LACY, PRESIDING OCTOBER 13, 2009 6:30 P.M. ROLL CALL Councilmember's Present: Councilmember Buckner, Councilmember Barnhart, Councilmember Johnson, Councilmember Raab, Councilmember Hendricks, Councilmember Bremmer, Councilmember McCourt, and Mayor Lacy. Staff Present: Dana Barnard, Devin Poulson, Brandon Mauseth, Catalina Garibay, Randy Harrison, Dawn Collings, and Nick Gerde. PLEDGE OF ALLEGIANCE DEPARTMENT REPORTS Finance Department — September Financial Report Finance Director/Treasurer, Nick Gerde, reviewed the Financial Report for the month of September and the year-to-date totals through September 30, 2009. Street Department — Energy Efficiency Grant Street Superintendent, Brandon Mauseth, said he had submitted a grant application to the Washington State Department of Commerce requesting the maximum eligible amount of $135,000 in Energy Efficiency Conservation Block Grant funding. He said if the City receives this grant, the funds would be used towards two projects the City would like to complete, which totals approximately $154,000. These projects include a pedestrian crossing on Grant Road at Georgia Avenue; and replacement of incandescent traffic signal lamps with Light Emitting Diode (LED) lamps citywide. Mayor Lacy clarified that when the City has applied for a grant and then receives an indication that they have been successful in procuring the grant, the final decision shall be made by Council as whether to accept or reject the grant funds. He added he makes the decision as to whether the City shall submit a grant application as long as it does not affect the budget of the City. MAYOR'S REPORT Mayor Lacy said he would like to open a discussion as to how Council wishes to proceed with the City owned rental home adjacent to City Hall. He said the options that have been brought up consist of the following: • Remodel the rental to move the library into that building; • Move one or more City Departments from the west wing of the City Hall to the rental; • Utilize the rental for additional housing of Police Department employees; • Rent the property for income; or • Sell the property. Mayor Lacy said he would prefer Council make a proposal by way of a motion to get a discussion started. He added the grant does not require matching funds and must be expended by June 30, 2011. Mayor Lacy explained the difference with this type of grant. He said that upon execution of this agreement, these funds are guaranteed. Therefore, by applying for this grant the City is agreeing to accept and expend these funds. Council Action: A motion was made by Councilmember Johnson, second by Councilmember Bremmer, authorizing the Mayor to sign a Grant Agreement between the State of Washington Department of Ecology and the City of East Wenatchee for the FY 2010-2011 Phase II Stormwater Pass -Through Grants Program. The motion carried, 7-0. 09-10-03 Authorization for the Mayor to sign an amendment to an Agreement for Services between the City of East Wenatchee and the Wenatchee Valley Convention and Visitor's Bureau extending the term of the Agreement to October 13, 2010. Mayor Lacy said this agreement will extend the term of the agreement from its current expiration of October 13, 2009, to October 13, 2010, to the Visitors Bureau. Council Action: A motion was made by Councilmember Barnhart, second by Councilmember Johnson, authorizing the Mayor to sign an amendment to an Agreement for Services between the City of East Wenatchee and the Wenatchee Valley Convention and Visitor's Bureau extending the term of the Agreement to October 13, 2010. The motion carried, 7-0. RESOLUTION 09-10-04 A resolution of the East Wenatchee City Council to execute a Possession and Use Agreement to the State of Washington regarding State Route 28 Spur, E. End of George Sellar Bridge to P Street. Mayor Lacy said this property is the land beneath the wall at Fred Meyer. He indicated that by adopting this resolution Washington State Department of Transportation (WSDOT) is granted a right to possess and use the property for the East End George Sellar Bridge project. He added WSDOT are suggesting that they, are still open to the idea of a land exchange, but if the land exchange does not happen then the amount that they are paying for this ground is still open for negotiation. Mayor Lacy said this is a Possession and Use Agreement and pursuant to condemnation law, the first step is a question of possession and use, which can be done separately from the negotiated price. He said WSDOT will simply deposit the $370,000 under conditions it will be returned in the event that there is an exchange of land, but it was very clearly communicated that WSDOT representatives understood that we still have the ability as a City to challenge the amount in the second phase of the condemnation. Council Action: A motion was made by Councilmember Barnhart, second by Councilmember Buckner, to adopt Resolution of the East Wenatchee City Council to execute a Possession and Use Agreement to the State of Washington regarding State Route 28 Spur, E.
