A dispute arose between the City of East Wenatchee ("City") and Mary Beth Holzerland, President of Local 846-W as to whether she was entitled to be paid for attending a Unit Clarification Hearing on May 19, 2010. 2. This dispute was grieved by Local 846-W, and heard by an arbitrator on November 4, 2010. 3. On November 4, 2010, the City became aware, for the first time, that Ms. Holzerland claimed that in addition to attending the Unit Clarification Hearing, she spent time working at her regular job duties. 4. As a result of an arbitration hearing that occurred on November 4, 2010, through counsel, Ms. Holzerland requested that the arbitrator award her eight hours of back pay. On November 30, 2010, Ms. Holzerland submitted a time sheet, verified by her Department Head, that she worked three hours on May 19, 2010 at her regular job duties. 6. The City has issued a check to Ms. Holzerland for these three hours. 7. The remaining dispute between the parties is whether Ms. Holzerland is entitled to be paid for the five hours she spent attending the Unit Clarification Hearing. 8. Accordingly, the parties agree that the City shall receive a three hour credit against any hours of back pay that may be awarded by the arbitrator.
