REGULAR SESSION OF THE CITY COUNCIL CONVENED MAYOR STEVEN C. LACY, PRESIDING AUGUST 9, 2016 6:30 P.M JOINT MEETING Commissioners present — Dale Snyder, Chair Steve Jenkins, Ken Stanton Councilmembers present — Wayne Barnhart, Tim Detering, George Buckner, John Sterk, Sandra McCourt, Chuck Johnson, and Harry Raab Mayor Lacy called the Joint City Council and Douglas County Commission meeting to order at 5:36 p.m. A joint public meeting with the Douglas County Board of County Commissioners to consider the recommendation of the East Wenatchee Planning Commission, and the Douglas County Planning Commission, regarding proposals to amend the East Wenatchee Municipal Code. CITY ORDINANCES Ordinance No. 2016-08 An Ordinance of the City of East Wenatchee amending the East Wenatchee Municipal Code and adding a new Section 17.72.270 to establish minimum Density Standards, Ordinance No. 2016.09 An Ordinance of the City of East Wenatchee amending the East Wenatchee Municipal Code Chapter 17.24 Residential Low Density District to reduce minimum lot area, lot dimensions, and setbacks; and increase lot coverage. Ordinance No. 2016-10 An Ordinance of the City of East Wenatchee amending the East Wenatchee Municipal Code Chapter 17.28 Residential Medium Density District to clarify land uses, reduce minimum lot area, lot dimensions, and setbacks; and increase lot coverage. Ordinance No. 2016.11 An Ordinance of the City of East Wenatchee amending the East Wenatchee Municipal Code Chapter 17.32 Residential High Density/Office District to clarify land uses; and reduce minimum lot area, lot dimensions, and setbacks. Ordinance No. 2016.12 An Ordinance of the City of East Wenatchee amending the East Wenatchee Municipal Code Chapter 17.72 General Provisions pertaining to off-street parking; structures and setbacks; lot size averaging; accessory dwelling units; and lot frontage. Ordinance No. 2016.13 An Ordinance of the City of East Wenatchee amending the East Wenatchee Municipal Code Chapter 17.08 Definitions sections regarding lot lines, lot width, and lot types and adding new definitions and diagrams illustrating certain defined terms. CITY OF EAST WENATCHEE COUNCIL MINUTES AUGUST 9, 2016 Ordinance No. 2016.14 An Ordinance of the City of East Wenatchee amending the East Wenatchee Municipal Code Section 17.38.070 Neighborhood Commercial to increase the district size limitation and correct text errors. Community Development Director Lori Barnett gave a Staff presentation regarding adding a new Section, 17.72.270, to the East Wenatchee Municipal Code (EWMC) to establish minimum Density standards for residential development within residential, and mixed -use zoning districts. She said it does provide for exceptions from those density provisions, and includes special provisions for properties not served by public and sanitary sewer. She reviewed the proposed changes to; residential zoning districts, the general provisions, definitions sections, and neighborhood commercial. Mayor Lacy opened the floor to take public comments. The following citizens spoke in opposition of adding a new Section, 17.72.270 - establishing minimum Density standards and requiring street improvements for development to the East Wenatchee Municipal Code; Jon Port, East Wenatchee Dean McKee, East Wenatchee Bob Rankin, East Wenatchee Paul Mares, Wenatchee John Cumpton, Wenatchee Steve Anderson, East Wenatchee The following were not opposed to the changes: Shanley Crane, East Wenatchee Russ Andrews, East Wenatchee Dan Beardsley, East Wenatchee Mark DeChenne, East Wenatchee Randy Johnston, East Wenatchee Bryan Campbell, Wenatchee Jim Nakata, parcel owner, East Wenatchee — would like options to exclude some properties Jim Huffman, Chair, Port of Douglas County Commission — encouraged adoption of the provisions. Following Council discussion, Mayor Lacy noted he would not be elevating the ordinances to second reading, as he has already heard one objection. He said this is a significant enough issue that it needs more time for evaluation. No action was taken by the East Wenatchee City Council or the Douglas County Commissioners. The amendment proposal was tabled for further consideration. MAYOR'S REPORT(S) Mayor Lacy noted that the Misawa Sister City Delegation will be leaving for Japan on August 11, 2016. CONSENT CALENDAR Items listed below were distributed to Councilmember's in advance for study and were enacted in one motion. Council Action: A motion was made by Councilmember Barnhart, second by Councilmember McCourt, to approve the Consent Calendar as presented. The motion carried, 7-0. Consideration of Minutes — Regular Session, July 26, 2016 Consideration of Payables i. 2016 Payables — As of this date, August 9, 2016, Council does approve check numbers 46295 through 46296, and 46316 through 46392 in the total amount of $240,429.25. No payables checks were voided. CITY OF EAST WENATCHEE COUNCIL MINUTES AUGUST 9, 2016 PUBLIC HEARINGS 16-08-08 A public hearing regarding Ordinance 2016-05 — An Ordinance of the City of East Wenatchee imposing a twelve-month moratorium on the issuance of any permits or licenses for the establishment of medical marijuana cooperatives and including a work plan. Presented by: Lori Barnett, Community Development Director Mayor Lacy opened the public hearing at 7:35 p.m. Hearing no comments he closed the Public Hearing at 7:35 p.m. 16-08-09 A public hearing to accept testimony regarding the "City Of East Wenatchee 2016 Annual Action Plan" in accordance with the requirements of the U.S. Department Of Housing And Urban Development Regulations at 24 CFR Part 91 and the City's Citizen Participation Plan. Presented by: Lori Barnett, Community Development Director Mayor Lacy opened the public hearing at 7:36 p.m. Hearing no comments he closed the public hearing at 7:36 p.m. RESOLUTIONS) 16-08-10 A Resolution adopting the 2016 Annual Action Plan. Presented by: Lori Barnett, Community Development Director Council Action: A motion was made by Councilmember Johnson, second by Councilmember Sterk, to approve Resolution No. 2016-09, adopting the 2016 Annual Action Plan, and authorize the Mayor to sign all required HUD certifications. The motion carried, 7-0. Resolution No. 2016-09 A Resolution of the City of East Wenatchee, Washington, adopting the "City of East Wenatchee Community Development Block Grant 2016 Annual Action Plan" in accordance with the requirements of the U.S. Department of Housing and Urban Development regulations at 24 CFR Part 91, and establishing an effective date. 16-08-11 A Resolution authorizing the Mayor to sign an Interlocal Agreement with Douglas County Sewer District for additional work for the pavement restoration of 41h Street SE. Presented by: Steven C. Lacy, Mayor, for Greg Pezoldt, Public Works Director Council Action: A motion was made by Councilmember Johnson, second by Councilmember Buckner, to authorize the Mayor to sign an Interlocal Agreement with the Douglas County Sewer District for additional work for the pavement restoration on 41h Street SE at a cost of $30,000. The motion carried, 6-0. (Councilmember Barnhart recused himself) Resolution No. 2016-10 A Resolution of the City of East Wenatchee, Washington, authorizing the Mayor to sign an Interlocal Agreement with the Douglas County Sewer District for additional work for the pavement restoration of 4th St SE. CITY OF EAST WENATCHEE COUNCIL MINUTES AUGUST 9, 2016 ACTION ITEMS) 06-08-12 Agreement GCB 2443 between Washington State Department of Transportation and the City of East Wenatchee for project administration of the 91' Street NE Dual Round -About Project. Presented by: Devin Poulson, City Attorney, for Greg Pezoldt, Public Works Director Council Action: A motion was made by Councilmember Detering, second by Councilmember Barnhart, to approve Agreement GCB 2443 between Washington State Department of Transportation and East Wenatchee, for the project administration of the 9d' St NE Dual Round -About Project. The motion carried, 7-0. DISCUSSION ITEMS) 06-08-13 A discussion regarding the Gateway Project to decide if the City Council wishes to follow the plan and continue a public process, or have City Councilmembers make the decisions regarding the project. Presented by: Steven C. Lacy, Mayor Council Action: A motion was made by Councilmember Johnson, second by Councilmember Detering, to follow the preliminary scope of work for the overall project, and continue with Task 2. Planning Phase — Identify use of the property and develop preliminary concept design sketch — Consultant. The motion carried, 6-1. (Barnhart) ® COUNCIL REPORT(S) Councilmember Detering requested an alternate for the Chamber of Commerce, and Link Transit Board meetings, as he will be on the Misawa trip, and unable to attend. Mayor Lacy asked City Clerk Dana Barnard to find alternates for those meetings. Councilmember Johnson thanked the Planning Commission for all they have done. The following reports/minutes were submitted in writing prior to the City Council meeting. • Councilmember Buckner — Minutes from the North Central Washington Economic Development District Board meetings held on June 8, 2016, and July 13, 2016. • Councilmember Barnhart — Minutes from the RiverCom Administrative Board meeting held on July 13, 2016. ADDITIONAL ITEMS) Wenatchee Valley Animal Care & Control — City of East Wenatchee Quarterly Report, 2nd Quarter - 2016 Informed Citizens Coalition, Chairman, Julanne Burts — Letter of support and gratitude to the Mayor and City Council for taking a stand against the recently proposed ban on fireworks within the City limits.
