Citizen Requests/Comments. Survey questions aimed at helping the group identified characteristics of the City that are within the City’s control—strengths and weaknesses—as well as external factors over which the City has no control—opportunities and threats. The group discussed the work progressing with Our Valley Our Future’s game changing initiative “One Community” and how that model can be used to collaborate with external partners. Further discussion led to group consensus on the value of continued, regular communications with public service partners. A group like the Community Leadership Advisory Group can provide relationship building, mutual trust and vision. There are opportunities for such a group to provide reporting back to participating entities and to operate under a memorandum of understanding that would lend greater weight to the group’s recommendations. o Big Hairy Audacious Goal or “BHAG”: In strategic planning, frequently there are multiple critical issues that surface from the SWOT analysis that can be broken down into manageable goals, objectives, and strategies. Sometimes one overarching issue dominates, and appears difficult to breakdown. This can inform a BHAG. The City’s lack of control of many of the services its citizens depend on (eg. water, sewer), and the critical nature of the relationships with the partners who provide those services are significant contributors to a BHAG. The group discussed this issue and the BHAG at length. 12:10 Break for Lunch 12:40 Meeting reconvened o Our Value Our Future (OVOF) SWOT Analysis: The group discussed OVOF stakeholder survey responses in comparison to the City’s above-mentioned SWOT analysis. o Review of a Draft Strategic Plan Template: 501 Consultants presented a draft Strategic Plan Template populated with statements taken from some of the City’s guiding documents to help inform Plan development. Project Development Manager Tom Wachholder provided a Public Works Department Report updating Council on all current projects which included information of an oil tank that was not closed in place on the Gateway Property. Mayor Lacy designated Community Development Director Lori Barnett to stay in touch with the Parks District and bring information to Council. Summary Title: An Ordinance of the City of East Wenatchee amending the Greater East Wenatchee Area Comprehensive Plan Land Use Map to change the land use designation of certain property located at 378 Eastmont Ave from Residential High/Office Use to Central Business District, containing a severability clause, and establishing an effect date. II. Background/History: CPA 2018-02: An application submitted by Lenka Slapnicka, Forte Architects, 240 N. Wenatchee Ave., Wenatchee, WA, on behalf of the property owner 302-312 Ninth St Holdings, LLC, for a land use map amendment in the Greater East Wenatchee Area Comprehensive Plan to change the designation of a .71-acre parcel from Residential High/Office to Central Business District. The subject property is located at 378 Eastmont Ave., East Wenatchee, WA. The property is currently improved with a single- family home and garage. The change in the comprehensive plan land use designation will allow the applicant to apply for a change in zoning to CBD. The property owner intends to expand and renovate the existing residence and convert it to a funeral service facility. It should be noted that a variance application was approved to allow the northside yard setback to be reduced from 15 feet to 5 feet. III.Planning Commission Recommendation: The East Wenatchee Planning Commission held a public hearing on February 26, 2019 to consider the proposed map amendment. The City Council of East Wenatchee (“City Council”) finds that it is in the best interests of the City and its citizens to adopt the proposed amendments to the Greater East Wenatchee Area Comprehensive Plan (GEWA) Land Use Map. 2.3. The application for the proposed amendment was submitted by Lenka Slapnicka, Forte Architects, on behalf of the property owner, 302-312 Ninth St Holdings, LLC. 2.4. The East Wenatchee Planning Commission held a public hearing on February 26, 2019 to consider the proposed map amendment (City File CPA 2018-02). The proposed map amendment received a recommendation of approval from the East Wenatchee Planning Commission with a unanimous vote in favor (Birks, Brawley, Hunter, Jessup, Johnson, Palmer, and Travis,). RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council toadopt ordinances of all kinds to regulate its municipal affairs and appropriate tothe good government of the City. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: 4.Purpose. The purpose of this ordinance is to amend the Land Use Map in theGreater East Wenatchee Area Comprehensive Plan to change the land usedesignation of property located at 378 Eastmont Ave from ResidentialHigh/Office Use to Central Business District. This is a joint project with DouglasCounty. 5.Legal Description. The legal description of the property is: Lot 1 of Binding SitePlan B2-95, in Douglas County, Washington, recorded April 2, 1996 in Book H ofShort Plats, Page 421. The subject property is within Section 11 Township 22 N.Range 20 E. W. M. Assessor’s Parcel Number 40100003508. 6.Amendment. The City Council accepts the recommendation of the EastWenatchee Planning Commission and adopts the amendment to the GreaterEast Wenatchee Area Comprehensive Plan Map as depicted on Exhibit A to thisOrdinance and incorporated by this reference. 7.Findings of Fact and Conclusions of Law. The City Council adopts the Recitalsstated above as well as the findings of fact and conclusion of law as set forthbelow: 7.1. Findings of Fact 7.1.1. A proposed amendment to the Greater East Wenatchee Area Comprehensive plan land use designation map to change the land use designation from Residential High/Office to Commercial Business District. The property currently has neighboring parcels to the south also designated as Commercial Business District. 7.1.2. The subject property is located at 378 Eastmont Ave., East Wenatchee, WA within Section 11 Township 22 N. Range 20 E. W. M and is Lot 1 of Binding Site Plan B2-95, in Douglas County, Washington. Assessor’s parcel number APN 40100003508. The fee owner is listed as 302-312 Ninth St Holdings, LLC. 7.1.3. The City of East Wenatchee and Douglas County have adopted the Greater East Wenatchee Area Comprehensive Plan in accordance with the provisions of the Growth Management Act and RCW Chapter 36.70A which covers the City and Douglas County unincorporated areas within the East Wenatchee Urban Growth Area Boundary. 7.1.4. The amendments under consideration are all part of the comprehensive plan 2018 Annual Update process. 7.1.5. The subject property is within the study area of the Greater East Wenatchee Area Comprehensive Plan (2018) and currently has a designation of Residential High/Office. 7.1.6. The subject property proposes to change the comprehensive Plan land use designation to Central Business District. 7.1.7. The Growth Management Act (GMA) requires comprehensive plans and development regulations to be consistent. 7.1.8. RCW Chapter 36.70A authorizes cities and counties to adopt and amend comprehensive plans and development regulations. 7.1.9. The planning commission is responsible for long-range planning matters and providing implementation recommendations to assure compliance with the GMA. 7.1.10. The proposal allows the applicant to apply for a change in zoning. 7.1.11. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed, and a Determination of Non-significance was issued on January 11, 2019 with a comment period ending on January 28, 2019. On January 13, 2019, the DNS was advertised in The Wenatchee World and the property was posted. No comments were received indicating that the proposed project would have a probable significant adverse impact on the environment. 7.1.12. Copies of the proposal and environmental documents were sent to the Washington State Department of Commerce on December 18, 2018 initiating the 60-day review process required by RCW 36.70A.106. The review period terminated on February 18, 2019. No comments were received from any state agency. 7.1.13. The East Wenatchee Planning Commission conducted a duly advertised public hearing on February 26, 2019. The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. 7.1.14. Any Finding of Fact that is more correctly a Conclusion of Law is hereby incorporated by this reference. 7.2. Conclusions of Law: 7.2.1. The proposed change in the comprehensive plan land use designation for the subject properties is consistent with and implements the goals 04/02/2019 Council Meeting Agenda Packet. Page 57 of 133 City of East Wenatchee Ordinance 2019-05 Page 4 of 7 and policies in the Greater East Wenatchee Area Comprehensive for designating the property for commercial business district. 7.2.2. The proposal is being processed in accordance with provisions of the Douglas County Regional Policy Plan. 7.2.3. The public involvement process for the proposed amendments meets the standards anticipated by RCW Chapter 36.70A.140 and Resolution 2010-06. The public involvement component included the opportunity for oral and written comment, and testimony at public hearings advertised by legal notice, and the news media. 7.2.4. It is the determination of the lead agency that no more than a moderate effect on the environment is a reasonable probability as a result of the proposed action. The proper exercise of the threshold determination process as required by WAC 197-11 is than an environmental impact statement is not required to be prepared for this project. 7.2.5. Proper legal requirements of RCW 36.70A.106, title 19 EWMC, and Chapter 17.100 EWMC were met and the community was given the opportunity to comment on the proposal at a duly noticed open record public hearing. 7.2.6. The proposed amendment has been processed in a manner consistent with the requirements of the Revised Code of Washington and the Washington Administrative Code. 7.2.7. Any Conclusion of Law that is more correctly a Finding of Fact is hereby incorporated by this reference. 8. Severability. If a court of competent jurisdiction declares any provision in this Ordinance to be contrary to law, such declaration shall not affect the validity of the other provisions of this Ordinance. 9. Publication. The City Council directs the City Clerk to publish a summary of this Ordinance. The summary shall consist of the title of this Ordinance. The City Council directs the City Clerk to publish a copy of this Ordinance on the City’s website. 10. Submittal of Notice of Adoption. In accordance with RCW 36.70A.106, this Ordinance shall be transmitted by the Community Development Director to the Washington State Department of Commerce within 10 days of adoption. 11. M and is Lot 1 of Binding Site Plan B2-95, in Douglas County, Washington. II.SITE INFORMATION A. Site Size: The subject property is approximately .71 acres in size. Site Characteristics: The subject property slopes down from Eastmont Avenue to 4th St. NE with a total grade difference of 18 feet. The steepest slope on the property is along the south boundary. There is an existing single-family home on the property that has a basement. The funeral services facility has a footprint of Exhibit 3 04/02/2019 Council Meeting Agenda Packet. The site will be landscaped in a typical residential manner. B. Neighborhood Characteristics: An aerial photo of the subject property and vicinity is included as Exhibit A. The neighborhood is a mix of single-family homes, multifamily apartments, retail sales, municipal offices and professional offices. The property is adjacent to properties zoned as Central Business District. North: Single-family and multifamily residential South: Professional offices and a retail garden center East: Single-family homes, apartments, professional offices, and the Douglas County Fire District headquarters West: Single-family homes and commercial uses III. PROJECT DESCRIPTION A. Historical: The subject property’s proposal to amend the GEWA Comprehensive Plan map designation is in conjunction with the property’s recent change in use. On October 12, 2018, a conditioned decision of approval was made by the City of East Wenatchee Hearing Examiner regarding a Conditional Use Permit and side yard setback Variance to operate a funeral chapel facility. Through the applicants proposal to not utilize body preparation service or cremation, but rather conduct administrative and viewing services only, the proposal’s impacts were interpreted to be similar to that of a church facility. The use as a funeral chapel facility was found to be in compliance with the Residential High Density/Office zoning district development regulations and associated conditional uses. The construction and full conversion of the existing single family residence into the funeral service facility is not complete at this time. There will be 3,075 square feet on the first floor for a reception area, offices, a selection room, restrooms, and a multipurpose room. There will be an 800 square foot attached garage. The basement will be expanded to 1,655 square feet for offices, a restroom and storage. The building will be wood frame construction. Extensive landscaping is proposed around the perimeter of the site, surrounding the building and within the parking lot. A site plan is attached as Exhibit B to this staff report. Exhibit C includes elevation drawings showing the proposed building from all angles. The applicant is intending to demolish the upper story of the existing building and retain the foundation/basement area. B. Circulation: The subject property is accessed from Eastmont Avenue. Eastmont Avenue is a north-south, public street, classified as a principal arterial. The street is fully improved with curb, gutter and sidewalks on both sides of the street with one travel lane in each direction and a continuous center, left-turn lane. Although the property has frontage on 4th St. NE, no vehicular access is permitted to that street in accordance with the prohibition stated on the recorded binding site plan. 04/02/2019 Council Meeting Agenda Packet. The driveway will be relocated to the south property line adjacent to the neighboring commercial use. A street cut permit and traffic control plan will be required. A parking lot for 30 vehicles will be constructed west of the structure. Due to the proposed use of the site, the parking configuration will be a series of aisles rather than a typical parking lot design. The garage will provide parking for business vehicles. IV. PROJECT ANALYSIS A. Comprehensive Plan: The subject property is within the study area of the Greater East Wenatchee Area Comprehensive Plan (GEWA Plan). The Comprehensive Plan designates the subject property, the properties east of Eastmont Avenue, and north and west of the subject property as suitable for residential high/office use. The properties south of the subject property are designated as central business district for commercial use. The GEWA Plan designations of adjacent properties are listed below and shown on Exhibit A. North: Residential high Density/Office (R-H) South: Central Business District (CBD) East: Residential high Density/Office (R-H) West: Residential high Density/Office (R-H) The following description for the residential high/office land use designation is from Chapter 3 – Land Use in the GEWA Plan: Residential High/Office Residential High/Office designation is a land use category that would allow a range of housing choices and a limited range of office style commercial opportunities for low intensity personal and professional services. This district is a transition designation providing a buffer between lower density land uses and higher intensity uses such as between residential and commercial uses or areas along major transportation routes where the intensity of activities on adjacent land make it less attractive for low density residential uses. Urban governmental services and infrastructure must be available at the time of development or there must be a plan in place, with funding, to insure that a full range of urban governmental services is available to serve the development. The Residential High/Office designation should be applied in areas along existing or planned arterial/collector transportation corridors and areas adjacent to commercial nodes. Development of this land use type should adhere to design standards to achieve compatible scale and design to enhance the livability and appearance of the community. These projects should be configured to be transit- oriented, pedestrian friendly, and provide affordable housing. This 04/02/2019 Council Meeting Agenda Packet. (Page 33) The subject property proposes to change the GEWA land use designation from Residential High Density/Office (R-H) to Central Business District (CBD). This proposed change in comprehensive plan designation would match the properties bordering to the south also designated as Central Business District (CBD). The following description for the commercial business district land use designation is from Chapter 3 – Land Use in the GEWA Plan: Central Business District The Central Business District generally follows a north to south direction as it follows Valley Mall Parkway and a west to east direction as it follows Grant Road. To ensure commercial development is compatible with surrounding uses and the general character of the community, design criteria has been developed that promotes street trees along major corridors, and stresses architectural and landscaping design to create pleasant and attractive developments. New development should be designed to be transit oriented, pedestrian friendly, and provide open spaces. Within the CBD there are existing land uses that are not permitted under the existing zoning regulations for that district. The CBD designation should be analyzed periodically during the development of the zoning districts regulations to determine the appropriate land uses for various locations. In the future, it may be appropriate to separate this district into smaller sub-districts to better address the particular land uses that currently exist and to insure that existing and proposed land uses are compatible. This analysis should also evaluate the infrastructure existing and planned for those areas with regards to the needs of the particular land uses. (Page 35) The following goals and policies in the comprehensive plan relate to the proposed project. Chapter 3 Land Use Goals: 3. Establish commercial areas that accommodate a variety of land use activities to support a diverse and stable economic base while maintaining the quality of life in the community and the natural environment. 4. Provide an opportunity for mixed-use areas in locations where residential and commercial land uses can develop in a manner that is complimentary to neighboring properties and/or will establish and sustain unique character areas for individual neighborhoods. Policies: C-2. Commercial development should provide well designed buffer areas to insure that the land use is complimentary and compatible with adjacent land uses. 04/02/2019 Council Meeting Agenda Packet. The standards should address landscaping, pedestrian access, vehicular access, traffic control, signage and other amenities ensuring that commercial uses will enhance and contribute to the natural attractiveness of the community. C-7 Promote appropriately buffered multi-family residential and office development compatible with existing and potential commercial activities. Such uses should be permitted as transition between high-intensity uses (e.g. commercial) and low-intensity uses (e.g. single-family residential). C-8 Require interior and perimeter landscaping which will provide an attractive entrance environment for commercial development, soften parking lots, provide shade, and screen unsightly areas. C-13 Expand commercial uses adjacent to existing similarly developed areas. Chapter 4 Housing Goals: 2. To maintain quality of life in residential neighborhoods by protecting residential properties from excessive noise, visual, air and water pollution. 4. To provide opportunities for a mixture of commercial and residential land uses developed in a coordinated and complimentary manner in designated mixed use areas. T-7 Ensure that current and future developments provide proper, adequate and safe access to the transportation system and facilities. • Provision for adequate parking must be included for all development • Natural and artificial landscaping should be considered in the design of system facilities • Traffic calming techniques should be required when there are conflicts between transportation modes. B. Comprehensive plan amendments require an analysis of the impact of the proposed change in relation to neighboring properties and the general plan of development for the community. While the Municipal Code does not contain specific criteria to be used in evaluating proposals to change land use designations, the general practice is to consider the following questions: 1. What is the current use of the site? Applicant’s Response: The site is currently used as a residential rental. 2. Please describe adjacent land uses in all directions around the subject property. Applicant’s Response: The sites north of the proposed property are currently residential homes. There is a fire station to the east of the property and a commercial nursey just south of the proposed property. A residential subdivision through-street sits just west of the proposed property as well. 3. A detailed statement how the proposed amendment is consistent with the Growth Management Act (RCW 36.70A), the Greater East Wenatchee Area Comprehensive Plan, and applicable policies in the Douglas County Regional Policy Plan. Applicant’s Response: The proposed property falls within the City of East Wenatchee, which is part of the Urban Growth Area. Additionally, the property is adjacent to public transportation, which provides ease of use to patrons of the proposed property, as well as encourages those patrons to utilize this service. The property is not located in any critical areas and will not negatively affect them with the proposed infrastructure. 4. (RCW35.70A), the Greater East Wenatchee Area Comprehensive Plan, and applicable policies in the Douglas County Regional Policy Plan. Applicant’s Response: The proposed site fits the goals and vision of the Greater East Wenatchee comprehensive plan. Specifically, this proposed site will enhance the adjacent residential area, while also adding beauty to the Commercial Business District. This proposed site will add several jobs in the City of East Wenatchee and the site encourages pedestrian foot traffic by the use of pedestrian right- of-ways as well as create ease of use for public transportation. 5. A detailed statement explaining why the proposed land use designation is more appropriate for the site than the existing land use designation. Applicant’s Response: The proposed site is currently a residential rental in the Residential High zone, but will cease to 04/02/2019 Council Meeting Agenda Packet. Page 70 of 133 Staff Report CPA2018-01 Chapel of the Valley February 26, 2019 Page 7 fit this category in the near future as the tenants are vacating the property. The owner proposes to demolish the current above-grade structure to assembly occupancy for chapel gatherings, while retaining the current below-grade infrastructure for business occupancy. The adjacent properties to the south fall within the Central Business District, and although the proposed property passes the conditional use, it will be better suited to permanently be adopted into the Central Business District. Since this structure is being built to suit, there are no appropriate sites within the Central Business District to fit the space needs of the structure as well as give ease of access for patrons. 6. A statement explaining how the site is suitable for the proposed designation and that there is a lack of appropriately designated alternative sites in the vicinity. Applicant’s Response: The current site is most suitable for the proposed designation because it supplies the needed size requirements, off-street parking, and location for the needs of the owner and proposed building. The location is easily accessible to patrons of the facility and is adjacent to commercial businesses. The proposed building will add much needed architectural interest to the area and will be visually appealing on one of the highly active roadways in East Wenatchee, while keeping a low-profile to fit in with the residential buildings adjacent to the site. Other sites in this vicinity do not meet this need, both in location exposure/accessibility and desired size. 7. Will the proposed amendment adversely affect lands designated as resource lands of long term commercial significance or critical areas? Applicant’s Response: The proposed amendment will in no way adversely affect lands designated as resource lands of long term commercial significance or critical areas. 8. Are public facilities, infrastructure and transportation systems present to serve the intended land use amendment or have provisions been made in accordance with the EWMC to provide the necessary facilities? Applicant’s Response: The site is closely located to public transportation, emergency services, dining establishments, and public-right-of-ways. There will be no need to provide and additional facilities. C. Staff comments addressing the findings: 1. As mentioned in Section IV(A) above, the proposal is compatible with and implements the comprehensive plan goals and policies. 2. The design of the facility is similar in character to the residences in the surrounding neighborhood. 04/02/2019 Council Meeting Agenda Packet. The landscaping and design of the proposal ensures there will not be a negative impact to the surrounding neighborhood. 4. The R-H District permits up to 24 dwelling units per acre. Traffic generated by multifamily housing averages 6.10 average daily trips (ADT). The subject property could accommodate 17 apartments which could generate 104 ADT or 10 peak hour trips. The proposed project has sporadic periods of 20 to 30 vehicles per hour. Although generating a higher hourly trip rate, the anticipated trip hours would typically not be AM or PM peaks and would therefore be unlikely to impact the traffic patterns in the neighborhood. 5. As mentioned previously, water, sewer, irrigation water, and power are all available to the subject property. 6. Given that this area is a mix of uses and the property is located on a high traffic corridor, the proposed use, as conditioned will not have an adverse impact on the neighbors. 7. The proposal has been designed to fit in with the neighborhood. The parking area is in the center of the property minimizing the visual impact to the neighbors. The driveway has been relocated to the south side of the property and away from the residential properties to the north. 8. The site has been designed with extensive landscaping along the perimeter and within the parking area effectively screening the site and providing a residential character to the facility. The proposed project complies with all the criteria listed above. C. Countywide Planning Policies. The Growth Management Act (GMA) is structured in a way that not only encourages but also requires local governments to work together to address common issues. One of the first tasks mandated by the GMA was for counties to work with their cities and towns to establish countywide planning policies as a framework of policies to direct the adoption and amendment of comprehensive plans and development regulations. Douglas County’s countywide planning policy is the Douglas County Regional Policy Plan (Policy Plan). The Policy Plan contains policies specific to the adoption and amendment of comprehensive plans and development regulations. Proposed amendments to the comprehensive plan, which do not include a change to the urban growth area boundary, and amendments to development regulations are to be processed by the respective city or town and, after adoption, transmitted to Douglas County for processing. D. Environmental Review: An Environmental Checklist was prepared on July 9, 2018. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed, and a Determination of Non-significance was issued on January 11, 2019 with a comment period ending on January 28, 2019. On January 13, 2019, the DNS was advertised in The Wenatchee World and the property was posted. E. State Review: RCW 36.70A.106 requires submittal of amendments to comprehensive plans and development regulations to the Washington State 04/02/2019 Council Meeting Agenda Packet. Page 72 of 133 Staff Report CPA2018-01 Chapel of the Valley February 26, 2019 Page 9 Department of Commerce (Commerce) for a 60-day review. The proposal was submitted to Commerce on December 18, 2018. The 60-day review period terminated on February 18, 2019. No comments were received from Commerce or other agencies receiving the proposed amendment documents. F. Public Comments: A Notice of Public Hearing was published in The Wenatchee World and sent to the property owners within 300 feet of the subject property on February 15, 2019. V. PLANNING SUMMARY Planning Staff Comments: Staff offers findings of fact and conclusions in Section VI of this Staff Report for consideration by the Planning Commission. The statements in that section may be modified by the Planning Commission as appropriate to support the decision and recommendation to the City Council. The properties south of the subject parcel are zoned and designated as Central Business District as well as much of the area extending east and west there after. The existing zoning classification provides a transition between residential uses and commercial uses due to the Residential High Density/Office district permitting uses for personal and professionals offices. Included with the chapel facility’s proposal, the applicant has made efforts to retain residential qualities although intending to use the property for professional services. Through residential-like landscaping, parking and vehicle access adjustments the property should have less impact on the surrounding residences. Maintaining these residential-like qualities provides an appropriate transition between the two land use types and allows for the full utilization of a parcel for a less intensive commercial use. Based on the above analysis, staff recommends approval of the proposed Comprehensive Map Designation Amendment. VI. SUGGESTED FINDINGS OF FACT AND CONCLUSIONS A. FINDINGS OF FACT 1. A proposed amendment to the Greater East Wenatchee Area Comprehensive plan land use designation map to change the land use designation from Residential High/Office to Commercial Business District. The property currently has neighboring parcels to the south also designated as Commercial Business District. 2. The subject property is located at 378 Eastmont Ave., East Wenatchee, WA within Section 11 Township 22 N. Range 20 E. W. M and is Lot 1 of Binding Site Plan B2-95, in Douglas County, Washington. Assessor’s parcel number APN 40100001709. The fee owner is listed as East Wenatchee Investments, LLC. 3. The subject property is within the study area of the Greater East Wenatchee Area Comprehensive Plan (2018) and currently has a designation nof Residential High/Office. 6. The subject property proposes to change the comprehensive Plan land use designation to Central Business District. 7. The Growth Management Act (GMA) requires comprehensive plans and development regulations to be consistent. 8. RCW Chapter 36.70A authorizes cities and counties to adopt and amend comprehensive plans and development regulations. 9. The planning commission is responsible for long-range planning matters and providing implementation recommendations to assure compliance with the GMA. 10. The proposal allows the applicant to apply for a change in zoning. 11. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed, and a Determination of Non- significance was issued on January 11, 2019 with a comment period ending on January 28, 2019. On January 13, 2019, the DNS was advertised in The Wenatchee World and the property was posted. No comments were received indicating that the proposed project would have a probable significant adverse impact on the environment. 12. Copies of the proposal and environmental documents were sent to the Washington State Department of Commerce on December 18, 2018 initiating the 60-day review process required by RCW 36.70A.106. The review period terminated on February 18, 2019. No comments were received from any state agency. 13. The East Wenatchee Planning Commission conducted a duly advertised public hearing on February 26, 2019. The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. 14. Any Finding of Fact that is more correctly a Conclusion of Law is hereby incorporated by this reference. 15. Public testimony was taken at the hearing. The main concerns expressed were: CONCLUSIONS 1. The public involvement component included the opportunity for oral and written comment, and testimony at public hearings advertised by legal notice, and the news media. 4. It is the determination of the lead agency that no more than a moderate effect on the environment is a reasonable probability as a result of the proposed action. The proper exercise of the threshold determination process as required by WAC 197-11 is than an environmental impact statement is not required to be prepared for this project. 5. Proper legal requirements of RCW 36.70A.106, title 19 EWMC, and Chapter 17.100 EWMC were met and the community was given the opportunity to comment on the proposal at a duly noticed open record public hearing. 6. The proposed amendment has been processed in a manner consistent with the requirements of the Revised Code of Washington and the Washington Administrative Code. 7. This proposal does not include a change in land use or construction of additional buildings on the property. B. Neighborhood Characteristics: The neighborhood is a mix of residential and commercial uses. The subject property is in the Eastmont Plaza which is a professional office and recreational complex occupying a converted school property. DESCRIPTION OF PROPOSAL A. Design: The proposal under consideration is a non-project action. No change in use or construction of any structures are proposed. A Vicinity Map with an aerial photo showing the subject property and vicinity has been included with this staff report as Exhibit A. The subject property is part of a personal and professional office complex with the converted old Eastmont Junior High School. The subject property is located on part of the old playground site. B. Circulation: The subject property has frontage on 9th Street NE. The property is part of a complex that uses joint access and parking. There is a driveway to 9th St. and to Colorado Avenue. 1. 9th Street NE is an east-west, public street classified as an arterial. The street is fully improved with curbs gutters and sidewalks. There is a Link public transit stop near the property on 9th. 2. Colorado Ave. is a north-south, public street that is classified as local access. The street is paved with no curbs gutters or sidewalks within a right of way that varies in width from 50 to 30 feet. IV. ANALYSIS OF PROPOSAL A. Comprehensive Plan: The Greater East Wenatchee Area Comprehensive Plan (GEWA Plan) was adopted by the city of East Wenatchee and Douglas County. The GEWA Plan has been amended several times, most recently in 2018. The subject property currently has a split designation with part of the property designated Low Residential and part of it designated as Residential High/Office. The GEWA Plan designations of adjacent properties are listed below and shown on Exhibit A. North: Medium Density Residential South: High Density Residential/Office East: Low Density Residential and High Density Residential/Office West: High Density Residential/Office Background: The 1998 East Wenatchee Comprehensive Plan designated the entire area between Baker Ave. and Eastmont Ave, south of 9th St., as residential high/office. During the process of changing the zoning, to be consistent with the comprehensive plan designation, the property owners along N. Devon Ave. – south of 9th St. NE - objected to the change due to the narrow street. They were concerned that residential high density development would adversely impact their street since there was a lot over one acre in size at the corner of 8th St. NE (a short cul-de-sac) and N. Devon Ave that could potentially have 24 dwelling units on it based upon the allowed density. That lot is addressed as 824 N. Devon Ave. The City agreed and created an island of low residential for all properties fronting on N. Devon Ave. However, the entire junior high school site remained 04/02/2019 Council Meeting Agenda Packet. Page 93 of 133 Staff Report CPA/ZC 2018-04 EW Investments Page 3 within the residential high/office designation and the zoning was then changed to Residential High Density/Office for that property. In 2007, a boundary line adjustment was completed reducing the size of the 824 N. Devon Ave. lot and increasing the old junior high school site property. It should be noted that the portion of the 824 N. Devon Ave lot that was combined with the school site was substantially lower in elevation than the street and at the same grade as the junior high school playground site. Subsequently, the Eastmont Plaza project was developed on the property with the conversion of the old gym to a commercial recreation facility, the conversion of the old junior high school to offices, and the construction of the office/storage building on the subject property. The development of the site was followed with the processing of a short plat creating individual lots for all the buildings within that complex. Unfortunately, no one realized that part of the Eastmont Plaza site had remained within the low residential designation. The proposed amendment will correct that error. The following description of the residential high/office land use designation is from Chapter 3 – Land Use in the GEWA Plan: Residential High/Office The Residential High/Office designation is a land use category that would allow a range of housing choices and a limited range of office style commercial opportunities for low intensity personal and professional services. This district is a transition designation providing a buffer between lower density land uses and higher intensity uses such as between residential and commercial uses or areas along major transportation routes where the intensity of activities on adjacent land make it less attractive for low density residential uses. Urban governmental services and infrastructure must be available at the time of development or there must be a plan in place, with funding, to ensure that a full range of urban governmental services is available to serve the development. The Residential High/Office designation should be applied in areas along existing or planned arterial/collector transportation corridors and areas adjacent to commercial nodes. Development of this land use type should adhere to design standards to achieve compatible scale and design to enhance the livability and appearance of the community. These projects should be configured to be transit-oriented, pedestrian friendly, and provide affordable housing. This land use designation is also intended to provide a location for low intensity office space. Residential densities allowed in the Residential High/Office land use category should be up to 24 dwelling units per acre with a target density of at least 8 dwelling units per acre. (Pages 33-34 GEWA Plan) The following goals in the GEWA Plan support the development pattern and intensity represented by the use of the subject property. 04/02/2019 Council Meeting Agenda Packet. Page 94 of 133 Staff Report CPA/ZC 2018-04 EW Investments Page 4 Chapter 3 - Land Use Goal 4: Provide an opportunity for mixed-use areas in locations where residential and commercial land uses can develop in a manner that is complimentary to neighboring properties and/or will establish and sustain unique character areas for individual neighborhoods. Chapter 4 - Housing Goal 4: To provide opportunities for a mixture of commercial and residential land uses developed in a coordinated and complimentary manner in designated mixed-use areas Comprehensive plan amendments require an analysis of the impact of the proposed change in relation to neighboring properties and the general plan of development for the community. 1. How is the proposed amendment consistent with the Growth Management Act (GMA) (RCW 36.70A), the Greater East Wenatchee Area Comprehensive Plan, and applicable policies in the Douglas County Regional Policy Plan. Response: The subject property is a logical extension of the residential high/office designation since it is physically isolated from the low residential designated properties on N. Devon Ave. The comprehensive plan envisions this designation as a buffer between low intensity residential and commercial designations. Other than the island of low-residential along N. Devon Ave, the general area on the south side of 9th St. NE is designated as residential high/office. The proposal is consistent with the intent in the comprehensive plan to allow low intensity office space within the residential high/office designation. is consistent with the intent of the comprehensive plan for the designation of lands for residential high/office development. The GMA and Douglas County Regional Policy Plan have no specific policies or requirements for land use designation changes. 2. Why is the proposed land use designation more appropriate for the site than the existing land use designation? Response: The original reason for the low residential designation was to limit the intensity of development that would use N. Devon Ave. for access. As mentioned previously, the property is fully developed. The subject property is only accessed from 9th St. NE or Colorado Ave and as such, the proposed change will have no adverse traffic impact on N. Devon Ave. As noted above, part of the subject property is already designated for residential high/office use. The proposed amendment will eliminate the inconsistency with the dual designation of the subject property. 3. How is the site suitable for the proposed designation and is there is a lack of appropriately designated alternative sites in the vicinity? Response: The site is currently being used for low intensity office space which is one of the purposes intended for the residential high/office designation according to the description in the GEWA Plan. The site is suitable for the proposed land use designation since it is part of the Eastmont Plaza complex utilizing shared driveways, parking, and landscaping. This is a logical expansion of the residential high/office designation that surrounds the subject property. 04/02/2019 Council Meeting Agenda Packet. Will the proposed amendment adversely affect lands designated as resource lands of long-term commercial significance or critical areas? Response: No, there are no resource lands of long-term commercial significance or critical areas on the subject property or in the vicinity. 5. Are public facilities, infrastructure and transportation systems present to serve the intended land use amendment or have provisions been made in accordance with the EWMC to provide the necessary facilities? Response: Yes, all public facilities are available to the site. The property has been developed with an on-site stormwater system and a blanket easement for access and parking. The re-development of the old junior high school into low intensity personal and professional offices created a mixed-use pattern of development that preserves the character of the adjoining neighborhood. The proposal is consistent with the description of the residential high/office designation and implements the goals in the GEWA Plan for a mixture of residential and commercial uses. B. Zoning: The property currently has a split designation with part of the property designated Residential Low Density (R-L) and part of it designated as Residential High Density/Office (R-H). Exhibit A to this staff report is a Vicinity Map showing the proposed rezone area and the existing designations of the subject property and neighboring properties. North: Residential Medium Density (R-M) South: Residential High Density/Office East: Residential Low Density and Residential High Density/Office West: Residential High Density/Office The R-H District permits all uses allowed in the R-L and R-M District as well as general and professional offices. Section IV(A) above explains how the property has been developed and the issue with the dual designations. The proposal under consideration will change the zoning as well as the comprehensive plan designation. C. Countywide Planning Policies. The Growth Management Act (GMA) is structured in a way that not only encourages but also requires local governments to work together to address common issues. One of the first tasks mandated by the GMA was for counties to work with their cities and towns to establish countywide planning policies as a framework of policies to direct the adoption and amendment of comprehensive plans and development regulations. Douglas County’s countywide planning policy is the Douglas County Regional Policy Plan (Policy Plan). The Policy Plan contains policies specific to the adoption and amendment of comprehensive plans and development regulations. Proposed amendments to the comprehensive plan, which do not include a change to the urban growth area boundary, and amendments to development regulations are to be processed by the respective city or town and, after adoption, transmitted to Douglas County for processing. D. Environmental Review: An Environmental Checklist was prepared on January 11, 2019. A threshold determination and environmental review pursuant to RCW 04/02/2019 Council Meeting Agenda Packet. Page 96 of 133 Staff Report CPA/ZC 2018-04 EW Investments Page 6 43.21C the State Environmental Policy Act was completed, and a Determination of Non-significance was issued on January 11, 2019 with a comment period ending on January 28, 2019. On January 13, 2019, the DNS was advertised in The Wenatchee World and the property was posted. E. State Review: RCW 36.70A.106 requires submittal of amendments to comprehensive plans and development regulations to the Washington State Department of Commerce (Commerce) for a 60-day review. The proposal was submitted to Commerce on December 18, 2018. The 60-day review period terminated on February 18, 2019. No comments were received from Commerce or other agencies receiving the proposed amendment documents. F. Public Comments: A Notice of Public Hearing was published in The Wenatchee World and sent to the property owners within 300 feet of the subject property on February 15, 2019. V. PLANNING SUMMARY Planning Staff Comments: Staff offers findings of fact and conclusions in Section VI of this Staff Report for consideration by the Planning Commission. The statements in that section may be modified by the Planning Commission as appropriate to support the decision and recommendation to the City Council. VI. SUGGESTED FINDINGS OF FACT AND CONCLUSIONS A. FINDINGS OF FACT 1. Douglas County and East Wenatchee coordinate in long-range planning within the Greater East Wenatchee Area. This is a joint process with Douglas County. The amendments under consideration are all part of the comprehensive plan 2018 Annual Update process. 6. RCW Chapter 36.70A authorizes cities and counties to adopt and amend comprehensive plans and development regulations. 10. The planning commission is responsible for long-range planning matters and providing implementation recommendations to assure compliance with the GMA. 11. The proposal is an extension of an adjacent residential high/office land use designation and zoning designation. 12. A threshold determination and environmental review pursuant to RCW 43.21C the State Environmental Policy Act was completed, and a Determination of Non- significance was issued on January 11, 2019 with a comment period ending on January 28, 2019. On January 13, 2019, the DNS was advertised in The Wenatchee World and the property was posted. No comments were received indicating that the proposed project would have a probable significant adverse impact on the environment. 13. Copies of the proposal and environmental documents were sent to the Washington State Department of Commerce on December 18, 2018 initiating the 60-day review process required by RCW 36.70A.106. The review period terminated on February 18, 2019. No comments were received from any state agency. 14. The East Wenatchee Planning Commission conducted a duly advertised public hearing on February 26, 2019. The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. 15. Any Finding of Fact that is more correctly a Conclusion of Law is hereby incorporated by this reference. 16. Public testimony was taken at the hearing. The main concerns expressed were: CONCLUSIONS 1. The proposed change in the zoning and comprehensive plan land use designation for the subject properties is consistent with and implements the goals and policies in the Greater East Wenatchee Area Comprehensive for designating property for residential high/office use. 2. The proposal is being processed in accordance with provisions of the Douglas County Regional Policy Plan. 3. The public involvement process for the proposed amendments meets the standards anticipated by RCW Chapter 36.70A.140 and Resolution 2010-06. Proper legal requirements of RCW 36.70A.106, title 19 EWMC, and Chapter 17.100 EWMC were met and the community was given the opportunity to comment on the proposal at a duly noticed open record public hearing. 6. The proposed amendment has been processed in a manner consistent with the requirements of the Revised Code of Washington and the Washington Administrative Code. 7. The proposal does not amend the City’s Zoning Map. However, a change was made to the Douglas County Official Zoning Map consistent with the comprehensive plan land use map amendment. All three properties are located on SR 28, south of the East Wenatchee City Limits. III.Planning Commission Recommendation: The East Wenatchee Planning Commission held a public hearing on February 26, 2019 to consider the proposed map amendment. The Douglas County Board of Commissioners held a public meeting on Tuesday, January 22, 2019 in the Commissioners Chambers of the Courthouse, for the purpose of accepting testimony, entering findings into the record, and to take action to approve CPRZ-2018-03 with the unanimous adoption of Douglas County Ordinance TLS 19-03-01D. 2.6. The East Wenatchee Planning Commission held a public hearing on February 26, 2019 to consider the proposed map amendment (Douglas Co. File CPRZ 2018-03). The proposed map amendment received a recommendation of approval from the East Wenatchee Planning Commission with a unanimous vote in favor (Birks, Brawley, Hunter, Jessup, Johnson, Palmer, and Travis). 3. Authority. RCW 35A.11.020 and RCW 35A.12.190 authorize the City Council to adopt ordinances of all kinds to regulate its municipal affairs and appropriate to the good government of the City. THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS: 4. Purpose. The purpose of this ordinance is to amend the Land Use Map in the Greater East Wenatchee Area Comprehensive Plan to change the land use designation of three parcels of land from Residential High/Office Use (R-H) to General Commercial (G-C). This is a joint project with Douglas County. 5. Legal Description. There are three parcels totaling approximately 6.7 acres owned by Doyle Hansbrough (APN 40200005601), State of Washington (APN 40200005602), and the Chelan County PUD (APN 40200005604). The properties are located on SR 28, within Section 13, Township 22 N., Range 20 EWM, Douglas County. 6. Amendment. The City Council accepts the recommendation of the East Wenatchee Planning Commission and adopts the amendment to the Greater East Wenatchee Area Comprehensive Plan Map as depicted on Exhibit A to this Ordinance and incorporated by this reference. 7. Findings of Fact and Conclusions of Law. The City Council adopts the Recitals stated above as well as the findings of fact and conclusion of law as set forth below: 7.1. Findings of Fact 7.1.1. Douglas County has adopted the Greater East Wenatchee Area Comprehensive Plan pursuant to the Growth Management Act (GMA) and RCW Chapter 36.70A, and a series of subarea plans for each municipality in the county. RCW Chapters 36.70 and 36.70A authorize the adoption of development regulations. 7.1.3. On September 10, 2018 Douglas County issued a Determination of Non- Significance pursuant to WAC 197-11 for amendments to the Douglas County Code. 7.1.4. Amendments to the development regulations, SEPA threshold determination and supporting documentation were sent to the Washington State Department of Commerce on September 11, 2018. 7.1.5. No written comments from agencies or the public were submitted during the review period. 7.1.6. The Notice of Public Hearing before the Planning Commission was published on September 13, 2018 in the Wenatchee World and Empire Press. 7.1.7. The Planning Commission conducted an advertised public hearing on November 14, 2018. The Planning Commission entered into the record the files on this amendment, accepted public testimony, and deliberated the merits of the proposal. 7.1.8. The proposal is located within the "shoreline residential" shoreline environment. 7.1.9. The proposal is located within geologically hazardous critical areas. 7.2. Conclusions of Law: 7.2.1. The procedural and substantive requirements of the State Environmental Policy Act have been complied with. 7.2.2. The procedural requirements of RCW 36.70A have been complied with. 7.2.3. The proposed amendments are consistent with the Douglas County Regional Policy Plan, Greater East Wenatchee Area Comprehensive Plan, East Wenatchee Municipal Code, Douglas County Code and the Douglas County Regional Shoreline Master Program. 7.2.4. The proposed amendments are consistent with the requirements of Revised Code of Washington and the Washington Administrative Code. 8.Severability. If a court of competent jurisdiction declares any provision in thisOrdinance to be contrary to law, such declaration shall not affect the validity ofthe other provisions of this Ordinance. 9.Publication. Page 118 of 133 IV. AGENCY AND PUBLIC COMMENTS: Douglas County initiated the 60-day review on September 11, 2018. The SEPA comment period concluded on November 13, 2018. During the public review period , no public or agency comments were received. V. PROJECT ANALYSIS CPRZ-2018-03 proposes a site-specific comprehensive plan amendment and rezone of three (3) parcels from the current zoning of Residential High Density/Office (R-H) to General Commercial (G-C). The three parcels are located south of East Wenatchee city limits along SR 28 and total approximately 6.7 acres. They are identified as Assessor's Parcel Numbers (APN): 40200005601 , 40200005602 and 40200005604. The parcels contain portions of SR 28 and the Apple Capital Loop Trail with the majority of land being vacant, shrub-steppe sloping down to the Columbia River. The purpose of the proposal is to square up an irregular boundary of the G-C zoning district that was created by the approval of CPRZ-2017-01 which did not include these three parcels. Growth Management Act Review: Planning Goals RCW 36 .70A020(1) Urban growth: encourages development where adequate public facilities and services exist and can be provided in an efficient manner. Planning Goals RCW 36.70A020(5) Economic Development: encourages economic development through promotion of opportunity for all citizens and the recruitment of new businesses. RCW 36.70A115(1): Amendments to comprehensive plans and development regulations shall provide sufficient capacity of land suitable for development, to include employment growth and commercial facilities. Analysis: A rezone of the three subject parcels from R-H to G-C would eliminate the risk of incompatible, piecemeal development and would promote the continuation ofcommercial development along the SR 28 corridor. The proposal would also eliminate irregular zoning boundaries, which is encouraged in the GMA RCW 36. 70A. Douglas County Regional Shoreline Master Program (SMP) Review: As shown on the map on page 3 of Attachment A, the proposal is located within the Shoreline Residential shoreline environment. The parcels identified as 40200005601 and 40200005604 are completely within shoreline jurisdiction. Only a portion of the southern half of parcel 40200005602 is within shoreline jurisdiction. Page 119 of 133 2.1 Economic Development Element: OBJECTIVE 3: Insure that any economic activity taking place in the shoreline operates in a manner that protects shoreline ecological functions and processes. Unavoidable impacts should be minimized and mitigated. OBJECTIVE 5: Proposed economic use of the shoreline should be consistent with local comprehensive plans and this Program. 3.6 Shoreline Residential Environment: POLICY 4: Access, utilities, and public services should be available and adequate to serve existing needs and/or planned future development. POLICY 5: Commercial development should be limited to water-oriented uses. Analysis: As stated in the SMP, all proposed uses and development occurring within the shoreline jurisdiction must conform to RCW 90.58 Shoreline Management Act and this Program. Consistent with allowed housing uses in the G-C zoning district, the SMP allows for commercial development as well as multi-family urban densities within the shoreline residential shoreline environment at 5 dwelling units per acre. The proposal is consistent with the Douglas County Regional Shoreline Master Program. Douglas County Municipal Code Critical Areas -Chapter 19.180 Geologically Hazardous Areas: The southeast portions of all three subject parcels are located with the critical area for geologically hazardous areas, identified as "torriorthents, very steep." Uses and activities allowed within designated geologically hazardous areas are those uses permitted by the zoning district, subject to the provisions of this chapter. Analysis: Any structures proposed for the areas identified as geologically hazardous would require review and analysis by a qualified geo-professional. Any building permit application involving this critical area would require a report or risk analysis to be submitted by the geo-professional. Greater East Wenatchee Area Comprehensive Plan Review: Urban Growth: UG-4: Consideration should be given to squaring up grossly irregular boundaries in the development of the urban growth area. GOAL 3: Establish development patterns that use urban land more efficiently. Staff Report CPRZ-2018-03 3 04/02/2019 Council Meeting Agenda Packet. Page 120 of 133 GOAL 4: The County and the City will collaborate on and adopt consistent regulations and development standards for areas located within the urban growth areas. Commercial: GOAL 1: Provide sufficient commercial land that is properly sited to take advantage of existing utility and public service infrastructure and the transportation network to ensure growth of the local business community. GOAL 3: Establish commercial areas that accommodate a variety of land use activities to support a diverse and stable economic base while maintaining the quality of life in the community and the natural environment. POLICY C-2: Commercial development should provide well designed buffer areas to insure that the land use is complimentary and compatible with adjacent land uses. POLICY C-13: Expand commercial uses adjacent to existing similarly developed areas. Economic Development: ED-1: Identify areas where future economic activity and growth is intended and encouraged to occur. ED-17: Ensure an adequate amount of land is designated for commercial uses based on site characteristics, market demand, community need, job creation, and the availability of support facilities and services. Analysis: Goals and Policies of the Greater East Wenatchee Comprehensive Plan encourage the removal of irregular boundaries in the urban growth area (UGA). This project eliminates a gap between the adjacent G-C parcels along SR 28. The proposal is consistent with the adjacent G-C zoned properties. The proposal is adjacent to a main transportation system for the region (SR 28), and will provide additional commercial land that is properly sited to take advantage of existing services and the transportation network. The R-H district (Attachment B) allows non-residential uses such as offices and limited commercial opportunities. Rezoning the three parcels to G-C (Attachment C) will allow for greater diversity of commercial and retail uses and will increase the acreage of the G-C district. Similarly, the G-C district allows for residential uses through accessory or conditional uses and will allow for more diverse retail and commercial uses. Page 121 of 133 East Wenatchee Municipal Code Review: The Residential High Density/Office (R-H) zoning district (Attachment D) allows for varying housing types as well as limited office-type businesses. General Commercial (G-C) (Attachment E) encourages the development of commercial uses that will create varied job opportunities and provide services to the community that are not strictly retail in nature. The businesses locating within the G-C district often draw customers from the outlying areas rather than from a more limited local trade area. Analysis: A rezone of the three parcels would still allow the County to further housing opportunities as the G-C zoning district allows for multi-family housing as accessory and conditional uses. In addition, the G-C zoning will allow for mixed use, retail and other commercial uses easily accessible from a major transportation system, as the G-C district is expected to be more automobiJe­ oriented than the Central Business District (CBD). VI. RECOMMENDATION Staff recommends that the Planning Commission forward a recommendation of approval to the Board of County Commissioners for the proposed amendments.
