REGULAR SESSION OF THE CITY COUNCIL CONVENED

SEPTEMBER 24, 2002

ROLL CALL
Councilmembers Present: Councilmember Buckner, Councilmember DeWitt, Councilmember
Aiken, Councilmember Smet, Councilmember Bremmer, Councilmember Hendricks, and Mayor
Lacy.
Staff Present: Dana Barnard, Randy Harrison, Bob Goodman, Lori Barnett, Teresa Allen, Mike
Martz, Marcia Martz, Darin Bender, Bruce Nash, and Chuck Zimmerman.
PLEDGE OF ALLEGIANCE
PROCLAMATIONS
Mayor Lacy read a proclamation designating October as Domestic Violence Awareness Month.
PRESENTATIONS
Matthew Warner, Take Pride in America, submitted a preliminary design to Council for the
Japanese Garden which will be located on 80' Street NE and Eastmont Avenue. He said the design
plans will be mailed to Misawa, Japan for further input on the project.
Mayor Lacy said he had received a letter from Douglas County Sewer District No. 1 giving
approval of the Japanese Garden.
CITY COUNCIL POSITION NO.2
Mayor Lacy read RCW 35A.12.030 to the candidates to ensure they met the requirements to be
considered for the position.
Candidates John Sterk, MargaLea Isaacs, Michael Roberts, Harry Raab, and Sue Mickelson
expressed their desire to fill vacant Council Position No. 2. Each candidate gave a summary of
their reasons for their interest in filling the vacant position and answered questions from Council.
Lynda Pheasant withdrew her letter of interest as she did not meet the requirements specified in
RCW 35A.12.030.
EXECUTIVE SESSION
Mayor Lacy called a twenty minute executive session to evaluate the qualifications of candidates
for appointment to the vacant Council position and to discuss potential litigation.
Convened: 7:30 p.m.
At 7:50 p.m. Mayor Lacy extended the Executive Session an additional five minutes.
Reconvened: 7:55 p.m.

Vouchers audited and certified by the auditing officer as required by RCW 42.24.080, and those
' expense reimbursement claims certified as required by RCW 42.24.090, have been recorded on a
listing that has been made available to Council.
As of this date, September 24, 2002, Council does approve warrant numbers 12582 through
12597, in the total amount of $51,547.94.
Council does approve payroll wan -ant numbers 19606 through 19685, and 220043, in the total
amount of $146,810.49, paid September 5, 2002, for the month of August 2002.
ORDINANCE
02-09-02 Second reading of an ordinance vacating an unimproved portion of an alley
located between Alvin Court and Valley Mall Parkway.
Council Action: A motion was made to adopt the ordinance vacating an unimproved portion of
an alley located between Alvin Court and Valley Mall Parkway by Councilmember Buckner,
second by Councilmember DeWitt. The motion carried, 6-0.

ORDINANCE 2002-19
AN ORDINANCE OF THE CITY OF EAST WENATCHEE, WASHINGTON,
' VACATING THE ALLEY LOCATED BETWEEN ALVIN COURT AND
VALLEY MALL PARKWAY AND RETAINING A CITY EASEMENT FOR
UNDERGROUND PUBIC UTILITIES IN THE VACATED ALLEY.
DISCUSSION / ACTION ITEMS
02-09-10 LINK bus stop on Valley Mall Parkway at Wenatchee Valley Mall
Mayor Lacy said this is regarding construction of a bus pull-out on Valley Mall Parkway adjacent
to the Mall. He said he had met with City Attorney Chuck Zimmerman, whose firm, Ogden
Murphy Wallace, represents both LINK and the City of East Wenatchee. He added he had signed
a waiver with Ogden Murphy Wallace as did LINK allowing legal council to draft an agreement
between the City and LINK.
City Attorney Zimmerman said the agreement will allow the City to do the design, engineer
work, advertise the job under the small works roster, and construct the project. He said the
agreement would be available at the next meeting for authorization of the Mayors signature.
02-09-12 Approval of final plat for Briarwood Division 5
Community Development Director Barnett said the City has received the as built plans and the
compaction test. The only item left is to modify the mylar and make sure it takes care of issues
related to closure of lots.
Council Action: A motion was made to authorize the Mayor to sign the final plat of Briarwood
Subdivision 5 upon completion of items listed in a memo attached to Council Bill No. 2-09-12
from the Planning Director by Councilmember Hendricks, second by Councilmember Bremmer.
The motion carried, 6-0.
