DECLARATION OF STORM WATER SYSTEM TREATMENT FACILITY
MAINTENANCE RESTRICTIONS AND COVENANTS
Grantors declare and covenant as follows:
1. Grantors incorporate all exhibits attached to this Declaration by reference.
2. The City of East Wenatchee is the beneficiary of all conditions and restrictions set
forth in this Declaration.
3. Grantors own real property located at _91 Eastmont Avenue, East Wenatchee,
Washington. The legal description of the property is set forth in the attached Exhibit
A.
4. In relation to the property, Grantors have completed work associated with the project
identified as East Wenatchee File # _Building Permit # 2421 .
5. As a condition of development, Grantors have designed and constructed a private
storm water drainage system ("System") to serve the real property. To ensure the
System functions as designed, the design engineer has prepared an operation and
maintenance manual (attached as Exhibit B) in accordance with the requirements of
the East Wenatchee Municipal Code.
6. Likewise, to ensure the System functions as designed, Grantors are perpetually
responsible for the maintenance and repair of the System.
7. Grantors will inspect, maintain, and repair the System in accordance with the
requirements of the East Wenatchee Municipal Code, with the operation and
maintenance manual, and with the plans that are attached as Exhibit B.
8. The Grantors shall not reduce, expand or otherwise modify the design or operation of
the System without first obtaining review by and written approval from the City of
East Wenatchee
9. Grantors shall maintain the records of the installation of the System. Likewise,
Grantors shall make records of all maintenance and repairs done on the System.
Grantors shall retain these records for at least five years. Grantors agree to submit
copies of these records to the City by December 1 of each year. Grantors will also
make these records available to the City within five day upon receiving a written
request from the City or any other agency having jurisdiction.
10. If the Grantors receive prior, written approval from the City to subdivide the property,
Grantors agree to implement a long-term funding mechanism to support the continued
inspection, maintenance, and repair of the System. The Grantors shall implement such
a funding mechanism by creating an Owner's Association by further declarations and
covenants binding upon the real property, binding upon all subdivided lots, and
binding upon any purchasers of a subdivided lot, and binding upon Grantors'
successors and assigns.
11. To inspect the condition of the System, the City has the right to enter the real property
at reasonable times and with reasonable notice. The Grantors agree to fully comply
with all written notices of corrective action issued by the City or by any agency with
jurisdiction.
12. If the Grantors fail to fully and timely comply as required by a written notice of
corrective action, then the City, or any agency with jurisdiction, may enter the real
property to perform all work necessary to bring the System into compliance with
these Covenants. The Grantors agree to pay all costs and expenses incurred by the
City, or any agency with jurisdiction, for such repairs and maintenance. These costs
include, but are not limited to: the cost of personnel or contractors, the cost of
equipment, the cost of any design and engineering, and the cost of materials. The City
will bill Grantors for all costs associated with any remedial work done by the City.
Measured from the time the remedial work is completed, the City will charge interest
(as allowed by law) and will place a lien on the property for any unpaid costs.
13. Grantors waive any and all claims for damages against the City arising from the
design, construction, inspection, repair and/or maintenance of the System.
14. Grantors agree to indemnify, defend and hold harmless the City from any and all
claims arising from the design, construction, inspection, repair or maintenance of the
System.
15. Unless Grantors receive prior, written approval from the City, the Grantors may not
amend or modify the restrictions and conditions set forth in this Declaration.
16. If one of the parties initiates legal action to enforce the terms of this Declaration, each
party shall bear its own costs, attorney's fees, expert fees, and other fees.
17. The law of the State of Washington governs the interpretation and enforcement of this
Declaration. Any dispute regarding the interpretation or enforcement of this
Declaration shall by resolved by the Douglas County Superior Court.
18. The conditions and restrictions contained in this Declaration, along with the City's
right to enforce them, are covenants that run with the real property in perpetuity.
Accordingly, the conditions and restriction contained in this Declaration apply and

are forever binding upon Grantors, heirs, executors, administrators, subsequent
purchasers, grantees, or assigns.
19. If the Douglas County Superior Court determines that any provision of this
Declaration is illegal, invalid or unenforceable, the remaining provisions of the
Declaration will remain in full force and effect

FEDERAL INTEREST IN FAVOR OF THE ADMINISTATION FOR CHILDREN
AND FAMILIES IN THE UNITED STATES DEPARTMENT OF HEALTH AND
HUMAN SERVICES
This is to notify all potential sellers, purchasers, transferors, transferees,
mortgages, creditors and any other persons or entities who have or may seek to obtain an
interest of any kind in the real property described in the foregoing Deed (the "Property")
of the Federal government's beneficial ownership interest and other interests ("Federal
Interest") in the Property, and all improvements thereto, as defined in and/or regulated by
the Head Start Act, as amended, 42 U.S.C. § 9801 et seq., 45 C.F.R. Parts 74, 92 and
1309, and relevant decisions of the United States courts. The United States Department
of Health and Human Services ("HHS'), through its component the Administration for
Children and Families has awarded funds to Educational Services District 105, a political
subdivision of the State of Washington, in connection with its acquisition of the Property,
and HHS may award further amounts in the future. The Federal Interest in the Property
arose because Educational Service District No. 105 used Federal grant funds awarded to
acquire, construct and/or improve the Property. The Head Start grants incorporate
condition that include restrictions on the use of the Property and provide for a Federal
Interest in the Property. The Federal share in the Property, as defined by 45 C.F.R. §
75.2, is one hundred percent (100%).
The Property to which this Notice applies is further identified as property located
in the City of East Wenatchee, County of Douglas, State of Washington commonly
known as Lot 4 of Eastpoint Plaza, East Wenatchee, Washington, 98802, and more
specifically described in the foregoing Deed.
In accordance with the terms of the Federal grants, the Head Start Act, as
amended, 42 U.S.C. § 9801 et seq., 45 C.F.R. Parts 74, 92 and 1309, and relevant
decisions of the United States courts, the restrictions on the Property include, among
others, the following:
• The Property may not be used for any purpose inconsistent with that authorized by
the Head Start Act and applicable regulations.
The Property may not be encumbered, mortgaged, used as collateral, sold or
otherwise transferred to another party without the written permission of the
responsible HHS official. Furthermore if HHS approves any form of mortgage
agreement, security agreement, or other encumbrance for the Property, that
document must require that, in the case of default, for a period of 60 days after
HHS is notified of such default, HHS may intervene to ensure that the default is
cured by the grantee or another agency designated by HHS and that the lender

shall accept the payment of money or performance of any other obligation by

1 PROJECT DESCRIPTION
This stormwater drainage Operation and Maintenance Manual addresses the stormwater facilities at the Head
Start Facility in East Wenatchee, Washington. The site has one onsite infiltration trench/gallery and one
drywell for roof drainage to treat the stormwater runoff from the school roof and parking lot. Multiple catch
basins are used to rout the stormwater to the infiltration facilities. All catch basin and facility locations are
shown in Attachment 1.
2 STORM FACILITY MAINTENANCE CRITERIA
Upon project completion, all stormwater facilities within the project limits will be owned and maintained by
the owner and will be subject to the current operations and operations and maintenance programs compliant
with the Stormwater Maintenance Manual for Eastern Washington. Basic maintenance criteria for the
constructed stormwater infrastructure are included as Attachment 2. Routine inspections shall be the
responsibility of the owner to ensure that proper maintenance is being completed in accordance with the
criteria presented in Attachment 2.

6.A.6 Maintenance Criteria for Drywelis
The structural life of a drywell is approximately 20 years, although hydraulic failure could potentially
occur at any time. Drywall performance is dependent on proper installation, regularly scheduled
maintenance and contaminants reaching the drywell. The following schedule is recommended as a
guide; actual schedule may need to be varied based on observed performance.

Definitions of Maintenance Tasks
Visual Inspection
Ensure metal grate and drywell are free of debris and obstructions. Remove anydebris from on top
of or around drywell and grate. Remove grate and inspect drywell for debris and sediment buildup in
the barrel. Debris needs to be removed immediately, if possible. Sediment needs to be cleaned out
before depth reaches the lowest row of slots providing outflow from drywell barrel.
Anytime that standing water is noticed in a drywell > 24 hours after an event has ceased, a visual
inspection is warranted. When standing water is observed, the inspector should be aware of any
signs of illicit discharge. If any of the following are observed, in addition to the sod and topsoil being
affected and requiring replacement, If it is evident that discharge was made directly into the drywell,
the drywell and affected surrounding drain rock must be replaced as soon as possible: oil sheen,
spilled paint, burned area due to battery add, multicolored appearance of antifreeze, brown to black
fuel oil, or any other materials that may be deemed deleterious to water quality. Sod, topsoil and
drain rock removed must be handled and disposed of in a manner consistent with a hazardous
material.
Remove Debris and Sediment
Remove any large debris that would interfere with the Vaporing (suction removal) of the drywell.
Sediment must be completely suctioned out of the drywell barrel. Care should be taken to note the
depth of the sediment. if it appears that the sediment is increasing with depth at each inspection, this

may be a sign that the Swale is not functioning properly; stormwater may be ponding and spilling,
carrying sediment laden stormwater into the drywell, rather than infiltrating at the design rate.
Check for Structural Damage
Inspect metal frame and grate, adjustment rings, mortar or any other visible parts of the drywell
structure. The metal frame and grate should sit flush on the top ring. Any separation of 2 0.75 inches
must be adjusted and repaired. The drywell should be replaced or repaired to design standards if 0
has settled > 2 inches or if standing water fails to drain out of the barrel slots. Adjustment rings
should be free of cracks. Crack repair should adhere be performed when:.

Note: Any crack, regardless of location or width, in which sediment is observed, needs to be
repaired as soon as possible. Cracks should be repaired with mortar similar to that used between
the adjustment rings. Mortar or grout should be waterproof and of the nonshdnk variety.
