Police Chief Councilmember Shayne Magdoff Mary Beth Phillips, Court Administrator Councilmember Timothy Detering Trina Elmes, Events Director/PIO Councilmember Matthew Hepner Maria Holman, City Clerk 6:00 p.m. Regular Meeting Call to Order, Roll Call and Pledge of Allegiance. 1. Consent Items: a. 11/5/2019, Checks: 52828-52829; 52837-52896, in the amount of $195,818.20 b. September 2019 Payroll Certification c. 10/10/2019 Council Workshop Minutes d. 10/15/2019 Council Meeting Minutes e. 10/22/2019 Council Workshop Minutes Motion by Councilmember Detering to approve consent items as presented. Councilmember Magdoff seconded the motion. Motion carried (7-0). 2. Citizen Requests/Comments. None. 3. Public Hearings. a. Finance Director Josh DeLay held a public hearing for Ordinance 2019-16 and 2019- 17, regarding the 2020 property tax revenue and possible increases in property tax revenues. Mayor Lacy opened the Public Hearing at 6:05 p.m. to obtain public comment, the hearing was closed and 6:08 p.m., no public comment was received. Mayor Lacy read the first reading of Ordinance 2019-16, an Ordinance of the City of East Wenatchee, Washington, authorizing the regular property tax levy to be collected in the 2020 tax year, an increase of 1% in the regular tax levy, and authorizing an increase which may be allowed in the amount under new construction, improvements to property and the State assessed property provisions of State law. ii. Mayor Lacy read the first reading of Ordinance 2019-17, an Ordinance of the City of East Wenatchee, Washington, authorizing the regular property tax levy to be collected in the 2020 tax year, an increase of $1,790.49 in the regular property tax resulting from previously banked capacity, an increase of 1% in the regular tax levy, and authorizing an increase which may be allowed in the amount under new construction, improvements to property and the State assessed property provisions of State law. The Council took no action. 4. Presentations. None. 5. Department Report. a. Events Director Trina Elmes presented a 2019 Wings and Wheels report and recap. The event had approximately 210 Cars, including snowmobiles, and approximately 200 kids participated in the Passport Kids’ activities. Comments provided by Councilmember Detering, Councilmember Magdoff, Councilmember Crawford and Mayor Lacy. b. Finance Director Josh DeLay presented to Council a September 2019 Finance Department Report and Preliminary Budget recap. Comments provided by Mayor Lacy to Council to bring all Preliminary Budget comments to Josh DeLay between now and the next Council Meeting. c. Project Development Manager Tom Wachholder presented to Council an October 2019 Public Works Department Report. The report included information on the Make a Difference Day City project on October 26, 2019. He had eight volunteers and placed approximately 150 “Only rain down the drain” placards on storm drains in the downtown corridor. Comments provided by Councilmember Magdoff, Councilmember Detering, Councilmember Crawford, and Mayor Lacy. Mayor’s Report. a. Mayor Lacy thanked the Council for contributing to the employee luncheon and reminded everyone that the employee luncheon is scheduled on Tuesday, December 10, 2019, at 12:00 p.m. b. Mayor Lacy acknowledged the work of the City Street Department and Street Manager Josh Toftness for the nice work putting up all the banners of the “Heroes Banners Project” that the City participated in this year. The Mayor has received positive feedback from the community regarding the banners. 7. Action Items. a. Mayor Lacy read a first reading of Ordinance 2019-19, amending the East Wenatchee Municipal Code to add new definitions in chapter 17.08, amend sections 17.66.050, 17.72.150, and chapter 17.74 and add a new section 17.72.270 adopting zoning controls relating to cryptocurrency mining operations, data processing, and regulating the use of cargo containers, containing a severability clause, and establishing an effective date. Community Development Director Lori Barnett provided a report to the Council. Comments by Councilmember Hepner. Mayor Lacy elevated Ordinance 2019-19 to the second reading without objection. Motion by Councilmember Detering approving Ordinance 2019-19, amending the City Code. Councilmember Raab seconded the motion. Motion carried (7-0). b. Project Development Manager Tom Wachholder presented Resolution 2019-24, a Resolution of the City of East Wenatchee, Washington authorizing the Mayor to terminate Interlocal Cooperative Agreement between Douglas County and the City of East Wenatchee for Storm and Surface Water Management. Motion by Councilmember Crawford to approve Resolution 2019-24, repealing resolution 1998-03, authorizing the Mayor to sign an Interlocal Agreement between the City of East Wenatchee and Douglas County for Storm and Surface Water Management. Councilmember Hepner seconded the motion. Motion carried (7-0). c. Project Development Manager Tom Wachholder presented Resolution 2019-25, a Resolution of the City of East Wenatchee, Washington authorizing the Mayor to execute the Interlocal Cooperative Agreement between Douglas County and City of East Wenatchee for Storm Water Debt Redemption. Motion by Councilmember Magdoff to approve Resolution 2019-25, authorizing the Mayor to sign an Interlocal Agreement between the City of East Wenatchee and Douglas County for Storm Water Debt Redemption. Councilmember Sterk seconded the motion. Motion carried (7-0). Project Development Manager Tom Wachholder presented Resolution 2019-26, a Resolution of the City of East Wenatchee, Washington authorizing the Mayor to execute the Memorandum of Understanding between Douglas County and the City of East Wenatchee for Stormwater Management and Planning. Project Development Manager Tom Wachholder provided a report to the Council. Comments provided by Councilmember Detering. Motion by Councilmember Detering to approve Resolution 2019-26, to approve the Mayor to sign a Memorandum of Understanding between the City of East Wenatchee and Douglas County for Stormwater Management Planning. Councilmember Hepner seconded the motion. Motion carried (7-0). While Project Development Manager Wachholder was still at the podium, Mayor Lacy reported that that he and staff discussed a franchise agreement with the Douglas County Sewer District. The Mayor said they are working on an agreement that will cover a process when for example a road cut is needed and cooperative planning. Staff is in the beginning of dialog only, the City of East Wenatchee has submitted a proposal, but the Mayor does not expect the proposal to be the final outcome. A final Franchise Agreement will come before Council before it is approved. e. City Clerk Maria Holman and Assistant Police Chief Ray Coble presented Resolution 2019-27, a Resolution of the City of East Wenatchee declaring certain property owned by the City as surplus to the needs of the City. City Clerk Maria Holman provided a report to the Council regarding the two Public Works trucks that are listed for surplus. Assistant Police Chief Ray Coble provided a report to Council regarding the Police radios. Comments provided by Councilmember Detering and Councilmember Tidd. Motion by Councilmember Tidd to approve Resolution 2019-17, declaring the property listed on exhibit-A as surplus to the City. Councilmember Magdoff seconded the motion. Motion carried (7-0). f. Project Development Manager Tom Wachholder presented the VPR Services, LLC Agreement Supplement Agreement No. 1 for Pavement Condition Surveys. Project Development Manager Tom Wachholder provided a report to the Council. Comments provided by Councilmember Detering. Motion by Councilmember Detering to approve VPR Services, LLC Agreement and authorize the Mayor to sign Supplement No. 1. Councilmember Magdoff seconded the motion. Motion carried (7-0).
