PROCLAMATION Mayor Lacy read a Proclamation proclaiming Thursday, May 18, 2016, as Peace Officers' Memorial Day, and the week of May 15-21, 2016, as National Police Week. Mayor Lacy read a Proclamation proclaiming Monday, May 30, 2016, as Memorial Day. PRESENTATION(S) Washington State Department of Transportation — SR 28/5th St. Intersection Improvements David Bierschback, Assistant Region Administrator for Engineering, Washington State Department of Transportation, noted that they do have funding, and have begun design on the SR28/5th Street Project. David Kieninger, Assistant Project Engineer, gave a PowerPoint Presentation on the SR28/5th Street intersection improvements. He noted there will be an Open House on the Project Wednesday, May 18, 2016, at the East Wenatchee City Hall from 3-7 p.m. Mr. Kieninger said they have started an early design on this project, and the primary goal is to improve safety. He reviewed collision history in the area, and showed three potential improvement options that are feasible to improve safety; (1) Right in - right out on 5th Street, (2) Traffic Signal Intersection, and (3) a Roundabout, which is the preferred option. Mr. Kieninger showed videos of the signal model, and the roundabout model. He added that they are hoping to advertise the project in December 2016, with construction starting in Spring or Summer of 2017. PUBLIC COMMENT(S) Doug Duncan, Arbor Terrace, East Wenatchee, between 13th & 15th Streets, recently had his property surveyed by Erlandsen & Associates Inc. He distributed an aerial photo of the property. He said the CITY OF EAST WENATCHEE COUNCIL MINUTES MAY 10, 2016 retaining wall on his property is starting to fail, and was considering building a secondary 3 foot wall in front of the existing wall, and another concrete wall in front of the failing wall to keep it from blowing out at the bottom. He said he would use it as a planter, and wanted to know if there were any reasons why he could not do that. Mayor Lacy said the City would not have any reason to prevent him from building an additional retaining wall on his own property. City Attorney Devin Poulson suggested holding all comments until the Executive Session. Mayor Lacy said there may be a potential dispute over ownership of the property based on conflicting surveys or viewpoints, and City Council is not in a position to resolve that in an open meeting, so this will have to be dealt with from a Legal standpoint. DEPARTMENT REPORT(S) Public Works Director Greg Pezoldt reviewed a status report for the May 2016 Construction Projects. MAYOR'S REPORT(S) Mayor Lacy reminded Councilmembers to contact City Clerk Dana Barnard if they were interested in attending the Association of Washington Cities Conference in June. Mayor Lacy said he has had numerous calls regarding a full ban on fireworks in East Wenatchee. City Council decided not to make any changes to the Ordinance on fireworks based on previous reports from Douglas County Fire District No. 2. Mayor Lacy said he would like the Project Team to work on the Gateway Project, he noted the Q Councilmembers and Staff who are members of that team. Without objection, he set the first meeting of that group for May 26, 2016, at 6:30 p.m., to start working on that process. CONSENT CALENDAR Items listed below were distributed to Councilmember's in advance for study and were enacted in one motion. Council Action: A motion was made by Councilmember Barnhart, second by Councilmember Sterk, to approve the Consent Calendar as presented. The motion carried, 7-0. Consideration of Minutes — Regular Session, April 26, 2016 Consideration of Payables i. 2016 Pa,, ables — As of this date, May 10, 2016, Council does approve check numbers 45689 through 45690, and 45725 through 45780 in the total amount of $165,083.33. No payables checks were voided. Advertising Services Agreement with Town Toyota COUNCIL REPORT(S) Councilmember Barnhart said that as past Chairman of the Classy Chassis Parade, sitting on the City Council, and seeing all the work done for the Classy Chassis Parade, he thinks it is a slap in the face to the City of East Wenatchee for the Apple Blossom Festival to support a car show in the City of Wenatchee on Friday night. He said he would like his displeasure conveyed to them. Mayor Lacy noted that it has been conveyed more than once to all those associated with the Wenatchee event, and it doesn't seem to have any affect. He noted that a record was set this year with over 400 entries to the Classy Chassis Parade and Car Show. CITY OF EAST WENATCHEE COUNCIL MINUTES MAY 10, 2016 Councilmember Johnson noted that he represents the City of East Wenatchee on the Douglas County Solid Waste Council, and noted that at the last meeting there was a discussion regarding a request from Waste Management to import municipal solid waste from Vancouver, B.C. to the Greater Wenatchee Area Regional Landfill in Douglas County. He said the Technical Advisory Committee was not prepared to address the issue or make any recommendations, and postponed discussion until the May 24, 2016 meeting. He said he and informed the Solid Waste Board members that he wanted to get a Legal opinion on this, and has agreed to come up with a list of questions for the Douglas County Prosecuting Attorney, which he is formulating with help from Municipal Research Services Center (MRSC). He said he will forward any information he receives from MRSC, and the Douglas County Prosecuting Attorney regarding this issue to City Attorney Devin Poulson. He added that he would pass any questions and concerns from the City on to the Committee. Councilmember Barnhart said this is a good reason for the Council of Governments to meet and a good topic to discuss between the City of East Wenatchee, City of Wenatchee, Chelan County and Douglas County representatives. He said they have not had a meeting in a couple years, and this is a good topic to bring that group back together. Mayor Lacy said he would explore this with Mayor Kuntz, and other people that might have an interest in reconvening that group. Councilmember Johnson mentioned the Art on the Avenue Organization. He reviewed how it got started, the process of the Art on the Avenue Organization, and said it might be interesting to ask them to come and talk with us regarding doing something unique in East Wenatchee. No objections were heard. Councilmember Johnson said he will contact Art on the Avenue regarding a presentation to the City. The following reports/minutes were submitted in writing prior to the City Council meeting. • Councilmember Buckner — Minutes from the NCW Economic Development District (NCWEDD) Qmeeting held on April 13, 2016. • Mayor Steven C. Lacy — Minutes from the Chelan -Douglas Transportation Council meeting held on April 14, 2016. EXECUTIVE SESSIONS) At 7:36 p.m. Mayor Lacy called a 10 minute Executive Session regarding Potential Litigation. Council reconvened at 7:46 p.m. Council Action: A motion was made by Councilmember Johnson, second by Councilmember Barnhart, to authorize the Mayor to send a letter to Mr. Doug Duncan asserting the City's prescriptive rights with respect to Arbor Terrace, in front of Mr. Duncan's home, between 13t' and 15th Streets.
