Recitals. 2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington; and 2.2. The City Council of East Wenatchee (“City Council”) finds that it is in the best interests of the City and its citizens to adopt the proposed amendments to the Greater East Wenatchee Area Comprehensive Plan (GEWA) Land Use Map and the Official Zoning Map. 2.3. Douglas County File No. CPRZ-2017-02: An application submitted by Cal Neva, LLC and Rogelio Hernandez for a site-specific comprehensive plan land-use designation map amendment and rezone of approximately 10 acres of land from Medium Density Residential (R-M) to Residential Office High (R-H). 2.4. The Douglas County Planning Commission transmitted a recommendation of approval to the Douglas County Board of Commissioners. City of East Wenatchee Ordinance 2018-03 Page 2 of 7 2.5. Douglas County Board of Commissioners held a public meeting on Tuesday, January 16, 2018 in the Commissioners’ Chambers of the Courthouse, for the purpose of accepting testimony, entering findings into the record, and to take action on CPRZ-2017-02. The County Commissioners approved the proposal with the adoption of Ordinance No. TLS 18-2-05B. 2.6. Notice of all public hearings and meetings on this matter have been published according to law. 2.7. The City and Douglas County are utilizing a phased adoption process for amendments to the comprehensive plan and will adopt a final resolution once the process for all amendments is concluded. 2.8. The East Wenatchee Planning Commission held a public hearing on February 6, 2018 to consider the proposed map amendment. The proposed map amendments received a recommendation of approval from the East Wenatchee Planning Commission with a vote of 4 in favor (Birks, Brawley, Hunter, and Jessup) and 1 in opposed (Nelson). 3. Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: 4. Purpose. The purpose of this ordinance is to amend the Land Use Map in the Greater East Wenatchee Area Comprehensive Plan and the Official Zoning Map for the property described in Exhibit A and depicted in Exhibit B thereby changing the designation of the property from Residential Medium Density (R- M) to Residential High Density (R-H). 5. Amendment. The City Council accepts the recommendation of the East Wenatchee Planning Commission and adopts the amendment to the Greater East Wenatchee Area Comprehensive Plan and the Official Zoning Map changing the designation of the property from Residential Medium Density (R- M) to Residential High Density (R-H) for the property described in Exhibit A and depicted in Exhibit B to this Ordinance, and incorporated by this reference. 6. Findings of Fact and Conclusions of Law. The City Council adopts the Recitals stated above as well as the findings of fact and conclusion of law as set forth below: 6.1. Findings of Fact 6.1.1.
