LACY, PRESIDING JUNE 11, 2002 6:30 P.M. ROLL CALL Councilmembers Present: Councilmember DeWitt, Councilmember Nash, Councilmember Hendricks, Councilmember Bremmer and Mayor Lacy. Councilmember Aiken and Councilmember Smet were excused. Councilmember Buckner was absent. Council Action: A motion was made to excuse Councilmember Aiken from this Council meeting by Councilmember Hendricks, second by Councilmember Bremmer. The motion carried, 4-0. PLEDGE OF ALLEGIANCE ' MAYOR'S REPORT Mayor Lacy said the 911 Regional Center Committee have submitted an estimated budget. Council discussed the options of contracting for dispatch services and joining as a partner in the Regional 911 Center. Council Action: A motion was made to join in a partnership with Chelan County, Douglas County and the City of Wenatchee in a Regional 911 Center by Councilmember DeWitt, second by Councilmember Bremmer. The motion carved, 4-0. Mayor Lacy said at the last Eastmont Recreation Service Area (ERSA) Board meeting it was discovered that Section 2 of the ERSA agreement had been changed prior to execution. The agreement states that upon termination of the ERSA, the assets revert back to Douglas County. However, the agreement was changed to a five year lease rather than a deed. Mayor Lacy said the Interlocal Agreement for Eastmont Recreation Service Area Agreement had gone through many drafts and this was not the intent of the final Interlocal Agreement. The intent of the Interlocal Agreement was to transfer the property and assets to ERSA by deed. He said the Douglas County Commissioners would ask for a revision to the hnterlocal Agreement. The motion carried, 4-0. Mayor Lacy read the ordinance summary. ORDINANCE NO.2002-14 AN ORDINANCE OF THE CITY OF EAST WENATCHEE, WASHINGTON, ADOPTING FINDINGS OF FACT TO JUSTIFY THE CONTINUED IMPOSITION OF AN INTERIM ORDINANCE CONCERNING WIRELESS FACILITIES, AS REQUIRED BY RCW 35A.63.220. AUTHORIZATION 02-05-10 Authorization to refund Cabaret license fees paid for 2002. Mayor Lacy said at the May 14, 2002 Council meeting Tradewinds Coffee Co. owner Kristen Kennedy gave a very good presentation requesting the Cabaret section of the code be refined or repealed. He asked City Attorney Zimmerman to draft an ordinance repealing the Cabaret section of the East Wenatchee Municipal Code noting that such licenses have been ruled unconstitutional restraints on free speech. Mayor Lacy said the City has received requests for a refund of Cabaret license fees for 2002 from Minn's Club, Clearwater Steakhouse and Saloon and 5 T's Restaurant and Lounge. Councilmember Nash asked if there could be potential litigation with the fees paid in preceding years. City Attorney Zimmerman suggested having the businesses submit a release of all claims prior to receiving the refund. Council Action: A motion to refund Cabaret fees paid for 2002 with submission of a completed release of all claims form was made by Councilmember Bremmer, second by Councilmember DeWitt. The motion carried, 4-0. 02-06-03 Authorization to surplus items through Northwest Auction Services at an auction to be held at the Chelan County Shop on Saturday, June 29, 2002. Councilmember Hendricks asked about placing the monies received from the surplus vehicle into the Equipment Rental and Replacement (ER&R) fund. City Treasurer Countryman said an ER & R fund had been established with the 2002 budget. Certain capital outlay purchases such as vehicles and possibly future computer equipment, may be budgeted in the ER&R fund. City Departments then "rent" the equipment from the ER&R fund. The proceeds from the surplused vehicle will be receipted into the ER&R fiord.
