Finance Director Nick Gerde submitted and reviewed the Financial Report for the month of July. City Attorney Devin Poulson reviewed a memo regarding 2013 Legislative changes related to All -Terrain Vehicles (ATV's) noting that the City has to opt in if they want to allow ATV's on city streets, he asked Council for direction on the issue. Following Council discussion it was decided to have the City Attorney draft an ordinance allowing ATV's on city streets. Loye Turner, 9* Street, and Cory Rowe of Rowe's Tractors, spoke in favor of allowing ATV's on city streets. MAYOR'S REPORT ' Mayor Lacy said he received preliminary acceptance from Greg Pezoldt to take the position of City Engineer with an annual salary of $85,000. Mayor Lacy said he received a letter from R142 Engineering which was a notice to KLB Construction notifying them that they are behind schedule on the Eastmont Avenue Reconstruction Project. He added the City has committed funds for projects on a continuing basis for about five years, and in order to continue receiving funds we must comply with the requirements set forth in the Compliance Agreement. 13-08-04 Authorization for the Mayor to sign the voluntary Compliance Agreement between the U.S. Department of Housing and Urban Development (HUD) and the City of East Wenatchee. Presented by: Lori Barnett, Community Development Director Council Action: A motion was made by Councilmember Johnson, second by Councilmember Raab authorizing the Mayor to sign the Compliance Agreement with the U.S. Department of Housing and Urban Development. The motion carried, 7-0. 13-08-02 First reading of an Ordinance of the City of East Wenatchee regulating the use of parks within the City by amending Chapter 12.12 of the East Wenatchee Municipal Code; Presented by: Devin Poulson, City Attorney. He indicated there was a change to the text in Chapter 12.12.080 paragraph D. ' Mayor Lacy elevated the ordinance to second reading without objection from the Council. Council Action: A motion was made by Councilmember Detering, second by Councilmember Buckner, to adopt the Ordinance regulating the use of parks by amending Chapter 12.12 including the text change in Chapter 12.12.080 paragraph D. The motion carried, 7-0. Ordinance No. 2013-05 An Ordinance of the City of East Wenatchee regulating the use of parks within the City by amending Chapter 12.12 of the East Wenatchee Municipal Code. 13-08-03 An Ordinance of the City of East Wenatchee, Washington, imposing a Moratorium on the establishment of certain marijuana -related facilities; defining certain marijuana -related terms, and entering Legislative findings. Presented by: Lori Barnett, Community Development Director Mayor Lacy elevated the ordinance to second reading without objection from the Council. ' Council Action: A motion was made by Councilmember Barnhart, second by Councilmember Johnson, to adopt the Ordinance imposing a Moratorium on the establishment of marijuana -related facilities; defining marijuana -related terms, and entering legislative findings.
