The Grantor, Owner and Developer of Fasteners, Inc., hereby declares and agrees as follows: 1. The Grantor is the Owner and Developer of the following described real property located at Douglas County, Washington: Attached as Exhibit C The Grantor is developing the property for commercial use. 2. The Grantor has designed and constructed a private storm water drainage system to serve the above real property in accordance with the plans the Grantor has filed with the City of East Wenatchee. The approved plans are attached hereto as Exhibit A. 3. The Grantor agrees to maintain the storm water drainage system as originally designed, and in accordance with the City of East Wenatchee Code and the specifications attached hereto as Exhibit B. The Grantor shall not reduce, expand or otherwise modify the design or operation of the storm water drainage system without first obtaining review by and written approval of the City of East Wenatchee. 4. If in the future the Grantor applies for and obtains approval to subdivide the above described real property, the Grantor agrees to implement a long-term funding mechanism to support operation, maintenance, repairs and improvements required for proper functioning of the private storm water drainage system as a condition of approval. Such funding mechanism shall be implemented by creation of an Owners' Association by further declarations and covenants binding upon the real property described above, all lots within the above development and Grantor's purchaser, successors and assigns. 5. The Grantors agree to maintain logs of inspection and maintenance activities for the storm water drainage system and to submit copies of the logs to the City of East Wenatchee not less than once each calendar year. 6. All inspection and maintenance logs, and other documents and records pertaining to the storm water drainage system shall, upon request, be made available to the City of East Wenatchee and any other agencies having jurisdiction for inspection and copying. 7. The City of East Wenatchee shall have the right to enter the above -described real property for the purpose of inspecting the condition and/or maintenance of the storm water drainage system and/or to determine the Grantor's compliance with these Covenants. The Grantor agrees to fully comply with all written notices of corrective action issued by the City of East Wenatchee and other agencies having jurisdiction. If the Grantor fails to fully and timely comply as required by a written notice of corrective action, then the City of East Wenatchee may enter the above -described property to perform all work necessary to fully complete repairs and maintenance to the storm water drainage system or otherwise bring the system into compliance with these Covenants. The Grantor agrees to pay all costs and expenses incurred by the City of East Wenatchee for such repairs and maintenance, including the cost of personnel, equipment and materials and City of East Wenatchee contractors. 8. The Grantor hereby waives any and all claims for damages against the City of East Wenatchee arising from the design, construction, inspection, repair and/or maintenance of the storm water drainage system. The Grantor agrees to indemnify, defend and hold the City of East Wenatchee harmless from any and all claims arising from the design, construction, inspection, repair and/or maintenance of the storm water drainage system. 9. These Covenants shall continue in perpetuity 10. The covenants shall run with the land described above and shall be binding on all Grantor's purchasers, successors and assigns. Maintenance and operation will be conducted by Fasteners, Inc. The system consists of perforated pipe and perforated concrete dry wells surrounded by drain rock within the property of Fasteners, Inc. The system utilizes catch basins with oil/water separators located within the property of Fasteners, Inc. and within the adjacent City of East Wenatchee Second Street S.E. right-of-way that are piped to the dry wells. The system will be inspected monthly or as often as necessary to insure proper operation. The person conducting the inspection will assure compliance with storm water standards and see that necessary repairs are made. Fasteners, Inc. will maintain the components of the storm drain system on its property. Maintenance and cleaning of catch basins and all other storm water collection devices shall be performed as needed. The applicable operational best management practices include.- 1 Inspect and clean treatment BMPs (Best Management Practices), conveyance systems, and catch basins as needed, and determine whether improvements in operations and maintenance are needed; 2. Promptly repair any deterioration threatening the structural integrity of the facilities. These include replacement of oil/water separators, catch basin and manhole lids, and rock in emergency spills; 3. Ensure that storm sewer capacities are not exceeded and that heavy sediment discharges to the storm drains are prevented; 4. Regularly remove debris and sludge from the BMPs used for peak -rate control and treatment, and discharge to a sanitary sewer, if approved by the local jurisdiction, or truck to a local or state government approved disposal site; 5. Clean the catch basins when the depth of deposits reaches 60 percent of the sump depth, as measured from the bottom of the basin to the invert of the lowest pipe into our out of the basin; 6. Clean woody debris in a catch basin as frequently as needed to ensure proper operation of the catch basin; 7. Post warning signs "Dump No Waste — Drains to Groundwater", or emboss on or adjacent to storm drain inlets where practical; 8. Treatment of sediments and liquids from the catch basins must comply with "Recommendations for Management of Street Wastes" described in Appendix 8B of the Stormwater Management Manual for Eastern Washington.
