Recitals. 2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington; and 2.2. The East Wenatchee Planning Commission held a duly advertised, public hearing on May 30, 2017, to consider proposed text amendments in chapter 17.48 of the East Wenatchee Municipal Code. Following the public hearing, the planning commission took action to recommend approval of the text amendments and entered findings and conclusions into the record in support of their recommendation. 2.3. The City Council finds that it is in the best interests of the City and its citizens to amend the purpose and dimensional standards in chapter 17.48 EWMC. 3. Authority. 3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City. 3.2. RCW 35A.63 and RCW 36.70A authorize the City Council to adopt and amend development regulations. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: City of East Wenatchee Ordinance 2017-09 Page 2 of 6 4. Purpose. The purpose of this ordinance is to amend chapter 17.48 EWMC to expand the purpose statement and standards for the Mixed Use Zoning District to better reflect the character of the two designated district sites. 5. Amendment 1. The City Council amends Section 17.48.010 of the East Wenatchee Municipal Code to read as follows. 17.48.010 Purpose. The MU mixed use designation allows a mixture of uses including residential and commercial activities to increase the variety of development opportunities where people can enjoy shopping, working, and living in the same area. The MU designation is located on upland areas that do not have specific shoreline influences other than views. A. This district is intended to accommodate low-rise, and low to medium density residential, with a mix of both attached and detached housing unit types, along with a limited amount of commercial usesservice retail that is oriented to the highway; B. The retail uses would should be designed to be compatible with the scale and character of residential and other uses in the neighborhood surrounding the project site; C. The character of the district should be considered in the design of projects would relate to the presence of the riverfront park and be a lush, green environment taking advantage of the shoreline available view corridor. 6. Amendment 2. The City Council amends Section 17.48.040 of the East Wenatchee Municipal Code to read as follows. 17.48.040 Dimensional standards. The following are dimensional standards in the MU district: Standard South End District Maximum building height 35' Maximum floor area ratio (not including parking) 1.0 Maximum impervious coverage 60% Minimum setback from R-L district 20' 7. Findings of Fact and Conclusions of Law. In addition to the Recitals listed above, the City Council adopts the following findings of fact and conclusions of law. Findings of Fact 1. Proposed text amendments to EWMC 17.48.010 and EWMC 17.48.040. 2. This is a joint project with Douglas County since the development regulations apply to the city and unincorporated areas within the East Wenatchee Urban Area. The city is the lead entity for this project City of East Wenatchee Ordinance 2017-09 Page 3 of 6 3. The proposal will be applicable to properties within the Mixed Use Zoning District in the unincorporated area within the urban growth area surrounding the city of East Wenatchee in Douglas County, Washington. 4. The City of East Wenatchee and Douglas County have adopted the Greater East Wenatchee Area Comprehensive Plan in accordance with the provisions of the Growth Management Act and RCW Chapter 36.70A which covers the City and all Douglas County unincorporated areas within the East Wenatchee Urban Growth Area. 5. The City of East Wenatchee and Douglas County provide opportunities to the public, local and state jurisdictions and agencies for early and continuous public participation in the drafting of amendments to development regulations. The City adopted Resolution 2010-06 on June 8, 2010 establishing a Public Involvement Plan for adoption and amendments of comprehensive plan and development regulations. 6. The public involvement process for the proposed amendment meets the standards anticipated by RCW Chapter 36.70A.140 and Resolution 2010-06. The public involvement component included the opportunity for oral and written comment, observation of public workshops, and testimony at public hearings advertised by legal notice, the city web page and news media. 7. Douglas County and East Wenatchee coordinate in long-range planning within the Greater East Wenatchee Area. The Douglas County Regional Policy Plan, as amended, established the protocol for comprehensive plan amendments. 8. RCW Chapters 36.70A authorize cities and counties to adopt and amend development regulations. 9. The proposed amendments to the East Wenatchee Municipal Code are consistent with the goals and policies of the Greater East Wenatchee Area Comprehensive Plan, the Douglas County Regional Policy Plan (countywide planning policy) and RCW 36.70A. 10. The planning commissions are responsible for long-range planning matters and providing implementation recommendations to assure compliance with the GMA. 11. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed and a Determination of Non-significance including a comment period was issued on April 21, 2017. The comment period for the Determination of Non-significance terminated on May 8, 2017. No comments were received. 12. A 60-day notice of intent to adopt amendments to the development regulations was submitted to Washington State Department of Commerce (Commerce) City of East Wenatchee Ordinance 2017-09 Page 4 of 6 and other state agencies on March 30, 2017. The deadline for comments was May 31, 2017. 13. The notice of intent to adopt amendments to the development regulations was submitted to Douglas County Transportation and Land Services, East Wenatchee Water District, Douglas County Sewer District, City of Wenatchee, Washington State Department of Transportation, Pangborn Airport, Eastmont Metropolitan Park District, Chelan Douglas Transportation Council, and Chelan County on March 30, 2017. 14. The proposed amendments to the development regulations were posted on the City’s web site on March 31, 2017. 15. A Notice of Availability for the proposed development regulation amendments was published in the Wenatchee World on April 7, 2017. 16. A briefing of the proposed development regulation amendments was presented to the City Council at a public meeting held on May 9, 2017. 17. The proposed development regulation amendments were discussed and reviewed by the City Planning Commission at a public workshop on May 2, 2017. Advance notices of the public workshop was published in the Wenatchee World, posted on the City web site and e-mailed to interested parties. 18. The proposed amendments to the East Wenatchee Municipal Code were discussed with Douglas County Planning Commission at their May 10, 2017 public meeting. Advance notice of the meeting was e-mailed to interested parties. 19. Advertisement of the City Planning Commission’s public hearing was published in the Wenatchee World on May 19, 2017 and posted on the City’s web site. 20. The East Wenatchee Planning Commission and Douglas County Planning Commission have reviewed the entire record including the goals and policies of the comprehensive plans, and public testimony (both written and oral) as it relates to the proposed comprehensive plan amendments. Conclusions of Law 1. The proposed amendments to the East Wenatchee Municipal Code are consistent with the procedural requirements of RCW 36.70A. 2. The Greater East Wenatchee Area Comprehensive Plan and development regulations are consistent with each other. 3. The proposal has been processed in compliance with the procedural and substantive requirements of the State Environmental Policy Act, RCW 43.21C.
