LACY, PRESIDING DECEMBER 13, 2005 6:30 P.M. ROLL CALL Councilmembers Present: Councilmember Bremmer, Councilmember Aiken, Councilmember Hendricks, Councilmember McCourt, Councilmember Buckner, Councilmember Raab, and Mayor Lacy, Councilmember DeWitt was excused. Council Action: A motion was made to excuse Councilmember DeWitt from this Council Meeting by Councilmember Raab, second by Councilmember Bremmer. The motion carried, 6-0. Staff Present: Dana Barnard, Linda Countryman, Bob Goodman, Lori Barnett, Joan Sims, Randy Harrison, Teresa Allen and Chuck Zimmerman. PLEDGE OF ALLEGIANCE PRESENTATION Director Linda Haglund, Wenatchee Sports Council introduced the following participants of the proposed Regional Event Center for Chelan and Douglas Counties: President Greg Thompson, Blodgett Construction; Executive Services Director Allison Williams, City of Wenatchee; and President and CEO Rick Kozuback, Global Entertainment Corporation. Mr. Kozuback gave a presentation regarding a Regional Event Center for Chelan and Douglas Counties. Mr. Kozuback said a Public Facilities District would receive 0.033 percent of the state's portion of all sales tax generated in both cities and unincorporated areas of Chelan and Douglas Counties for the next 25 years. He said the Event Center would be located on Walla Walla Avenue north of Lowe's Home Improvement Warehouse. He added the Event Center would replace the current ice arenas and would seat 5,000 — 7,000. Mr. Kozuback asked council if they would support passage of legislation similar to 3SSB 5514 passed by the Senate on March 7, 2002, which allowed the creation of Public Facility Districts. Councilmember Aiken expressed concerns about the financing of the project. Council Action: A motion was made to send a letter of support for legislation to allow a Public Facilities District which would allow the Regional Event Center for Chelan and Douglas Counties to begin the process of construction by Councilmember Bremmer, second by Councilmember Raab. VNgM ISd9 30 AID CITY OF EAST WENATCHEE COUNCIL MINUTES DECEMBER 13, 2005 ACTION ITEMS 05-12-02 Approval of First Amendment to the Interlocal Agreement between the City of East Wenatchee and Douglas County regarding annexation delivery of services and revenue sharing. Community Development Director Barnett said the proposed amendment is the result of negotiations between the Mayor and County Commissioner Ken Stanton and staff members to change the provisions relating to payment of capital expenditure projects and the timing of collection of information used to analyze financial impacts of a proposed annexation. She said an additional revision was made to Section 6.1 of the proposed amendment adding to the end of the paragraph, "if the annexation is being processed using the petition method or within (60) days if the annexation is being processed using the election method". She also reviewed Section 9.2 of the proposed amendment regarding Capital Expenditure Reimbursement which defines the formula and procedure for reimbursement and also the Assumption of indebtedness. Councilmember Aiken questioned the formula in calculating the reimbursement. A discussion occurred explaining the formula and reimbursement procedure and the Douglas County Commissioners who were in attendance agreed to the following revision; The language was changed from: to: 9.2.2 Assumption of Indebtedness. Any capital road projects that have been funded in whole or in part by a loan or other obligation that provides for the assumption of said indebtedness by another jurisdiction shall not be included in the reimbursement amount calculated above, except that the principal and interest that has already been repaid shall be subject to the reimbursement formula above. The CITY agrees to assume or pay-off the remaining unpaid balance of said indebtedness as per subsection 9.2.1. In the event the capital road project funded by a loan or other obligation is not assumable or is not annexed in its entirety, the CITY shall pay its fair share of the COUNTY'S payment upon said debt based upon the formula in Subsection 9.2.1 above. 9.2.2 Assumption of Indebtedness. Any capital road projects that have been funded in whole or in part by a loan or other obligation that provides for the assumption of said indebtedness by another jurisdiction shall not be included in the reimbursement amount calculated above, except that the 'principal and interest that has already been repaid shall be subject to the reimbursement formula above. The CITY has the option to (1) assume or pay off the remaining unpaid balance of said indebtedness as per subsection 9.2.1, or (2) pay the COUNTY the amount owed pursuant to subsection 9.2.1. In the event the capital road project funded by a loan or other obligation is not assumable or is not annexed in its entirety, the CITY shall pay its fair share of the COUNTY'S payment upon said debt based upon the formula in Subsection 9.2.1 above. Council Action: A motion was made to approve the amendment to the Interlocal Agreement with the discussed revisions and authorize the Mayor to sign the document by Councilmember Aiken, second by Councilmember Bremmer. The motion carried, 6-0. 05-12-05 First reading of an ordinance adding a new section to the East Wenatchee Municipal Code, increasing the speed limit on 91h Street NE between Valley Mall Parkway and Eastmont Avenue from 25 miles per hour to 30 miles per hour. Mayor Lacy read the Ordinance summary. ORDINANCE NO. 2005-13 AN ORDINANCE OF THE CITY OF EAST WENATCHEE, WASHINGTON, ADDING A NEW SECTION 10.32.080 TO THE EAST WENATCHEE MUNICIPAL CODE, INCREASING THE SPEED LIMIT ON 9TH STREET N.E. BETWEEN VALLEY MALL PARKWAY AND EASTMONT AVENUE FROM 25 MILES PER HOUR TO 30 MILES PER HOUR. Council Action: A motion was made to elevate the ordinance increasing the speed limit on 91h Street NE between Valley Mall Parkway and Eastmont Avenue from 25 miles per hour to 30 miles per hour to second reading by Councilmember Hendricks, second by Councilmember Raab. The motion carried, 6-0. Council Action: A motion was made to adopt the ordinance increasing the speed limit on 90' Street NE between Valley Mall Parkway and Eastmont Avenue from 25 miles per hour to 30 miles per hour by Councilmember Buckner, second by Councilmember Aiken. The motion carried, 6-0. 05-11-08 Second reading of an ordinance amending Ordinance No. 04-12 regarding salaries and compensation to be paid to certain officials and employees of the City of East Wenatchee. Mayor Lacy said he discussed this at the previous meeting and held first reading of the ordinance at the last Council Meeting. The question becomes whether or not we should adopt the salary schedule in the current budget which is outlined in ordinance form with the attached salary schedule or if we should go back to a blanket approach which was discussed during the budget committee meetings. This approach would give a cost of living adjustment across the board then move employees up one step on the salary schedule. What we ended up with in the current budget is a new schedule based on an analysis made after that which included an increase, but then compared it with parity. He added he would like to see the City salaries comparable to wages in this community rather than other cities in the State. Mayor Lacy said he does not feel that an employee in the pubic sector should be compared with someone in the private sector as the types of job duties do not compare. Councilmember Buckner said we are trying to view what other cities and municipal employees have in the way of pay rates and specific jobs. The only way we can come anywhere to understanding this, is not to just take the local economy and base everything on this particular economy because that does not apply to what we are doing in municipal type work this is a composite of many to develop a fairness. Council Action: A motion was made to adopt the ordinance as presented with the attached salary schedule by Councilmember Buckner, second by Councilmember McCourt. The motion failed, 3-3. (Hendricks, Bremmer, Aiken) Mayor Lacy said this ordinance reflects the 2.5 percent across the board increase and also a one step increase with all positions listed in the attachment except six positions that were adjusted to come into parity with cities of comparable size. Community Development Director said the salary schedule was changed knowing what the total 5 percent increase would be and then placing the employee nearest to that 5 percent increase on the scale. She added that by creating the new step plan some employees actually moved back in steps even though the wage was increased. Mayor Lacy asked for a re -vote of the current motion. Mayor Lacy said the Budget Ordinance reflects the salary schedule just passed. Council Action: A motion was made to adopt the ordinance regarding the final budget for the City of East Wenatchee for 2006 by Councilmember Buckner, second by Councilmember Raab. The motion carried, 6-0. COUNCIL REPORTS Councilmember Buckner submitted minutes from the Wenatchee Valley Transportation Council meeting held November 10, 2005. He added the EDD and the RC&D meetings will be held tomorrow in Chelan which Councilmember Aiken will be attend in his absence. Councilmember Raab submitted minutes from the Chelan -Douglas Health District Board of Health meeting held November 21, 2005. City Attorney Zimmerman said in reviewing RCW 35A.12.120, which states the passage of any ordinance, grant or revocation of franchise or license, and any resolution for the payment of money shall require the affirmative vote of at least a majority of the whole membership of the council. Therefore four votes are needed to pass the previous vote taken concerning the budget schedule ordinance, agenda item 05-11-08.
