Minutes: b.06/28/2018 Council Workshop Minutes. c.07/10/2018 Council Meeting Minutes. Motion to approve agenda, vouchers, and minutes from previous meetings. 3.Citizen Requests/Comments. The “Citizen Comments” period is to provide the opportunity for members of the public to address the Council on items either not on the agenda or not listed as a public hearing. The Mayor will ask if there are any citizens wishing to address the Council. When recognized, please step up to the microphone, give your name and mailing address, and state the matter of your interest. If your interest is an agenda item, the Mayor may suggest that your comments wait until that time. Citizen comments will be limited to three minutes. 4.Public Hearings. The Mayor will call the Public Hearing to order and state the ground rules, the purpose of the hearing, the action that the hearing body may take on the matter and will state the manner in which the hearing will proceed. Staff will first give a report, followed then by public testimony. All speakers must speak into the microphone and clearly state their names and addresses. All comments should be addressed to the hearing body, should be relevant to the application. Public testimony may be limited to three minutes unless further time is granted by the Mayor. If there are a large number of speakers, a representative may be appointed to speak on behalf of the group. a.2018 CDBG Annual Action Plan second public hearing. 5.Presentations. a.General update on local WSDOT projects and programs by David Bierschbach, Acting Region Administrator, North Central Regional Office, Washington State Department of Transportation. 6.Department Report. a.Finance Department Report provided by Nick Gerde, Finance Director. 07/27/2018 Council Meeting Agenda Packet. Presented by Lori Barnett, Community and Development Director. Motion to approve the Value Engineering Review design modifications with an increase in the construction cost limit to $516,821 and; Motion to approve the Mayor’s signature on the SCJ Alliance Contract Amendment #1 for Design Revisions and Bid Advertisement #2 for $4,112.00 and; Motion to authorize staff to rebid this project in winter for a spring of 2019 construction timeline. b. First reading of Ordinance 2018-10, an Ordinance of the City of East Wenatchee, Washington, amending Ordinance Number 2017-25 which set the City of East Wenatchee 2018 Budget. Presented by Nick Gerde, Finance Director. Elevate to second reading. Motion for City Council to approve the Budget Amendment Ordinance 2018-10 amending Ordinance 2017-25 which set the 2018 Budget. c. First reading of Ordinance 2018-11, An Ordinance of the City of East Wenatchee, Washington, amending Ordinance 2017-24 which fixed and confirming the salaries and compensation to be paid to certain officials and employees of the City of East Wenatchee during the year 2018, containing a severability clause, and establishing an effective date. Presented by Nick Gerde, Finance Director. Elevate to second reading. Motion for City Council to approve Ordinance 2018-11 amending ordinance 2017- 24 Salary Ordinance for 2018 compensation. d. Ordinance 2018-09, an Ordinance of the City of East Wenatchee updating the City’s process of regulating business-license fees by amending Section 5.04.020 and Section 5.04.060 of the East Wenatchee Municipal Code. Motion for City Council to authorize the Mayor to sign the Douglas County Sewer District Temporary Easement. f. PUD No. 1 of Douglas County Area Lighting Service Agreement – Area Lighting Service Agreement Between Public Utility District (PUD) No. 1 of Douglas County and the City of East Wenatchee for installing three streetlights on PUD-owned utility poles on 11th Street NE between Baker Ave and Valley Mall Parkway. Motion for City Council to authorize the Mayor to sign three streetlight - PUD area lighting service agreements. g. 2018 Residential Pavement Overlay Projects on Johnson Place, S. Iowa Ave., Tedford St. SE, S. June Ave., and 1st St. SE. Change Order Number 1 Motion for City Council to authorize the Mayor to sign the proposed 2018 Residential Overlay Program Change Order No. 1 in the amount of $17,000.00 for additional asphalt grinding. 9. Councilmembers Crawford and Detering provided positive feedback about what the Museum offers the community. 6. Department Report. a. Project Development Manager Tom Wachholder provided a Public Works Report. i. Tom Wachholder introduced new staff member Clayton Verellen, Natural Resource Specialist. Comments provided by Mayor Lacy, Councilmember Hepner, Councilmember Crawford, Councilmember Hepner, and Councilmember Crawford. ii. Mayor Lacy updated the Council regarding the potential of the City taking over the payment for streetlights that are currently being paid by private individuals. The Mayor clarified that it would be the lights that illuminate the City right-of-way only. This topic will be presented to Council at a later date. b. Finance Director Nick Gerde provided a June Financial update to Council. Mr. Gerde also informed the Council regarding the budget amendment that will be on the next Council Meeting Agenda. Comments provided by Councilmember Detering and Councilmember Johnson. 7. Mayor’s Report. a. Mayor Lacy announced that he has decided on a replacement for the Finance Director who will retire at the end of July. The City is in the midst of a background check, and a name was not given. b. Mayor Lacy informed Council about Police Department storage needs and a Storage- Shed Project taking place at City Hall. The project will involve a storage shed being placed on the NW side of City Hall in the grass area along with a concrete pad. The Mayor will keep Council informed regarding the project. c. Councilmember Johnson asked about the Public Works Facility Project. The Mayor stated that he met with Josh Toftness this afternoon and that the City is considering modifying and expanding the existing buildings and adding concrete floors to meet the current needs of the City. Summary Title: 2018 Annual Action Plan second public hearing. II. Background/History: The City of East Wenatchee annually receives CDBG funds from the U.S. Department of Housing and Urban Development (HUD). Each year, the city adopts an annual action plan listing the projects or programs that will be funded. The program year runs from October 1, 2018 through September 30, 2019. Including funds remaining from previous years, the City anticipates up to $152,769 for the 2018 Program Year. At the public meeting held on June 26, 2018, the Council took action to allocate the funds to the following projects and activities: • $10,000 for City CDBG planning and administrative activities. • Housing Authority of Chelan County and the City of East Wenatchee - $69,300 to convert 18 seasonal housing units at Heritage Glen, 665 3rd St. NE, East Wenatchee, to year-round units. The project will result in 16 one-bedroom apartments and 2 two-bedroom apartments for year-round use for eligible farmworkers. The project includes unit rehabilitation including new bathroom cabinets, replacement of flooring and countertops, new closets and other improvements to prepare them for year-round use. • Columbia Valley Housing Association - $73,469 for their Down Payment Assistance for Low-Income Families program. The funding is estimated to provide down payment assistance to 3 low-income households for the purchase of a home. Two public hearings are required before the City can adopt the annual action plan. From/Presenter: Lori Barnett, Community Development Director Subject: Gateway Park Project – final decision Date: July 24, 2018 I. Summary Title: Gateway Park Project – Council decision whether to proceed with the project. II. Background/History: On January 23, 2018, the City Council approved the design and construction of the Gateway project based upon an engineering construction cost estimate of $387,000; a final design cost of $45,000; and an estimated cost of $38,500 for engineering services during construction. The design engineer’s final construction estimate was $387,525. The project was advertised for bid. Only two companies responded: Pipken and KRCI. Pipken was the lowest responsive bidder at $626,311. Since the bids were substantially above the engineering estimate, both bids were rejected by Council. On May 1, 2018, Dan Ireland, SCJ Alliance and the Gateway Project Team met and went through a Value Engineering Review process to modify the design to reduce the project construction cost. As a result of that work, the engineer’s construction cost estimate was increased from $387,500 to $516,821. Those design modifications were reviewed by Council at the May 24, 2018 workshop and at the June 26, 2018 Council meeting and are included in this packet. It should be noted that the estimated cost for services during construction has increased from $38,500 to $41,368 since that amount is influenced by the overall cost of construction. It was noted during a recent staff meeting that WSDOT compensated the City $28,763 for the removal of the Viewpoint Park at the end of Grant Road when they constructed the SR 28 Bypass. Those funds are available and appropriate for use on the Gateway Park. Staff suggests that the final design for the Gateway project include using some of the materials from the old Viewpoint Park that might be appropriate for this setting including the time capsule. 07/27/2018 Council Meeting Agenda Packet. BACKGROUND/HISTORY: Legal Considerations: 1. The City is obligated under RCW 35.33.055 to prepare a preliminary budget for the following year and make them available to the public not later than six weeks before the beginning of the next year; 2. The City is obligated under its bargaining unit contracts and employee contracts to pay the salaries and benefits agreed to under those contracts; and 3. The City is obligated under RCW 35.33.107 that, notwithstanding the appropriations for any salary, or salary range of any employee or employees adopted in a final budget; the City Council may by ordinance, change the wages, hours, and conditions of employment of any or all of its appointive employees if sufficient funds are available for appropriation to such purposes. Financial Considerations: 1. The City’s Finance & Budget Policy (Resolution No. 2009-06), outlines the processes, informational tools and expenditure data that need to developed, reviewed and approved for inclusion in the City’s Annual Financial Budget. The expenditure data includes the salaries, payroll and benefit costs which the City expects to spend in the budget year in support of City operations. 2. The City Council annually approves the monthly base salaries of certain City Officials, non-bargaining unit/ non- contract employees, and temporary part- time employees. City Officials include the Mayor and seven Council members. Non-bargaining and non-contract employees include a total of eight employees, 07/27/2018 Council Meeting Agenda Packet. Page 47 of 83 seven salaried and one hourly. 3. Subsequent to the approval of Ordinance 2017-24, the Mayor has recommended a two-step compensation increase effective August 1, 2018 for the Municipal Court Administrator, resulting in additional 2018 budgeted salary costs of $1,228.40. Recitals. 2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington. 2.2. The legislature recently enacted RCW 35.90.080. The effective date of this statute is 7/23/17. 2.3. Working with the Association of Washington Cities, the Department of Revenue composed a model ordinance to regulate general business licenses. 2.4. The first mandatory provision of the model ordinance requires the City to adopt the model ordinance’s definition of “engaging in business. 2.6. The second mandatory provision of the model ordinance requires the City to adopt a uniform minimum licensing threshold under which a person would be relieved of the requirement to obtain a city's general business license. 2.7. Because the City has partnered with the Business Licensing Services provided by the Department of Revenue, the City’s deadline for adopting the mandatory provisions of the model ordinance is October 17, 2018. 2.8. RCW 35.90.090 states, “A city that has not complied with the requirements of this section by January 1, 2019, may not enforce its general business licensing requirements on any person until the date that the mandatory provisions of the model ordinance take effect within the city.” 3. Authority. 3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City. 3.2. Amendment. The City Council amends Section 5.04.020D of the East Wenatchee Municipal Code to read: D. “Engaging in business” means commencing, conducting or continuing in any business, and also the exercise of corporate or franchise powers, as well as liquidating a business when the liquidators hold themselves out to the public as conducting such business. D. "Engaging in business" 1. The term “engaging in business” means commencing, conducting, or continuing in business, and also the exercise of corporate or franchise powers, as well as liquidating a business when the liquidators thereof hold themselves out to the public as conducting such business. 2. This section sets forth examples of activities that constitute engaging in business in the City, and establishes safe harbors for certain of those activities so that a person who meets the criteria may engage in de minimus business activities in the City without having to pay a business license fee. The activities listed in this section are illustrative only and are not intended to narrow the definition of "engaging in business" in subsection 1. If an activity is not listed, whether it constitutes engaging in business in the City shall be determined by considering all the facts and circumstances and applicable law. 3. Without being all inclusive, any one of the following activities conducted within the City by a person, or its employee, agent, representative, independent contractor, broker or another acting on its behalf constitutes engaging in business and requires a person to register and obtain a business license. (i) Picking up and transporting tangible personal property, solid waste, construction debris, or excavated materials. (j) Providing disinfecting and pest control services, employment and labor pool services, home nursing care, janitorial services, appraising, landscape architectural services, security system services, surveying, and real estate services including the listing of homes and managing real property. Background/History: The City of East Wenatchee (City) formed the Transportation Benefit District (TBD) in November 2012 and ratified a Residential Street Preservation Program in January 2013. Initially, the TBD was formed as a separate legal entity; however, in 2015 the TBD transitioned to a Special Revenue Fund. In 2017, during the scoping phase, residential street paving projects were coordinated with local utility districts (e.g., East Wenatchee Water District, Douglas County Sewer District) to make the most efficient use of City and utility district resources. On June 13, 2017, City Council authorized Mayor Pro Tem Detering to execute Resolution 2017- 02b which updated the City’s Residential Street Preservation Program. The 2018 Residential Street Preservation Program includes overlaying Johnson Place, S. Iowa Ave., Tedford St. SE, S. June Ave., and 1st St. SE (map attached). The streets identified primarily coincide with the East Wenatchee Water District’s (District) capital improvement project schedule. Therefore, the City’s 2018 Residential Street Preservation Program was made part of the District’s contract, identified as a separated schedule in the bid documents. On July 24, 2018, RH2 Engineering (District Engineer) contacted staff to inform them about a potential issue with the grinding associated with preparation of the existing asphalt surface. A three-foot section of asphalt was removed to allow for the new asphalt to match the preexisting shoulder thickness. However, site observations reveal that a quarter crown will exist if the roadways are overlaid with the current site condition (see road cross section exhibit). To prevent a quarter crown, additional asphalt will need to be removed to restore the roadway back to the approximate 2% cross section slope. This additional grinding will remove an additional three feet (approximate) of asphalt adjacent to the current asphalt removal area. 07/27/2018 Council Meeting Agenda Packet. Page 77 of 83 This additional work will cost the City $17,000 and is within the original budget of $197,335. Cost breakdown: Task Amount City Overlay $147,271 Engineering $2,000 Change Order No. 1 $17,000 TOTAL $166,271 Remaining Budget $31,064 An Interlocal Agreement between the City and the District was executed on May 8, 2018. Per Section 6, Change Orders require written authorization from the City. III.
