5. Action Items.
a. First reading of Ordinance 2022-23, amending chapter 8.20 of the East Wenatchee
Municipal Code changing the definition of dangerous building – Curtis Lillquist,
Community Development Director. Pg. 51
Request to suspend second reading.
Motion by the City Council to approve Ordinance 2022-23, amending chapter 8.20
of the East Wenatchee Municipal Code changing the definition of dangerous
building.
b. Resolution 2022-42 of the City of East Wenatchee, declaring certain property owned
by the City as surplus to the needs of the City – Curtis Lillquist, Community
Development Director. Pg. 60
Motion by the City Council to approve Resolution 2022-42, declaring the property
identified in Exhibit A as surplus to the needs of the City.
c. Resolution 2022-44, authorizing the Mayor to execute an Amended and Restated
Interlocal Agreement between the City of East Wenatchee and the Eastmont School
District for School Resource Officer (SRO) Services beginning in the 2022-2023 school
year – Rick Johnson, Police Chief. Pg. 65
Motion by the City Council to approve Resolution 2022-44, authorizing the Mayor
to execute an Amended and Restated Interlocal Agreement between the City of

0.1% sales tax. Public Works Manager Garren Melton provided a staff report. Mayor
Crawford opened the public comment period, no comments were received. The
Mayor closed the public hearing at 6:09 pm.

$20 vehicle licensing fee imposed by the East Wenatchee Transportation Benefit
District. Councilmember Johnson seconded the motion. Motion carried (5-0).
ii. Public Works Manager Garren Melton presented Ordinance 2022-22,
implementing a 0.1% Sales and Use Tax to fund the East Wenatchee
Transportation Benefit District.
Mayor Crawford suspended the second reading.
Motion by Councilmember Sleiman to approve Ordinance No 2022-22,
implementing a 0.1% Sales and Use Tax to fund the East Wenatchee
Transportation Benefit District. Councilmember Tidd seconded the motion.

b. Mayor Crawford opened a public hearing for the purpose of receiving public
comment regarding Ordinance 2022-19 - Interim Official Controls for temporary use
of Valley Mall Parkway right-of-way for streateries. Community Development
Director Lori Barnett provided a brief staff report. Mayor Crawford opened the
public comment period, no comments were received. The Mayor closed the public
hearing at 6:09 pm.
Motion by Councilmember Sleiman to affirm the finding of facts presented in the
agenda bill. Councilmember Magdoff seconded the motion. Motion carried (5-0).
4. Presentations.
a. Mayor Crawford presented a Certificate of Recognition to East Wenatchee Police
Officer Leeon Leyde for 10 Years of Dedicated Service.
b. Police Chief Rick Johnson presented information regarding the August 3, 2022,
National Night Out event at the Eastmont Community Park.
Public Works Manager Garren Melton provided an update regarding the natural gas
leak that occurred today at the Hamilton Street project site, off Valley Mall Parkway.

a. Mayor Crawford acknowledged Community Development Director Lori Barnett, who

b. Mayor Crawford provided information to the Council regarding a possible Regional
Aquatics District and how the formation may occur.

Powerhouse Ministries which is the only day shelter in Douglas County, and the
impact it will have on homeless services in our community.

City Association and visits to and from Japan.
e. Mayor Crawford provided information regarding Waste Management (WM) notices
that were mailed to city residents that will be affected by garbage collection day
changes. Not all residents will be impacted by the WM schedule change.

the Mayor to execute an Administrative Settlement for the East Wenatchee –
Sterling Safe Routes to School, Pedestrian Improvements, Project Parcel Number: 8,
5th Street Administrative Settlement, Project No. 2019-08.

Motion by Councilmember Tidd to approve Resolution 2022-35, authorizing the
Mayor to sign the Administrative Settlement for the Sterling Safe Routes to School

c. Mayor Crawford presented Resolution 2022-43, confirming the appointment of

I. Summary Title:
An ordinance of the City of East Wenatchee amending the definition of dangerous
building in Chapter 8.20 Nuisances.
II. Background/History:
The current version of code states “Any dangerous building as defined in the
Uniform Code for the Abatement of Dangerous Buildings, “. The State changed from
the uniform building codes to the international building codes ten to fifteen years
ago. Therefore, the Uniform Code for the Abatement of Dangerous Buildings is no
longer used.
The international codes have an International Property Maintenance Code and once
we have a full time building official; staff will discuss with council whether the city
wants to adopt that code.
This proposal is to remove the reference to the Uniform Code for the Abatement of
Dangerous Buildings and replace it with the definition of dangerous building from
that code.

the East Wenatchee Municipal Code changing the definition of
dangerous building, containing a severability clause, and establishing
an effective date.

2. Recitals.
2.1. The City of East Wenatchee (“City”) is a non-charter code city, duly
incorporated and operating under the laws of the State of Washington.
2.2. The East Wenatchee City Council desires to protect the public health, safety
and welfare of the citizens of the incorporated area of the City of East
Wenatchee and maintain a high quality of life for the citizens of East
Wenatchee through the maintenance of structures in the City of East
Wenatchee.
2.3. Properties that are neglected and have damaged or unsecured, accessible
structures have a negative impact on community value, create conditions
that invite criminal activity, and foster unsafe and unhealthy environment
for all citizens.
3. Authority.
3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt
ordinances of all kinds to regulate its municipal affairs and appropriate to
the good government of the City.
4. Purpose. The purpose of this ordinance is to update the East Wenatchee
Municipal Code (EWMC) Chapter 8.20 to change the definition of dangerous
building in the City’s nuisance code.

5. Amendment. The City Council amends EWMC Chapter 8.20 as set forth in
Exhibit A.
6. Findings of Fact. The City Council adopts as its findings of fact the recitals
set forth above.
7. Repeal. The City Council repeals those provisions of any ordinance that are in
conflict with the language of this Ordinance.
8. Severability. If a court of competent jurisdiction declares any provision in this
Ordinance to be contrary to law, such declaration shall not affect the validity of
the other provisions of this Ordinance.
9. Publication. The City Council directs the City Clerk to publish a summary of this
Ordinance. The summary shall consist of the title of this Ordinance. The City
Council directs the City Clerk to publish a copy of this Ordinance on the City’s
website.
10. Effective Date. This Ordinance becomes effective immediately.

8.20.020 Definitions.
The words and phrases used in this chapter, unless the context otherwise indicates, shall have
the following meanings:
A. “Abate” means to repair, replace, remove, destroy or otherwise remedy the condition which
constitutes a violation of this chapter by such means and in such a manner and to such an
extent as the enforcement officer determines is necessary in the interest of the general health,
safety and welfare of the community.
B. “Apparently inoperable vehicle” means any vehicle that is not currently licensed or is visibly
damaged such that it would appear to the reasonable person to be inoperable in its present
condition.
C. “Building” means any edifice constructed with walls and a roof for permanent use built for
enclosure of persons, animals, chattels or property of any kind. The term “building” does not
include a tarp or canopy made of canvas, plastic or other similar materials.
D. “Building materials” means and includes, but is not limited to, lumber, plumbing materials,
wall board, sheet metal, plaster, brick, cement, asphalt, concrete block, roofing materials, cans
of paint and similar materials.
E. “Dangerous building” is any building or structure which has any or all of the conditions or
defects hereinafter described shall be deemed a dangerous building, provided that such
conditions or defects exist to the extent that the life, health, property or safety of the public or its
occupants are endangered.
1. Whenever any door, aisle, passageway, stairway or other means of exit is not of
sufficient width or size or is not so arranged as to provide safe and adequate means of
exit in case of fire or panic.
2. Whenever the walking surface of any aisle, passageway, stairway or other means of exit
is so warped, worn, loose, torn, or otherwise unsafe as to not provide safe and adequate
means of exit in case of fire or panic.
3. Whenever the stress in any materials, member or portion thereof, due to all dead or live
loads, is more than one and one half times the working stress or stresses allowed in the
Building Code for new buildings of similar structure, purpose or location.
4. Whenever any portion thereof has been damaged by fire, earthquake, wind, flood or by
other cause, to such an extent that the structural strength or stability thereof is material
less than it was before such catastrophe and is less than the minimum requirements of
the Building Code for new buildings of similar structure, purpose or location.
5. Whenever any portion or member or appurtenance thereof is likely to fail, or to become
detached or dislodged, or to collapse and thereby injure persons or damage property.
6. Whenever any portion of a building, or any member, appurtenance or ornamentation on
the exterior thereof is not of sufficient strength or stability, or is not so anchored,
attached or fastened in place so as to be capable of resisting a wind pressure of one half
of that specified in the Building Code for new buildings of similar structure, purpose or
location without exceeding the working stresses permitted in the Building Code for such
buildings.
7. Whenever any portion thereof has wracked, warped, buckled or settled to such an extent
that walls or other structural portions have materially less resistance to winds or
earthquakes than is required in the case of similar new construction.

8. Whenever the building or structure, or any portion thereof, because of a) dilapidation,
deterioration or decay; b) faulty construction; c) the removal, movement or instability of
any portion of the ground necessary for the purpose of supporting such building; d) the
deterioration, decay or inadequacy of its foundation; or e) any other cause, is likely to
partially or completely collapse.
9. Whenever the building or structure, or any portion thereof, is manifestly unsafe for the
purpose for which it is being used.
10. Whenever the exterior walls or other vertical structural members list, lean or buckle to
such an extent that a plumb line passing through the center of gravity does not fall inside
the middle one third of the base.
11. Whenever the building or structure, exclusive of the foundation, shows 33 percent or
more damage or deterioration of its supporting member or members, or 50 percent
damage or deterioration of its nonsupporting members, enclosing or outside walls or
coverings.
12. Whenever the building or structure, has been so damaged by fire, wind, earthquake or
flood or has become so dilapidated or deteriorated as to become a) an attractive
nuisance to children; b) a harbor for vagrants, criminals or immoral persons; or as to c)
enable persons to resort thereto for the purpose of committing unlawful or immoral acts.
13. Whenever any building or structure has been constructed, exists or is maintained in
violation of any specific requirement or prohibition applicable to such building or
structure provided by the building regulations of this jurisdiction, as specified in the
building code or housing code, or of any law or ordinance of this state or jurisdiction
relating to the condition, location or structure of buildings.
14. Whenever any building or structure which, whether or not erected in accordance with all
applicable laws or ordinances, has in any nonsupporting part, member or portion less
than 50 percent, or in any supporting part, member or portion less than 66 percent of the
a) strength, b) fire-resisting qualities or characteristics, or c) weather-resisting qualities
or characteristics required by law in the case of a newly constructed building of like area,
height and occupancy in the same location.
15. Whenever a building or structure, used or intended to be used for dwelling purposes,
because of inadequate maintenance, dilapidation, decay, faulty construction or
arrangement, inadequate light, air or sanitation facilities, or otherwise, is determined by
the health office to be unsanitary, unfit for human habitation or in such a condition that is
likely to cause sickness or disease.
16. Whenever any building or structure, because of obsolescence, dilapidated condition,
deterioration, damage, inadequate exits, lack of sufficient fire-resistive construction,
faulty electric wiring, gas connections or heating apparatus, or other cause, is
determined by the fire marshal to be a fire hazard.
17. Whenever any building or structure is in such a condition as to constitute a public
nuisance know to the common law or in equity jurisprudence.
18. Whenever any portion of a building or structure remains on a site after the demolition of
the building or structure or whenever any building or structure is abandoned for a period
in excess of six months so as to constitute such building or portion thereof an attractive
nuisance or hazard to the public.

FE. “Disposable package or container” means all packages or containers defined as such by
rules and regulations adopted by the State of Washington Department of Ecology.
GF. “Enforcement officer” means the “code compliance officer” of the city of East Wenatchee or
any designated alternate who is empowered by the mayor or by ordinance to enforce a city
ordinance or regulation.
HG. “Litter” means all waste material including, but not limited to, disposable packages or
containers thrown or deposited on public or private property, including depositing handbills on
vehicles or public property, but not including the waste of primary processes of mining, logging,
saw milling, farming or manufacturing.
IH. “Person” means any individual, firm, partnership, corporation, association or other entity,
public or private, whether acting by themselves or by a servant or employee.
JI. “Premises” means any building, lot parcel, real estate or land or portion of land whether
improved or unimproved, including adjacent sidewalks and parking strips.
JK. “Property” means any object of value that a person may lawfully acquire and hold.
KL. “Person responsible for the violation” means any person who has an interest in or resides
on the property, whether as owner, lessor, tenant, occupant or other person entitled to control,
use and/or occupy the property.
LM. “Refuse” means vegetable offal, animal offal, discarded food, cans, bottles, junk, waste
paper, boards and boxes, tree limbs and all other waste substances from private and public
establishments and from residences; but shall not include temporary seasonal small amounts of
weeds, twigs, grass, or other material resulting from the normal tending of lawns or gardens.
MN. “Repeat violation” means a violation of the same regulation in any location by the same
person for which voluntary compliance previously has been sought or a notice of civil violation
has been issued, within the immediately preceding 12-consecutive-month period.
NO. “Structure” means that which is built or constructed, an edifice or building of any kind, or
any piece of work artificially built up or composed of parts joined together in some definite
manner. The term “structure” does not include a tarp or canopy made of canvas, plastic or other
similar materials.
8.20.030 Types of nuisances.
A. Unless otherwise permitted by law, the city council declares each of the following conditions
to constitute a public nuisance:
1. An act or omission to act, or a condition or use of property which injures or endangers the
comfort, repose, health or safety of the public; offends public decency; or in any way
renders other persons insecure in life or in the use of property.
2. The erecting, maintaining, using, placing, depositing, causing, allowing, leaving or
permitting to be or remain in or upon any portion of a private lot, building, structure, or
premises, or in or upon any street, avenue, alley, park, parkway, public water (including
lakes, rivers, streams, drainage ways, and/or gullies), or other public or private place in the
city, any one or more of the following conditions, things, or acts:

a. Any accumulation of refuse, iron, steel, aluminum, or other metal, vehicle parts,
machinery or equipment, mattresses, bedding, clothing, rags, or cloth, straw, packing
material, cardboard or paper, tin cans, wire, bottles, glass, cement, wood or timber, not
stored within a permitted structure, except that this provision shall not apply to
construction sites where the progress of construction is proceeding with reasonable
diligence or to a neat and orderly compost pile that is covered or concealed from view
from all public places and neighboring private properties and does not emit obnoxious
odors or otherwise negatively affect the public health or safety;
b. Carcasses of animals not buried or destroyed within 24 hours after death;
c. All limbs of trees overhanging a public sidewalk which are less than 10 feet above the
surface of said sidewalk, or overhanging a city street which are less than 15 feet above
the surface of said street;
d. The existence of any vines or climbing plants growing into or over any street, public
hydrant, power or light pole; or the existence of any shrub, vine or plant growing on,
around or in front of any hydrant, stand pipe, sprinkler system connection or any other
appliance or facility provided for fire protection purposes in such a way as to obscure
the view thereof or impair the access thereto; or obstruct or interfere with the proper
diffusion from the light from any street lamp;
e. Any use of property abutting on a public street or sidewalk or any use of public street
or sidewalk which causes any obstruction of traffic and the free use of the streets or
sidewalks; provided, that this subsection shall not apply to events, programs or parades
authorized by the city council;
f. Any poisonous or harmful substance which is reasonably accessible to persons or to
animals;
g. Any attractive nuisances which may prove detrimental to children which are left in
any place exposed or accessible to children. This includes, but is not limited to, unused
or abandoned refrigerators, freezers, or like containers, or other large appliances or
equipment or parts thereof; abandoned motor vehicles; any structurally unsound or
unsafe fence or edifice; any unsecured or abandoned excavation, pit, well, cistern,
storage tank or shaft; any lumber, trash debris or vegetation which may prove a hazard
for minors;
h. The existence of any dead, diseased, infested or dying tree or other vegetation that
may constitute a danger to property or persons;
i. The existence of any fence or structure which creates any traffic safety problem
through obscured sight distance pursuant to EWMC 17.74.050(E) as the same exists
now or may hereafter be amended;
j. The existence of any fence or structure or thing which is in a sagging, leaning, fallen,
decayed or other dilapidated or unsafe condition on private property abutting or fronting
upon any public street, sidewalk or place;
k. The existence of any fence or structures located in a public right-of-way without
specific approval from the city;

l. Any accumulation of material on property including, but not limited to, animal matter,
ashes, bottles, boxes, broken stone, building materials which are not properly stored,
cans, cement, crates, empty barrels, dead animals or animal waste, glass, litter,
mattresses or bedding, old appliances or equipment or any parts thereof, furniture, iron
or other scrap metal, packing cases, packing material, plaster, plastic, rags, wire, yard
waste or debris or other objects which endanger property or public safety, or constitute
a fire hazard or vermin habitat; provided, that nothing herein shall prevent the
temporary retention of waste in covered receptacles approved by the enforcement
officer;
m. Any dangerous building as defined in the Uniform Code for the Abatement of
Dangerous Buildings, or any building, structure, or addition to such, commenced and
left unfinished six months beyond the expiration of the building permit issued for that
building or 12 months from the date of building commencement if no building permit
was required to be issued;
n. The nonemergency repair of an automobile, truck or other motor vehicle of any kind
upon the public streets, alleys, or other public property of the city;
o. The erection, continuance or use of any building, room or other place in the city for
the exercise of any trade, employment or manufacture which, by producing noxious
fumes, offensive odors or other annoyances, is discomforting, offensive or detrimental
to the health of individuals or of the public;
p. Any unguarded or abandoned excavation, pit, well, or holes which would endanger
health or safety;
q. Dumping, depositing, placing or leaving of any litter, refuse, ashes, debris, gravel,
earth, rock, stone or other material upon the banks, channels, beds or bars of any
navigable water, or the felling of any tree or trees, so that the same shall in whole or in
part project within the high water bank of any navigable water course, or the casting,
placing, depositing or leaving of any logs, roots, snags, stumps, or brush upon the
banks or in the bed or channel of any navigable watercourse;
r. Storage for in excess of three consecutive days of any apparently inoperable vehicle
outside of an enclosed building and not located on property properly licensed for the
operation of a vehicle repair, vehicle sales, and/or vehicle storage business;
s. Storage of in excess of eight vehicles outside of an enclosed building and not located
on property properly licensed for the operation of a vehicle repair, vehicle sales, and/or
vehicle storage business;
t. Weeds, grass, shrubs, and other growth more than 12 inches in height that is found to
be a fire hazard;
u. Any tree or shrub or the roots thereof that in any manner shall interfere with the
surface of any street or sidewalk or that shall cause the surface of the street or sidewalk
to be upheaved or otherwise disturbed; and
v. Any vegetation, including trees, plants, shrubs, or parts thereof, infected by aphids,
elm leaf beetle, San Jose scale, cottony scale, lecanium scale, tent caterpillars, leaf
roller larvae, coddling moth, and peach leaf twig borer, portions of which grow upon or
overhang any sidewalk, street or alley.

I. Summary Title:
A Resolution of the City of East Wenatchee declaring the Building Official vehicle as
Surplus to the needs of the City.
II. Background/History:
The Building Official’s vehicle needs to be replaced. Community Development has a
replacement budgeted for 2022 but have not yet made the purchase because we have
not been successful in hiring for the building official position yet. We will bring
forward that budget item to replace the vehicle in 2023. Purchase of the new vehicle
makes the old vehicle unnecessary to accomplish the tasks of the building official.
Staff is requesting to surplus the 2003 Chevy Blazer.
Once declared surplus, the city will put the Blazer up for auction. Revenue from the
auction will be put towards future purchases of vehicles.

market value, it will not hold a public hearing.
3.Sale of Property. The City Council instructs the Mayor or her
designee to sell the assets listed on Exhibit A using such other means
of marketing and as the Mayor or her designee reasonably determines
to maximize the net return to the City on the sale.

I. Summary Title: Resolution 2022‐44, authorizing the Mayor to sign the amended and restated
Interlocal Agreement between the City of East Wenatchee and the Eastmont School District for School
Resource Officer (SRO) services beginning in the 2022‐2023 school year.
II. Background/History: At the council meeting of 11/2/2021, the City Council approved an amended
Interlocal agreement for one SRO to be within the Eastmont School District for the upcoming school
year. Since then, the Eastmont School District identified a need for a second SRO, resulting in this
agreement.
This amended and restated agreement adds a second SRO under terms similar to the first, with a
60/40 split on costs between the District and the City respectively. Additionally, the District will
provide $1980 per quarter to partially offset the cost of the vehicle the second SRO will use.
The second SRO is not expected to be fully selected and trained until around January 1, and therefore
costs assessed to the District for the second SRO will be adjusted accordingly. This effort is budgeted
for FY 2023.
III. Recommended Action: Motion to authorize the Mayor to sign the amended and restated Interlocal
Agreement between the City of East Wenatchee and the Eastmont School District for School Resource
Officer (SRO) services beginning in the 2022‐2023 school year.

both, in accordance with RCW 39.34.040.

AMENDED AND RESTATED INTERLOCAL AGREEMENT
BETWEEN THE CITY OF EAST WENATCHEE AND
THE EASTMONT SCHOOL DISTRICT
FOR SCHOOL RESOURCE OFFICER SERVICES
The City of East Wenatchee (“City”) and the Eastmont School District
#206 (“District”), both municipal corporations of the State of Washington,
located in Douglas County, Washington, entered into an INTERLOCAL
AGREEMENT on October 11, 2021 (“Agreement”) and desire now to enter into
this AMENDED AND RESTATED INTERLOCAL AGREEMENT(“Amended
Agreement”), with respect to the following facts:
WHEREAS, the City and the District have the power, authority, and
responsibility to provide security services within their respective jurisdictions and
facilities; and
WHEREAS, the District has expressed a desire to execute this
Amended Agreement with the City for the services of two full-time police
officers, known as a School Resource Officers (“SRO”) to be stationed at
Eastmont High School and serving the District’s schools located within the City’s
corporate boundaries and those schools out of the City, but within Douglas
County; and
WHEREAS, both parties desire to enter into this Amended Agreement
for the purpose of utilizing the City’s capabilities to provide the District with SRO
services; and
WHEREAS, the District and the City believe that the services
rendered by SROs will enhance school security and benefit public safety; and
WHEREAS, the City is willing to assign police officers to serve as

SRO’s as set forth herein, subject to the District’s commitment to reimburse the
City for 60% of the basic salary and benefits for maintaining such positions; and
WHEREAS, the City and the District agree to fund SRO positions in
accordance with the terms and conditions set forth in this Amended Agreement;
and
WHEREAS, this Amended Agreement is specifically authorized by the
Interlocal Cooperation Act set forth in Chapter 39.34 of the Revised Code of
Washington;
NOW THEREFORE,
IN CONSIDERATION OF THE PROMISES AND AGREEMENTS
CONTAINED HEREIN, IT IS AGREED AS FOLLOWS:
1.Provision of School Resource Officer Services. Commencing with the
start of the 2022-23 school year, thereafter during the term of this
Amended Agreement, the City shall provide SRO services (collectively
referenced as “ Services”).
The SROs shall be stationed at a site to be determined by the District
and shall primarily serve the District’s secondary schools located
within the City, but shall also serve the District’s others schools located
within the City and County on an “as needed” basis. Services are more
fully described in Exhibit “A” attached hereto and incorporated by this
reference.
The City shall have the sole discretion regarding determination of an
SRO applicant pool for the District to collaboratively choose finalists
from. The Police Chief will then appoint two SRO’s from the
collaboratively chosen finalists. The City shall select the equipment,
uniform, and supplies that will be used by the SROs, and shall be the
sole judge as to the most appropriate, efficient, and effective manner of

handling and responding to calls for Services or the rendering thereof,
and for assisting the District with its annual reporting of SRO activities to
the Office of the Superintendent of Public Instruction (“OSPI”). In
addition, the City shall be solely responsible to ensure that any SRO
assigned to work with the District pursuant to this Amended Agreement
is fully qualified and trained in accordance with ESHB 1214.SL 2021.
The City shall provide documentation that the SROs training series has
been completed or describe the plan for the SROs to complete the
training series within the first six months of working on school property
when students are expected to be present. All training costs required by
ESHB 1214.SL 2021 shall be the responsibility of the City.
The SROs are and will remain employees of the City. The delivery of
Services, the standards of performance, the discipline of officers, the
supervision of the SRO and any other City personnel, and other matters
incidental to the performance of the Services, shall remain under the
control of the City.
2.Salary and Overtime. The District shall not assume any liability for the
direct payment of any salaries, wages, or other compensation to an
SRO performing the Services provided hereunder. The City shall be
responsible for any cost of overtime for work not covered within the
scope of Services defined in Exhibit “A”.
The District shall not be responsible for any off-duty employment costs
or overtime costs due to off-duty employment. Off-duty employment
agreements, if any, shall be between the District and the City using a
separate mutually agreed upon written agreement. Except as otherwise
specified herein, the District shall not be liable for compensation for
wages or indemnity to any City employee for injury or sickness arising
out of his/her employment pursuant to this Amended Agreement.
3.Term. This Amended Agreement shall be effective for a 1-year term, from
September 1, 2022 through August 31, 2023. Following expiration of the
initial year term, this Amended Agreement shall automatically be extended

for additional one-year terms thereafter, unless advance written notice of
cancellation is provided by one party to the other not less than 30 days
prior to expiration of the then current one-year term.
4.Payment for Services. The parties agree that the annual base salary
cost, including benefits, for maintaining one full-time SRO position is
presently $134,920.95. The cost for two full-time SRO positions
therefore is $269,841.90. The District will reimburse the City 60% of the
aforementioned annual base salary and benefits costs for two non-
supervisory full-time officers as provided by this Amended Agreement,
for the term of this Amended Agreement. Annual charges will be billed in
four quarterly installments. The City further has agreed to provide a
vehicle for the first full-time SRO officer at no additional cost to the
District. However, for the second full-time SRO officer, the District shall
remit an additional of $1,980.00 per quarter as a vehicle offset for the
second SRO. In the event an SRO position isn’t filled or becomes
vacant, then the cost to the District will be prorated. Both parties
acknowledge some training will need to occur during the 180 days with
summer training utilized whenever possible.
The District shall remit payment to the City within thirty (30) days after
receipt of a quarterly invoice. The finance directors for each party are
authorized to modify this payment schedule and process by subsequent
mutual agreement, provided such understandings or modifications shall
be in writing so long as full total payment for a given school year is made
at least annually.
5.Emergency Situations. During days when school is in session, SROs will
not be assigned by the City to duties other than those set forth herein,
except for required City Police Departmental training or in response to
emergency conditions, as determined by the sole discretion of the Chief
of Police, that necessitate the response of additional police personnel.

6.Indemnification. The parties mutually agree to defend at its own
expense, indemnify and hold harmless the other party, its hired,
appointed and elected officers, officials, employees, agents, and
volunteers from and against any and all liabilities, judgments, liens,
losses, costs, damages and expenses, including costs and attorney fees
in defense thereof, because of actions, claims or lawsuits of any kind
that allege injury or death to a person, or damage, injury, or destruction
to property or the enjoyment of property caused or allegedly caused or
occasioned in whole or in part by or arising out of the performance or
carrying out of the terms of this Amended Agreement and/or
amendments to this Amended Agreement, except to the extent that such
injury or death to a person, or damage, injury, or destruction of property
or the enjoyment of property is caused by the negligent or intentional
tortious acts of the other party, and/or its hired, appointed and elected
officers, officials, employees, agents and volunteers.
7.Compliance with Laws. The District acknowledges that, in addition to
compliance by the City with all applicable laws and regulations relating
to employee hiring, the City’s Civil Service rules prohibit discrimination
on the basis on non-merit factors. Additionally, the District acknowledges
and agrees that the Services rendered hereunder may be affected by
provisions of the collective bargaining agreement between the City and
the union representing the SRO’s.
8.Future Costs. Amount for subsequent years. Commencing January 1,
2023, and for each year thereafter, the District will increase its payment
to the City by 100% of the U.S. Consumer price Index for Urban Wage
Earners and Clerical Worker (CPI-W) July to July statistics for the Pacific
Region (Series ID # CWUR0490SA0) for the preceding twelve months.
Minimum increase shall be 1%; maximum increase 3%. The City’s
Finance Director shall notify the District of the amount of the payment on
or before November 1 of each year.

9.Student Discipline. The parties understand and agree that the District
has sole responsibility for the administration of student discipline.
10. Modification. Either party may, in writing, request changes in the
Amended Agreement. Any and all agreed modifications shall be in
writing, signed, by each of the parties and affixed to this Amended
Agreement.
11.Venue and Governing Law. In the event of litigation arising out of the
construction or interpretation of any of the terms of this Amended
Agreement, the venue of such action of litigation shall be in the courts of
the State of Washington, County of Douglas. This Amended Agreement
shall be governed by the law of the State of Washington.
12.Evaluation and Complaints. The evaluation of an SRO shall be the
responsibility of the City. The evaluation of an SRO shall include
information obtained from the District Superintendent or designee.
The parties shall have a process for families to file complaints related to
the SRO’s with the District and City. The District’s complaint resolution
process is found in District Policy and Procedure 4311 (School Safety
and Security Services Program). The City’s complaint resolution
process for the SRO is found in City Department Policy 1010.
13.Mediation. In the event that a dispute shall arise regarding the terms,
conditions, or breach of this Amended Agreement, the parties shall, as a
condition precedent to taking any action and as a condition precedent to
litigation, mediate the dispute using the services of a mutually agreed
upon independent mediator. The site of the mediation shall be in
Douglas County. The parties shall equally split the expenses of the
mediator and the facility for the mediation. Each party shall otherwise
pay its own expenses.
14.Confidentiality. Laws involving confidentiality govern both the District and
the City. Both the District and the City agree that its employees,

subcontractors, and others shall maintain the confidentiality of all
information provided by the other to the extent authorized to do so by the
laws governing each. The federal Family Educational Rights and Privacy
Act (FERPA) governs the District and the City understands that this act
and other state and federal laws will restrict the issuance of certain
information to the City. The District likewise understands that certain
intelligence and law enforcement information is to remain confidential
and in the sole control of the City. Each agency agrees to respect the
requirement imposed on the other and in the event of any judicial action
being taken to promptly notify the other of any attempt to seek disclosure
of information.
15.Notices. Any notices required to be given by the parties shall be
delivered at the addresses set forth below. Any notices may be delivered
personally to the addressee of the notice or may be deposited in the
United States mail, postage prepaid, to the address set forth below. Any
notice so posted in the United States mail shall be deemed received
three (3) days after the date of mailing.
16.Severability. If any term or condition of this Amended Agreement or the
application thereof to any persons(s) or circumstances is held to be
unconstitutional or invalid by a court of competent jurisdiction, such
invalidity shall not affect the validity of the remaining portion of this
Amended Agreement and the remainder shall remain in full force and
effect. The terms and conditions of this Amended Agreement are
declared severable.
17.Captions. The captions used herein are for convenience only and are not
a part of this Amended Agreement and do not in any way limit or amplify
the terms and provisions hereof.
18.No Waiver. Waiver of any breach or condition of this Amended
Agreement shall not be deemed a waiver of any prior or subsequent
breach. No term or condition of this Amended Agreement shall be held

to be waived, modified, or deleted except by an instrument, in writing,
signed by the parties hereto.
19.Entire Agreement. This written Amended Agreement represents the
entire agreement between the parties and supersedes any prior oral
statements, discussions, or understanding between the parties.
20.Counterpart Originals. This Amended Agreement may be executed in
two or more counterparts, each of which shall be deemed an original,
but all of which together shall constitute one and the same instrument.
21.No New Entity. This Amended Agreement is for the provision of services
to benefit both parties. No new entity or governing board is needed or
created. The administrators of this Amended Agreement shall be the
Superintendent of the District and the Mayor for the City. The parties do
not anticipate acquiring jointly-owned personal or real property under
this Amended Agreement. All assets of each party shall remain their
assets through the term of the Amended Agreement and its expiration.
22.Filing. As required by RCW 39.34.040, prior to this Amended
Agreement’s entry into force, this Amended Agreement shall be filed
with the county auditor or, alternatively, listed by subject on each party’s
web site or other electronically retrievable public source.

PROGRAM GOALS:
To improve the relationship between the City of East Wenatchee Police Department
and the Eastmont School District.
To reduce crime and improve security in the schools.
To improve the quality of education in school.
PROGRAM BENEFITS:
The SRO Program should help reduce crime in the schools and community. It will
do so by intervening earlier in the delinquency pattern as well as offering
students a positive role model.
The physical security of the schools will be improved. This will result in a safer
environment for students and faculty.
The SRO will improve the liaison between students and faculty and the City
Police Department. Overall, the relationship between the schools, staff, students,
the City Police Department, and the community will improve.
SRO duties are those duties that are typically outside of the standard law enforcement
requirements or do not require a commission to perform. An SRO is often performing
dual roles, those identified as an SRO and those performed as a commissioned law
enforcement officer. By way of illustration the duties performed as an SRO and duties
performed as a commissioned law enforcement officer are described below.
SRO DUTIES:
1.Complete the required OSPI training prior to assignment.
2.Not participate in formal school discipline situations that are the responsibility of
school administrators.
3.Respond to administrator approved requests from teachers and staff for SRO
assistance.
4.Provide specialized training to school staff and students designed to improve
security in the school. Topics, for example, can include drug and gang
identification, stranger awareness, sexual predators, crime prevention, and safety
presentations, etc.
5.Provide advice to School District personnel on law enforcement issues. Officers
will assist in suggesting solutions to security problems that arise in the School
District.
6.Assist School District personnel in the identification of/and behavior modification
of behaviors not conducive to a positive school environment and assist in law

7.Work with School District security personnel on matters of mutual concern and

Agreement to accommodate evening meetings, presentations, or other classes
involving the SRO.
10.SROs generally will not take any vacation during periods in which school is in
session. If this should occur, the City agrees to make reasonable efforts to assign
other officers to provide SRO Services in the regular officer’s absence.
11.Maintain appropriate school records and preserve the confidentiality of student
records.
LAW ENFORCEMENT DUTIES:
1.Conduct preliminary investigations of crimes that have occurred on/off campus
involving students from any school district and that are reported at the schools
within the Eastmont School District.
2.Handle traffic complaints involving anyone on District properties and immediately
adjoining areas.
3.Attend City of East Wenatchee Police Department and District training as
required.
4.Conduct investigations involving crimes committed on school property located
within the City of East Wenatchee.
5.Investigate illegal acts and suspicious activities occurring on school property.
6.Conduct investigations into reported or suspected abuse or neglect of students.

I.Summary Title:
A Resolution of the City of East Wenatchee, Washington authorizing the Mayor to
execute Administrative Settlements for Project Parcel Numbers 5 and 6 on the
Sterling Safe Routes to School project.
II.Background/History:
In summer 2019 the City of East Wenatchee was notified that it had received two
Safe Routes to School grants for sidewalks, streetlights, pedestrian crossing
improvements, and stormwater enhancements for Kenroy Elementary School, and
Sterling Junior High School. The Grants include a total of $3,936,466 in federal
funding ($1,937,791 for Sterling, and $1,998,675 for Kenroy) for the design, right of
way acquisition and construction of the projects.
The right of way process for federally funded projects has very specific procedures
that must be followed for any Temporary Construction Easements (TCE’s) or right of
way acquisitions. This project needs primarily TCE’s, which are for tying existing
driveways into the proposed sidewalk, or in areas where proposed improvements in
the right of way requires access to the owner’s property to construct.
Offers have been made to property’s where TCEs are needed, and responses are
beginning to come in. Initial offers were based off what an appraisal determined was
fair market value for the area within the TCE, in addition to improvements that will
be damaged or removed because of the project. Owners may negotiate following the
initial offer.
If the owner and City can agree upon a price that is supported by market data, the
City can sign an Administrative Settlement for more than the initial offer with
Council approval. This process can be cost effective for the City because it avoids the
need for the City to initiate condemnation proceedings and trial. This specific
settlement reflects an increase of $500 for Parcel 5, and $1,000 for parcel 6.

Background:
The Safe Routes to School Project will provide improvements along 5th Street NE, from
approximately North Grover Place on the West and running to North Kentucky on the East end.
This project also includes improvements along North James, North June, North Jonathon, North
Keller, and a small section of 8th Street Northeast. Improvements will include curb, gutter,
sidewalk, and sidewalk intersection improvements with signaling at various locations. Most work
will be completed within the existing right of way. All properties will be subject to a Temporary
Construction Easement which is needed primarily to re-establish driveway connections and grade
back of sidewalk to each property. All are believed to have minimal impacts and no damages noted.
The Administrative Offer Summary for the property was signed 3/2/2022. Proposed for the subject
is a 478-sf TCE (478 sf * $8.24 p/sf * 10%/yr / 12mo * 34mo = $1,116.00) located in the vicinity
of the driveway. This area is improved with a driveway that is partially gravel and partially
concrete. There are also basic landscaping improvements which include lawn, a medium shrub,
cyclone fence, and driveway light. It is my understanding that the northern leg of the cyclone fence
is in the existing right of way and therefore is not a candidate for compensation. The leg of the
fence parallel to the driveway is in the TCE and will be impacted. This fence is 3 feet tall and 20
feet long and has one gate, ($14.53 p/lf * 20’ + $276 for the gate, or $567). The shrub is medium
sized and could be replaced with a functional equivalent for $350. There is a small concrete
walkway, landscape bed and stretch of concrete curbing. These, including the shrub, will be
compensated for in a lumpsum of $750. The main driveway will be replaced in like kind with
concrete. Total approved just compensation is $2,500.00 (rounded)
I met with Ms. Roper at her residence on 6/16/2022 and presented the offer. The owner expressed
concerns regarding her fencing that fell within the ROW. I explained that the survey work
performed determined the area of concern fell within the public ROW and was therefore not
compensable. Ms. Roper advised she would review the documents and was not satisfied with the
amount of the offer.
I was advised by Melinda Burkhart that she had spoken to Ms. Roper on 9/1/2022 and she shared

Justification:
Review of the project goals and timeline, especially considering the deadline for the project’s
acquisitions to pass the WSDOT agency certification review process, which is essential for the
project to be awarded a substantial dollar amount of additional project funding, justifies the
addition of the signing incentive settlement with additional negotiation or property value research
and documentation.

Conclusion:
The project will incur increased costs for continued negotiation, re-evaluation, and/or surveys
should the incentive not be approved. In addition, the project runs the risk of losing a large amount

requirements for completing the agency certification process.
For all the reasons stated above, the proposed settlement represents a reduced risk than continued
negotiations. We recommend the City of East Wenatchee approve the amount we propose to
offer Ms. Roper.

Project: Title: East Wenatchee - Safe Routes to School, Pedestrian Improvements

Background:
The Safe Routes to School Project will provide improvements along 5th Street NE, from
approximately North Grover Place on the West and running to North Kentucky on the East end.
This project also includes improvements along North James, North June, North Jonathon, North
Keller, and a small section of 8th Street Northeast. Improvements will include curb, gutter,
sidewalk, and sidewalk intersection improvements with signaling at various locations. Most work
will be completed within the existing right of way. All properties will be subject to a Temporary
Construction Easement which is needed primarily to re-establish driveway connections and grade
back of sidewalk to each property. All are believed to have minimal impacts and no damages noted.
The Administrative Offer Summary for the property was signed 3/2/2022. Proposed for the subject
is a 1,100-sf TCE (1,100 sf * $11.48 p/sf * 10%/yr / 12mo * 34mo = $3,578.00) located along the
entire 5th Street NE frontage. The area is improved with a gravel driveway and lawn. The gravel
driveway falls within the TCE and will be replaced in kind. The lawn area measures approximately
900 sf. and will be damaged because of the project which must be compensated. Lawn is valued
at $0.75 p/sf (900 sf @ $0.75/sf = $675.00). Total approved just compensation is $4,300.00
(rounded)
I met with Jeremy Goforth at his residence on 7/26/2022 and presented the offer. The owner
expressed concerns regarding his landscaping and a portion of his irrigation system that fell within
the ROW. I explained that the survey work performed determined the area of concern fell within
the public ROW and was therefore not compensable. Mr. Goforth advised he would review the
documents and was not satisfied with the amount of the offer.
I was advised by Melinda Burkhart that she had spoken to Mr. Goforth on 8/22/2022, and he is
counteroffering at a land value of $14.75 / sf based on his belief that his parcel is more valuable
than had been determined by the data in the AOS. Mr. Goforth was adamant that the approved
amount for compensation was not sufficient to compensate him for his loss and used the values of
the comparable sales detailed within the AOS as justification for the amount being requested. Mr.
Goforth is asking his TCE be valued at $14.75/sf, or (1,100 sf * $14.75 p/sf * 10%/yr / 12mo *
34mo = $4,597.00). He is not asking for an increase in improvement value, which will remain
$675.00 for 900 sf of lawn.

Justification:
Review of the data supports the higher end of the AOS’s comparable sales’ unit prices ($18.76-
$11.41 / sf). It is reasonable to use the sales contained within the report to reach a settlement
without an additional value report. The appreciating market in the area does support the owner’s
request for additional consideration for the 34-month TCE on the land. (2021 to 2022 was a 10%
year over year increase according to Douglas County Assessor’s records.)
Approved Compensation (offer): $4,300.00
Administrative Increase: $1,000.00
Total Payment: $5,300.00
Conclusion:
The 2020-2022 comparable sales range from $11.41-$18.76 per/sf. An increased land value is
reasonable and justifiable. Increased assessed values also support the steady incline. The proposed
settlement is less than this growing market trend.
The project will incur increased costs for continued negotiation, re-evaluation, and/or surveys
should the agreement not be approved.
For all the reasons stated above, the proposed settlement represents a reduced risk than continued
negotiations. I recommend the City of East Wenatchee approves the amount being requested by
Mr. Goforth.
