1. Call to Order, Roll Call and Pledge of Allegiance.
2. Consent Items:
a. 02/28/2018 Council Meeting Minutes.
Vouchers:
Checks: 49649-49653; 49664-49665; 49679-49775 and voided check: 49468, in the amount of
$286,034.15.
Motion to approve agenda, vouchers, and minutes from previous meetings.
3. Public Hearings.
The Mayor will call the Public Hearing to order and state the ground rules, the purpose of the hearing, the action that the hearing body
may take on the matter, will address the appearance of fairness doctrine, and will state the manner in which the hearing will proceed. Staff will first give a report, followed by testimony of experts and/or the applicant, followed then by public testimony. All speakers must speak into the microphone and clearly state their names and addresses. All comments should be addressed to the hearing body, should be relevant to the application, and should not be of a personal nature. Public testimony may be limited to three minutes unless further
time is granted by the Mayor. If there are a large number of speakers, a representative may be appointed to speak on behalf of the
group. 1.) A public hearing for reconsideration for an application submitted by Paul Bondo on behalf of the
Jennings Trust (property owner) to change the land use designation and zoning of a 3.7 acre parcel
from Residential Low Density to Residential Medium Density. The subject property is located at 50
14th St. NE, East Wenatchee WA.
Ordinance 2018-01, second reading, an Ordinance amending the Greater East Wenatchee Area
Comprehensive Plan Land Use Map and the Official Zoning Map.
Presented by Lori Barnett, Community Development Director.
Motion for City Council to approve, deny, modify or remand the proposal back to the Planning
Commission for further consideration specifying the time within which the Planning
Commission shall report back to the with its findings and recommendations.

Public Hearing Continued: 2.) A public hearing for an application submitted by D+D Investments Washington, LLC requesting
approval of an amendment to the GEWA Plan land use map and corresponding zoning district
reclassification of 4 parcels totaling approximately 5.6 acres from Office High Residential to General
Commercial. The properties are located at 540, 542, 620 and 630 Rock Island Road, East
Wenatchee, WA.
Ordinance 2018-02, an Ordinance of the City of East Wenatchee amending the Greater East
Wenatchee Area Comprehensive Plan Land Use Map and the Official Zoning Map to change the
land use designation and zoning of certain property located at 540, 542, 620, and 630 Rock
Island Road from Residential High Density to General Commercial, containing a severability
clause, and establishing an effect date.

requesting approval of an amendment to the GEWA Plan land use map and corresponding zoning
district reclassification of approximately 10 acres from Residential Medium Density to Office High
Residential. The properties are located at 2621 2nd Street SE, East Wenatchee, WA.
Ordinance 2018-03, an Ordinance of the City of East Wenatchee amending the Greater East
Wenatchee Area Comprehensive Plan Land Use Map and the Official Zoning Map to change the
land use designation and zoning of certain property located on 2nd Street SE surrounding and
including 2621 2nd St. SE from Residential Medium Density to Residential High Density,
containing a severability clause, and establishing an effect date.

Motion for City Council to approve, deny, modify or remand the proposal back to the Planning
Commission for further consideration specifying the time within which the Planning

4.) A public hearing for the adoption of Ordinance 2018-04 by the City Council on February 27, 2018
extending the moratorium on the acceptance of applications for use permits, wireless
telecommunications facility permits, building permits, right of way use authorizations and franchises
for new wireless communication facilities within the City, for a period of six months.
4. Citizen Requests/Comments.
The “Citizen Comments” period is to provide the opportunity for members of the public to address the Council on items either not on the agenda or not listed as a public hearing. The Mayor will ask if there are any citizens wishing to address the Council. When recognized, please step up to the microphone, give your name and mailing address, and state the matter of your interest. If your interest is an agenda
item, the Mayor may suggest that your comments wait until that time. Citizen comments will be limited to three minutes.

members to the East Wenatchee Events Board.

Motion for City Council to appoint members to the East Wenatchee Events Board
for the designated terms provided by Resolution No. 2018-05.
B. Small Works – City of East Wenatchee, 2018 LED Streetlight Conversion bid award.
Presented by Tom Wachholder, Land & Water Resource Program Manager.
Motion for City Council to authorize the Mayor to sign a contract with NE Electric,
the lowest bidder for the 2018 LED Streetlight Conversion Project in the amount of
$74,895.00.
C. Eastmont Metropolitan Park District, funding request for a directional maker
windsock.
Presented by Mayor Lacy.
Motion for City Council to authorize the Mayor to sign a contract to reimburse the
Eastmont Metropolitan Parks District in the amount not to exceed $7,122.00 for
the construction of a directional marker windsock.

5. Mayors Report.
a. Mayor Lacy commented on a request received from Eastmont Metropolitan Parks &
Recreation District Director Sally Brawley. The Mayor requested that Mrs. Brawley
provide the council with a breakdown of the cost for the proposed Eastmont splash
pad windsock, before funding consideration is provided by council.
6. Action Items.
A. 2018 Small Stormwater Project – Astor Court and Ashland Avenue Bid Decision.
The staff report presented by Land & Water Resource Program Manager Tom
Wachholder. Comments provided by Mayor Lacy and by Councilmember Chuck Johnson.
Motion by Councilmember Tim Detering to authorize the Mayor to sign a contract
with Smith Excavation the lowest bidder, for the construction of the 2018 small
stormwater project-Astor Ct and Ashland Ave. in the amount of $106,397.20.
Councilmember Harry Raab seconded the motion. Motion carried (7-0).
B. First Reading of Ordinance 2018-04, an Ordinance of the City of East Wenatchee
extending the moratorium on the acceptance of applications for use permits, wireless
telecommunications facility permits, building permits, right of way use authorizations
and franchises for new wireless communication facilities within the City, for a period of
six months, declaring an emergency, establishing a public hearing date, and providing
for severability

Motion to Elevate to second reading and approve Ordinance 2018-04 by
Councilmember Chuck Johnson. Councilmember Matthew Hepner seconded the
motion. Motion carried (7-0).
C. Agreement GCB 2443 with Washington State Department of Transportation (WSDOT)
for dual roundabouts on 9th St. N.E. at the intersections with Valley Mall Parkway and
SR 28.
Report provided by Mayor Lacy and by Community Development Director Lori Barnett.
Comments provided by Councilmember Chuck Johnson, Tim Detering and Matthew
Hepner.
Motion to authorize the Mayor to initiate termination of the Agreement GCB 2443 by
Councilmember Chuck Johnson. Councilmember Tim Detering seconded the motion.
Motion carried (7-0).

D. 2018 5th Street NE and S Kentucky Avenue Transportation Improvement Board (TIB)
Overlay Consultant Agreement for Design Services.
The staff report presented by Land & Water Resource Program Manager Tom
Wachholder. Comments provided by Councilmember Chuck Johnson.
Motion by Councilmember Tim Detering to approve and authorize the Mayor to sign
the TIB Consultant Agreement in an amount not to exceed $62,322.37 for design
services. Councilmember Jerrilea Crawford seconded the motion. Motion carried
(7-0).
7. Council Reports & Announcements. None.
8. Executive Session. At 7:15 Mayor Lacy called a 15 min executive session discuss with legal
counsel representing the City matters of litigation or potential litigation to which the City is
likely to become a party, when public knowledge regarding the discussion is likely to result
in an adverse legal or financial consequence to the City. RCW 42.30.110(1)(i). At 7:30 p.m.
the Mayor extended the executive session for an additional 5 min.
No action was taken.
9. Adjournment. With no further business, the meeting adjourned at 7:35 p.m.

Please Note – This is a quasi-judicial action and as such the City Council is prohibited from obtaining evidence from the public or the applicant outside of the public hearing. The following procedure from Section 10.4 of the Council Rules of Procedure must be followed:
In addition to the Rules of Order set forth in Section 10.3, the
following rules should be observed during a quasi-judicial hearing:
a. The Chair announces the matter for consideration and asks
Councilmembers to disclose any ex parte oral or written
communications with a party, disclose any conflicts of interest, and
disclose any potential violations of the appearance of fairness
doctrine. After all disclosures are made, the Chair will ask if any party
to the quasi-judicial matter desires to challenge or request a
Councilmember to recuse himself/herself from the decision on the
matter. The challenge shall be placed on the record.
b. A Councilmember who is recused from participating must leave the
hearing room until the matter under consideration has been
concluded.
I. Summary Title: An Ordinance of the City of East Wenatchee
amending the Greater East Wenatchee Area Comprehensive Plan
Land Use Map and the Official Zoning Map to change the land use designation and zoning of certain property located at 50 14th Street NE from Residential Low Density to Residential Medium Density, containing a severability clause, and establishing an effect date.
II. Background/History: This hearing is for an application submitted by Paul Bondo on behalf of the Jennings Trust (property owner) to change the land use designation and zoning of a 3.7 acre parcel from
Residential Low Density to Residential Medium Density. The subject

property is located at 50 14th St. NE, East Wenatchee WA. This is a joint project with Douglas County.
The East Wenatchee Planning Commission held an open record public hearing on December 5, 2017 to consider the proposal. The
Planning Commission recommended approval of the proposal with a
vote of 4-0 (Brawley, Everett, Jessup, and Birks).
This proposal was presented to the City Council for first reading on
January 9, 2018. Staff presented the staff report, and the public was afforded an opportunity to comment.
On January 23, 2018, Council held second reading. The public was provided an opportunity to comment on the proposal. Following deliberation by the Council no motion for approval or denial was put forth. Without a motion, the proposal was deemed denied. However,
since this is a quasi-judicial action, the Council is required to provide
written findings of fact and conclusions supporting whatever action is
taken. The “no action” alternative is not permitted.
The hearing this evening is intended to provide an opportunity for the
Council to reconsider the proposal, obtain public testimony, and to take formal action which must include findings of fact and conclusions of law to support whatever action the Council takes. The attached ordinance includes findings of fact and conclusions that may be modified to support the Council’s decision. As a comprehensive plan amendment, the action requires an affirmative vote of not less than a
majority of total members of the City Council.
III. Recommended Action: Motion to approve, deny, modify or remand
the proposal back to the Planning Commission for further
consideration specifying the time within which the Planning
Commission shall report back to the Council with its findings and
recommendations.

2. Recitals.
2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington; and
2.2. The City Council of East Wenatchee (“City Council”) finds that it is in the best interests of the City and its citizens to adopt the proposed amendments to the Greater East Wenatchee Area Comprehensive Plan (GEWA) Land Use Map and the Official Zoning Map.
2.3. The application for the proposed amendment was submitted by Paul Bondo for Equilus Capital Partners, LLC on behalf of the Jennings Trust (property owner).
2.4. The East Wenatchee Planning Commission held a public hearing on December 5, 2017 to consider the proposed map amendment. The proposed map amendments received a recommendation of approval from the East Wenatchee Planning Commission with a unanimous vote in favor (Birks, Brawley, Everett and Jessup).

3. Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS:
4. Purpose. The purpose of this ordinance is to amend the Land Use Map in the Greater East Wenatchee Area Comprehensive Plan and the City’s Official Zoning Map to change the land use designation and zoning of certain property located at 50 14th Street NE from Residential Low Density (R-L) to Residential Medium Density (R-M). The legal description of the property is: Lot 1, Jennings Short Plat No. SP2006-03, Douglas County, Washington, recorded February 14, 2007 in Book 1 of Short Plats, Pages 115 and 116. APN 07900000045. This is a joint project with Douglas County.
5. Amendment. The City Council accepts the recommendation of the East Wenatchee Planning Commission and adopts the amendment to the Greater East Wenatchee Area Comprehensive Plan and the Official Zoning Map as depicted on Exhibit A to this Ordinance, and incorporated by this reference.
6. Findings of Fact and Conclusions of Law. The City Council adopts the Recitals stated above as well as the findings of fact and conclusion of law as set forth below:
6.1. Findings of Fact 6.1.1. The proposal is a request to amend the Greater East Wenatchee Area Comprehensive plan land use map and the East Wenatchee Official Zoning Map that would change the land use designation and zoning of the subject property from Residential Low Density (R-L) to Residential Medium Density (R-M).
6.1.2. The subject property is located at 50 14th St. NE, East Wenatchee, WA and is legally described as Lot 1, Jennings Short Plat, all within Section 2, Township 22 N. Range 20 EWM Douglas County, Washington.
6.1.3. The subject property is identified as Douglas County Assessor Parcel number 07900000045. The fee owner is listed as Jennings Trust with Daniel & Tennye Jennings, Trustees.
6.1.4. The City of East Wenatchee and Douglas County have adopted the Greater East Wenatchee Area Comprehensive Plan in accordance with the provisions of the Growth Management Act and RCW Chapter 36.70A which covers the City and Douglas County unincorporated areas within the East Wenatchee Urban Growth Area Boundary.

6.1.5. The subject property is within the study area of the Greater East Wenatchee Area Comprehensive Plan (2017) and is designated as suitable for low density residential development.
6.1.6. The GMA requires comprehensive plans and development regulations to be consistent.
6.1.7. RCW Chapter 36.70A authorizes cities and counties to adopt and amend comprehensive plans and development regulations.
6.1.8. The City of East Wenatchee and Douglas County provide opportunities to the public, local and state jurisdictions and agencies for early and continuous public participation in the drafting of amendments to comprehensive plans and development regulations. The City adopted Resolution 2010-06 on June 8, 2010 establishing a Public Involvement Plan for adoption and amendments of comprehensive plan and development regulations.
6.1.9. Douglas County and East Wenatchee coordinate in long-range planning within the Greater East Wenatchee Area. The Douglas County Regional Policy Plan established the protocol for comprehensive plan and development regulation amendments.
6.1.10. The planning commission is responsible for long-range planning matters and providing implementation recommendations to assure compliance with the GMA.The change from Residential Low Density to Residential Medium Density will provide a transition between the higher intensity General Commercial and Waterfront Mixed Use designation to the west and the low intensity Residential Low Density designation to the east.
6.1.11. The proposal is an extension of an adjacent residential medium density land use designation.
6.1.12. Copies of the application materials and environmental documents were sent to agencies with jurisdiction and commenting agencies requesting their review and comment on the proposed project. Agencies consulted include: Douglas County PUD; Douglas County Transportation and Land Services; Douglas County Fire District; Douglas County Sewer District; East Wenatchee Water District; City of Wenatchee Community Development Department, Chelan County Community Development Department, the Washington State Department of Transportation; and the Washington State Department of Ecology. No comments were received from those agencies.
6.1.13. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed and a Determination of Non- significance and Adoption of Existing

Environmental Document was issued on November 13, 2017 with a 14-day comment period. No comments were received indicating that the proposed project would have a probable significant adverse impact on the environment.
6.1.14. Copies of the proposal and environmental documents were sent to the Washington State Department of Commerce on September 29, 2017 requesting their review and comment on the proposal and initiating the 60-day review process required by RCW 36.70A.106. No comments were received from any state agency.
6.1.15. The East Wenatchee Planning Commission has reviewed the entire record including the goals and policies of the comprehensive plans, and public testimony (both written and oral) as it relates to the proposed comprehensive plan map and zoning map amendments.
6.1.16. The East Wenatchee Planning Commission conducted a duly advertised public hearing on December 5, 2017. The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal.
6.2. Conclusions of Law 6.2.1. The proposed change in the zoning and comprehensive plan land use designation for the subject properties is consistent with and implements the goals and policies in the Greater East Wenatchee Area Comprehensive for designating property for medium density residential use.
6.2.2. The proposal is being process in accordance with provisions of the Douglas County Regional Policy Plan.
6.2.3. The public involvement process for the proposed amendments meets the standards anticipated by RCW Chapter 36.70A.140 and Resolution 2010-06. The public involvement component included the opportunity for oral and written comment, and testimony at public hearings advertised by legal notice, the city web page and the news media.
6.2.4. It is the determination of the lead agency that no more than a moderate effect on the environment is a reasonable probability as a result of the proposed action. The proper exercise of the threshold determination process as required by WAC 197-11 is than an environmental impact statement is not required to be prepared for this project.
6.2.5. Proper legal requirements of RCW 36.70A.106, title 19 EWMC, and Chapter 17.100 EWMC were met and the community was given the opportunity to comment on the proposal at a duly noticed open record public hearing.

6.2.6. The proposed amendment has been processed in a manner consistent with the requirements of the Revised Code of Washington and the Washington Administrative Code.
6.2.7. Any Finding of Fact that is more correctly a Conclusion of Law is hereby incorporated by this reference.
7. Severability. If a court of competent jurisdiction declares any provision in this Ordinance to be contrary to law, such declaration shall not affect the validity of the other provisions of this Ordinance.
8. Publication. The City Council directs the City Clerk to publish a summary of this Ordinance. The summary shall consist of the title of this Ordinance. The City Council directs the City Clerk to publish a copy of this Ordinance on the City’s website.
9. Submittal of Notice of Adoption. In accordance with RCW 36.70A.106, this Ordinance shall be transmitted by the Community Development Director to the Washington State Department of Commerce within 10 days of adoption.
10. Effective Date. This Ordinance becomes effective five days after the date its summary is published.

Dear Ms Barnett,
I am writing in regards to the Public hearing scheduled for March 13 2018. I will be out of town and not able to
attend the hearing in person. I was present at the January 23 2018 public meeting at the City Council. At that
meeting I spoke along with a number of other neighbors. Our biggest concern seemed to be on traffic concerns with
a re-zone from low density to medium density. This property has many problems different than the adjacent property
that has already been rezoned as R-M. Specifically the new residents would mostly be going over to 15th street and
up the hill to exit the area which has many problems already addressed especially during the winter. I encourage you
to review the comments from the the speakers at the January 23rd public meeting.
I’ve also re-read the application signed by Joel Frank and Paul Bondo. They did not really seem to address traffic
concerns as voiced later by a number of neighbors at the January 23rd meeting.
I definitely agree that we have a housing problem in East Wenatchee and a need for more affordable housing.
However I don’t believe that this property should be re-zoned R-M.

A. Planner Barnett distributed copies of correspondence received before the hearing from the Washington State Department of Ecology, Rick and Anette Holt, 1417 N. Anne Ave., Frank & Dawn Collings 1336 N. Ashland Ave., and Carol May to the planning
commission and entered them into the record. The members had an opportunity to read all materials submitted.
Chair Brawley explained the order of business and procedures for the Public Hearing.
Since the proposal is a site specific zone change Chair Brawley asked the members if they had any financial or ownership interest in the subject property or proposal under consideration? All members answered in the negative.
Chair Brawley asked if the members believed that they were able to hear and consider the proposal in a fair and objective manner. All members answered in the affirmative.

Chair Brawley asked if any member had received any communication regarding the proposal under consideration. Commissioner Birks explained that he had a general
conversation with the applicant Paul Bondo regarding the property.
Chair Brawley asked if there was any one who objected to any members of the planning commission participating in the hearing. No one objected.
Chair Brawley opened the public hearing at 5:40 PM.
Planner Barnett entered the staff report and written testimony into the record. She reviewed the application for the proposed amendment to the Greater East Wenatchee Area Comprehensive Plan land use map and the East Wenatchee Official Zoning Map using a PowerPoint presentation to summarize the staff report. She offered findings of fact and conclusions for consideration by the Planning Commission.
The applicant Paul Bondo approached the board and explained that the property has been listed for sale for the past two-years as single-family zoning with very little interest.
He explained that the property will be expensive to develop because of the topography and soil. The vacancy rate in the East Wenatchee area is at all-time low and affordable rentals are in demand, the proposed property is one of the few sites available for
development in the City and it is suitable for a higher density zoning.

Motion by Commissioner Birks to recommend approval of the proposed amendment to the Greater East Wenatchee Area Comprehensive Plan land use map and the East Wenatchee Official Zoning Map that would change the land use designation and zoning of the subject property from Residential Low Density to Residential Medium Density based upon the staff report findings and conclusions, Commissioner Everett seconded and the motion carried 4-0.

A. Proposal: A proposed amendment to the Greater East Wenatchee Area Comprehensive plan land use map and the East Wenatchee Official Zoning Map that would change the land use designation and zoning of the subject property
from Residential Low Density (R-L) to Residential Medium Density (R-M). This is
a joint project with Douglas County.
B. Location: The subject property is located at 50 14th St. NE, East Wenatchee, WA and is legally described as Lot 1, Jennings Short Plat, all within Section 2, Township 22 N. Range 20 EWM Douglas County, Washington. Assessor’s parcel
number 07900000045.
II. SITE INFORMATION
A. Site Characteristics: The subject property is a 3.7 acre parcel that is currently vacant. There is very little vegetation on the property. There are a few trees and
shrubs along the south boundary. The majority of the site is grasses. The
property has significant changes in topography as it slopes up from west to east with a change in elevation of over 50 feet.
B. Neighborhood Characteristics: The neighborhood is a mix of residential, and commercial uses. Land uses in the vicinity include:
North: Single-family homes South: Single-family home, vacant land, and commercial – public use (the Douglas County PUD) East: Single-family homes West: Commercial uses and single-family homes

III. DESCRIPTION OF PROPOSAL
A. Design: The proposal under consideration is a non-project action - no specific projects are proposed at this time. A Vicinity Map with an aerial photo showing the subject property and vicinity has been included with this staff report as Exhibit A.
B. Circulation: The subject property has frontage on 14th Street NE and SR 28.
1. 14th Street NE is an east-west, public street classified as a local access street. The street is paved with no curbs gutters or sidewalks within a 50 foot right of way. A dedication of 20 feet of right of way and a parallel 5 foot utility easement was provided when the Jennings Short Plat was approved.
2. SR 28 is a north-south, state highway that is classified as a major arterial.
The street is paved with no curbs gutters or sidewalks within a 70 foot right of way. A right of way dedication of 10 feet was provided when the Jennings Short Plat was approved. No access from the subject property to SR 28 is permitted. Any driveway or street proposed for access from 14th St. NE must
be at least 130 feet from the intersection of 14th St. and SR 28.
IV. ANALYSIS OF PROPOSAL
A. Comprehensive Plan: The Greater East Wenatchee Area Comprehensive Plan (GEWA Plan) was adopted on March 28, 2006 by the city of East Wenatchee
and Douglas County. The GEWA Plan has been amended several times, most
recently in 2017. The subject property is designated as suitable for low density residential development. The GEWA Plan designations of adjacent properties are listed below and shown on Exhibit A.
North: R-L: Low Density Residential
South: R-M: Medium Density Residential and R-L: Low Density Residential East: R-L: Low Density Residential West: General Commercial (G-C) and WMU-U: Waterfront Mixed Use - Uptown
The following descriptions of the low residential and medium residential land use
designation are included in the GEWA Plan (page 23-24):
Low Residential
It is envisioned that this designation would permit a range of housing options
and densities to provide areas desirable for single-family residential use. The primary and preferred land use is residential. The use of innovative
housing techniques such as attached single family, zero-lot line housing,
averaging lots sizes, and other alternates should be encouraged infilling and
variety of housing types and densities. In order for these techniques to be
used in a manner that protects the integrity of the surrounding properties, there must be mechanisms to ensure neighborhood compatibility and good
design quality.
Urban governmental services and infrastructure must be available at the
time of development or there must be a plan in place, with funding, to insure
that a full range of urban governmental services is available to serve the development within the planning period. To ensure that land development
patterns provide urban densities, mechanisms such as minimum densities,

maximum setbacks, and other regulatory tools may be necessary in areas
where these urban services are planned for but are not yet available.
Residential densities allowed in the low residential land use category should
be up to 8 dwelling units per acre or up to 10 dwelling units per acre if
developed adjacent to commercial or mixed uses. Future development within the UGA is expected to attain a target average density of at least 4
dwelling units per acre.
Medium Residential
The Medium Residential designation is intended to provide areas suitable
and desirable for residential use accommodating multi-family and medium density single-family opportunities. Mixed residential and professional office
or residential and retail can also be accommodated in this district adjacent to
commercial designations.
Urban governmental services and infrastructure must be available at the
time of development or there must be a plan in place, with funding, to insure that a full range of urban governmental services is available to serve the
development.
Multi-family designations should be applied in areas along existing or
planned arterial/collector transportation corridors, or areas in proximity or
within walking distance of commercial nodes. The multi-family designation may provide a transition from low density residential to higher intensity
residential and commercial uses. Multi-family areas should be accompanied
by open spaces, and transit linkage in order to make these densities viable
and compatible with the community.
Design standards should be applied during the development phase of the projects to ensure that multi-family development is compatible with existing
and surrounding neighborhoods.
Residential densities allowed in the medium residential land use category
should be up to 15 dwelling units per acre with a target density of at least 12
dwelling units per acre.
The following goal and policies from Chapter 4 - Housing in the GEWA Plan pertain to residential land use designations:
Goal 3: To provide for a variety of housing types and densities to ensure a
range of affordable housing options for all segments of the community.
H-7 Use the following criteria for the establishment of residential densities:
a. Adjacent to commercial development, residential development
should range from 8 to 24 dwelling units per acre and may
include mixed-use type projects.
b. Adjacent to the existing single-family districts, densities should
range from 8 to 15 dwelling units per acre.
H-8 Provide for multi-family densities near major activity centers, parks,
commercial, and business centers, that are adequately serviced by
transportation systems and utilities.

The proposed change from low residential to medium density would be an expansion of the existing medium density residential designation of the property
to the south. It should be noted that the land capacity analysis completed in 2013 concluded that there was a deficiency in the amount of land available for multifamily development. As a result, additional land was designated for multifamily development. Much of that multifamily designated land, outside of the City Limits, is in the process of being developed for small lot, single-family
homes.
The description of the medium residential designation indicates that the designation should be used along existing or planned arterials and as a transition from low density residential to higher intensity residential and commercial uses.
SR 28 is a major arterial and serves as the major north-south conduit for freight
traffic through East Wenatchee. The high volume of vehicles and intensive truck traffic impacts the subject property with noise and exhaust fumes.
As mentioned above, properties to the west are designated General Commercial and Waterfront Mixed Use-Uptown. Both designations are classified as commercial designations. Projects in the mixed use designation are intended to
be developed with the use of a master plan allowing commercial, recreational and residential uses all on one site. The mixed use designation uses a floor area ratio rather than a strict maximum density. The target density for those districts is 15 dwelling units per acre but development could have a much higher density depending upon the size of the property, the height of the structures, and size of
the dwelling units. The general commercial designation is the City’s highest intensity commercial land use designation.
One of the factors mentioned in the GEWA Plan policies referenced above, pertaining to the designation of land for multifamily residential use, is the availability of transportation and utilities to serve development. Water, sewer, and
power are available to the subject property. As mentioned above, any project on the subject property would be limited to access from 14th St. only. Street improvements on that street would be required at the time of development.
The Applicant provided a narrative to support the requested change in the designation of the property. That narrative has been included as Exhibit B to
this staff report.
The subject property is located on a major arterial and separates a commercial designation from a low density residential designation. The proposal is consistent with the description of the medium residential designation and implements the goal and policies in the GEWA Plan.
B. Zoning: The subject property is located in the Residential Low (R-L) Density Zoning District. The R-L District permits single-family homes (one per lot), adult family homes, bus passenger amenities, and duplexes under certain conditions on an outright permitted basis. The maximum density in the R-L District is 8 dwelling units per acre.

The R-M District permits all uses allowed in the R-L District as well as apartments, duplexes, and multifamily dwelling units up to 15 dwelling units per acre. Table 1 compares the R-L and R-M District dimensional standards.

Potential residential density would increase with the proposed change in zoning. It should be noted that the R-L District permits duplexes on lots at least 8,000 sq. ft. in area if the property is across the street from or adjacent to a commercial zoning district. The subject property meets that criteria.
Table 3 estimates the number of dwelling units that could be developed on the
property. The comparison of potential residential development starts with the assumption that at least 15% of the lot area would be used up for internal roads and utilities. This estimate does not take into consideration the topographical constraints of the subject property, it simply uses the lot size and the dimensional standards for each district.

As Table 3 shows, the potential number of single family dwelling units increases
from 27 in the R-L District to 34 under the R-M District. Under the R-L District a
maximum of 34 dwelling units could be constructed within 17 duplex style buildings compared to 46 dwelling units in 23 duplexes or as a multifamily development under the R-M District. That represents an increase of 12 units or 35% if the full build-out potential is realized under each district.
The adjacent property south of the subject property is zoned Residential Medium
Density. The proposal would be an expansion of that R-M District. Both parcels are currently vacant. The properties south of 13th St. NE and west of SR 28 are zoned General Commercial (C-G) or Waterfront Mixed Use. Both of those designations are commercial districts. The C-G District is the most intensive
commercial designation in the City.
As noted by the applicant, the topography of the subject property makes development for single-family homes challenging. The increased density could

provide more flexibility for the design of on-site stormwater facilities, internal circulation, and the placement of the buildings.
The impact of traffic resulting from development of the subject property was estimated using the Trip Generation Manual and the potential full buildout scenarios in Table 3. It should be noted that multifamily developments have lower average daily trips (ADT) per dwelling unit than those generated by single-family developments.
• R-L District
o If developed as single-family homes, traffic generation from the proposed site is estimated at 10.06 ADT per dwelling unit or 272 ADT (27*10.06= 272).
o If developed as duplexes, traffic generation from the proposed site, is estimated at 10.06 ADT per dwelling unit or 342 ADT (34*10.06=342).
• R-M District
o If developed as single-family homes, traffic generation from the proposed site is estimated at 10.06 ADT per dwelling unit or 342 ADT (34*10.06=342).
o If developed as duplexes, traffic generation from the proposed site, is
estimated at 10.06 ADT per dwelling unit or 463 ADT (46*10.06=463)
o For low-rise apartments (up to 2 stories) the traffic generation is estimated at 6.10 ADT per dwelling unit and 4.20 ADT per dwelling unit for high-rise apartments. With the potential full buildout of 46 dwelling units, traffic generation could range from 281 ADT for low-
rise apartments (46 * 6.10 = 281) to 193 ADT for high-rise
apartments (46*4.2=193).
As noted above, multifamily development would generate traffic volumes similar in intensity to a single-family development under the existing R-L designation. The highest traffic generation would be if the property were to develop as
duplexes under the provisions of the R-M designation. At this time, no specific
development plans have been identified. Development of the site with a project generating 200 ADT or more will be required to complete a traffic impact analysis and mitigate any impacts identified in that report.
The traffic on SR 28 has increased substantially over the years which has
adversely impacted the homes along that street with exhaust fumes, traffic
congestion, and excessive noise. These traffic associated impacts have made the area less and less attractive as a single-family neighborhood.
The proposed land use change would provide greater flexibility for the design of residential development as well as providing additional land for multifamily use.
C. Countywide Planning Policies. The Growth Management Act (GMA) is
structured in a way that not only encourages but also requires local governments to work together to address common issues. Coordination and consistency among the different jurisdictions’ comprehensive plans and development regulations are required. One of the first tasks mandated by the GMA was for

counties to work with their cities and towns to establish countywide planning policies as a framework of policies to direct the adoption and amendment of
comprehensive plans and development regulations.
The group responsible for the establishment of the countywide planning policy in Douglas County is the Douglas County Regional Council (Regional Council). The Regional Council includes the mayors from each city and the three Douglas County Commissioners.
Douglas County’s countywide planning policy is the Douglas County Regional
Policy Plan (Policy Plan). The Policy Plan contains policies specific to the adoption and amendment of comprehensive plans and development regulations in Section C. Policy C-8 describes the process for amendments to comprehensive plans and development regulations for properties within the
incorporated city or town limits which do not include a change to the urban growth area boundary. Proposed amendments are to be processed by the respective city or town and, after adoption, transmitted to Douglas County for processing. Unless inconsistent with the jurisdiction’s comprehensive plan or RCW Chapter 36.70A, Douglas County agrees to ratify the amendments adopted
by the city or town.
C. Environmental Review: The file contains a completed Environmental Checklist prepared on July 19, 2017. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed and a Determination of Non-significance was issued on November 13, 2017 with a
comment period ending on November 29, 2017. The DNS was advertised in the Wenatchee World on November 15, 2017. (See Exhibit C) Copies of the application materials and environmental documents were sent to agencies with jurisdiction and commenting agencies requesting their review and comment on the proposal. No comments were received.
D. State Review: RCW 36.70A.106 requires submittal of amendments to comprehensive plans and development regulations to the Washington State Department of Commerce (Commerce) for a 60 day review. The proposal was submitted to Commerce on September 29, 2017. The review period terminated on December 4, 2017. No comments were received from Commerce or other
agencies receiving the proposed amendment documents.
E. Public Comments: A Notice of Application was published in the paper and sent to the property owners within 300 feet of the subject property on September 29, 2017. An e-mail was received on October 2, 2017 from Leonard Howard of 1434 Sunset Highway, East Wenatchee objecting to the proposal. A letter was
received on November 7, 2017 from J. Paul Downs of 1402 N. Aurora Ave. NE objecting to the proposal. A Notice of Public Hearing was published in the Wenatchee World and sent to the property owners within 300 feet of the subject property on November 22, 2017. An e-mail objecting to the proposed amendments was submitted by Judie and Gary Donabauer on November 27,
2017. Copies of all public correspondence has been included as Exhibit D.
F. Local Agency Comments: The application and exhibits were sent to the: Douglas County PUD; Douglas County Transportation and Land Services; Douglas County Fire District; Douglas County Sewer District; East Wenatchee Water District; City of Wenatchee Community Development Department, Chelan

County Community Development Department, Washington State Department of Transportation; and Washington State Department of Ecology.
V. PLANNING SUMMARY
Planning Staff Comments: Staff offers findings of fact and conclusions in Section VI of this Staff Report for consideration by the Planning Commission. The statements in that section may be modified by the Planning Commission as appropriate to support the
decision and recommendation to the City Council.
VI. SUGGESTED FINDINGS OF FACT AND CONCLUSIONS
A. FINDINGS OF FACT
1. The proposal is a request to amend the Greater East Wenatchee Area
Comprehensive plan land use map and the East Wenatchee Official Zoning Map that would change the land use designation and zoning of the subject property from Residential Low Density (R-L) to Residential Medium Density (R-M).
2. The subject property is located at 50 14th St. NE, East Wenatchee, WA and is
legally described as Lot 1, Jennings Short Plat, all within Section 2, Township 22
N. Range 20 EWM Douglas County, Washington.
3. The subject property is identified as Douglas County Assessor Parcel number 07900000045. The fee owner is listed as Jennings Trust with Daniel & Tennye Jennings, Trustees.
4. The City of East Wenatchee and Douglas County have adopted the Greater East
Wenatchee Area Comprehensive Plan in accordance with the provisions of the Growth Management Act and RCW Chapter 36.70A which covers the City and Douglas County unincorporated areas within the East Wenatchee Urban Growth Area Boundary.
5. The subject property is within the study area of the Greater East Wenatchee
Area Comprehensive Plan (2017) and is designated as suitable for low density residential development.
6. The GMA requires comprehensive plans and development regulations to be consistent.
7. RCW Chapter 36.70A authorizes cities and counties to adopt and amend
comprehensive plans and development regulations.
8. The City of East Wenatchee and Douglas County provide opportunities to the public, local and state jurisdictions and agencies for early and continuous public participation in the drafting of amendments to comprehensive plans and
development regulations. The City adopted Resolution 2010-06 on June 8, 2010
establishing a Public Involvement Plan for adoption and amendments of comprehensive plan and development regulations.
9. Douglas County and East Wenatchee coordinate in long-range planning within the Greater East Wenatchee Area. The Douglas County Regional Policy Plan
established the protocol for comprehensive plan and development regulation
amendments.
10. The planning commission is responsible for long-range planning matters and providing implementation recommendations to assure compliance with the GMA.

11. The change from Residential Low Density to Residential Medium Density will provide a transition between the higher intensity General Commercial and
Waterfront Mixed Use designation to the west and the low intensity Residential Low Density designation to the east.
12. The proposal is an extension of an adjacent residential medium density land use designation.
13. Copies of the application materials and environmental documents were sent to
agencies with jurisdiction and commenting agencies requesting their review and comment on the proposed project. Agencies consulted include: Douglas County PUD; Douglas County Transportation and Land Services; Douglas County Fire District; Douglas County Sewer District; East Wenatchee Water District; City of Wenatchee Community Development Department, Chelan County Community
Development Department, the Washington State Department of Transportation; and the Washington State Department of Ecology. No comments were received from those agencies.
14. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed and a Determination of Non-
significance and Adoption of Existing Environmental Document was issued on November 13, 2017 with a 14-day comment period. No comments were received indicating that the proposed project would have a probable significant adverse impact on the environment.
15. Copies of the proposal and environmental documents were sent to the
Washington State Department of Commerce on September 29, 2017 requesting their review and comment on the proposal and initiating the 60-day review process required by RCW 36.70A.106. No comments were received from any state agency.
16. The East Wenatchee Planning Commission has reviewed the entire record
including the goals and policies of the comprehensive plans, and public testimony (both written and oral) as it relates to the proposed comprehensive plan map and zoning map amendments.
17. The East Wenatchee Planning Commission conducted a duly advertised public hearing on December 5, 2017. The Planning Commission entered into the record
the files on this amendment, accepted public testimony, and deliberated the merits of the proposal.
18. Public testimony was taken at the hearing. The main concerns expressed were:
CONCLUSIONS
1. The proposed change in the zoning and comprehensive plan land use designation for the subject properties is consistent with and implements the goals and policies in the Greater East Wenatchee Area Comprehensive for designating property for medium density residential use.
2. The proposal is being process in accordance with provisions of the Douglas County Regional Policy Plan.

3. The public involvement process for the proposed amendments meets the standards anticipated by RCW Chapter 36.70A.140 and Resolution 2010-06.
The public involvement component included the opportunity for oral and written comment, and testimony at public hearings advertised by legal notice, the city web page and the news media.
4. It is the determination of the lead agency that no more than a moderate effect on the environment is a reasonable probability as a result of the proposed action.
The proper exercise of the threshold determination process as required by WAC 197-11 is than an environmental impact statement is not required to be prepared for this project.
5. Proper legal requirements of RCW 36.70A.106, title 19 EWMC, and Chapter 17.100 EWMC were met and the community was given the opportunity to
comment on the proposal at a duly noticed open record public hearing.
6. The proposed amendment has been processed in a manner consistent with the requirements of the Revised Code of Washington and the Washington Administrative Code.
7. Any Finding of Fact that is more correctly a Conclusion of Law is hereby
incorporated by this reference.

Good afternoon,
My husband and I (Gary and Judie Donabauer) would like to express our displeasure with changing the land use designation
and zoning for the property at 50 14th St. N.E. in East Wenatchee. We have a small, family friendly street on Aurora with
children playing in the street and neighbors visiting each other. Inserting additional traffic onto Aurora will negatively change
that. In addition Sunset Highway does not need any additional traffic coming onto the road. When I leave for work in the
morning getting onto Sunset is a nightmare, adding additional traffic will not help the situation.
My husband and I will be at the meeting December 5th to voice our objections.

I am writing to make a few comments on an application submitted by Paul Bondo, for Equilus Capital
Partners, LLC on behalf of property owner Jennings Trust. This proposed amendment would change the
land use designation and zoning from Residential Low Density to Residential Medium Density for a 3.7
acre parcel that is currently vacant. The property is located at 50 14th St. NE, East Wenatchee and is
legally described as Lot 1, Jennings Short Plat, all within Section 2, Township 22 N. Range 20 EWM
Douglas County.
My name is Leonard Howard, and I live at 1434 Sunset Hwy, in East Wenatchee.
I, and about 6-8 other property owners in the general vicinity, share irrigation water from a common
system. Our irrigation water source is a spring that flows into a cistern located on Baker Street. This
water source was deeded to us many years ago, by Ginsinger, when the family divided and sold some of
their property here in East Wenatchee. The Jennings property shares in these water rights, but this
property has been vacant for years, with no need for irrigation water.
The spring water flows through piping that has been repaired and replaced (in areas), for many years. It
is a gravity flow system, and can adequately supply the user's needs but it is not capable of supplying
irrigation water to a new development. If our water source is tapped into, by numerous new homes/lots,
then I fear all of us current users will not be able to adequately water our own property. I'm assuming
that, if this property is divided up into multiple lots, each lot would be provided an allotment of water from
our system. I don't know how many lots could be created under the current Residential Low Density
zoning, but I do know that any additional use of our irrigation water would negatively impact the current
users of the system. And, to increase the number of lots, by a zoning change to Residential Medium
Density, would make matters even worse.
Another reason why allowing "more" potential lots/homes on this property would have a negative impact,
is the current traffic situation on Sunset Highway. I know, first hand, how difficult it can be to get out onto
Sunset Highway, and to get from Sunset Highway into my own driveway. I had hoped that the new
highway that goes up and over, would route a lot of our traffic away from Sunset Highway. I haven't seen
any improvement since that highway opened. During certain times of the day, it is absolutely terrible
trying to get onto Sunset Highway. The last thing we need is to introduce even more traffic, by allowing
even more homes to be built in this area. It can be reasonably assumed that most, or all, of the lots
created from the division of this property, would need to access Sunset Highway.
I would be against any variance from existing zoning restrictions, or against changing any existing zoning
in this area.
Please consider my concerns.

II. Background/History: Douglas County File No. CPRZ 2017-01: This hearing is for an application submitted by D & D Investments for a site-specific comprehensive plan land-use designation map amendment and
rezone of approximately 5.6 acres from Residential Office High (R-H) to
General Commercial (G-C). The subject property is located at 540, 542,

620, and 630 Rock Island Road, East Wenatchee, WA. A map showing the location of the property is included as Exhibit C in the attached Ordinance 2018-02.
Since the City and Douglas County have adopted the same
comprehensive plan, this is a joint project with Douglas County. When a
comprehensive plan amendment proposal applies only to property within
the City, the City is the lead. Once the City has made a final decision on
a proposal, it is transmitted to the Douglas County Planning Commission and then to the County Commissioners for final action. If a comprehensive plan amendment proposal applies only to property within the urban growth boundary but outside the City limits, the County is the lead. Once the County has made a final decision on a proposal, it is transmitted to the City Planning Commission and then to the City
Council for final action.
The Douglas County Board of Commissioners approved the proposal
with the adoption of Ordinance No. TLS 18-1-05B on January 16, 2018.
The East Wenatchee Planning Commission held an open record public
hearing on February 6, 2018 to consider the proposal. The Planning Commission recommended approval of the proposal with a vote of 4-0 (Brawley, Hunter, Jessup, and Birks).
III. Recommended Action: Elevate to second reading and make a motion to approve, deny, modify or remand the proposal back to the Planning Commission for further consideration specifying the time within which
the Planning Commission shall report back to the Council with its
findings and recommendations.

2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington; and

2.5. Douglas County Board of Commissioners held a public meeting on Tuesday, January 16, 2018 in the Commissioners’ Chambers of the Courthouse, for the purpose of accepting testimony, entering findings into the record, and to take action on CPRZ-2017-01. The County Commissioners approved the proposal with the adoption of Ordinance No. TLS 18-1-05B.
2.6. Notice of all public hearings and meetings on this matter have been published according to law.
2.7. The City and Douglas County are utilizing a phased adoption process for amendments to the comprehensive plan and will adopt a final resolution once the process for all amendments is concluded.
2.8. The East Wenatchee Planning Commission held a public hearing on February 6, 2018 to consider the proposed map amendment. The proposed map amendments received a recommendation of approval from the East Wenatchee Planning Commission with a vote of 4-0 in favor (Birks, Brawley, Hunter, and Jessup).
3. Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS:
4. Purpose. The purpose of this ordinance is to amend the Land Use Map in the Greater East Wenatchee Area Comprehensive Plan and the Official Zoning Map for the property described in Exhibit A and depicted in Exhibit B thereby changing the designation of the property from Office High Residential (R-H) to General Commercial (G-C).
5. Amendment. The City Council accepts the recommendation of the East Wenatchee Planning Commission and adopts the amendment to the Greater East Wenatchee Area Comprehensive Plan and the Official Zoning Map as described in Exhibit A and depicted in Exhibit B to this Ordinance, and incorporated by this reference.
6. Findings of Fact and Conclusions of Law. The City Council adopts the Recitals stated above as well as the findings of fact and conclusion of law as set forth below:
6.1. Findings of Fact
6.1.1. Douglas County has adopted a Countywide Comprehensive Plan pursuant to the Growth Management Act (GMA) and RCW Chapter 36.70A, and a series of subarea plans for each municipality in the county. These plans have been found to be consistent with each other.

6.1.2. RCW Chapters 36.70 and 36.70A authorize the adoption of development regulations.
6.1.3. CPRZ-2017-01 was submitted on May 31, 2017 in conformance with DCC14.32.040.
6.1.4. Application materials were sent to Department of Commerce on August 31, 2017.
6.2. Conclusions of Law
6.2.1. The Procedural and Substantive requirements of the State Environmental Policy Act have been complied with.
6.2.2. The procedural and substantive requirements of RCW 36.70A have been complied with.
6.2.3. The proposed amendments are consistent with Douglas County Code, Douglas County Countywide Comprehensive Plan, and the Growth Management Act.
6.2.4. The proposed amendments are consistent with the requirements of the Revised Code of Washington and Washington administrative code.
7. Severability. If a court of competent jurisdiction declares any provision in this Ordinance to be contrary to law, such declaration shall not affect the validity of the other provisions of this Ordinance.
8. Publication. The City Council directs the City Clerk to publish a summary of this Ordinance. The summary shall consist of the title of this Ordinance. The City Council directs the City Clerk to publish a copy of this Ordinance on the City’s website.
9. Submittal of Notice of Adoption. In accordance with RCW 36.70A.106, this Ordinance shall be transmitted by the Community Development Director to the Washington State Department of Commerce within 10 days of adoption.
10. Effective Date. This Ordinance becomes effective five days after the date its summary is published.

Chair Sally Brawley called the meeting to order at 5:30 PM.

II. ADMINISTRATIVE PROCEDURES
A. Approval of Summary Minutes from December 5, 2017 meetings.
Motion by Commissioner Nelson, second by Commissioner Jessup to approve the December 5, 2017 Summary Minutes. Motion carried 5-0
B. Election of Officers: Chair and Vice-Chair Terms begin in March.
Robert Hunter was nominated for the Chair position. Norma Jean Jessup was nominated for the Vice-Chair position. The nominations were approved unanimously.

Chair Brawley explained the order of business and procedures for the Public Hearing. Since the proposal is a site-specific zone change Chair Brawley asked the members three questions:

approximately 5.6 acres from Office High Residential to General Commercial. The properties involved are at 540, 542, 620 and 630 Rock Island Road, East Wenatchee.
Douglas County Associate Planner Tanner Ackley entered the October 26, 2017 staff report into the record and gave a brief report.
Chair Brawley opened the hearing for public comment. There was no one in attendance offering testimony regarding the proposal. Chair Brawley closed the hearing and opened deliberations of the Commission.
Motion by Commissioner Birks to forward a recommendation of approval to the East Wenatchee City Council for application CPRZ-2017-01 to amend the East Wenatchee Comprehensive Plan and the Official Zoning map based on the findings of fact and conclusion as presented in the October 26, 2017 staff report. Commissioner Hunter seconded and the motion carried 4 (Brawley, Birks, Hunter, Jessup) - 0.
Commissioner Nelson returned to the hearing room and took his seat.
B. CPRZ-2017-02: Open record public hearing to consider an application submitted by Cal-Neva, LLC and Rogelio Hernandez requesting approval of amendments to the Greater East Wenatchee Area Comprehensive Plan and corresponding zoning district reclassifications for re-designation of approximately 10 acres from Residential Medium Density to Office High
Residential. The properties are located at 2621 2nd Street SE, East Wenatchee.
Douglas County Associate Planner Tanner Ackley entered the staff report into the record and gave a brief report.
Chair Brawley opened the hearing for public comment. There was no one in attendance offering testimony regarding the proposal. Chair Brawley closed the
hearing and opened deliberations of the Commission. There was a discussion regarding the zoning of adjoining properties and the close proximity to agricultural property.
Motion by Commissioner Hunter to forward a recommendation of approval to the East Wenatchee City Council for application CPRZ-2017-02 to amend the East Wenatchee Comprehensive Plan and the Official Zoning map based on the findings of fact and conclusions as presented in the October 26, 2017 staff report. Commissioner Jessup seconded and the motion carried 4 in favor (Brawley, Birks, Hunter, Jessup) and 1 opposed (Nelson).
V. OLD BUSINESS
A. Wireless Communications Facility Code Update: Workshop #4 regarding proposed amendments to the East Wenatchee Municipal for Wireless Communications Facilities. Including updates to address periodic upgrades to

facilities, distributed antenna systems, small cell facilities, facilities in the right of way, and general placement provisions and preferences.
Planner Barnett updated the Planning Commission on her progress on a new Wireless Communications Facilities code. She provided a copy of a letter and attachment that was received prior to the meeting from the Wireless Policy Group on behalf of AT&T wireless. She used a PowerPoint presentation to illustrate various types of macro and small cell facilities. She reviewed the draft that
incorporates provisions for towers, attached wireless facilities and facilities in the right of way.
Planner Barnett indicated that the draft allows towers in the commercial and industrial districts on an outright permitted basis and by conditional use permit in the residential high density zoning district. She explained that the major emphasis
was to include a preference for concealed facilities over basic towers. She asked the Commissioners for specific direction to prepare the final draft. The Commissioners all agreed with the direction she was taking on the new code chapter and indicated that she should move forward with the final draft.
Gregor Gadbaw with Verizon approached the board with information on small cells
and cell towers. He stated that small cells provide capacity and coverage for 25 to 40 feet. The cell tower signals travel in a line of sight for up to 10 miles. He thanked the Commissioners for the work they are doing.
John Hughes with the Douglas County PUD approached the board and suggested an addition to Section 17.69.070.L.4. of the draft. “Unless the Utility requires a
height change.”

I. REQUESTED ACTION
Adoption of CPRZ-17-01, a site specific comprehensive plan amendment to the Greater East
Wenatchee Area Comprehensive Plan and Douglas County Official Zoning Map. The proposal
requests re-designation of approximately 5.6 acres from Office High Residential to General
Commercial.
II. ENVIRONMENTAL REVIEW
On August 30, 2017 Douglas County Issued a Determination of Non-Significance pursuant to
WAC 197-11 for Amendments to the Douglas County Code.
III. PUBLIC PROCESS
Notice for the public hearing was sent by US Postal Service mail to surrounding property
owners and distributed by mail to the interested parties distribution list. Notice for the public
hearing was published in The Wenatchee World and The Empire Press. The draft amendments
to Douglas County Code were made available on the Douglas County website and at the
Douglas County Public Services Building in East Wenatchee. The public review of draft
amendments followed the timeline below:

IV. AGENCY AND PUBLIC COMMENTS
Douglas County issued a 60-day review on August 31, 2017 that concludes on October 31, 2017.
No comments have been received to date. Comments, if any, received prior to the planning
commission meeting will be provided at that time.
V. PROJECT ANALYSIS
CPRZ-2017-01 proposes a site-specific Comprehensive Plan amendment and rezone of four
parcels from the current zoning of Residential High Density/office (R-H) to General commercial
(G-C). Affected parcels include 40200005614, 40200005617, 40200005615, and 40200005616.
These are at are at 540, 542, 620 and 630 Rock Island Road, East Wenatchee. All four parcels

are currently being used for residential purposes with existing manufactured homes and
accessory storage structures on site.
Vicinity uses are a mix of residential and commercial, as well as vacant lands. The property
extends between Rock Island Road and SR-28, giving it two “front yards” for setback purposes
although access will be limited to Rock Island Road. The aerial photograph in Exhibit 1 provides
a good representation of the project site and neighborhood.
Supporting infrastructure in the vicinity includes public water, electrical power and
communications. The county road system in the area is at a rural standard without curb,
gutter, sidewalk or dedicated stormwater collection system. Commercial-scale development
will require analysis of infrastructure demands from proposed development and may require
associated improvements.
Comprehensive plan designations and corresponding zoning district classifications in the vicinity
are depicted in Exhibit 2. These include General Commercial (C-G) adjoining on the west of the
subject property, the existing Residential High/Office to the north and south and Residential
Low adjoining on the east.
Growth Management Act Review
Planning goal RCW 36.70A.020(5) encourages economic development throughout the state that
is consistent with adopted comprehensive plans.
The Growth Management Act, in RCW 36.70A.080(1), requires each county to adopt
development regulations that promote having a variety of land uses and encourage economic
development.
A land use element designating the proposed general distribution and general location
and extent of the uses of land, where appropriate, for agriculture, timber production,
housing, commerce, industry, recreation, open spaces, general aviation airports, public
utilities, public facilities, and other land uses;
CPRZ-2017-01 would further this goal by designating more commercial zoning. The zoning
change would allow for more economic development opportunities for land owners and the
community.
Greater East Wenatchee Area (GEWA) Comprehensive Plan Review
The comprehensive plan description of the Residential High/Office designation is:
“The Residential High/Office designation is a land use category that would allow a range
of housing choices and a limited range of office style commercial opportunities for low

intensity personal and professional services. This district is a transition designation
providing a buffer between lower density land uses and higher intensity uses such as
between residential and commercial uses or areas along major transportation routes
where the intensity of activities on adjacent land make it less attractive for low density
residential uses.
“Urban governmental services and infrastructure must be available at the time of
development or there must be a plan in place, with funding, to insure that a full range of
urban governmental services is available to serve the development.
“The Residential High/Office designation should be applied in areas along existing or
planned arterial/collector transportation corridors and areas adjacent to commercial
nodes. Development of this land use type should adhere to design standards to achieve
compatible scale and design to enhance the livability and appearance of the community.
These projects should be configured to be transit-oriented, pedestrian friendly, and
provide affordable housing. This land use designation is also intended to provide a
location for low intensity office space.”
The comprehensive plan description of the General Commercial designation is:
“The General Commercial designation permits a greater range of commercial uses than
those allowed in the CBD designation. Additional uses may include mini-storage, light
warehousing, or other non-retail uses in addition to a full range of retail uses. The intent
of this designation is to allow commercial uses that will create varied job opportunities
and provide services to the community that are not strictly retail in nature.
“Although pedestrian access is stressed throughout this plan, the general commercial
designation is expected to be more automobile oriented than the CBD designation.
Design criteria for commercial and industrial land development in this designation
should be similar to the CBD but with less reliance on pedestrian access.”
The GEWA Comprehensive Plan states that it is a goal to strengthen the local economy while
ensuring a sustainable community for current and future generations. CPRZ-2017-01 would
further this goal by providing additional opportunity for economic growth.
GOAL: Diversity and strengthen the local economy to ensure a sustainable community
for present and future generations.
Policy ED-1 requires municipalities to identify areas where future economic activity and growth
may occur. CPRZ-2017-01 supports this policy by identifying specific areas where commercial
growth could occur.

ED-1 Identify areas where future economic activity and growth is intended and
encouraged to occur.
Policy ED-2 suggests encouraging economic development that would provide family-wage jobs.
CPRZ-2017-01 would support this policy by providing commercial zoning to attract businesses
and create these types of jobs.
ED-2 Support and encourage economic development that will increase personal income
by attracting a variety of business opportunities that provide family-wage jobs.
Policy ED-17 ensures that an adequate amount of land is designated for commercial use based
on community need, availability of public services/facilities, as well as some other
characteristics. CPRZ-2017-01 supports this policy by designating commercial land in an area
where it would be supported by public services and facilities.
ED-17 Ensure an adequate amount of land is designated for commercial uses based on
site characteristics, market demand, community need, job creation, and the availability
of support facilities and services.
Policy ED-21 looks to achieve a mix of uses within commercial areas. CPRZ-2017-01 would
support this policy by providing the opportunity for commercial development within those
areas while also maintaining a mix of existing residential structures.
ED-21 Achieve a mix of uses in the commercial areas to improve the City’s tax and
employment base.
Douglas County Code Review
The R-H residential high density/office (R-H) district is a land use classification suitable
for high level of diversity and density in residential housing types and offices and limited
commercial opportunities that can be integrated into the residential area. Uses are
limited to residential and office uses and those uses deemed not to be unduly
detrimental to the character of the district.
The general commercial (G-C) district encourages the development of commercial uses
that will create varied job opportunities and provide services to the community that are
not strictly retail in nature. This district will implement the General Commercial category
of the comprehensive plan. The uses within this district may require large areas for
customer parking, retail service, office establishments, limited outdoor activities,
displays and other commercial activities. The businesses locating within these areas
often draw customers from the outlying areas rather than from a more limited local
trade area. This district is expected to be more automobile-oriented than the CBD
district.

The permitted uses between the two districts vary. The R-H zone is a mix of high density
residential use, some general/professional office space, and limited commercial opportunities.
The General Commercial district allows for a mix of uses all focused on commerce and
economic development. General Commercial allows for a variety of uses including retail trade,
wholesale trade, manufacturing, transportation and warehousing, professional and technical
services, educational service, healthcare, and public administration.
VI. RECOMMENDATION
Staff recommends that the Planning Commission forward a recommendation of approval to the
Board of County Commissioners for the proposed amendments to the Douglas County
Countywide Comprehensive Plan.
Suggested motion: I make a motion to recommend approval of application CPRZ-2017-01 to
amend the East Wenatchee Comprehensive Plan and the Official Zoning map based on the
findings of fact and conclusions as presented in the October 26, 2017 staff report.
VII. FINDINGS AND CONCLUSIONS
Suggested Findings
1. Douglas County has adopted a Countywide Comprehensive Plan pursuant to the Growth
Management Act (GMA) and RCW Chapter 36.70A, and a series of subarea plans for
each municipality in the county. These plans have been found to be consistent with each
other.
2. RCW Chapters 36.70 and 36.70A authorize the adoption of development regulations.
3. CPRZ-2017-01 was submitted on May 31, 2017 in conformance with DCC 14.32.040.
4. Application materials were sent to the Department of Commerce on August 31, 2017
5. On August 30, 2017 Douglas County issued a Determination of Non-Significance
pursuant to WAC 197-11 for amendments to the Douglas County code.
Suggested Conclusions
1. The procedural and substantive requirements of the State Environmental Policy Act
have been complied with.
2. The procedural and substantive requirements of RCW 36.70A have been complied with.
3. The proposed amendments are consistent with the Douglas County Code, Douglas
County Countywide Comprehensive plan, and the Growth Management Act.
4. The proposed amendments are consistent with the requirements of the Revised Code of
Washington and the Washington Administrative Code.

site-specific comprehensive plan land-use designation map amendment

and rezone of approximately 10 acres of land from Medium Density Residential (R-M) to Residential Office High (R-H). A map showing the location of the subject property is included as Exhibit C in the attached Ordinance 2018-03.
Since the City and Douglas County have adopted the same
comprehensive plan, this is a joint project with Douglas County. When a
comprehensive plan amendment proposal applies only to property within
the City, the City is the lead. Once the City has made a final decision on a proposal, it is transmitted to the Douglas County Planning Commission and then to the County Commissioners for final action. If a comprehensive plan amendment proposal applies only to property within the urban growth boundary but outside the City limits, the County is the lead. Once the County has made a final decision on a proposal, it is transmitted to the City Planning Commission and then to the City
Council for final action.
The Douglas County Board of Commissioners approved the proposal
with the adoption of Ordinance No. TLS 18-2-05B on January 16, 2018.
The East Wenatchee Planning Commission held an open record public hearing on February 6, 2018 to consider the proposal. The Planning Commission recommended approval of the proposal with a vote of 4 in favor (Brawley, Hunter, Jessup, and Birks) and 1 opposed (Nelson).
III. Recommended Action: Elevate to second reading and a motion to approve, deny, modify or remand the proposal back to the Planning
Commission for further consideration specifying the time within which
the Planning Commission shall report back to the Council with its
findings and recommendations.

2.5. Douglas County Board of Commissioners held a public meeting on Tuesday, January 16, 2018 in the Commissioners’ Chambers of the Courthouse, for the purpose of accepting testimony, entering findings into the record, and to take action on CPRZ-2017-02. The County Commissioners approved the proposal with the adoption of Ordinance No. TLS 18-2-05B.
2.6. Notice of all public hearings and meetings on this matter have been published according to law.
2.7. The City and Douglas County are utilizing a phased adoption process for amendments to the comprehensive plan and will adopt a final resolution once the process for all amendments is concluded.
2.8. The East Wenatchee Planning Commission held a public hearing on February 6, 2018 to consider the proposed map amendment. The proposed map amendments received a recommendation of approval from the East Wenatchee Planning Commission with a vote of 4 in favor (Birks, Brawley, Hunter, and Jessup) and 1 in opposed (Nelson).
3. Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS:
4. Purpose. The purpose of this ordinance is to amend the Land Use Map in the Greater East Wenatchee Area Comprehensive Plan and the Official Zoning Map for the property described in Exhibit A and depicted in Exhibit B thereby changing the designation of the property from Residential Medium Density (R-M) to Residential High Density (R-H).
5. Amendment. The City Council accepts the recommendation of the East Wenatchee Planning Commission and adopts the amendment to the Greater East Wenatchee Area Comprehensive Plan and the Official Zoning Map changing the designation of the property from Residential Medium Density (R-M) to Residential High Density (R-H) for the property described in Exhibit A and depicted in Exhibit B to this Ordinance, and incorporated by this reference.
6. Findings of Fact and Conclusions of Law. The City Council adopts the Recitals stated above as well as the findings of fact and conclusion of law as set forth below:

Residential. The properties are located at 2621 2nd Street SE, East Wenatchee.

Motion by Commissioner Hunter to forward a recommendation of approval to the East Wenatchee City Council for application CPRZ-2017-02 to amend the East Wenatchee Comprehensive Plan and the Official Zoning map based on the findings of fact and conclusions as presented in the October 26, 2017 staff report. Commissioner Jessup seconded and the motion carried 4 in favor (Brawley, Birks, Hunter, Jessup) and 1 opposed (Nelson).
V. OLD BUSINESS
A. Wireless Communications Facility Code Update: Workshop #4 regarding proposed amendments to the East Wenatchee Municipal for Wireless Communications Facilities. Including updates to address periodic upgrades to

facilities, distributed antenna systems, small cell facilities, facilities in the right of way, and general placement provisions and preferences.
Planner Barnett updated the Planning Commission on her progress on a new Wireless Communications Facilities code. She provided a copy of a letter and attachment that was received prior to the meeting from the Wireless Policy Group on behalf of AT&T wireless. She used a PowerPoint presentation to illustrate various types of macro and small cell facilities. She reviewed the draft that
incorporates provisions for towers, attached wireless facilities and facilities in the right of way.
Planner Barnett indicated that the draft allows towers in the commercial and industrial districts on an outright permitted basis and by conditional use permit in the residential high density zoning district. She explained that the major emphasis
was to include a preference for concealed facilities over basic towers. She asked the Commissioners for specific direction to prepare the final draft. The Commissioners all agreed with the direction she was taking on the new code chapter and indicated that she should move forward with the final draft.
Gregor Gadbaw with Verizon approached the board with information on small cells
and cell towers. He stated that small cells provide capacity and coverage for 25 to 40 feet. The cell tower signals travel in a line of sight for up to 10 miles. He thanked the Commissioners for the work they are doing.
John Hughes with the Douglas County PUD approached the board and suggested an addition to Section 17.69.070.L.4. of the draft. “Unless the Utility requires a
height change.”

I. REQUESTED ACTION
Adoption of CPRZ-17-02, a site specific Comprehensive Plan amendment to the Greater East
Wenatchee Area Comprehensive Plan and Douglas County Official Zoning Map. The proposal
requests re-designation of approximately 10 acres from Residential Medium Density to Office
High Residential.
II. ENVIRONMENTAL REVIEW
On August 30, 2017 Douglas County Issued a Determination of Non-Significance pursuant to
WAC 197-11 for Amendments to the Douglas County Code.
III. PUBLIC PROCESS
Notice for the public hearing was sent by US Postal Service mail to surrounding property
owners and distributed by mail to the interested parties distribution list.. Notice for the public
hearing was published in The Wenatchee World and The Empire Press. The draft amendments
to Douglas County Code were made available on the Douglas County website and at the
Douglas County Public Services Building in East Wenatchee. The public review of draft
amendments followed the timeline below:
June 28, 2017 – Application received by Douglas County
August 30, 2017 – Notice of Application comment period began and was mailed to
surrounding property owners’
August 30, 2017 – Application materials were sent to the department of commerce in
accordance with RCW 36.70A.106
August, 31, 2017 – Legal notice published in Wenatchee world and Empire Press
Newspapers
October 31, 2017 – Sixty-day review period ends
November 8, 2017 – Planning Commission Public Hearing.
IV. AGENCY AND PUBLIC COMMENTS
Douglas County issued a 60-day review on August 31, 2017 that concludes on October 31, 2017.
No comments have been received to date. Comments, if any, received prior to the planning
commission meeting will be provided at that time.

V. PROJECT ANALYSIS
CPRZ-2017-02 proposes a site-specific comprehensive plan amendment and rezone of four
parcels from their current zoning of Medium Density Residential (R-M) to Residential High
Density/ Office (R-H). This proposal is located at 2621 2nd St SE. The current property is being
used for agricultural and residential purposes with one single family structure existing.
Surrounding uses are best described as “rural” even though the area is within the urban growth
area. Large parcels, primarily used for agricultural purposes, are a predominate land use in an
area that includes very low density residential activities.
Supporting infrastructure in the vicinity includes public water, electrical power and
communications. The county road system in the area is at a rural standard without curb,
gutter, sidewalk or dedicated stormwater collection system. Higher intensity development will
require analysis of infrastructure demands from proposed development and may require
associated improvements both on and off the site.
Comprehensive plan designations and corresponding zoning district classifications in the vicinity
are depicted in Exhibit 2. These include General Commercial (C-G) adjoining on the north of the
subject property, the existing Medium Residential to the west and southwest, Residential Low
adjoining on the immediate south and the east, and Commercial Agriculture (nonurban) on the
southeast.
Growth Management Act Review
Planning Goal RCW 36.70A.020(1) identifies urban growth as one of the main priorities for
areas where adequate public facilities and services exist.
The Growth Management Act RCW 36.70A.070(1) requires counties to adopt
development regulations that designate the proposed general distribution, general
location, and extent of the uses of land where appropriate , for agriculture, timber
production, housing, commerce, industry, recreation, open spaces, general aviation
airports, public utilities, public facilities, and other land uses.
CPRZ-2017-02 would be furthering the planning goal of the Growth Management Act by
promoting urban growth in an area that has adequate access to services and public facilities.
Greater East Wenatchee Area (GEWA) Comprehensive Plan Review
The comprehensive plan description of the Residential Medium designation is:

“The Medium Residential designation is intended to provide areas suitable and desirable
for residential use accommodating multi-family and medium density single-family
opportunities. Mixed residential and professional office or residential and retail can also
be accommodated in this district adjacent to commercial designations.
“Urban governmental services and infrastructure must be available at the time of
development or there must be a plan in place, with funding, to insure that a full range of
urban governmental services is available to serve the development.
“Multi-family designations should be applied in areas along existing or planned
arterial/collector transportation corridors, or areas in proximity or within walking
distance of commercial nodes. The multi-family designation may provide a transition
from low density residential to higher intensity residential and commercial uses. Multi-
family areas should be accompanied by open spaces, and transit linkage in order to
make these densities viable and compatible with the community.
“Design standards should be applied during the development phase of the projects to
ensure that multi-family development is compatible with existing and surrounding
neighborhoods.
“Residential densities allowed in the medium residential land use category should be up
to 15 dwelling units per acre with a target density of at least 12 dwelling units per acre.”
The comprehensive plan description of the Residential High/Office designation is:
“Urban governmental services and infrastructure must be available at the time of
development or there must be a plan in place, with funding, to insure that a full range of
urban governmental services is available to serve the development.
“The Residential High/Office designation should be applied in areas along existing or
planned arterial/collector transportation corridors and areas adjacent to commercial
nodes. Development of this land use type should adhere to design standards to achieve
compatible scale and design to enhance the livability and appearance of the community.
These projects should be configured to be transit-oriented, pedestrian friendly, and
provide affordable housing. This land use designation is also intended to provide a
location for low intensity office space.
“Residential densities allowed in the Residential High/Office land use category should be
up to 24 dwelling units per acre with a target density of at least 8 dwelling units per
acre.”
Urban Growth Goal #4 explains that the county and city have adopted consistent regulations
and development standards governing areas located within the Urban Growth Area (UGA).

GOAL 4: The County and the City will collaborate on and adopt consistent regulations
and development standards for areas located within the urban growth areas.
Urban Growth policy UG-1 states that urban growth shall occur within urban growth
boundaries where adequate public facilities and services exist. CPRZ-2017-02 is consistent with
this policy as it allows for growth in an area with adequate public facilities and services.
UG-1 Urban Growth shall occur within urban growth boundaries where adequate public
facilities and services exist or can be provided in an efficient manner within the 20-year
planning period. The urban growth area must provide enough land to accommodate
future urban development.
Transportation policy T-6 ensures that as public or private development occurs, there are
sufficient transportation systems in place; this includes adequate streets, sidewalks, and
walkways. CPRZ-2017-02 stays consistent with this policy because the project site is located
next to an existing transportation corridor, 2nd St SE, which would be able to handle the density
increase. Additionally, if any new development were to occur on the property, improvements
to the street would be required.
T-6 As public and private development occurs, ensure that transportation systems
improvements have adequate streets, sidewalks and walkways; and are consistent with
the transportation and adopted system design.
Transportation policy T-38 is key to the anticipated development of not just the subject
property, it is critical to the overall efficient development of the greater area. This policy states:
“Expansion of the UGA to the east towards the Pangborn Memorial Airport along the
Grant Road corridor must incorporate development of an east-west and north-south
urban style roadway network to facilitate access and connectivity.”
The policy supports transportation connectivity as well as utility connectivity since utility
purveyors rely on road rights-of-way to extend services. Although the area is rural in character,
urbanization is expected and must be facilitated through foresight in establishing
transportation and utility corridors and making logical extensions that benefit the overall
development pattern. For example, accommodation will need to be made for the
creation/extension of First Street SE (northern boundary of the subject property) as well as
additional north-south corridors.
It is important that development interests consult early with the County Engineer and the utility
purveyors so that there are no unanticipated surprised during the design process.

Douglas County Code Review
The R-M residential medium density district is a land use classification suitable for
residential uses with a variety of housing types, forms and densities to provide a greater
degree of flexibility of design as an alternative to conventional single-family detached
development. Uses are limited to residential uses and under certain conditions public
and private service uses which are required to service residential uses in residential
areas.
The R-H residential high density/office district is a land use classification suitable for
high level of diversity and density in residential housing types and offices and limited
commercial opportunities that can be integrated into the residential area. Uses are
limited to residential and office uses and those uses deemed not to be unduly
detrimental to the character of the district.
The primary differences between the R-M and R-H districts is the density of dwelling units per
acre with the R-M being 15 units per acre and the R-H being 24 per acre. The primary uses for
the two districts differentiate slightly as well. Within the R-H district there are limited
commercial opportunities permitted compared to the R-M. In addition to all of the permitted
uses within the R-M district, the R-H district allows for boardinghouses, general/professional
office space, and manufactured home parks.
VI. RECOMMENDATION
Staff recommends that the Planning Commissions forward a recommendation of approval to
the board of county commissioners for the proposed amendments to the County
Comprehensive Plan.
Suggested motion: I make a motion to recommend approval of application CPRZ-2017-02 to
amend the East Wenatchee Comprehensive Plan and the Official Zoning map based on the
findings of fact and conclusions as presented in the October 26, 2017 staff report.
VII. FINDINGS AND CONCLUSIONS
Suggested findings
1. Douglas County has adopted a Countywide Comprehensive Plan pursuant to the Growth
Management Act (GMA) and RCW Chapter 36.70A, and a series of subarea plans for
each municipality in the county. These plans have been found to be consistent with each
other.
2. RCW Chapters 36.70 and 36.70A authorize the adoption of development regulations.
3. CPRZ-2017-02 was submitted on June 28, 2017 in conformance with DCC 14.32.040.

County Countywide Comprehensive plan, and the Growth Management Act.
4. The proposed amendments are consistent with the requirements of Revised Code of
Washington and Washington Administrative Code.
5. The corridors for transportation and utilities to assure efficient circulation and utility
extension to support anticipated growth of all properties in the area.

II. Background/History: The City Council adopted Ordinance 2017-05 on February 28, 2017 establishing a moratorium for a period of six months
to provide time to review City codes related to wireless communication
facilities and to propose amendments to address changes to federal and
state laws, court cases and technological developments. That
moratorium was extended on 9/12/2017 for an additional six month
period ending on March 12, 2018.
At the February 27, 2018 City Council meeting, the Council approved Ordinance 2018-04 extending the moratorium for an additional 6 months until August 27, 2018. This public hearing is required to allow for public comment on the ordinance and to affirm the findings of fact and conclusions to support the ordinance.

Hold the public hearing and affirm the findings of fact and conclusions
adopted in support of Ordinance 2018-04.

2. Recitals.
2.1. The City of East Wenatchee (“City”) is a non-charter code city, duly incorporated and operating under the laws of the State of Washington.
2.2. The Telecommunications Act of 1996 (Public Law No. 104-104, 110 Stat. 56, 31-136 (the "Act"), was designed to remove regulatory barriers and encourage competition among all types of communications companies.
2.3. The Act ratified the authority of local government to regulate the construction and modification of wireless communications service facilities, but also limits local governments' authority in certain respects.

2.4. The City, on November 12, 2002 through the adoption of Ordinance No. 2002-22, added Chapter 17.70 of the East Wenatchee Municipal Code (“EWMC”) establishing zoning standards applicable to wireless communication facilities.
2.5. The City, on January 12, 2010, through the adoption of Ordinance No. 2010-03, amended certain sections of chapter 17.70 East Wenatchee Municipal Code (EWMC).
2.6. In 2012, Congress passed the “Middle Class Tax Relief and Job Creation Act of 2012” (the “Spectrum Act”) (Public Law No. 112-96; codified at 47 U.S.C. § 1455(a)), which in part, amended the Act.
2.7. Recent changes to federal laws, regulations and court cases related to wireless communication services as well as technological developments and changes in consumer demand and usage have reshaped the wireless industry and increased the demand for and complexity of siting wireless facilities within the City.
2.8. A comprehensive review of City’s telecommunications standards has not occurred since 2002. The City Council has determined that the EWMC currently lacks adequate provisions to regulate wireless communication facilities within the City in compliance with current federal laws and technologies.
2.9. The City needs to review its codes and ordinances related to wireless communications facilities and right of way use permits in a comprehensive manner to determine if amendments are necessary to more adequately address the siting and permitting process for such facilities.
2.10. The City Council finds that the vesting of permit applications for construction of wireless communication facilities under the existing EWMC provisions would be detrimental to public health, safety and welfare.
2.11. Washington State’s vested rights doctrine, which allows certain land use applications to vest to land use regulations which are in effect on the date of complete application, could allow application for wireless communications facilities to vest under inadequate regulations while the City studies the changes that may be needed in those regulations, thereby undermining effective City planning for those facilities and constituting an emergency.
2.12. In accordance with WAC 197-11-880, the adoption of this ordinance is exempt from the requirements of a threshold determination under the State Environmental Policy Act.
2.13. The City Council adopted Ordinance 2017-05 on February 28, 2017

establishing a moratorium for a period of 6 months prohibiting the acceptance of applications for use permits, wireless telecommunications facility permits, building permits, right of way use authorizations and franchises for new wireless communication facilities within the City to provide more time to investigate this issue further to evaluate the best alternatives for the community. By Ordinance 2017-16, the Council extended the moratorium to March 12, 2018.
2.14. The Planning Commission has held three workshops and has prepared a draft Wireless Communication Facility code as an amendment to the East Wenatchee Municipal Code. However, the Planning Commission has not completed their work and needs additional time to process and review draft amendments.
2.15. The City Council finds that it is in the best interests of the City and its citizens to extend the moratorium for a period of 6 months prohibiting the acceptance of applications for use permits, wireless telecommunications facility permits, building permits, right of way use authorizations and franchises for new wireless communication facilities within the City to provide more time to investigate this issue further to evaluate the best alternatives for the community.
3. Authority.
3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City.
3.2. RCW 35A.63.220 and RCW 36.70A.390, authorize the City Council to establish a moratorium.
4. Purpose. The purpose of the moratorium is to allow the City adequate time to comprehensively review and amend its regulations relating to the siting of wireless communications facilities in a manner that addresses the Telecommunications Act of 1996, the Spectrum Act, other recently adopted FCC rules, changes in technology, local concerns and efforts to provide the public with access to wireless services for its safety, convenience and productivity.

I. Summary Title: 2018 Transportation Improvement Board (TIB) Funded LED Streetlight
Conversion Project Bid Decision
II. Background/History: In 2017, the TIB approved the Relight Washington Grant for the
conversion of all City streetlights to LED. The grant covers 100% of the conversion cost. Per
the interlocal agreement (Resolution 2017-06) and associated supplement (Resolution 2018-
04) between the City and Douglas PUD, the new LED fixtures were purchased by Douglas PUD
for the City. Costs associated with the purchase will be reimbursed through the TIB grant.
Utilizing the City’s Small Works Roster, bid solicitation letters were sent on February 7, 2018
to five (5) contractors with two (2) submitting bids. The lowest bid was submitted by NE
Electric from Woodland, WA in the amount of $74,895.00.
