Subject: Review of EWMC Title 19 Administration of Development
Regulations
EWMC Title 19 was created by the city in 1996 shortly after the legislature
passed the Regulatory Reform Act. Since that time the legislature has
amended the statute and the city has amended various code sections
which has created numerous code conflicts. The way municipalities
process land use permits has significantly changed in the last 25 years.
Concepts such as governmental transparency, public notice/participation,
equity, and permitting efficiency play a much more prominent role today.
Community Development has initiated a review and update of Title 19. The
attached two charts show which permit actions fall to the city council to
render decisions on.
Working through this update, staff would like to ask the following question:
How involved with land use permitting does the city council want to be?
As you think about a response, please keep the following points in mind:
• These actions are quasi-judicial which means, as the hearing body, you
are restricted from making ex-parte contact with the applicant, citizens
etc. on the issue.
• Some of the actions (public improvements decisions) require that the
application be placed on hold in order for the council to go through that
decision process. This adds delay for a citizen getting their permit.
• The city has adopted the hearing examiner system for land use
permitting in order to provide consistency and efficiency into our
permitting process.
Staff is recommending that the quasi-judicial actions currently decided on
by city council be moved to the hearing examiner’s authority.
