Recitals. 2.1. The City of East Wenatchee (“City”) is a non-charter code City duly incorporated and operating under the laws of the State of Washington; and 2.2. The City Council of East Wenatchee (“City Council”) finds that it is in the best interests of the City and its citizens to adopt the proposed amendments to the Greater East Wenatchee Area Comprehensive Plan (GEWA) Land Use Map and text for the Baker Flats Industrial Area. 2.3. Douglas County initiated a process for a site-specific comprehensive plan land use designation map amendment, expansion of the urban growth boundary, and rezone of three parcels of land approximately 26 acres in size from Commercial Agriculture 5 to General Industrial and amending the text relating to the size and location narrative for the Baker Flats Industrial Area within the Industrial Section of the Land Use Chapter (Ch. 3). City of East Wenatchee Ordinance 2019-10 Page 2 of 10 2.4. The Douglas County Planning Commission held a public hearing on January 9, 2019 and transmitted a recommendation of approval to Board of County Commissioners regarding the adoption of amendments of the Douglas County Official Zoning Map, the Greater East Wenatchee Area Comprehensive Plan Map and text, and the Douglas County Countywide Comprehensive Plan Map. 2.5. The Douglas County Board of Commissioners held a public meeting on Tuesday, February 5, 2019 in the Commissioners Chambers of the Courthouse, for the purpose of accepting testimony, entering findings into the record, and to take action to approve the proposed amendments with the unanimous adoption of Douglas County Ordinance TLS 19-06-11B. 2.6. The East Wenatchee Planning Commission held a public hearing on April 30, 2019 to consider the proposed map and text amendment (EW File CPA-ZC2018-05). The proposed amendments received a recommendation of approval from the East Wenatchee Planning Commission with a unanimous vote in favor (Birks, Brawley, Jessup, Johnson, Palmer, and Travis). 2.7. The City of East Wenatchee and Douglas County utilized a phased adoption process for amendments to the comprehensive plan. 2.8. This is a joint project with Douglas County and concludes the 2018 Annual Review and Update Cycle for the Greater East Wenatchee Area Comprehensive Plan. 3. Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: 4. Purpose. The purpose of this ordinance is to amend the Greater East Wenatchee Area Comprehensive Plan Land Use Map expanding the urban growth boundary and changing the designation of approximately 26 acres from Commercial Agriculture 5 to General Industrial and amending the text relating to the size and location narrative for the Baker Flats Industrial Area within the Industrial Section of the Land Use Chapter (Ch. 3). 5. Legal Description. There are three parcels totaling approximately 26 acres. One parcel is owned by Phillippi (APN 78000001800) and 2 parcels are owned by Lindell Family Investments, LLC (APN 78000001700) and (APN 78000001302). See Exhibit A for a map of the subject properties. The properties are located on US Hwy 2-97 and NW Cascade Ave, within Section 11 and 14, Township 23 N., Range 20 EWM, Douglas County. 6. Amendment. The City Council accepts the recommendation of the East Wenatchee Planning Commission and adopts the amendment to the Greater City of East Wenatchee Ordinance 2019-10 Page 3 of 10 East Wenatchee Area Comprehensive Plan Map as depicted on Exhibit A to this Ordinance and text as illustrated on Exhibit B to this ordinance. Both exhibits are incorporated by this reference. 7. Findings of Fact and Conclusions of Law. The City Council adopts the Recitals stated above as well as the findings of fact and conclusion of law as set forth below: 7.1. Findings of Fact 7.1.1. Adoption of amendments to the Douglas County Countywide Comprehensive Plan and the Douglas County Code (DCC) and the Greater East Wenatchee Comprehensive Plan to implement expansion of the industrial lands in the Greater East Wenatchee Area. 7.1.2. A comprehensive plan map amendment of the countywide plan and zone change of approximately 131 acres from Dryland Agriculture and Commercial Agriculture 10 to General Industrial expanding the Pangborn Industrial Service Boundary (ISB) to the north and east. 7.1.3. Amendments to the size narrative for urban growth boundaries found in the Population and General Land Use Chapter (Ch. 3) of the countywide plan. 7.1.4. A comprehensive plan map amendment and zone change/urban growth boundary amendment of approximately 26 acres from Commercial Agriculture 5 acres to General Industrial to the Baker Flats Industrial Area. 7.1.5. Amendments to the size and location narrative for the Baker Flats Industrial Area found in the Industrial Section of the Land Use Chapter (Ch. 3) of the Greater East Wenatchee Area Plan. 7.1.6. Douglas County and East Wenatchee have adopted a Comprehensive Plans pursuant to the Growth Management Act (GMA) and RCW Chapter 36.70A, which through a series of planning area Comprehensive Plans there were found to be consistent with each other and with the adopted GMA plans of the adjoining jurisdictions. 7.1.7. RCW Chapters 36.70 and 36.70A authorize the adoption of amendments the comprehensive plan and development regulations. 7.1.8. The Planning Commission is responsible for long range planning matters and providing implementation recommendations to assure compliance with the Growth Management Act. 7.1.9. Douglas County conducted a windshield survey for the inventory and quantification of the industrial lands that are developed, underutilized and vacant as a component of a industrial lands capacity analysis. This survey determined that only 34% of the land in the Pangborn Industrial City of East Wenatchee Ordinance 2019-10 Page 4 of 10 Service Boundary and 29% of the land in the Baker Flats Industrial Area are currently vacant. This low percentage of vacant land indicates a need for an expansion. 7.1.10. The industrial land capacity analysis identifies a need for 158.16 acres of additional industrial land to support the 2040 projected population. 7.1.11. The Douglas County Planning Commission reviewed the results of the windshield survey and land capacity analysis and discussed next steps at a public workshop on July 11, 2018. Notice of the workshop was emailed to the county’s interested parties list. 7.1.12. A General Industrial Expansion Property Owners Meeting was held in October 2018 and all property owners in the proposed expansion area boundaries were invited to attend. The purpose of the meeting was to inform property owners of the need to expand the industrial lands, explain how the potential change in zoning would affect their property and to solicit comment. The land in all of the expansion areas is owned by a total of 6 property owners. Five of these owners attended the meeting in October. All five owners expressed support of changing the zoning on their property. 7.1.13. Douglas County issued a Determination of Nonsignificance and Adoption of Existing Environmental Document for the proposed amendments in accordance with WAC 197-11-340(2) on November 7, 2018. The comment period ended on January 7, 2019. 7.1.14. Douglas County initiated a joint 60-day comment period with the City of East Wenatchee as required by RCW 36.70A.106 on November 8, 2018. The comment period concluded on January 7, 2019. 7.1.15. The Notice of Public hearing before the Planning Commission was published on December 27, 2018. 7.1.16. Notice of Public Hearing before the Douglas County Planning Commission was emailed to the county’s interested parties list and mailed to property owners in and surrounding the proposed expansion areas. 7.1.17. The Douglas County Planning Commission conducted an advertised public hearing on January 9, 2019. The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. 7.1.18. The Douglas County Regional Policy Plan establish that urban growth areas should include sufficient area to accommodate anticipated growth for projected land use needs for residential, recreational, commercial and industrial uses for the 20-year planning horizon. These City of East Wenatchee Ordinance 2019-10 Page 5 of 10 areas shall also be large enough to avoid market constraints that induce leapfrogging development. 7.1.19. The last comprehensive review of the industrial urban growth areas occurred in 2011. 7.1.20. The industrial areas within the Pangborn Industrial Service Boundary and the East Wenatchee Urban Growth Area do not contain sufficient land area to accommodate the estimated industrial growth for the 20-year projection. 7.1.21. With the exception of an old residential subdivision (Airway Acres) the Pangborn Industrial Service Boundary is surrounded by agricultural resource lands (AC-10, A-D). 7.1.22. There is a large amount of non-resource lands surrounding the Baker Flats Industrial Area; however, the rural lands to the east are a nearly vertical cliff and the Rural Essential Public Facility (Rocky Reach Dam complex) to the north is permanently utilized. 7.1.23. The Growth Management Act (RCW 36.70A) and the Douglas County Countywide Comprehensive Plan require an analysis to support the de-designation of agricultural lands. 7.1.24. Expansion into the agricultural resource lands is the only viable option for increasing the amount of available industrial land. 7.1.25. Douglas County has demonstrated through a reasoned process and analysis of existing conditions and data, adopted policies and minimum guidelines and statutes, that the expansion of the Pangborn Industrial Service Boundary and the East Wenatchee Urban Growth Area into designated agricultural lands of long term commercial significance is appropriate and necessary to accommodate the estimated industrial growth for the 20-year projection. 7.1.26. The Douglas County and East Wenatchee Planning Commissions have reviewed the entire record including the goals and policies of the comprehensive plan and public testimony as it relates to the proposed development regulations. 7.2. Conclusions: 7.2.1. The procedural and substantive requirements of the State Environmental Policy Act have been complied with. 7.2.2. The procedural requirements of RCW 36.70A have been complied with. 7.2.3. The proposed amendments are consistent with the Douglas County Regional Policy Plan, the Douglas County Countywide Comprehensive Plan and the Greater East Wenatchee Area Comprehensive Plan.
