ROLL CALL Mayor Steven C. Lacy Councilmember John Sterk Councilmember Harry Raab Councilmember Tim Detering Councilmember Wayne Barnhart Councilmember George Buckner Councilmember Sandra McCourt Councilmember Chuck Johnson - Excused EMPLOYEES IN ATTENDANCE Sergeant Ben Fauconnier City Clerk Dana Barnard City Attorney Devin Poulson Finance Director Nick Gerde Public Works Director/City Engineer Greg Pezoldt Executive Secretary/Accounting Assistant Teresa Allen Clerical Assistant Shawn Murison PUBLIC COMMENT(S) Carrie Kilgo, said she has been selling fruits and vegetables at the corner of Pace Drive and Highline ® Drive and was asked by the City to leave that location, as it is City right of way. She asked Council if they would grant her permission to continue selling at this location. Mayor Lacy reviewed City Ordinances that pertain to this issue. He added, the solution would be to revise the Ordinance in such a way as to do what the Council wants to see done. He asked Council if they would like to revise the Ordinance, no objection was heard. He noted that a draft Ordinance will be on the next Council meeting agenda. City Attorney Devin Poulson noted that it has been City policy to not allow people to use City right of way or property, and said we do not have a process for granting permits for the use of our right of way. Shelby Pickering, 319 N. Georgia Avenue, East Wenatchee, expressed concerns regarding cars speeding on Georgia Avenue. She asked if she could submit a signed petition asking for speed bumps to be placed in the area, or some other remedy to slow vehicles down, as there are several children and elderly in the area. Mayor Lacy said he would talk to the Police Chief in regards to having special patrol in the area. DEPARTMENT REPORT(S) Public Works Director Greg Pezoldt reviewed the 2016 Construction Projects Status Report for September. Councilmember Barnhart noted there is still an issue with flooding on Dolfay Lane, as well as the U stormwater pond on 3rd Street SE, just west of Highline Drive that could lead to a potential problem with mosquitos. Public Works Director Greg Pezoldt said time has been spent on that pond, and it has been pumped out a couple times. CITY OF EAST WENATCBEE COUNCIL MINUTES SEPTEMBER 13, 2016 MAYOR'S REPORT(S) Mayor Lacy said he is scheduled to have surgery, and will not be available for a couple weeks. He said he would not be able to attend the Welcome Reception at East Wenatchee City Hall for the visiting Misawa Sister -City Delegation on Thursday, September 29, 2016, at 3:30 p.m., and has asked Wenatchee's Mayor Kunz to be his alternate. Mayor Lacy reviewed the Wenatchee Valley Misawa Sister City Association's schedule of events and encouraged all Councilmembers to attend them, as well as the reception. Mayor Lacy noted an email submitted by Community Development Director Lori Barnett, setting a date for a Joint Special Meeting with Douglas County Commissioners to conduct a workshop and joint public hearing with the City Council, to consider recommendations from the September 6, 2016, City and County Planning Commission meeting regarding two proposals; A subarea plan for the North End Study area in East Wenatchee's Urban Growth Area, and a North End Planned Action Ordinance; and proposed amendments to the East Wenatchee Municipal Code Title 12 & 17, and Douglas County Code Title 12 & 18 regarding the Loop Trail Overlay. He said this is important business, and encourages all Councilmembers to attend. The special meeting is tentatively scheduled for Monday, October 10, 2016, starting at 4 p.m. with a light dinner, Workshop at 4:30 p.m., and public hearing at 6 p.m. BUDGET ISSUES) Mayor Lacy said there is a need to change the Budget Committee meeting from September 22na to September 21" CONSENT CALENDAR Items listed below were distributed to Councilmember's in advance for study and were enacted in one motion. Council Action: A motion was made by Councilmember Detering, second by Councilmember Sterk, to approve the Consent Calendar as presented. The motion carried, 6-0. 1. Consideration of Minutes — Regular Session, August 23, 2016 2. Consideration of Payables i. 2016 Pa, a� — As of this date, September 13, 2016, Council does approve check numbers 46462 through 46463, and 46495 through 46575 in the total amount of $222,027.23. Payables check 46385 was voided. ACTION ITEMS) 16-10-01 Supplemental Agreement I to the Professional Services Contact for the for Valley Mall Parkway LID Construction Phase with Pace Engineers Inc. Presented by: Greg Pezoldt, Public Works Director Council Action: A motion was made by Councilmember Detering, second by Councilmember McCourt, to authorize Mayor Lacy to sign the Supplemental Agreement 1 to the Professional Services Contract, for the Valley Mall Parkway Parking Lot LID — Construction Phase, with Pace engineers, Inc. The motion carried, 6-0. 16-10-02 2016 Overlay Project TIB Consultant Supplemental Agreement with Gray and Osborne. Presented by: Greg Pezoldt, Public Works Director 2 CITY OF EAST WENATCHEE COUNCIL MINUTES SEPTEMBER 13, 2016 Council Action: A motion was made by Councilmember Detering, second by Councilmember Raab, to approve the Transportation Improvement Board (TIB) Consultant Supplemental Agreement for Gray & Osborne, for Construction Management Services for the 2016 Overlay Project in an amount not to exceed $55,000. The motion carried, 6-0. 16-10-03 Award the bid for purchase of one used 2000 Sterling L7500 truck, including a sander and plow in the amount of $69,982.50. Presented by: Greg Pezoldt, Public Works Director Councilmember Barnhart said he would rather the City purchase new vehicles rather than used ones. Council Action: A motion was made by Councilmember Detering, second by Councilmember Buckner, to approve the purchase of one 2000 Sterling L7500 truck, including a sander and plow, in the amount of $69,982.50. The motion carried, 5-1. (Barnhart) DISCUSSIONS) 16-10-04 Request from The City of Tekoa, WA concerning the proposed closure of sections of the John Wayne Trail. QPresented by: Steven C. Lacy, Mayor Council Action: A motion was made by Councilmember Detering, second by Councilmember McCourt, to draft a Resolution in support for the John Wayne Trail, using Spokane Resolution No. 2015-0114 as an example. The Motion carried, 6-0. COUNCIL REPORT(S) Councilmember Barnhart noted a letter that was included in the packet from the Douglas County Sewer District No. 1 Manager, Bernita Landers, to Representative Dave Reichert regarding a Public Works Trust Fund Program. He said this was a unique letter with actual facts of what it costs to borrow money versus going out for bonds, or using Public Works Funds, so he would like all Councilmembers to read it. Mayor Lacy stated that he agrees with the letter 100%, and the loss of this Program has eliminated some opportunities for our City as well as others. The following reports/minutes were submitted in writing prior to the City Council meeting. • Mayor Lacy — Minutes from the Chelan -Douglas Transportation Council meeting held on July 14, 2016. ADDITIONAL ITEM(S) Kazumasa Taneichi, Mayor of Misawa City — Appreciation letter regarding our support to their Sister City Program, and announcement that their Delegation will be here September 29th through October 4th.
