Fix code and continue current sales and uses2. Ban July 4thand allow New Years3. Ban entirely•RCW 70.77.250•Any (Fireworks related) ordinances adopted by a county or city that are more restrictive than state law shall have an effective date no sooner than one year after their adoption. Current status•Due to the EWMC citing to portions of the WAC that no longer exist, some EWMC sections remain operative, but the current enforcement mechanism is at least partly through the RCW’s.•Our current restriction prohibiting aerial devices and combination items is not likely enforceable, because the state definitions we cite to in EWMC were repealed in 2015. •Restriction of sales and use of “common” fireworks mightbe enforceable based on ordinary meaning. Current status(cont’d)•Sales allowed between the hours of 10:00 a.m. to 10:00 p.m. each day on July 1st through July 3rd and between the hours of 10:00 a.m. and 9:00 p.m. on July 4th.•Discharge allowed•A. Between the hours of 1:00 p.m. and 11:59 p.m. on July 3rd and 4th; and•B. Between the hours of 6:00 p.m. on December 31st and 1:00 a.m. on January 1st. Fix code and continue current sales and uses1. This would tighten enforceability of EWMC.The Rock Island Municipal Code appears to be substantially similar to ours (including referencing WAC sections that no longer exist). Ban July 4thand allow New YearsThis option is a combination of fixing the code to ensure that restrictions are enforceable, coupled with removing sales and uses for July 4thand (optionally) adding sales for Dec. 30‐Jan. 1.Ellensburg and Leavenworth allow discharge but not sales for Dec. 30‐Jan. 1. Ban EntirelyThis option would replace much of our current fireworks code with a complete ban on sale and discharge. Our code does not address public displays.Wenatchee and Chelan are examples of cities that have completely banned sales and discharge other than public displays. A complete ban on fireworks in Waterville goes into effect in August 2022. Proposal1. This workshop to outline main options2. A formal, fully advertised public hearing to listen to input from interested parties3. Motion of a Council member and vote of the Council following the public hearing requesting that the Mayor direct staff to prepare an Ordinance according to one or more options.4. Staff prepares and presents proposed Ordinance for action by Council.
