An Ordinance of the City of East Wenatchee updating excavation permit
performance bond requirements and the title of the responsible city official
by amending Section 12.04.080 of the East Wenatchee Municipal Code.

2. Recitals.
2.1. The City of East Wenatchee (“City”) is a non-charter code City duly
incorporated and operating under the laws of the State of
Washington; and
2.2. The City Council of East Wenatchee (“City Council”) finds that
it is in the best interests of the City and its citizens to bring the East
Wenatchee Municipal Code into greater conformity with the Revised
Code of Washington.

3. Authority.
3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to
adopt ordinances of all kinds to regulate its municipal affairs and
appropriate to the good government of the City.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN
AS FOLLOWS:
4. Purpose. The purpose of this ordinance is to update excavation permit
performance bond requirements and the title of the responsible city official
by amending Section 12.04.080 of the East Wenatchee Municipal Code.
5. Amendment. The City Council amends Section 12.04.080 of the East
Wenatchee Municipal Code as set forth in Exhibit A.
6. Repeal. The City Council repeals those provisions of any ordinance that is
in conflict with the language of this ordinance.
7. Severability. If a court of competent jurisdiction declares any provision in
this Ordinance to be contrary to law, such declaration shall not affect the
validity of the other provisions of this Ordinance.
8. Publication. The City Council directs the City Clerk to publish a summary
of this Ordinance. The summary shall consist of the title of this Ordinance.
The City Council directs the City Clerk to publish a copy of this Ordinance
on the City’s website.
9. Effective Date. This Ordinance becomes effective five days after the date
its summary is published.

Ordinance 2020-11 Exhibit A 12.04.080 Performance Surety bond required.
Before an excavation permit may be issued under the provisions of this
chapter, the applicant shall deposit with the city Project Development
Manager street superintendent a surety bond in an amount determined by
the city Project Development Manager street superintendent to be
sufficient to ensure completion of the work and fulfillment of the warranty
provided for herein and in a form approved by the city attorney. Said bond
shall guarantee completion of all excavation and street restoration work
required by this chapter and by the conditions of the permit within the time
limits set on the permit by the city Project Development Manager street
superintendent. Said bond shall further guarantee that all excavation and
restoration work shall be free from settling and defects in workmanship or
materials for a period of five two years after the date said work is completed
and accepted by the city. The city Project Development Manager street
superintendent shall have authority to waive the requirements of this
section if in his or her sole judgment the facts and circumstances warrant a
waiver.
