Barta, Notary Public, Chelan County, Washington My commission expires: May 10, 2021 00002646 00051321 Amber Schulz CITY OF EAST WENATCHEE 271 9TH ST EAST WENATCHEE, WA 98802 9 TART PU E NOTICE OF DECISION CPA-ZC 2017-01 The City of East Wenatchee hereby issues this Notice of Decision for the proposal described below as required by RCW 36.70B.130 and EWMC 19.05.070: A proposed amendment to the comprehensive plan map and zoning map submitted by Paul Bondo for Equilus Capital Partners, LLC on behalf of the property owner, Jennings Trust that would change the land use designation and zoning of the subject property from Residential Low Density (R-L) to Residential Medium Density (R-M) for a 3.7 acre parcel that is currently vacant. The property is located at 50 14th St. NE, East Wenatchee, WA and is legally described as Lot 1, Jennings Short Plat, all within Section 2, Township 22 N. Range 20 EWM Douglas County, WA. This is a joint project with Douglas County. The East Wenatchee Planning Commission held an open record public hearing on December 5, 2017. After considering comments by the public, the City staff, and by the applicant, the Planning Commission recommended approval of the proposal. The East Wenatchee City Council held first reading of Ordinance 2018-01 relating to the proposal at their January 9, 2017 public meeting and considered comments by the public and City staff. The City Council entertained second reading of Ordinance 2018-01 at their January 23, 2018 public meeting. After considering comments by the public, City staff, and the applicant, no action was taken on the Ordinance. The City Council held a public hearing on March 13, 2018 to reconsider the proposal. After taking into consideration testimony provided by the public and the applicant, the City Council took action to approve the proposal with a vote of 4 in favor (Detering, Crawford, Hepner, and Johnson) and 3 opposed (Raab, McCourt, and Sterk). The approval of the proposal was supported by the findings of fact and conclusions adopted in Ordinance 2018-01. A full copy of that Ordinance is available on the City's website. The decision of the City Council is final and conclusive unless an appeal is filed in accordance with Chapter 19.06 of the East Wenatchee Municipal Code and RCW 36.70C. Any appeal of the project decision must be filed by a Party of Record within 21 calendar days from the date of issuance of this Notice of Decision. Appeals must be delivered to the Douglas County Superior Court by April 12, 2018 at 203 S.
