PUBLIC COMMENT(S) Dave Waller — Complaint against Public Works Department Dave Waller, 591-A Eastmont Ave, East Wenatchee, said on Thursday, September 17, 2015, at 11:15 a.m., his beloved dog Sam was hit by a City of East Wenatchee Street Department employee. Mr. Waller asked the City to pay for the cost of cremation, as well the cost of a new dog. He said the loss has hit him pretty hard, and caused him to suffer a stress induced seizure at home. City Attorney Devin Poulson stated that Mr. Waller has fled a Tort Claim with the City, and the claim has been submitted to the Cities Insurance Company. Jim Russell, 401 19`h Street, East Wenatchee, thanked the City for enabling him to ride his bicycle in bike lanes the City has provided. He also personally invited everyone to the "Wildfires and Us Summit" on November 9, 2015, at the Performing Arts Center in Wenatchee. He noted that the cost is free, and ( l said there will be booths, presentations, and information on how to be fire wise. V CITY OF EAST WENATCBEE COUNCIL MINUTES OCTOBER 13, 2015 MAYOR'S REPORT Mayor Lacy thanked Events Coordinator Dan White, Assistant Events Director Brooke Black, and all volunteers, for a successful Wings & Wheels event this year. Santa Claus Decoration Mayor Lacy said Staff has advised that our City Santa Claus decoration has worn out, and has requested authorization to purchase a new Holiday decoration. He said the City has received a bid for a 16'xl8' custom designed Santa flying Miss Veedol decoration, which enhances our City theme, with costs ranging from $8,350-9,954, and estimated shipping charges of $300. Council Action: A motion was made by Councilmember Detering, second by Councilmember Buckner, to approve the expenditure of a custom designed Santa flying Miss Veedol decoration. The motion carried, 6-0. Request for Tree Planting Mayor Lacy said he attended Yuriko "Elsie" Nakata's funeral on Saturday, October 10, 2015. He noted she was a founding member of the Misawa Sister City Association, and developed a Japanese cultural display at the Wenatchee Valley Museum. He said the family requested a tree planting at the cemetery but were turned down, so they asked the City to be involved. Mayor Lacy said he would like to incorporate a tree or plaque in the City's Japanese garden, which would be paid for by the family. Council Action: A motion was made by Councilmember Johnson, second by Councilmember Detering, to approve the placement of a commemorative tree or plaque in the City's Japanese garden in honor of Yuriko "Elsie" Nakata. The motion carried, 6-0. BUDGET ISSUES Nick Gerde, Finance Director — 2016 Preliminary Budget Report Finance Director Nick Gerde distributed and reviewed pie charts related to the 2016 Preliminary Budget showing 2016 Operational Revenue & Total Estimates, 2002-2016 Sales Tax Revenue Trends and Average Annual Growth Rates, 2016 Labor & Benefits by Functional Area, and the 2016 City Staffing Plan. He also reviewed the 2016 Preliminary Budget Message included in the packet. Finance Director Nick Gerde noted other items to be aware of which include; two new sources of revenue including a $2,000 quarterly transportation distribution to Cities that comes from State Motor Vehicle Transportation Revenue collected, a $5,056.35 quarterly Marijuana Revenue Distribution; a $10,000 Public Defense Improvement Grant; an annual $4,000 Property Tax increase; a 3.1% increase in Medical Premiums; and a 8.4% increase in Workers Compensation rates for the Police and Street Departments. He said the mission of the Budget Committee meeting on October 22, 2015, will be to go through these factors, and start incorporating changes. Budget Amendment Memo Finance Director Nick Gerde reviewed the Schedule of Proposed 2015 Budget Amendments Mayor Lacy asked Council to consider the snow plow expenditure soon, as it appears we have insufficient assets in the case of severe snow conditions. He said he would like Public Works Director Greg Pezoldt to immediately start the process of replacement, and have it completed by this winter. 2 CITY OF EAST WENATCHEE COUNCIL MINUTES OCTOBER 13, 2015 Council Action: A motion was made by Councilmember Johnson, second by Councilmember Raab to authorize the process of purchasing two snow plow vehicle replacements for the City. The motion carried, 6-0. DEPARTMENT REPORTS Dan White, Events Coordinator — Wings & Wheels update Dan said the format of Wings & Wheels has always been a Saturday and Sunday event, but this year it was changed to a Saturday only event, with registered participants partaking in a very successful cruise on Friday evening. He said events on Saturday included the car show, kid's activities, and a carnival. He noted there were 268-270 cars registered this year, a photographer was hired to take pictures, and the Public Utility District (PUD) supplied a man lift enabling aerial photos to be taken during the event. He said Roy and Linda Henson became ambassadors for the kid's activities and delivered brochures to private and public schools, which was very successful. He thanked Deb Lacy for the huge success with the kid's activities. Mayor Lacy said he has discussed, with Dan, having a meeting with the Pangborn Airport Board to get them more involved in the Wings aspect of the event. He said the City tried to get Miss Veedol at the Park, and although they were unable to do that Miss Veedol did fly over the Park a couple times during the day. Dana Barnard, City Clerk — Business License Report City Clerk Dana Barnard reviewed the Business License Activity for the first three quarters of 2015. She asked Council if there was anything else they would like to see included in the report. Mayor Lacy asked Council to give that some thought, and inform himself or Dana directly. CONSENT CALENDAR Items listed below were distributed to Councilmember's in advance for study and were enacted in one motion. Council Action: A motion was made by Councilmember Barnhart, second by Councilmember Collings, to approve the Consent Calendar as presented. The motion carried, 6-0. 1. Consideration of Minutes — Regular Session, September 22, 2015 2. Consideration of Payables and Payroll i. 2015 Payables — As of this date, October 13, 2015, Council does approve check numbers 44328 through 44339, 44343 through 44344, and 44367 through 44450 in the total amount of $672,252.87. Payables check 44342 was voided. ii. 2015 August Payroll — As of this date, October 13, 2015, Council does approve check numbers 44026 through 44073, 44141, 44142, and 44197 through 44267 in the total amount of $391,787.17. Councilmember Johnson asked if someone would address Page 111, a letter from Director of Licensing and Regulation regarding Senate Bill 5052 and House Bill 2136, relating to Marijuana. Community Development Director Lori Barnett explained that the City adopted buffers of 1000 feet after passage of Initiative Bill 502, Initiative Bill 2136 allows buffers to go down to 100 feet. The City has not had any discussions about whether or not we want to do that. She said, as of Monday, the Liquor and Cannabis Board began accepting new applications for retail licenses to an unlimited number of businesses 3 CITY OF EAST WENATCHEE COUNCIL MINUTES OCTOBER li, 2015 applying for licenses, but our Ordinance still has a 1000 foot buffer, so the areas that are available for these types of businesses are fairly small, and only allowed in Commercial areas. Mayor Lacy noted that we will probably need to revisit this in light of the new rules, and decide whether or not we want to take further action. He said our Ordinance is consistent with the Regional State Law, which allows one retail store in the City. He said it doesn't sound like we need to have a specific session about this, but should consider having the Planning Commission look at it. Mayor Lacy noted that he has no plans of recommending our buffer to go down from 1000 feet, and has not heard any requests for it. PUBLIC HEARING 15-10-01 A public hearing to consider the City's proposed assumption of the Transportation Benefit District's rights, powers, functions, and obligations. Presented by: Devin Poulson, City Attorney Mayor Lacy opened the Public hearing at 7:39 p.m. Hearing no comments, Mayor Lacy closed the Public Hearing at 7:40 p.m. ORDINANCE(S) 15-10-02 An Ordinance of the City of East Wenatchee assuming the rights, powers, functions, and obligations of the East Wenatchee Transportation Benefit District. ® Presented by: Devin Poulson, City Attorney Mayor Lacy read the first reading of Ordinance No. 2015-18, followed by discussion. Mayor Lacy elevated the Ordinance to second reading, without objection. Council Action: A motion was made by Councilmember Detering, second by Councilmember Johnson, to approve Ordinance No. 2015-18 assuming the rights, powers, functions, and obligations of the East Wenatchee Transportation Benefit District. The motion carried, 6-0. ORDINANCE NO.2015-18 An Ordinance of the City of East Wenatchee assuming the rights, powers, functions, and obligations of the East Wenatchee Transportation Benefit District. 15-10-03 An Ordinance of the City of East Wenatchee increasing its business license fee by amending Section 5.04.080 of the East Wenatchee Municipal Code. Presented by: Devin Poulson, City Attorney Mayor Lacy read the first reading of Ordinance No. 2015-17, followed by discussion. Mayor Lacy elevated the Ordinance to second reading, without objection. Council Action: A motion was made by Councilmember Barnhart, second by �j Councilmember Johnson, to approve Ordinance No. 2015-17 as drafted, increasing its business license fee by amending Section 5.04.080 of the East Wenatchee Municipal Code. The motion carried, 6-0. 4 CITY OF EAST WENATCHEE COUNCIL MINUTES OCTOBER 13, 2015 ORDINANCE NO.2015-17 An Ordinance of the City of East Wenatchee increasing its business license fee by amending Section 5.04.080 of the East Wenatchee Municipal Code. ACTION ITEM(S) 15-10-04 Authorization for staff to open up a PayPal Account. Presented by: Devin Poulson, City Attorney Council Action: A motion was made by Councilmember Detering, second by Councilmember Johnson, to authorize staff to set up a PayPal account for the ability to accept payments on the City website. The motion carried, 5-1. (Raab) 15-10-05 Authorization for the Mayor to sign a lease agreement with Xerox for a Printer/Copier. Presented by: Lori Barnett, Community Development Director Council Action: A motion was made by Councilmember Buckner, second by Councilmember Barnhart, to authorize the Mayor to sign a 5-year lease agreement with Xerox for a Model XC70 copy machine for the main administrative office. The motion carried, 6-0. 15-10-06 A recommendation to accept the Bid for the City Hall Painting Project. Presented by: Greg Pezoldt, Public Works Director Council Action: A motion was made by Councilmember Johnson, second by Councilmember Buckner, to authorize the Mayor to sign a Contract with Gallardo Painting, LLC for the City Hall Painting Project in the amount of $17,744.80. The motion carried, 6-0. 15-10-07 Authorization to reject the Bid for the Transportation Benefit District Overlay Project. Presented by: Greg Pezoldt, Public Works Director Council Action: A motion was made by Councilmember Buckner, second by Councilmember Detering, to authorize rejection of all bids submitted for the Transportation Benefit District Overlay Project. The motion carried, 6-0. Councilmember Barnhart asked Greg Pezoldt to give an update regarding the French Street Project. Greg stated we are ahead of schedule on that project, there were no archeological findings, and it is scheduled to be completed in November. COUNCIL REPORT(S) Councilmember Johnson noted that on October 14, 2015 he will be filling in for Councilmember Buckner at the Economic Development District (EDD) meeting at 4 p.m., will attend the AWC Regional meeting at 5 p.m., and the AWC round table discussion. CITY OF EAST WENATCHEE COUNCIL MINUTES OCTOBER 13, 2015 Councilmember Detering said Community Development Director Lori Barnett, Eastmont Community Parks Executive Director Sally Brawley, and he attended a Trust for Public Lands meeting, and asked Sally to give a brief review. Sally Brawley, Executive Director for Eastmont Parks, said the meeting was the first held for two Park Initiatives; Colonial Vista Park, and the East Wenatchee Park vision. She said she was happy that Tim and Lori attended the meeting representing East Wenatchee. Sally said she worked with the Wenatchee poller to put together the Eastmont Parks poll at the end of the year. Councilmember Raab said he is unable to attend the Storm Water Utility meeting at 8:30 a.m. on October 14, 2015, and asked if another Councilmember could fill in for him. Councilmember Johnson volunteered to attend.
