BACKGROUND/HISTORY: Legal Considerations: •The City is allowed to increase its property tax levy by up to the Implicit Price Deflator (IPD) or one percent, whichever is lower, from the highest lawful levy since 1985. •The City may still levy the full one percent, or bank the capacity for the future, if the Council passes an ordinance of substantial need. •The City may also increase its property tax levy by the amount of the previously banked capacity. •The Ordinance for any percentage or banked capacity amount must be approved by a majority plus one of the City Council (five affirmative votes) for Cities with more than four Council members. •The Ordinance must specifically state the increase in terms of both dollars and percentage. •Prior to adopting the Ordinance, the City must hold a public hearing to discuss the following year's current expense budget. •The public hearing must include discussion on the possibility of an increase in property tax revenues. •The Finance Director must file the certified budget or estimate with Douglas County on or before November 30th. Financial Considerations: 1.The Council has been apprised of the alternatives which it could consider and approve for implementation in 2018. Council consensus was to consider the alternative, which has been re-stated below. 2.For 2018, the City has stated its desire to consider the following alternative: Authorize the regular property tax levy, and authorize any increases allowed in the amount under new construction, improvements to property and the State assessed property provisions of State law, resulting in total property tax collections of approximately $1,632,785.90 in 2018. 11-28-2017 Council Agenda Packet Page 69 of 134 Page 2 of 2 Financial Considerations (continued: 3. The City has also been apprised by the Douglas County Assessor that its 2017 receipt will be less by the amount of $3,083.78 because of changes in value of properties causing a refund to be issued to owners for the 2017 tax year. The RCW states that the City may ask for a refund levy for any loss due to this refund. The Ordinance includes language requesting that refund levy in the amount of $3,086.78. Council consensus was to consider alternative which has been re-stated below. 2.For 2018, the City has stated its desire to: Authorize the regular property tax levy, an increase in the regular property tax resulting from previously banked capacity, an increase of the allowable one percent increase and authorize any increases allowed in the amount under new construction, improvements to property and the State assessed property provisions of State law, resulting in total property tax collections of approximately $1,767,842.02 in 2018. 11-28-2017 Council Agenda Packet Page 81 of 134 Page 2 of 2 Financial Considerations (continued: 3.The City has also been apprised by the Douglas County Assessor that its 2017 receipt will be less by the amount of $3,083.78 because of changes in value of properties causing a refund to be issued to owners for the 2017 tax year. The RCW states that the City may ask for a refund levy for any loss due to this refund. The Ordinance includes language requesting that refund levy in the amount of $3,086.78. Lacy and City Council From/Presenter: City Attorney Devin Poulson Subject: Truck Routes Date: October 24, 2017 I.Summary Title: Ordinance No. 2017-19. An Ordinance of the City of East Wenatchee designating truck routes through the City by adding Chapter 10.64 to the East Wenatchee Municipal Code. II.Background/History: The City has been receiving complaints of heavy and noisy trucks traveling through residential areas of the city. To minimize these complaints and to establish a method to preserve the City’s pavement, the proposed Ordinance would establish a truck route through the City that would require heavy trucks to only drive on designated routes. These routes are SR 28 and Grant Rd. Because SR 28 is a state highway, the City has no authority to regulate it. Grant Rd. has been designated as an intermodal connector. Intermodal connectors play an essential role in ensuring the reliability, transit time, efficiency and cost sought by shippers. Intermodal connectors allow transportation providers to use the best of each mode and to provide seamless door-to-door movements.1 Intermodal connectors serve heavy truck volumes moving between freight terminals and the national highway system.2 Under the proposed Ordinance, trucks with a gross vehicle weight rating that exceeds 26,000 pounds would be required to use a truck route. This would allow something like a Ford F-650 to operate on all city streets. 1 https://ops.fhwa.dot.gov/freight/freight_analysis/nhs_connectors/role_nhs_conn/role_sys_conn_4.htm#role 2 NHS Intermodal Freight Connectors A Report to Congress 11-28-2017 Council Agenda Packet Page 87 of 134 Vehicles over 26,000 pounds would have to use a truck route. A Ford F-750 is an example of a vehicle with a GVWR of over 26,000 pounds. Below are more examples of the various truck classifications: 11-28-2017 Council Agenda Packet Page 88 of 134 The Ordinance would require the City to post truck route signs throughout the city to inform drivers of the weight limitations. I have not calculated the cost of time and material necessary to construct and post the signs. Our agency that can bring in more revenue and can move the defendants through your system quickly and efficiently. Here are some ways Dynamic Collectors, Inc. can increase East Wenatchee Municipal Court’s revenue: 1. Dynamic Collectors, Inc. will send out thirty day pre-collect notices at no cost to you. This will save the court the cost of postage, paper, envelopes, and staff time. Your staff could be using this time to do other tasks. 2. We are confident that over a five year cycle we can beat the percentage of money your current agency is bringing in by 12%. We have done this consistently for other courts like Lewis County District Court, Cowlitz County District Court, Grays Harbor County District Court, Kitsap County District Court, Mason County District Court and Lincoln County District Court. 3. We can automatically increase revenue by giving East Wenatchee Municipal Court 100% of the interest on your accounts. You should be able to increase your revenue by 12% over what you are currently receiving. 4. Dynamic Collectors, Inc. can remit payments the court every week or we can even wire transfer daily. Your staff will be able to post payments faster and payments will be easier to post if the court is paid every week, or at least twice a month. Adjudication will be done more promptly. We would report accounts paid in full daily to your office. 11-28-2017 Council Agenda Packet Page 129 of 134 5. After thirty days if our collectors have not been able to obtain guaranteed payment arrangements for an account, we will review the file for garnishment if we have employment or bank information, or file an abstract lien to any property the defendant may own. The county will have the added benefit of an increase in filing fees, as we will file more abstracts and garnishments on citations than your current agency. If a garnishment is issued without success, then a Subpoena is issued requesting employment information from the Employment Security Division or Supplemental Proceeding. 6. We have the most state of the art computer and phone system to work with the court’s accounts efficiently. I strongly believe that we outperform other agencies as we are not afraid to spend the money to actively pursue small balance accounts. Dynamic Collectors, Inc. is experienced in working on citations as we currently collect for Lincoln County District Court, Lewis County District Court, Cowlitz County District Court, Grays Harbor District Court, Mason County District Court and Kitsap County District Court.
