This settlement is entered into between the City of East Wenatchee
("City"), Teamsters Local 760 ("Union"), and William Redfield.
("Redfield") as a full and final settlement of the grievance filed by the
Union contesting the City's demotion of Redfield from the rank of
Sergeant to the rank of Patrol Officer 1st Class. The Parties desire to
resolve this grievance amicably and avoid the costs associated with
arbitration. .
In order to resolve this disputed claim, the parties hereby agree:
1. This Agreement settles Grievance No. FMCS 14106-50261.6 in its
entirety and the pending request for arbitration is deemed
withdrawn as of the date of this fully executed Agreement.
2. The Union agrees that it will not file any Unfair Practice Charges, as
it relates to this grievance.
3. This agreement does not create any precedent or establish any
practice.
4. This agreement is not to be construed as an admission of wrongdoing
or error on the part of the City or the Union in the exercise of their
rights under the Collective Bargaining Agreement.
5. For the purposes of this Agreement, there is no prevailing party.
6. Redfield shall remain in the rank of Patrol Officer ist Class at this
time.
7. Redfield's rate of pay from the date of his demotion up through
February 28, 2014 shall be at the Sergeant rate of pay. Thereafter,
Redfield shall be compensated at the contractual rate for a Patrol
Officer let Class.
8. The City shall remove the disciplinary investigation and notice of
discipline from Redfield's personnel file.
9. Redfield may apply for promotion in the future and neither the
incident underlying the demotion nor anything within the
disciplinary investigation referenced in paragraph 7 shall be
considered by the City as a factor when assessing Redfield for
promotion.
10. The arbitrator's cancelation fee shall be equally shared by the City
and the Union.
11. If a competent court of law determines any section of this
Agreement to be unlawful, such determination does not affect the
remaining terms and conditions of the Agreement.
