BUDGET ISSUE(S) Finance Director Nick Gerde distributed and reviewed the Financial Report for February 2016. DEPARTMENT REPORT(S) Greg Pezoldt, Public Works Director, discussed smoking on the City Hall Campus. He noted the City Employee Handbook states under the "No Tobacco Use" Policy that; For health and safety considerations, the City prohibits tobacco use by employees in all City facilities, including City owned buildings, vehicles, and offices or other facilities rented or leased by the City, including individual employee offices. "Tobacco" includes any lit or unlit cigarette, cigar, pipe, blunt, bidi, clove cigarette and any other tobacco product, and spit tobacco, also known as smokeless tobacco, dip, chew and snuff, in any form. "Use" means the chewing, lighting, smoking and any other usage of any tobacco product. Discussion ensued regarding smoking outside, what is allowed under State Law, and what the City is able to enforce on City Hall Property. Mayor Lacy asked City Attorney Devin Poulson to further research the issue, and have it come back at a future Council meeting. CITY OF EAST WENATCHEE COUNCIL MINUTES March 8, 2016 MAYOR'S REPORT(S) Mayor Lacy thanked Councilmember Johnson for sending a letter to our local Legislators, and said he has also proposed a letter to Senator Linda Evans-Parlette outlining some of the reasons why the Municipal Research Services Center (MRSC) has been so valuable to the City, and asked that she exercise her influence to see that funds are not cut off to the MRSC in the future. Mayor Lacy said the City has had a month to month lease with a tenant on the property purchased for the Gateway Project. He noted that the City is now ready to start the design phase of that project, and without objection of the Council he would like to send the tenant a notice to vacate the property by May 31, 2016. No objection was heard. Mayor Lacy said a Sister City Board meeting is being held tonight to complete the delegation process. He said there are approximately 20 delegates going to Misawa, Japan this year, which will include all three of the Apple Blossom Royalty. Mayor Lacy said he would like to discuss the draft letter signed by local Douglas County Officials encouraging Legislators to include Phase 2 in the scope of work for the Eastside Corridor Project. He noted that at the February 9, 2016, Council meeting Councilmembers agreed by consensus to have the Mayor sign the letter. He said at the previous Chelan -Douglas Transportation Council (CDTC) retreat a discussion was held regarding project funding allocations made by the State Legislators, and they had concerns about attempting to change the allocation from what the Legislature had done. After seeing the draft letter that local officials have signed, he feels this would potentially conflict with other interests East Wenatchee has, specifically with respect to the configuration at the bottom of 9`h Street, as well as the potential risk that funding for Sunset Highway could be lost if we express to the Legislature that we did Q not like the way they allocated the funds. Mayor Lacy pointed out that the Legislature determined funding allocation based upon traffic and safety criteria, not economic development, which was the interest of Douglas County Officials, and the primary reason for the letter to Legislators. Upon receiving the draft letter he said he would not sign it until he brought it back to Council for discussion, and in the meantime they simply went ahead and revamped the letter without Mayor Lacy's signature and sent it out. He said his intent would still be to follow the direction of the Council if that is what they wish to do. He added that he invited Chelan Douglas Transportation Council (CDTC) Director Jeff Wilkins to this meeting to answer any questions. Jeff Wilkens, (CDTC) Executive Director, submitted and reviewed the Legislative Evaluation and Accountability Program (LEAP) Transportation Document 2016-1 as developed March 7, 2016, which lists all the projects funded by the gas tax increase. He said Mayor Lacy described effectively the concerns about being careful what you ask for, and if you open this up you might not get the outcome you are asking for. He said the House and the Senate have been working through their supplemental budget this year with some pretty big differences, this is the consensus negotiation between the House and the Senate on what should be the final supplemental budget, and it is pretty reasonable to expect that nothing will change. Mayor Lacy wanted it noted on the record that he supports the efforts of the North End Study Group 100%, he thinks that at some point we will get funding for the Cascade Interchange, Phase 2 of the Eastside Corridor Project, and is willing to voice that support in all future attempts to obtain funding for that project. Mayor Lacy stated his reasons for not signing the letter, and asked Council for their thoughts. Following Council discussion it was decided to go with the Mayor's recommendation to not send a letter to the Legislator's. However, Councilmember Johnson said he would like a letter sent to the other jurisdictions notifying them that the City Council supports the efforts of the North End Group. 2 CITY OF EAST WENATCHEE COUNCIL MINUTES March 8, 2016 CONSENT CALENDAR Items listed below were distributed to Councilmember's in advance for study and were enacted in one motion. Council Action: A motion was made by Councilmember Detering, second by Councilmember Sterk, to approve the Consent Calendar as presented. The motion carried, 6-0. 1. Consideration of Minutes — Regular Session, February 23, 2016 2. Consideration of Payables i. 2016 Pa,, a� — As of this date, March 8, 2016, Council does approve check numbers 45304 and 45326 through 45377 in the total amount of $79,826.34. Payables checks 45197 and 45316 were voided. ii. 2016 January Payroll As of this date, March 8, 2016, Council does approve check numbers 45058 through 45079; 45148 through 45170; 45212 through 45225; and direct deposits of $51,691.14 and $49,248.27 in the total amount of $410,292.08. No payroll checks were voided. ACTION ITEM(S) 16-03-01 Authorization for the Mayor to sign a lease agreement with Xerox for a Printer/Copier for the basement offices. Presented by: Greg Pezoldt, Public Works Director Council Action: A motion was made by Councilmember Detering, second by Councilmember McCourt, to authorize the Mayor to sign a 5-year lease agreement with Xerox. The motion carried, 5-0. 16-03-02 A recommendation to award the bid for the Paint Striping Machine. Presented by: Greg Pezoldt, Public Works Director Council Action: A motion was made by Councilmember Johnson, second by Councilmember Detering, to award the bid for a new road marking machine to Arrow Construction Supply in the amount of $39,459.45. The motion carried, 5-0. 16-03-03 Authorization for the Mayor to sign a Contract with David Kelts for Tour Guide Services to Misawa, Japan for the 2016 Misawa Delegation. Presented by: Steven C. Lacy, Mayor Council Action: A motion was made by Councilmember Sterk, second by Councilmember McCourt, to authorize the Mayor to sign the Agreement with David Kelts for Tour Guide Services. The motion carried, 5-0. COUNCIL REPORT(S) Councilmember Johnson suggested the City look into doing a beautification project adding such things as statues, bark, paintings, and foliage around the City of East Wenatchee. Mayor Lacy suggested that Councilmember Johnson schedule this on a future Council agenda for discussion, and suggestions on how to develop the project. CITY OF EAST WENATCHEE COUNCIL MINUTES March 8, 2016 Councilmember Barnhart asked if the new snow plows had been retrofitted. Greg Pezoldt said one of the } trucks has been retrofitted with a snow plow. Councilmember Barnhart also noted that a Presentation by Douglas County Fire District No. 2 has been scheduled for the next City Council meeting. The following reports/minutes were submitted in writing prior to the City Council meeting. • Councilmember Chuck Johnson — Minutes from the Douglas County Solid Waste Advisory Committee Meeting held on November 5, 2015. • Councilmember Harry Raab — Minutes from the Douglas County Solid Waste Advisory Committee meeting, and the Douglas County Solid Waste Council meeting held on February 4, 2016. • Councilmember Sandy McCourt — Minutes from the Housing Authority of Chelan County & the City of Wenatchee meeting held on January 28, 2016. ADDITIONAL INFORMATION City Attorney Devin Poulson submitted an article from the Powell Tribune regarding a project similar to what the City has discussed for the Gateway Project.
