LACY PRESIDING AUGUST 16, 1999 6:30 P.M. OATH OF OFFICE Robert Smet was sworn into Council Position Number 1 by Mayor Lacy. ROLL CALL Councilmembers Present: Councilmember Nash, Councilmember Buckner, Councilmember Smet, Councilmember Stanton, Councilmember Carson, Councilmember Hendricks, Mayor Lacy. Councilmember Aiken, excused. Council Action: A motion was made by Councilmember Stanton, second by Councilmember Nash to excuse Councilmember Aiken from this Council meeting. The motion carried 5-0. (Hendricks abstained) Staff Present: Harry Staven, Dana Barnard, Randy Harrison, Nancy Lynn, Christy Patterson, Gil Sparks. PLEDGE OF ALLEGIANCE CITIZEN COMMENTS Bruce Alen Banister asked to have the following noted for the record: RCW 35.23.081 Oath and bond of officers. In a city of the second class, the treasurer, city attorney, clerk, chief of police, and such other officers as the council may require shall each before entering upon the duties of office, take an oath of office and execute and file with the clerk an official bond in such penal sum as the council shall determine, conditioned for the faithful performance of his or her duties and otherwise conditioned as may be provided by ordinance. The oath of office shall be filed with the county auditor. Notice of Deficiency of Bond noted for the record. On July 24 A.D. 1999 in the evening I was riding in a truck when stopped by an armed woman claiming to be a "peace officer" in this state. When confronted by her I requested evidence of her authority to act as a peace officer in this area. She refused to provide such evidence and threatened me. I called the Douglas County Sheriffs office regarding this crime and was advised to speak with her alleged Sergeant, Sergeant Rierson. He refused to act, but advised me to speak with the Police Chief for the City of East Wenatchee. I contacted the Police Chief on Monday, July 26" and he refused to provide evidence that the woman he said was named Christina Patterson was a peace officer in this state, but did admit he was responsible for her conduct, and that he was not bonded. Inc. City Attorney Gil Sparks said the ordinance transfers control from Falcon Communications to Charter Communications. He added the ordinance has been reviewed by Charter Communications, Inc. Council Action: A motion was made by Councilmember Hendricks, second by Councilmember Stanton to elevate the ordinance transferring the cable communications franchise from Falcon Communications to Charter Communications to second reading. The motion carried, 6-0. Council Action: A motion was made by Councilmember Carson, second by Councilmember Hendricks approve the ordinance transferring the cable communications franchise from Falcon Communications to Charter Communications to second reading. The motion carried, 6-0. Mayor Lacy read the ordinance title. ORDINANCE NO. 99-11 AN ORDINANCE OF THE CITY OF EAST WENATCHEE, WASHINGTON, RELATING TO CABLE TELEVISION FRANCHISING, CONSENTING TO A TRANSFER OF CONTROL OF THE CABLE COMMUNICATIONS FRANCHISE FROM FALCON COMMUNICATIONS L.P. TO CHARTER COMMUNICATIONS INC., AMENDING SECTION 4.5 OF ORDINANCE 92-7, AND REPEALING ORDINANCE NO.98-6, AND ESTABLISHING AN EFFECTIVE DATE. DISCUSSION Community Public Access Programming City Administrator Staven said in the contract between the City of Wenatchee and Charter Communications Inc. Charter Communications Inc. agreed to provide funding in the amount of one hundred thousand dollars to purchase equipment for local access programming on cable TV. He added Charter Communications would recover the funded amount through their subscribers. Charter Communications representative Bob Lam said the price passed on to the subscribers would be lower if other Cities were to join in the agreement with Wenatchee. City Administrator Staven said a presentation of the program will be given on August 23, 1999 at 1:30 p.m. at Wenatchee City Hall. Councilmember Smet and Councilmember Stanton said they would attend the presentation. Wenatchee and East Wenatchee Regional Sanitary Sewer Service. Mayor Lacy said the City had received an invitation to participate in a forum relating to regional sanitary sewer service to see whether interest exists among governmental agencies. Council suggested having Community Development Director Barnett attend the fonun.
