Councilmember's Present: Councilmember Hendricks, Councilmember Barnhart, Councilmember
Bremmer, Councilmember Buckner, and Mayor Pro Tern Harry Raab.
Council Action: A motion was made by Councilmember Barnhart, second by Councilmember Buckner,
to excuse Councilmember McCourt from this meeting. The motion carried, 5-0.

PLEDGE OF ALLEGIANCE
PROCLAMATION
Mayor Pro Tern Raab read a proclamation proclaiming East Wenatchee's support for the 2009
Washington State Special Olympics Winter Games being held in the Wenatchee Valley March 6 through
March 8, 2009.
PRESENTATION
Douglas County Sheriff, Harvey Gjesdal, introduced himself and said he had been visiting other
jurisdictions in the County in which the Douglas County Sheriff's Office has contracts with. He said he
had attended the National Sheriffs Institute Conference last fall in which they expressed that Sheriffs
present themselves to City Council of cities that have their own Police Department. He said even though
the city has its own law enforcement agency that takes care of the City's needs he wanted to extend a
hand to let them know that the Sheriff's office is here for them, especially during these tough economic
times it is important for law enforcement to work together.
Councilmember Hendricks asked Sheriff Gjesdal if he could explain why the Douglas County
Commissioners decided not to prosecute property crimes involving amounts less than $750 when state
statute says property crimes involving amounts over $250 are felonies.
Sheriff Gjesdal explained that Douglas County has decided it will no longer prosecute property crimes
involving amounts less than $750 and these will have to be handled at the City. The amount was raised to
$750 due to state of the economy and rising costs. He added the statute remains at $250, but the County
will not prosecute any cases under $750.
BUDGET ISSUES
Mayor Pro Tern Raab said that Mayor Lacy has set a budget committee meeting for March 12, 2009, at
6:30 p.m.

ACTION ITEMS
09-02-04 Authorization for the Mayor to sign a contract with Tony DiTommaso and Nicholas A.
Yedinak of Kottkamp and Yedinak, PLLC ("Attorneys") for Public Defender Services for
2009.
Council Action: A motion was made by Councilmember Buckner, second by Councilmember Bremmer,
to authorize the Mayor to sign a Contract with Tony DiTommaso and Nicholas A. Yedinak for Kottkamp
and Yedinak PLLC ("Attorneys") for Public Defender Services for 2009. The motion carried, 5-0.
RESOLUTION
09-01-07 A resolution of the City of East Wenatchee adopting a new Manual of Personnel Policies
and Procedures.
City Attorney, Devin Poulson, reviewed the changes made to: 1.30), 6.1(e), 7.2(e), and 7.3(f). He said
these changes were recommended by the Handbook Committee.
Councilmember Bremmer expressed concerns that an employee may plan to use the sick leave rather than
state that they are retiring so that they can use up their sick leave of up to 960 hours rather than be cashed
out at 25%.
City Attorney Poluson said there are other provisions in the handbook that would not allow that to
happen.
Councilmember Barnhart said it is up to management to ensure these types of things do not happen. He
suggested changing the language and insert shall, instead of may, so that it does not leave any ambiguity.
Council Action: A motion was made by Councilmember Bremmer, second by Councilmember Barnhart,
to amend Chapter 7.3(d) to read shall, instead of may, in the City of East Wenatchee manual of personnel
policies and procedures as previously discussed. The motion carried, 4-1. (Hendricks)
Councilmember Hendricks expressed concerns about changing the word from aay require a doctor's note
to shall require a doctor's note. He asked whose responsibility it would be to pay for the doctor visit as he
feels it is a pretty bold statement and he would not like the city to have to pay for that.
Council Action: A motion was made by Councilmember Hendricks, second by Councilmember
Barnhart, to adopt the City of East Wenatchee manual of personnel policies and procedures and
resolution. The motion carried, 5-0.
