Recitals. 2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington. According to RCW 35A.11.020, the legislative body of each code city shall have power define the functions, powers, and duties of its officers and employees; within the limitations imposed by vested rights, to fix the compensation and working conditions of such officers and employees and establish and maintain civil service, or merit systems, retirement, and pension systems not in conflict with the provisions of Title 35A.11 of the RCW. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: 4.Purpose. The purpose of this Ordinance is to delegate the City Council’s authority to define the functions, powers, duties, and job descriptions of the non-court employees of the City of East Wenatchee to the Mayor and of the court employee of the East Wenatchee Municipal Court to the Presiding Judge. 5.Non-Court Employees of the City of East Wenatchee. As long as the City Council has appropriated funds for a position, the Mayor has discretion to define the functions, powers, and duties of each non-court position within the City of East Wenatchee. This discretion is limited by any applicable state or federal laws, Title 2 of the East Wenatchee Municipal Code, any applicable civil service rules, regulations, or laws, and any applicable Collective Bargaining Agreement. Based on the recommendation of Human Resources, the Mayor may update a job description, as needed. 6.Employees of the East Wenatchee Municipal Court. As long as the City Council has appropriated funds for a position, the Presiding Judge has discretion to define the functions, powers, and duties of each position within the East Wenatchee Municipal Court. This discretion is limited by any applicable state or federal laws and any applicable Collective Bargaining Agreement. The Presiding Judge may update a job description, as needed. 7.Repeal. The City Council repeals those provisions of any ordinance that is in conflict with the language of this ordinance. 8.Corrections. Upon approval by the City Attorney, the City Clerk and the code reviser may correct this Ordinance if it contains a clerical error; an incorrect reference to other local, state or federal laws, codes, rules or regulations; or an error in ordinance numbering, section number, or subsection numbering.
