LACY PRESIDING MAY 3, 1999 6:30 P.M. ROLL CALL Councilmembers Present: Councilmember Carson, Councilmember Hendricks, Councilmember Stanton, Councilmember Buckner, Councilmember Nash, Councilmember Mikow, Mayor Lacy. Councilmember Aiken excused. Council Action: A motion was made by Councilmember Nash, second by Councilmember Hendricks to excuse Councilmember Aiken from this Council meeting. The motion carried 6-0. Staff Present: Harry Staven, Dana Barnard, Linda Countryman, Randy Harrison, Lori Barnett, Darin Bender, Chuck Zimmerman. PLEDGE OF ALLEGIANCE PRESENTATIONS Best SELF representative Beverly Jagla gave a presentation of the program. She said the program is requesting funding from the City of East Wenatchee. The program will be a summer school recreations learning program. PROCLAMATIONS Mayor Lacy read proclamations for Buddy Poppy Sales, Memorial Day and Mental Health Month. DEPARTMENT REPORTS Executive City Administrator Staven said the Skills Resource Center was ready to start creating a web page for the City of East Wenatchee and would like to have a some ideas of what the City wishes to have included. City Administrator Staven reminded Council of the upcoming Association of Washington Cities Annual Conference being held in Wenatchee, June 22-25, 1999. Community Development Community Development Director Barnett said the Fred Meyers Developer is requesting that the installation of a fence along the walking trail be placed within one foot of the trail rather than along the property line. She added the reason for the request was for safety issues. Council Action: A motion was made by Councilmember Mikow, second by Councilmember Buckner to authorize the mayor to write a letter of consent authorizing the fence placement as a permissive use. ORDINANCE 99-04-05 Second reading of an ordinance adding section 9.36.50 to the East Wenatchee Municipal Code relating to the use of laser devises. City Attorney Zimmerman explained the differences between the proposed City ordinance and Substitute House Bill 2086. He indicated that depending upon what the state law as enacted provided, the City may need to amend this ordinance at a future date to comply with state law. Council Action: A motion was made by Councilmember Stanton, second by Councilmember Buckner to adopt the ordinance adding a new section to the East Wenatchee Municipal Code relating to the use of laser devices. The motion carried, 6-0. Mayor Lacy read the ordinance title. ORDINANCE NO. 99-7 AN ORDINANCE OF THE CITY COUNCIL OF EAST WENATCHEE, WASHINGTON, ADDING A NEW SECTION 9.36.50 TO THE EAST WENATCHEE MUNICIPAL CODE RELATING TO THE USE OF LASER DEVICES; CONTAINING A SEVERABILITY CLAUSE AND SETTING AN EFFECTIVE DATE. 99-04-09 Second reading of an ordinance amending the Surface and Storm Water Utility for Comprehensive Surface and Storm Water Management. Councilmember Hendricks asked if the Surface and Storm Water Utility would be prorated for the remainder of 1999. Community Development Director Barnett said the Utility would be prorated for a six month period for 1999. Council Action: A motion was made by Councilmember Buckner, second by Councilmember Carson to adopt the ordinance amending the Surface and Storm Water Utility for Comprehensive Surface and Storm Water Management. The motion carried, 4-2. (Nash, Hendricks) Mayor Lacy read the ordinance title. ORDINANCE NO. 99-5 AN ORDINANCE OF THE CITY COUNCIL OF EAST WENATCHEE, WASHINGTON, AMENDING CHAPTER 13.10 OF THE EAST WENATCHEE MUNICIPAL CODE; AMENDING THE SURFACE AND STORM WATER UTILITY FOR COMPREHENSIVE SURFACE AND STORM WATER MANAGEMENT. ADOPTING NEW SECTIONS AND SUBSECTIONS, CONTAINING A SEVERABILITY CLAUSE AND SETTING AN EFFECTIVE DATE.
