Recitals. 2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington; and 2.2. The City Council of East Wenatchee (“City Council”) finds that it is in the best interests of the City and its citizens to adopt the proposed amendments to the Greater East Wenatchee Area Comprehensive Plan (GEWA) Land Use Map and the Official Zoning Map. 2.3. Douglas County initiated a process for a site-specific comprehensive plan land use designation map amendment and rezone of three parcels of land approximately 6.7 acres in area from Residential High/Office Use (R-H) to General Commercial (G-C). 2.4. The Douglas County Planning Commission held a public hearing on November 14, 2018 and transmitted a recommendation of approval to this Board regarding the adoption of amendments of the Douglas County City of East Wenatchee Ordinance 2019-07 Page 2 of 6 Official Zoning Map and the Greater East Wenatchee Area Comprehensive Plan Map. 2.5. The Douglas County Board of Commissioners held a public meeting on Tuesday, January 22, 2019 in the Commissioners Chambers of the Courthouse, for the purpose of accepting testimony, entering findings into the record, and to take action to approve CPRZ-2018-03 with the unanimous adoption of Douglas County Ordinance TLS 19-03-01D. 2.6. The East Wenatchee Planning Commission held a public hearing on February 26, 2019 to consider the proposed map amendment (Douglas Co. File CPRZ 2018-03). The proposed map amendment received a recommendation of approval from the East Wenatchee Planning Commission with a unanimous vote in favor (Birks, Brawley, Hunter, Jessup, Johnson, Palmer, and Travis). 3. Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: 4. Purpose. The purpose of this ordinance is to amend the Land Use Map in the Greater East Wenatchee Area Comprehensive Plan to change the land use designation of three parcels of land from Residential High/Office Use (R-H) to General Commercial (G-C). This is a joint project with Douglas County. 5. Legal Description. There are three parcels totaling approximately 6.7 acres owned by Doyle Hansbrough (APN 40200005601), State of Washington (APN 40200005602), and the Chelan County PUD (APN 40200005604). The properties are located on SR 28, within Section 13, Township 22 N., Range 20 EWM, Douglas County. 6. Amendment. The City Council accepts the recommendation of the East Wenatchee Planning Commission and adopts the amendment to the Greater East Wenatchee Area Comprehensive Plan Map as depicted on Exhibit A to this Ordinance and incorporated by this reference. 7. Findings of Fact and Conclusions of Law. The City Council adopts the Recitals stated above as well as the findings of fact and conclusion of law as set forth below: 7.1. Findings of Fact 7.1.1. Douglas County has adopted the Greater East Wenatchee Area Comprehensive Plan pursuant to the Growth Management Act (GMA) and RCW Chapter 36.70A, and a series of subarea plans for each municipality in the county. These plans have been found to be City of East Wenatchee Ordinance 2019-07 Page 3 of 6 consistent with each other. 7.1.2. RCW Chapters 36.70 and 36.70A authorize the adoption of development regulations. 7.1.3. On September 10, 2018 Douglas County issued a Determination of Non- Significance pursuant to WAC 197-11 for amendments to the Douglas County Code. 7.1.4. Amendments to the development regulations, SEPA threshold determination and supporting documentation were sent to the Washington State Department of Commerce on September 11, 2018. 7.1.5. No written comments from agencies or the public were submitted during the review period. 7.1.6. The Notice of Public Hearing before the Planning Commission was published on September 13, 2018 in the Wenatchee World and Empire Press. 7.1.7. The Planning Commission conducted an advertised public hearing on November 14, 2018. The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. 7.1.8. The proposal is located within the "shoreline residential" shoreline environment. 7.1.9. The proposal is located within geologically hazardous critical areas. 7.2. Conclusions of Law: 7.2.1. The procedural and substantive requirements of the State Environmental Policy Act have been complied with. 7.2.2. The procedural requirements of RCW 36.70A have been complied with. 7.2.3. The proposed amendments are consistent with the Douglas County Regional Policy Plan, Greater East Wenatchee Area Comprehensive Plan, East Wenatchee Municipal Code, Douglas County Code and the Douglas County Regional Shoreline Master Program. 7.2.4. The proposed amendments are consistent with the requirements of Revised Code of Washington and the Washington Administrative Code. 8. Severability. If a court of competent jurisdiction declares any provision in this Ordinance to be contrary to law, such declaration shall not affect the validity of the other provisions of this Ordinance. 9. Publication. The City Council directs the City Clerk to publish a summary of this Ordinance. The summary shall consist of the title of this Ordinance.
