PUBLIC COMMENT(S)
Calvin White, 4000 State Rt. 28, Rock Island, WA, said he has owned, operated, or sub -leased several
businesses on Valley Mall Parkway for many years, and wanted to go on record noting he has some real
serious concerns about losing a traffic lane on Valley Mall Parkway as part of the Bicycle Lane Proposal,
and the traffic congestion that would be generated due to that loss.
BUDGET ISSUE(S
Finance Director Nick Gerde distributed and reviewed the Budget Committee meeting minutes from
February 18, 2016.
CONSENT CALENDAR
Items listed below were distributed to Councilmember's in advance for study and were enacted in one
motion.
Council Action: A motion was made by Councilmember Detering, second by Councilmember Johnson,
to approve the Consent Calendar as presented. The motion carried, 7-0.
1. Consideration of Minutes — Regular Session, February 9, 2016
2. Consideration of Payables
i. 2016 Payables — As of this date, February 23, 2016, Council does
approve check numbers 45247 through 45303 in the total amount of
$126,177.49. Payables checks 45184 and 45237 were voided.

16-02-05 A recommendation to reject all bids for the Valley Mall Parkway LID Improvements
Project. Tabled from the previous Council meeting.
Presented by: Greg Pezoldt, Public Works Director
Council Action: A motion was made by Councilmember Barnhart, second by
Councilmember Johnson, to authorize City Council to reject all bids for the Valley Mall
Parkway LID Parking Lot Project. The motion carried, 7-0.
16-02-06 A recommendation to award the bid for the North Dolfay Lane Stormwater
Improvements to Smith Excavation.
Presented by: Greg Pezoldt, Public Works Director
Council Action: A motion was made by Councilmember Detering, second by
Councilmember Buckner, to approve and authorize the Mayor Pro Tempore to sign the
Contract with Smith Excavation, Inc. The motion carried, 7-0.
16-02-07 Approval of a Consultant Agreement with RH2 Engineers for the Highline Drive
Reconstruction Project.

Council Action: A motion was made by Councilmember Johnson, second by
Councilmember Detering, to approve and authorize the Mayor Pro Tempore to sign the
Highline Drive Consultant Agreement with RH2 Engineers for the Highline Drive
Project. The motion carried, 7-0.
Councilmember Barnhart suggested making a motion to complete the patch work that is
needed on Highline Drive until the project can be completed.
Council Action: A motion was made by Councilmember Barnhart, second by
Councilmember Detering, to authorize repair work on Highline Drive, and submit an
advertisement for bids not to exceed $20,000. The motion carried, 7-0.
Public Works Director Greg Pezoldt noted there will be a pre -pave meeting with the
Contractor for Valley Mall Parkway held on Thursday, February 25, 2016, and at that
time he will approach the Contractor about completing an asphalt patch on Highline
Drive.
16-02-08 Approval of a Consultant Agreement with PACE Engineers for the Baker Avenue
Reconstruction Project.

Council Action: A motion was made by Councilmember Detering, second by
Councilmember Raab, to approve and authorize the Mayor Pro Tempore to sign the
agreement with Pace Engineers for the Baker Avenue Project. The motion carried, 7-0.

nPublic Works Director Greg Pezoldt mentioned a previous discussion that was had with
the Department of Fish and Wildlife regarding negotiations to install a fish barrier at
Sand Canyon and Baker Avenue, and said he received a formal letter from the
Department of Fish and Wildlife stating that the City is not required to put in the fish
barrier.
Public Works Director Greg Pezoldt gave an update on the roundabout proposal on 9th
Street. He said the estimated cost for both roundabouts, one at Valley Mall Parkway and
one on SR28, would be approximately $2 million. The Washington State Department of
Transportation (WSDOT) Engineer was asked to refigure a lower amount in order to get
the cost lower to receive a successful grant. Greg reviewed the proposal, discussed why
roundabouts are more effective, and noted that if anyone has questions related to the
roundabouts to direct them to him.
Public Works Director Greg Pezoldt said he is distributing an informational letter from
the Mayor to all businesses and property owners along Valley Mall Parkway regarding
information about bike lanes and requesting feedback on the project so an informed
decision can be made, as the outcome of this informational letter is based on citizen
response. He noted that this will come up again at the last Council meeting in March.
Shayne Magdoff, resident on 11t" Street, East Wenatchee, suggested submitting another
article in the Wenatchee World regarding bike lanes, and said she is currently not
opposed to or in favor of bike lanes.
COUNCIL REPORT(S)
Councilmember Detering noted an article in the Wenatchee World about an annual Federal Government
Program for Small Transit Intensive Cities (STIC), of which LINK qualifies for. It has 6 Federal
performance standards to achieve, and if passed a grant fund award is given in the amount of $189,432 for
each of the six standards achieved. He said one of his duties is serving on the LINK Board of Directors,
and since 2007 LINK has met only 4 of the criteria annually, and by surpassing all 6 standards this year it
earned $378,864 extra for a total annual grant of nearly $1.4 million. He noted that not only is LINK
performing well they are actually providing levels of transit service far greater than characteristics would
typically suggest for a small City. He noted Link is one of the 13 transit services, out of the 300+ Cities,
that surpassed all six performance incentives, so this is quite an accomplishment.

• Councilmember John Sterk — Minutes from the Chelan -Douglas Health District Board of Health
meeting held on January 25, 2016.
EXECUTIVE SESSION — Contract Negotiations, Potential Litigation
At 7:22 p.m. Mayor Pro Tempore McCourt called a twenty minute Executive Session regarding potential
litigation, and Contract Negotiations, with action to follow.
Council reconvened at 7:38 p.m. City Attorney Devin Poulson stated that the City has received an offer
Settlement from Mr. Juan Zabala through his Attorney. Mr. Poulson is seeking the authority to make a
counter offer, and enter into negotiations with Mr. Zabala's Attorney.
Council Action: A motion was made by Councilmember Johnson, second by Councilmember Barnhart,
authorizing City Attorney Devin Poulson to negotiate this particular situation, and try to reach a
settlement.
