, spoke in opposition of the application request. With no further public comment given, the hearing was closed at 7:37pm. Community Development Director Curtis Lillquist provided clarification regarding the process of administrative (department) review of an application and described to Council the action(s) permitted on this item. Comments were made by: Councilmember Sleiman, Councilmember Magdoff, and Councilmember Hepner. A Motion by Councilmember Sterk was made to deny the application and adopt Resolution 2023-51. Councilmember Johnson seconded the motion. Discussion took place and it was determined that for the motion to be accepted, the need to incorporate findings of fact (as part of the motion) had to be made. Councilmember Sterk requested 5 minutes to amend and incorporate findings of fact in his motion. A recess of 7 minutes was granted at 7:50 p.m. The meeting was resumed at 7:57 p.m. Councilmember Sterk amended his motion to deny the application CPA-ZC 2023-01 and adopt Resolution 2023-51, to include the following finding of fact: • the inconsistency to the Greater East Wenatchee Area Comprehensive Plan states that, under Residential High/office land use, “Urban governmental services and infrastructure must be available at the time of development or there must be a plan in place, with funding, to ensure that a full range of urban governmental services is available to serve the development.” Under RCW 36.70A.030 (43), Urban governmental services is defined as ‘those publics services and public facilities at an intensity historically and typically provided in cities, specifically including storm and sanitary sewer systems, domestic water systems, street cleaning services, fire and police protection services, public transit services and other public utilities associated with urban areas and normally not associated with rural areas. It has been said that the area proposed for Residential High office use does not have necessary services such as storm water drainage or fire hydrants. Without storm drains or fire hydrants on the street in question, and no emergency vehicle turnarounds, the subject property does not seem to be served with a full range of urban services. There is a reasonable probability that a change in the land use designation will have more than a moderate effect on the environment. Additionally, it must be remembered, the current members of the neighborhood are in complete opposition to this proposal. Councilmember Johnson seconded the motion. Discussion: Comments by councilmember Magdoff, Councilmember Sleiman. Motion Passed: 4-2. (Magdoff, Sleiman).
