LACY, PRESIDING MAY 9, 2006 6:30 P.M. ROLL CALL Councilmembers Present: Councilmember Raab, Councilmember Aiken, Councilmember Hendricks, Councilmember Johnson, Councilmember McCourt Councilmember Buckner, and Mayor Lacy. Councilmember DeWitt was excused. Council Action: A motion was made to excuse Councilmember DeWitt from this Council Meeting by Councilmember Raab, second by Councilmember Johnson. The motion carried, 6-0. Staff Present: Dana Barnard, Bob Goodman, Lori Barnett, Teresa Allen and Chuck Zimmerman. PLEDGE OF ALLEGIANCE PROCLAMATION Mayor Lacy read a proclamation declaring the week of May 20-26, 2006, as National Safe Boating Week. MAYOR'S REPORT Mayor Lacy said the Classy Chassis event was successful this year with 362 entrants compared to approximately 200 entrants in 2005. He added there was some concern expressed of the candy being thrown from entrants vehicles during the parade as children were running into the street to collect it. He commended everyone involved including Teresa Allen who spent many hours ensuring a successful Classy Chassis event and asked Teresa to convey thanks to the other staff that participated in the event. Mayor Lacy personally thanked City Attorney Chuck Zimmerman for 22 years of contracting service with the City of East Wenatchee. He said the decision to hire an in-house attorney had nothing to do with lack of confidence or dissatisfaction with Mr. Zimmerman or his firm. He said Mr. Zimmerman has been an extremely knowledgeable and professional attorney representing the City. There have been many times over the years that advice from legal counsel has not only saved the City money but simply helped the City through periods when they might not have done so otherwise. He added the decision to hire an in- house attorney is not an issue of service we have received but rather something that will constitute a savings to the City. Mayor Lacy then addressed Mr. Zimmerman and said, "on behalf of myself and the City I know we are going to continue to have a relationship with you and Ogden Murphy Wallace from time to time when needed. In terms of the retainer or the service that you have provided please accept my heartfelt thanks". She added Marilynn Lynn has been hired as a facilitator. She has also been working with the Foster Creek Conservation District for 4-5 years as the facilitator for the Watershed Planning process in Douglas County. Council Action: A motion was made to approve and authorize the Mayor to sign Amendment No.I to the Interlocal Agreement among Cities and County for planning related services pertaining to the FY 2005- 2007 Shoreline Master Program Update Grant by Councilmember Buckner, second by Councilmember Johnson. The motion carried, 6-0. 06-05-02 Approval of a Construction Engineering Services Agreement for the 15th Street, Eastmont Avenue to Baker Avenue Project. Street Superintendent Goodman said the City has an Agreement with this engineer firm for the design services which is now complete. He said the Supplemental Agreement is for the construction phase of the project. He said there are two agreements even though the project is combined in the same grant this is because the Eastmont portion of the project has Federal funding and the 15`h Street project is State funded. Council Action: A motion was made to approve a Construction Engineering Services Agreement for the 15th Street, Eastmont Avenue to Baker Avenue Project and authorize the Mayor to sign the Agreement, by Councilmember Hendricks, second by Councilmember Buckner. The motion carried, 6-0. 06-05-03 Approval of an Engineering Services Agreement for the Eastmont Avenue, 15`h Street NE to 19th Street NE Project. Council Action: A motion was made to approve an Engineering Services Agreement for the Eastmont Avenue, 151h Street NE to 19`h Street NE Project and authorize the Mayor to sign Agreement, by Councilmember Johnson, second by Councilmember Aiken. The motion carried, 6-0. 06-05-04 Approval of a Federal Grant mandate provision. Street Superintendent Goodman said that every agency receiving funding from Federal Highway Administration (FHWA) is required to have an approved Title VI plan that addresses the requirements contained within the Local Agency Guidelines (LAG) Manual. He said this can be a copy of the City's existing Title VI program that addresses all the requirements, which we do not have, or the City can sign and submit the Non -Discrimination Agreement from the LAG Manual. He added the Non -Discrimination Agreement allows someone to investigate within the agency if there are allegations of discrimination. Council Action: A motion was made to authorize the Mayor to sign the Non -Discrimination Agreement, Policy Statement, by Councilmember Hendricks, second by Councilmember Buckner. The motion carried, 6-0. ORDINANCE 06-05-05 First reading of an ordinance amending certain provisions of Chapter 9.20 of the East Wenatchee Municipal Code relating to the possession, sale, and discharge of firearms and air guns. Mayor Lacy read first reading of the ordinance. Mayor Lacy said this ordinance is the result of a citizen complaint regarding air -soft guns and Council discussion during the April 25, 2006, Council meeting to consider a revision to the East Wenatchee Municipal Code relating to the unlawful use of air guns. Mayor Lacy said this would require an amendment to the Bargaining Unit Agreement and to date we have not received this from Teamsters Local No 760 representative Fred Miner. Councilmember Buckner said he would be attending the Economic Development District (EDD) meeting and also the Resource Conservation and Development (RC&D) meeting in Chelan tomorrow. Councilmember Johnson asked Councilmembers representing the different organizations to request that the acronyms in the meeting minutes be spelled out at lease once. Councilmember Buckner submitted minutes from the Economic Development District meeting held April 12, 2006; The Wenatchee Valley Transportation Council meeting held April 13, 2006; the Wenatchee Valley Chamber of Commerce Committee meeting held April 13, 2006; and the Council of Governments meeting held April 20, 2006. Councilmember DeWitt submitted minutes from the Chelan Douglas Regional Support Network meeting held April 3, 2006. The Wenatchee Valley Convention and Visitors Bureau submitted a report for the I" quarter of 2006. Mayor Lacy said the City of East Wenatchee received a letter from Mayor Suzuki, City of Misawa, Japan expressing his happiness with the participation with our Wings and Wheels festival by the Japanese last fall and also gives more detail on the visiting delegates. He added he appreciates the fact the Mayor Suzuki takes the time to write these letters showing his support for our relationship. Councilmember Johnson thanked the Mayor and the City of East Wenatchee for the superb job of hosting the Welcome Reception and the dinner at Mayor Lacy's home. ADJOURNMENT — 7:50 P.M.
