An Ordinance of the City of East Wenatchee creating an Alcohol Impact
Area.

2. Recitals.
2.1. The City of East Wenatchee ("City") is a non ·charter code
City duly incorporated and operating under the laws of the State
of Washington.
2.2. Washington Administrative Code ("WAC") §314-12-215
authorizes the City to identify areas within its boundaries where
there are increased levels of chronic public inebriation and illegal
activity associated therewith as Alcohol Impact Areas ("AIAs").
2.3. By creating an AIA, the City seeks to reduce levels of chronic
public inebriation and illegal activity associated with alcohol
sales or consumption by asking business engaged in off-premises
liquor sales to voluntarily stop selling products associated with
chronic public inebriation in the AIA.
2.4. City data, input from business owners, and input from
residents supports a finding that the geographic area identified in
section 1 of this ordinance has increased levels of chronic public
inebriation and suffers from its effects, such as increased crime,
blight, and use of social and public safety services. These effects

negatively affect the health, safety, and welfare of the nearby
businesses and residents.
2.5. The homeless population accounts for the majority of those
chronically and publically inebriated.
2.6. By establishing an AIA, the City seeks to reduce public
chronic inebriation through restrictions on the sale of certain
products associated with chronic public inebriation.
2.7. The majority of business owners within the affected area
favor the City creating an AIA
2.8. If, after six months, the City's efforts to voluntarily reduce
chronic public inebriation and illegal activity associated
therewith in the AIA are unsuccessful, the City may request
mandatory restrictions on the sale of certain products in the AIA
from the Washington State Liquor Control Board.
2.9. The City Council of East Wenatchee ("City Council") finds it
is in the best interests of the City and its citizens to establish an
AIA. The area described in section 4 of this ordinance as an AIA
is appropriate as a part of the City's effort to reduce chronic
public inebriation and the illegal activity associated with the sale
and consumption of alcohol, and as one element in the City's
efforts to reduce homelessness.
3. Authority. RCW 35A.ll.020 and RCW 35A.12.190 authorize the City
Council to adopt ordinances of all kinds to regulate its municipal affairs
and appropriate to the good government of the City.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO
ORDAIN AS FOLLOWS:
4. Alcohol Impact Area. The City Council establishes an Alcohol Impact
Area with the city limits of East Wenatchee.
4.1. The City Council declares the geographical area depicted on
the map in Exhibit A as an Alcohol Impact Area.
4.2. The borders of the AIA are: Beginning at the intersection of
SR 28 and Valley Mall Parkway, thence South on SR 28 to 3rd St.
S.E., thence East on 3rd St. S.E. to Rock Island Road, and then
thence North along Rock Island Road and Valley Mall Parkway
back the point of origin. The borders include the parcels on both
sides of each street

4.3. By December 31, 2015, the Chief of Police must report to the
City Council on the outcome of the voluntary efforts to address
chronic public inebriation issues in the AIA. This report may
include crime statistics, police reports, emergency response data,
detoxification reports, sanitation reports, public health records,
and other information that document the success or failure of the
voluntary efforts to address chronic public inebriation in the AIA.
4.4. Based upon the information in the report, by Resolution, the
City Council may direct the Chief of Police to request the State
Liquor Control Board to impose further restrictions on liquor
licensees in the AIA under WAC §314-12-215.
5.Product Restrictions. The City requests that each business with a
license to sell liquor for off-premises consumption voluntarily restrict
the sale of the products in Exhibit B.
6. Severability. If a court of competent jurisdiction declares any provision
in this Ordinance to be contrary to law, such declaration shall not affect
the validity of the other provisions of this Ordinance.
7. Publication. The City Council directs the City Clerk to publish a
summary of this Ordinance. The summary shall consist of the title of
this Ordinance. The City Council directs the City Clerk to publish a
copy of this Ordinance on the City's website.
8. Effective Date. This Ordinance becomes effective five days after the
date its summary is published.
