AN ORDINANCE OF THE CITY OF EAST WENATCHEE,WASHINGTON,
ANNEXING CERTAIN REAL PROPERTY TO THE CITY PURSUANT TO
THE PETITION METHOD,SAID AREA BEING LEGALLY DESCRIBED AS
SET FORTH IN EXHIBIT "A"TO THIS ORDINANCE,AND DEPICTED
IN THE MAP,EXHIBIT "B"TO THIS ORDINANCE,SETTING AN
EFFECTIVE DATE OF THIS ORDINANCE AND THE ANNEXATION OF
DECEMBER 31,1994,DESIGNATING THE ZONING OF THE AREA,
AND APPROVING THIS TITLE AND EXHIBITS "A"AND "B"AS A
SUMMARY OF THE ORDINANCE.
WHEREAS,Hal Blean,the initiator of the petition to annex
property into the City of East Wenatchee,filed with the City
Council a written notice of intention to commence annexation
proceedings signed by the owners of not less than 10%in value of
the property for which annexation was sought;and
WHEREAS,on March 7,1994,the City Council met with the
initiating parties,represented by Hal Blean,and accepted the
proposed annexation and approved the same for circulation of the
60%petition;and
WHEREAS,a petition for annexation of the area approved by the
city Council was signed by the owners of not less than 60%of the
assessed value of the property and was filed with the City Council;
and
WHEREAS,the City determined the petition was sufficient
according to the rules set forth in RCW 35A.01.040;and
WHEREAS,a public hearing was held on September 6,1994 at the
City Council chambers in the East Wenatchee City Hall;and
WHEREAS,the residents and owners of property within the area

included in this annexation were afforded an opportunity to be
heard;and
WHEREAS,after closing the public hearing,the City Council
deliberated on the issue of the annexation and decided to accept
the annexation;and
WHEREAS,a Notice of Intention was filed with the Douglas
County Boundary Review Board on July 15,1994 by the City of East
Wenatchee,proposing to annex the area described in the petition
for annexation;and
WHEREAS,on August 22,1994 the Douglas County Boundary Review
Board received a request from the Douglas County Commissioners to
invoke its jurisdiction in this matter pursuant to RCW
36.93 .100 (2);and
WHEREAS,on October 14,1994 the Douglas County Boundary
Review Board held a pUblic hearing to consider the petition for
annexation and following this public hearing,adopted a proposal
for modification submitted by the Douglas County Commissioners with
the Commissioners I request for jurisdiction to be invoked and added
territory to the annexation described in the annexation petition;
and
WHEREAS,following its public hearing and decision,the
Douglas County Boundary Review Board prepared written findings and
a decision on October 14,1994,and forwarded the same to the City;
and
WHEREAS,RCW 36.93.160 provides that decisions of the Douglas
County Boundary Review Board may be appealed to the Douglas County

Superior Court within 30 days of the date of the action taken by
the Board,and no such appeal has been made;and
WHEREAS,Exhibits "A"and "B"to this annexation ordinance
include the area added to the annexation by the Douglas County
Boundary Review Board at the request of the Douglas County
Commissioners;and
WHEREAS,RCW 36.93.155 provides that the City may only annex
the entire area as amended by the Douglas County Boundary Review
Board and may not annex a smaller portion of the area;and
WHEREAS,the city has adopted proposed zoning regulations for
areas outside of the City including the areas included in this
annexation ordinance and the zoning of the areas annexed herein
should be as designated on the Official Pre-annexation Zoning Map
of the city as the same was adopted by the City in Resolution No.
94-12;and
WHEREAS,the City Council finds that it is in the best
interest of the health,safety,morals and general welfare of the
citizens of the City and the areas covered in this annexation
ordinance for the areas to be annexed to the City,
NOW,THEREFORE,
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE,WASHINGTON,DO
ORDAIN AS FOLLOWS:
section 1.The territory that is contiguous,approximate
and adjacent to the present corporate limits of the City of East
Wenatchee and is legally described in Exhibit "A"attached hereto
and depicted on the map,Exhibit "B"attached hereto,should be and

hereby is made a part of the city of East Wenatchee,Washington.
section 2.The zoning of the territory annexed as described in
section 1 of this Ordinance,shall be as depicted in the Official
Pre-annexation Zoning Map of the city as adopted by city Resolution
No.94-12.The city Planning Director is directed to insert this
zoning on the Official Zoning Map of the city when this Ordinance
becomes effective.
section 3.Terri tory annexed by this Ordinance shall be
assessed and taxed at the same rate and upon the same basis as the
lands now located in the city of East Wenatchee,Washington;
provided,that the lands annexed by this Ordinance shall not be
subject to the payment of any portion of any outstanding
indebtedness of the city that was incurred prior to the date this
annexed area becomes part of the city.
section 4.The title of this Ordinance and Exhibits "A"and
"B"to this Ordinance collectively are hereby approved as a summary
of this Ordinance.
section 5.The area annexed hereby shall become a part of the
city of East Wenatchee,Washington and this Ordinance shall take
effect and be in force on the 31st day of December,1994.
section 6.The city Clerk/Treasurer is hereby directed to
cause the summary of this Ordinance to be published in The Douglas

and the City's official newspaper.
