7.Public hearings.
The Mayor will call the Public Hearing to order and state the ground rules, the purpose of the
hearing, the action that the hearing body may take on the matter, will address the appearance of
fairness doctrine, and will state the manner in which the hearing will proceed. Staff will first give a
report, followed by testimony of experts and/or the applicant, followed then by public testimony.
All speakers must speak into the microphone and clearly state their names and addresses. All
comments should be addressed to the hearing body, should be relevant to the application, and
should not be of a personal nature. Public testimony may be limited to three minutes, unless
further time is granted by the Mayor. If there are a large number of speakers, a representative may
be appointed to speak on behalf of the group.
a)A public hearing for the purpose of fixing the 2018 Final Budget, which has been
filed with the City Clerk. A copy thereof will be furnished to any taxpayer by
contacting the City Clerks Office. Any Taxpayer may appear and be heard for or
against any part of the budget.

A.Ordinance No. 2017-25 an Ordinance of the City Council of the City of East
Wenatchee, Washington, adopting the annual budget of the City for the fiscal year
commencing January 1, 2018. Fist reading.

B.Ordinance No. 2017-24 an Ordinance of the City of East Wenatchee, Washington,
fixing and confirming the salaries and compensation to be paid to certain officials
and employees of the City of East Wenatchee during the year 2018, containing a

C.Ordinance No. 2017-20 of the City of East Wenatchee establishing Property a Tax
Revenue Ordinance. Authorizing the regular property tax levy to be collected in the
2018 tax year, and authorizing an increase which may be allowed in the amount
under new construction, improvements to property and the State assessed property
provisions of State Law. Second reading.

Motion for City Council to authorize the Mayor to sign the Animal Control Services
Agreement on behalf of the City.
H.Resolution 2017-11 January 01, 2018 Chelan County Regional Justice Center
Contract Amendment increasing bed rental rate from $87.00 to $96.00 per bed day,
a 10% increase. Due to increased staff salaries, internal medical costs, vehicle costs,
and other supplies. Presented by Devin Poulson, City Attorney.
Motion for City Council to accept and authorize the Mayor to sign the Amendment
to the contract for the bed rental rate increase to $96.00.
I.Professional services contract between East Wenatchee Municipal Court and
Dynamic Collectors, Inc..

5. Mayor’s Report
a) Contract for the Gateway Project demolition is out, Mayor Lacy provided comments
as to possibly adding asphalt removal to the contract.
Comments provided by Councilmembers Wayne Barnhart, Harry Raab and Jerrilea
Crawford. Additional comments by staff member Lori Barnhart, Community
Development Director and Greg Pezoldt, City Engineer.
b) Chelan County Regional Justice Center has provided a rate increase for 2018 and
information will be coming forward. Mayor Lacy commented regarding possible
home monitoring programs in the future.

6. Action Items.
A. Ordinance No. 2017-19 an Ordinance of the City of East Wenatchee designating truck
routes through the City by adding chapter 10.64 to the East Wenatchee Municipal Code.
First reading by Mayor Lacy.
B. Proposed four-year Professional Services Agreement for Municipal Court Judge; the
current four-year agreement ends December 31, 2017
City Attorney Devin Poulson presented the staff report. Comments provided by Mayor
Lacy, and Councilmembers Tim Detering and Wayne Barnhart.
Motion to approve by Councilmember Tim Detering. Councilmember Chuck Johnson
seconded the motion. Motion carried (6-0).
C. Baker Ave. Project change order No. 10, in the amount of $14,143.44.
City Engineer Greg Pezoldt presented the staff report. Comments provided by
Councilmember Tim Detering.
Motion to approve by Councilmember Wayne Barnhart. Councilmember Tim Detering
seconded the motion. Motion carried (6-0).
D. Ordinance No. 2017-23 an Ordinance of the City of East Wenatchee adopting the 2018
Greater East Wenatchee Storm Water Utility Budget for the fiscal year commencing on
January 1, 2018.
Elevated to second reading by Mayor Lacy.
Motion to approve by Councilmember Wayne Barnhart. Councilmember Sandra
McCourt seconded the motion. Motion carried (6-0).

7. Public Hearing
a.) A public hearing for Ordinance 2017-16 regarding a moratorium on new wireless
communications facilities was held. Community Development Director Lori Barnett
presented staff report, no public comments received, meeting closed by Mayor Lacy.
b.) A public hearing for Ordinance 2017-20, Ordinance 2017-21 and Ordinance 2017-22
regarding 2018 Property Tax Revenue. Authorizing the regular property tax collections.
Finance Director Nick Gerde presented the staff report and Mayor Lacy provided the
first reading of each Ordinance. No public comments received, meeting closed by
Mayor Lacy.
8. Council Reports & Announcements.
a. Councilmember Wayne Barnhart commented on Link Transit’s proposed tax
increase.

b. Mayor Lacy commented on Transportation Council and efforts to broaden Link
Transit services to aid reducing traffic and congestion in our region.

TITLE:
An ordinance of the City Council of the City of East Wenatchee, Washington, adopting
the annual budget of the City for the fiscal year commencing January 1, 2018.
BACKGROUND/HISTORY:
Legal Considerations:
1.The City is obligated under RCW 35.33.031 to receive and consider estimates of
revenues and budgeted expenditures from City staff prior to the 2nd Monday of
September, prepared in accordance with the requirements and classification of
the Washington State Auditor.
2.The City is obligated under RCW 35.33.057 to provide a budget message with
the preliminary budget at least 60 days before the end of the fiscal year;
3.The City is obligated under RCW 35.33.055 to prepare a preliminary budget for
the following year and make it available to the public not later than six weeks
before the beginning of the next fiscal year;
4.The City is obligated under RCW 35.33.061 to provide timely notice for the
purpose of fixing the final budget, designating the date, time and place of the
City Council meeting, and that any taxpayer may appear thereat and be heard
for or against any part of the budget; and
5.The City has met its obligations under prevailing RCW’s for a public hearing of
its annual financial budget on November 28, 2017 for the year 2018.
Financial Considerations:
1.In May of 2009, by passing Resolution 2009-06, the City Council adopted a
Finance and Budget Policy which outlines the purposes, framework and
organizational participation for the City to accomplish its Annual Financial
Budget and Annual Financial Plan;
2.Through participation by the City’s 2018 Budget Committee, Mayor, City
Council and City Staff, the City has followed its Policy in preparing a Preliminary
Budget for 2018. The Preliminary Budget includes resources sufficient to
support its budgeted expenditures.

3.The Preliminary Budget has been available to the public at the City Clerk’s Office
has been subsequently posted on the City’s website.
4.The Public Hearing to be held on November 28, 2017, will provide an
opportunity for the public (any taxpayer) to gain a better understanding of the
elements of the Preliminary Budget and be heard for or against any part of the
budget.
5.Following conclusion of the Public Hearing, the City Council may discuss and
make such adjustments and changes as it deems necessary or proper to finalize
the budget.
6.The City Council has scheduled a workshop on December 7, 2017 for the
purpose of a final review and possibility that adjustments and changes may be
necessary to finalize the 2018 Budget.
7.Adoption of the Annual Budget occurs after the second reading of the Ordinance
scheduled for December 12, 2017, but no later than prior to the beginning of
the 2018 fiscal year.

1.Recitals
a.Preamble. The City of East Wenatchee (“City”) is a non-charter code city duly
incorporated and operating under the laws of the State of Washington; and
b.Conditions Precedent. Previously, the City Council of East Wenatchee (“City
Council”):
i.prepared and filed its preliminary budget for the year 2018;
ii.gave notice of the time and place of hearing thereon according to law;
iii.met in accordance with said notice; and
iv. considered the proposed budget.
c.Authority.
i.RCW 35A.11.020 authorizes the City Council to regulate local affairs and
provide municipal services.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS:
Section 1: Purpose. Adopt a City budget for the year 2018.
Section 2: Adoption of 2018 Budget. In accordance with RCW 35A.33.075, the City
Council adopts, by reference, the final budget for the year 2018 for the City of
East Wenatchee, Washington.

Section 6: Final Budget on file. A detailed final budget, including a list of revenues and
expenditures for each separate fund, shall be on file with the City Clerk of the
City of East Wenatchee, East Wenatchee, Washington. The City Council also
directs the City Clerk to upload a copy of the final budget on the City’s website.
Section 7: Transmittal. The City Treasurer shall transmit a complete copy of the final
budget for 2018 as adopted, together with a copy of this adopting ordinance to the
Division of Municipal Corporations of the State Auditor and to the Association of
Washington Cities.
Section 8: Publication. The City Council directs the City Clerk to publish a summary of this
Ordinance. The summary shall consist of the title of this Ordinance.
Section 9: Effective Date. This Ordinance becomes effective on January 1, 2018.

I.Summary Title: An Ordinance of the City Council of the City of East Wenatchee,
Washington, fixing and confirming the salaries and compensation to be paid
to certain officials and employees of the City of East Wenatchee during the
year 2018, containing a severability date, and establishing an effective date.
Background/History:
Legal Considerations:
1.The City is obligated under RCW 35.33.055 to prepare a preliminary budget
for the following year and make them available to the public not later than
six weeks before the beginning of the next year;
2.The City is obligated under its bargaining unit contracts and employee
contracts to pay the salaries and benefits agreed to under those contracts;
and
3.The City is obligated under RCW 35.33.107 that, notwithstanding the
appropriations for any salary, or salary range of any employee or employees
adopted in a final budget; the City Council may by ordinance, change the
wages, hours, and conditions of employment of any or all of its appointive
employees if sufficient funds are available for appropriation to such
purposes.
Financial Considerations:
1.The City’s Finance & Budget Policy (Resolution No. 2009-06), outlines the
processes, informational tools and expenditure data that need to developed,
reviewed and approved for inclusion in the City’s Annual Financial Budget.

The expenditure data includes the salaries, payroll and benefit costs which
the City expects to spend in the budget year in support of City operations.
II.The City Council annually approves the monthly base salaries of certain City
Officials, non-bargaining unit/ non- contract employees, and temporary
part-time employees. City Officials include the Mayor and seven Council
members.
III.Non-bargaining and non-contract employees include a total of eight
employees, seven salaried and one hourly. These monthly base salary costs
and the associated payroll tax and benefit costs are included in substance in
various departments and funds in the City’s 2018 Annual Financial Budget,
as well as those salary and benefits costs delineated in collective bargaining
unit, employee contracts and independent contractor agreements.
IV.Recommended Action: : First reading of the 2017 Salary Ordinance for 2018
compensation.

The City Council of the City of East Wenatchee do ordain as follows:
Section 1: Exhibit: The attached Exhibit A to this ordinance includes the amended monthly
base salary schedule within a seventeen-step salary plan for non-bargaining/non-
contract employees; the monthly base salaries to be paid to temporary part-time
employees based upon an hourly rate and actual hours worked; and the monthly
salaries to be paid to the officials of the City of East Wenatchee.

The monthly compensation amounts have been determined based upon provisions in the Manual of Personnel Policies and Procedures ("Manual"). Because the "Manual" refers to availability of a higher rate in the case when the

TITLE: An ordinance of the City of East Wenatchee authorizing the regular property tax levy to
be collected in 2018, and authorizing any increase which may be allowed in the amount under
new construction, improvements to property and the State assessed property provisions of
State Law.
BACKGROUND/HISTORY:
Legal Considerations:
•The City is allowed to increase its property tax levy by up to the Implicit Price Deflator
(IPD) or one percent, whichever is lower, from the highest lawful levy since 1985.
•The City may still levy the full one percent, or bank the capacity for the future, if the
Council passes an ordinance of substantial need.
•The City may also increase its property tax levy by the amount of the previously banked
capacity.
•The Ordinance for any percentage or banked capacity amount must be approved by a
majority plus one of the City Council (five affirmative votes) for Cities with more than
four Council members.
•The Ordinance must specifically state the increase in terms of both dollars and
percentage.
•Prior to adopting the Ordinance, the City must hold a public hearing to discuss the
following year's current expense budget.
•The public hearing must include discussion on the possibility of an increase in property
tax revenues.
•The Finance Director must file the certified budget or estimate with Douglas County on
or before November 30th.
Financial Considerations:
1.The Council has been apprised of the alternatives which it could consider and approve
for implementation in 2018. Council consensus was to consider the alternative, which
has been re-stated below.
2.For 2018, the City has stated its desire to consider the following alternative: Authorize
the regular property tax levy, and authorize any increases allowed in the amount under
new construction, improvements to property and the State assessed property provisions
of State law, resulting in total property tax collections of approximately $1,632,785.90
in 2018.

3. The City has also been apprised by the Douglas County Assessor that its 2017 receipt
will be less by the amount of $3,083.78 because of changes in value of properties
causing a refund to be issued to owners for the 2017 tax year. The RCW states that the
City may ask for a refund levy for any loss due to this refund. The Ordinance includes
language requesting that refund levy in the amount of $3,086.78.

ORDINANCE NO. 2017-20
An Ordinance of the City of East Wenatchee, Washington, authorizing the
regular property tax levy to be collected in the 2018 tax year, and authorizing
an increase which may be allowed in the amount under new construction,
improvements to property and the State assessed property provisions of State
Law.

1.Recitals.
a.Preamble. The City of East Wenatchee (“City) is a non-charter code City duly
incorporated and operating under the laws of the State of Washington; and
b.The City Council of East Wenatchee (“City Council”) finds that it is in the best
interests of the City of East Wenatchee (“City”) and its citizens to increase the
amount of the City’s regular property tax levy for 2017.
c.Findings.
i.The population of the City is more than 10,000;
ii.The Implicit Price Deflator (Personal Consumption Expenditures “PCE”)
for 2017 is 1.553%, resulting in an allowable 1.00% increase in the 2017
property tax levy.
iii.The City Council has considered the City’s anticipated financial
requirements for 2018 and beyond, and the amounts necessary and available
to be raised by ad valorem taxes on real, personal and utility property,
including amounts resulting from new construction, improvements to
property, and any increase in the assessed value of state-assessed property;
iv.After proper notice, the City Council held a public hearing on November 14,
2017. At this public hearing, the City Council considered revenue sources
for the City’s current expense budget for 2018.
v.After the hearing and after duly considering all relevant evidence and
testimony presented, the City Council determined and finds that the City
does not have a future substantial need to increase property tax revenue from
the previous year by the allowable 1.00%, does not need to increase property
tax revenue by collecting previously banked capacity, but does have a need
for the increase in property tax revenue resulting from the addition of new
construction, improvements to property, and any increase in the value of

state-assessed property, in order to discharge the expected expenses and
obligations of the City.
vi. After the hearing and after duly considering all relevant evidence and
testimony presented, the Council finds that the City has future substantial
need for an increase in years subsequent to 2018.
2. Authority
a. RCW 32A.11.020 and RCW 35A.2.190 authorize the City Council to adopt
ordinances of all kinds to regulate its municipal affairs and appropriate to the
good government of the City.
b. RCW 84.55.12 authorizes the City Council to adopt a tax increase by ordinance.
THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS:
Section 1: Purpose. The City wishes to establish its regular property tax levy for the year
2017.
Section 2: Authorization. The City Council authorizes an increase in the general property tax
levy, for the 2017 property tax levy on all real, personal and utility property
authorized for collection in 2018 in the amount of $0.00 resulting in a 0.00%
increase in the regular tax levy, and authorizing any amount from the addition of
new construction and improvements to property, plus any increase in the value of
state-assessed property, and plus any additional amount resulting from annexations
that have occurred and refunds made.
Section 3: Estimate. As required by RCW 84.52.020, for budget purposes, the City Council
estimates that the amount of property tax to be collected in the year 2018 will be
approximately $1,632,785.90. The City Council estimates that the contingency
property tax to be collected will be approximately $50,000.
Section 4: Certification. As required by RCW 84.52.020, the City Council certifies to
Douglas County’s legislative authority that the City is requesting that the regular
levy, in the amount of $1,632,785.90 be collected in 2018.
Section 5: Payment. The property taxes levied by this Ordinance shall be collected and paid
to the City Treasurer at the time and in the manner provided by the laws of the
State of Washington.
Section 6: Refund Levy for 2018. As a result of the refunds issued during the 2017 tax year,
we are requesting the collection of $3,083.78 in the form of a refund levy for the
tax year 2018.
Section 7: Severability. If a court of competent jurisdiction declares any provision in this
Ordinance to be contrary to law, such declaration shall not affect the validity of
the other provisions of this Ordinance.

Section 8:Publication. The City Council directs the City Clerk to publish a summary of this
Ordinance. The summary shall consist of the title of this Ordinance
Section 9:Effective Date. This Ordinance becomes effective five days after the date its
summary is published.
Section 10:Filing. The City Council directs the City Clerk to file this Ordinance with the
legislative authority of Douglas County.
Section 11:Short Title. This Ordinance shall be known as the 2017 Levy and may be cited as
such.

THE CITY COUNCIL OF THE CITY OF EAST WENATCHEE DO ORDAIN AS FOLLOWS:
Section 1: Purpose. The City wishes to establish its regular property tax levy for the year
2017.
Section 2: Authorization. The City Council authorizes an increase in the general property tax
levy, for the 2017 property tax levy on all real, personal and utility property
authorized for collection in 2018, in the amount of $117,651.75, which is the
previously banked capacity allowed under the provisions of state law, the current
allowable 1% increase in the amount of $17,404.37, additional revenue resulting
from the addition of new construction and improvements to property, plus any
increase in the value of state-assessed property, and plus any additional amount
resulting from annexations that have occurred and refunds made.
Section 3: Estimate. As required by RCW 84.52.020, for budget purposes, the City Council
estimates that the amount of property tax to be collected in the year 2018 will be
$1,767,842.02. The City Council estimates that the contingency property tax to
be collected will be $50,000.
Section 4: Certification. As required by RCW 84.52.020, the City Council certifies to
Douglas County’s legislative authority that the City is requesting that the regular
levy, in the amount of $1,767,842.02, be collected in 2018.
Section 5: Payment. The property taxes levied by this Ordinance shall be collected and paid
to the City Treasurer at the time and in the manner provided by the laws of the
State of Washington.
Section 6: Refund Levy for 2018. As a result of the refunds issued during the 2017 tax year,
we are requesting the collection of $3,083.78 in the form of a refund levy for the
tax year 2018.

Section 7: Severability. If a court of competent jurisdiction declares any provision in this
Ordinance to be contrary to law, such declaration shall not affect the validity of
the other provisions of this Ordinance.
Section 8: Publication. The City Council directs the City Clerk to publish a summary of this
Ordinance. The summary shall consist of the title of this Ordinance
Section 9: Effective Date. This Ordinance becomes effective five days after the date its
summary is published.
Section 10: Filing. The City Council directs the City Clerk to file this Ordinance with the
legislative authority of Douglas County.
Section 11: Short Title. This Ordinance shall be known as the 2017 Levy and may be cited as
such.

I.Summary Title: Ordinance No. 2017-19. An Ordinance of the City of East Wenatchee designating
truck routes through the City by adding Chapter 10.64 to the East Wenatchee Municipal Code.
II.Background/History: The City has been receiving complaints of heavy and noisy trucks
traveling through residential areas of the city. To minimize these complaints and to establish a
method to preserve the City’s pavement, the proposed Ordinance would establish a truck
route through the City that would require heavy trucks to only drive on designated routes.
These routes are SR 28 and Grant Rd. Because SR 28 is a state highway, the City has no
authority to regulate it. Grant Rd. has been designated as an intermodal connector.
Intermodal connectors play an essential role in ensuring the reliability, transit time, efficiency
and cost sought by shippers. Intermodal connectors allow transportation providers to use the
best of each mode and to provide seamless door-to-door movements.1 Intermodal connectors
serve heavy truck volumes moving between freight terminals and the national highway
system.2
Under the proposed Ordinance, trucks with a gross vehicle weight rating that exceeds 26,000
pounds would be required to use a truck route. This would allow something like a Ford F-650
to operate on all city streets.

Vehicles over 26,000 pounds would have to use a truck route. A Ford F-750 is an example of a
vehicle with a GVWR of over 26,000 pounds.

The Ordinance would require the City to post truck route signs throughout the city to inform
drivers of the weight limitations. I have not calculated the cost of time and material necessary to
construct and post the signs.

2.Recitals.
2.1. The City of East Wenatchee (“City”) is a non-charter code
City duly incorporated and operating under the laws of the State
of Washington; and
2.2.The City Council of East Wenatchee (“City Council”) finds
that it is necessary to designate a truck through the City.
2.2.1. The City has a road standard requiring roads to be built to a
structural standard when reconstructed.
2.2.2. The City does not yet have a road network that traverses the
city that meets the current road structural standard.
2.2.3. The City does not have funding to rebuild roads that are
damaged as a result of heavy loads.

3. Authority.
3.1. RCW 35A.11.020 and RCW 35A.12.190 authorize the City
Council to adopt ordinances of all kinds to regulate its municipal
affairs and appropriate to the good government of the City.
3.2. As authorized by RCW 46.44.080, the City Council may
prohibit the operation of motor trucks on a public highway
whenever any such public highway will be seriously damaged or
destroyed unless the operation of vehicles thereon be prohibited
or restricted.
3.3. As authorized by RCW 46.44.080, the City Council may
impose limits as to the weight of a motor truck on a public
highway whenever any such public highway will be seriously
damaged or destroyed unless the permissible weight of the motor
truck is reduced.

10.64.010 Definitions.
A. “City” is the City of East Wenatchee.
B. “Deviating truck” is a truck which leaves and departs from a truck
route while traveling inside the City.
C. “Person” is any person, firm, partnership, association, corporation,
company, or organization of any kind.
D. “Truck” is any vehicle designed or operated for the transportation of
property, and whose body weight or whose combined body and load
weight or whose gross vehicle weight rating exceeds 26,000 pounds.
E. “Truck route” is a way over certain streets, as designated in this
chapter, over and along which trucks coming into and going out of the
City must operate.
10.64.020 Application of regulation.
No person may operate a truck within the City, except upon a truck
route established in this chapter.
10.64.030 Exceptions.
This chapter does not prohibit:
A. Operation on Street of Destination. The operation of a truck upon
any street where necessary to the conduct of business at a destination
point, provided streets upon which such traffic is permitted are used
until reaching the intersection nearest the destination point;
B. Perishable Commodities. The operation of a truck while transporting
a perishable commodity.
C. Government Vehicles. The operation of a truck owned and operated
by a government agency;
C. Emergency Vehicles. The operation of an emergency vehicle upon
any street in the City;

D. Public Utilities. The operation of a truck owned or operated by the
City, public utilities, any contractor or materialman, while engaged in
the repair, maintenance or construction of streets, street improvements,
or street utilities within the City;
E. Recreational Vehicles. The operation of a recreational vehicle
including a motor home, a camper, or a travel trailer;
F. Solid Waste. The operation of a truck while engaged in the collection
of solid waste within the City; or
G. Detoured Trucks. The operation of a truck upon any officially
established detour.
10.64.040 Truck route
A. The City Council establishes the following truck routes:
1.State Route 28 from 19th St. N.E. to 3rd St. S.E.
2.Grant Rd. from SR 28 to Kentucky Ave.
B. A truck entering the City for a destination point outside the City may
only operate over and along a route designated in this section.
10.64.050 Truck traffic in the City – Outside origin.
A. One Inside Destination Point. A truck entering the City for a
destination point within the City must proceed only over an established
truck route and may deviate only at the intersection with the street
nearest to the designation point. Upon leaving the destination point, a
deviating truck must return to the truck route by the shortest
permissible route.
B. Multiple Inside Destination Points. A truck entering the City for
multiple destination points must proceed only over established truck
routes and may deviate only at the intersection with the street nearest
to the first destination point. Upon leaving the first destination point, a
deviating truck must proceed to other destination points by the shortest
direction. Upon leaving the last destination point, a deviating truck
must return to the truck route by the shortest permissible route.

10.64.060 Truck traffic in City – Inside origin.
A. Outside Destination Point. A truck, on a trip originating in the City,
and traveling in the City for a destination point outside the City, must
proceed by the shortest direction over streets on which such traffic is
permitted to a truck route as established in this chapter.
B. Inside Destination Points. A truck on a trip originating in the City,
and traveling in the City for destination points in the City must proceed
as provided in EWMC 10.64.050.
10.64.070 Maps.
The City Council directs the City Clerk to keep and maintain an
accurate map setting out truck routes and streets upon which truck
traffic is permitted. The City Clerk must keep the map on file at the
office of the City Clerk and must publish it on the City’s website.
10.64.080 Signs.
The City Council directs the City Engineer to post clearly marked signs
along the designated truck routes to give notice that this chapter is in
effect.
10.64.090 Weigh-in.
A police officer may require a person driving or in control of a truck, not
proceeding over a truck route, to proceed to any public or private scale
available for the purpose of weighing and determining whether this
chapter has been complied with.
10.64.100 Violation – Penalty.
Violation of or failure to comply with any of the penal provisions of this
chapter is punishable by a fine not to exceed $200.00.
6.Signs. The City Council directs the Public Works Department to erect
and maintain signs designating the provisions of this ordinance in each
end of the portion of any city street affected this ordinance.

I.Summary Title: Animal Control Services Agreement Wenatchee Valley Animal Control, LLC –
City of East Wenatchee.
II.Background/History: The City’s current agreement with Animal Control expires on December
31, 2017. Currently, the City is paying $70,200 per year. The proposed annual fee for the next
three years is $73,514.82 (a 4.72 % increase in 2018, a 0% increase in 2019, and a 0% increase
in 2020).
Animal Control’s responsibilities remain the same in terms of providing services. In terms of
reporting, the proposed agreement will require Animal Control to provide more financial
information to the City and require it to make an annual presentation before the City Council.
III.Recommended Action: Motion to authorize the Mayor to sign the Animal Control Services
Agreement on behalf of the City.

Animal Control Services Agreement
Wenatchee Valley Animal Control, LLC – City of East Wenatchee
The parties to the Contract for Service (“Agreement”) are the City of
East Wenatchee (“City”) and Wenatchee Valley Animal Control, LLC
(“WVAC”), a not for profit subsidiary of the Humane Society.
1.Term. The term of this agreement is from January 1, 2018
through December 31, 2020. This Agreement shall automatically
renew for an additional three-year term, unless one party gives sixty
days written notice to the other party that it intends to terminate
the Agreement.
2.Obligations of WVAC. WVAC agrees to do the following:
(a) Furnish and maintain the present animal shelter existing
at 1474 S. Wenatchee Ave., Wenatchee, and all necessary equipment
for handling stray animals, impounded animals, and animals
received by WVAC from citizens of the City of East Wenatchee.
These facilities shall include all kennels and facilities for the WVAC
disposal of sick and injured animals. WVAC will maintain the
shelter in a clean and sanitary condition, and it will not permit any
conditions to exist which might constitute a public nuisance.
(b) Give the best possible care and treatment to all animals in
its custody by providing them with adequate housing and food.
(c)Keep the animal shelter open for the purpose of receiving
animals and allowing animals to be redeemed by citizens for a
minimum of four hours each day, six days per week, to be set as a
regular schedule by WVAC, except legal holidays.
(d)Maintain 24-hour phone service for the purpose of receiving
complaints from the citizens of the City of East Wenatchee.
(e)Enforce all state laws pertaining to the control of animals,
prohibiting cruelty to animals and all city ordinances pertaining to
the control and licensing of animals, the disposal of animals, and
any and all other regulations relative to animals within the City of
East Wenatchee, except ordinances relating to barking dogs.

(f)Employ a person or persons who shall enforce the laws and
regulations as specified in paragraph 2.(e), by investigating
complaints, impounding animals, securing evidence of violations of
city ordinances or state laws, and furnishing reports of said
violations to the appropriate city officials and also appearing in
court in the case of prosecution of any of these violations. The
person or persons so employed to perform its obligations under this
agreement shall be employees of WVAC and not employees of the
City. In addition to maintaining the phone service as agreed to in
paragraph 2(d), a person shall be on call to respond to emergency
situations and to dispose of injured or dead animals, which are,
located in the City limits. The City and WVAC shall mutually
develop procedures for handling emergency calls and responding to
complaints within the limitations of the WVAC's personnel in order
to provide the service as specified herein.
(g)Issue dog licenses, collect dog fees throughout the City, and,
upon request furnish all license tags and record books used in said
licensing.
(h) Pick up and dispose of dead animals on City streets within
24 hours of notification.
(i) Provide for the humane disposal of unclaimed animals.
(j)Maintain complete records of licenses issued, fees collected,
animals received, animals disposed of, complaints received and
investigations conducted and shall make such records available for
the City's inspection at all reasonable times at the place of business
of WVAC. WVAC shall furnish quarterly reports of their activities
to the City of East Wenatchee Police Department. At a minimum,
the quarterly reports shall contain the following information:
Number of licenses issued;
Amount of licensing fees collected;
Number of animals received;
Number of animals impounded;
Number of animals quarantined;

(k) As soon as it is finalized, furnish the City with a copy of
WVAC’s budget for the upcoming year.
(l) Furnish the City with a copy of WVAC’s year-end
income/expense report by January 31 of each year.
(m) Furnish all equipment and supplies used in performing
WVAC's obligations arising from this agreement, except equipment
and supplies which the City shall furnish from time to time at its
own volition.
(n) In January of each year, make a presentation to the City
Council outlining WVAC’s activities over the past year and outlining
WVAC’s proposed activities for the upcoming year.
3. Obligations of the City. The City agrees to the following:
(a) Allow WVAC to retain all impounding fees collected by
WVAC.
(b) Pay WVAC in the amount and manner set forth in
paragraph 4 of this Agreement.
(c) Allow WVAC to retain all animal licensing fee collected by

WVAC.
(d)Provide, at the discretion of the City of East Wenatchee
Police Chief, commission cards to employees of WVAC so authorizing
that employee to act for the City to enforce the city laws pertaining
to animals. The City shall further cooperate with WVAC to see that
each employee who is employed to enforce any obligations assumed
hereunder shall have the authority to act on behalf of the City to
issue citations for violations of animal ordinances.
(e)Consult with WVAC and its employees and to educate
WVAC and its employees of the city ordinances.
4.Payments by the City. For service rendered under this
Agreement by WVAC, the City will pay WVAC an annual fee. The
annual fee is $73,514.82.
5.Annexation. If the City annexes additional area into its city
limits, it is understood that this contract may be renegotiated for a
different amount, prior to the end of the year. Either party may
terminate this agreement by delivering written notice to the other
party at least 90 days prior to the intended termination date.
6.Public Records. WVAC shall comply with the Public Records
Act, Chapter 42.56 RCW, Preservation and Destruction of Public
Records Act, Chapter 40.14 RCW, and Local Records Disposition
Authorization, Chapter 434-635 WAC, as they pertain to this
agreement.
7.Hold Harmless Agreement. WVAC releases and shall defend,
indemnify and hold harmless the City, its elected officials, officers,
employees, agents and volunteers from any and all claims, demands,
losses, negligent acts or omissions, and liabilities (including costs
and all attorney's fees) to or by any and all persons and entities,
including without limitation, their respective agents, licensees, or
representatives, arising from, resulting from, or connected with this
Agreement to the extent caused by the negligent acts, errors or
omissions of WVAC, its partners, shareholders, agents, employees,
or by WVAC's breach of this Agreement.
8.Insurance. WVAC shall maintain the following insurance
coverage and shall provide the City with certificates of insurance,

naming the City as an additional insured on all the following
policies: (a) Comprehensive general liability, premises operation,

2.Authority.

I.Summary Title: Professional Services contract between East Wenatchee Municipal Court and
Dynamic Collectors, inc.
II.Background/History: Municipal Court will be terminating the professional services contract
with Armada Corp. effective December 31, 2017. The Municipal Court has bargained with
Dynamic Collectors, inc. to enter into a contract beginning January 1, 2018. Attached you will
find a letter of collection services geared towards our court from Dynamic and a copy of the
contract.

THIS CONTRACT made and entered into this ____________ day of ____________________, 2017 by East
Wenatchee Municipal Court, East Wenatchee, Washington (hereafter called “COURT”) and Dynamic
Collectors, Inc. (hereafter called “AGENCY”). It is understood that the AGENCY will be principally liable for
compliance with this contract and insuring compliance of its affiliates, if any.
WHEREAS, the COURT holds unpaid judgments, which it desires to have collected; and
WHEREAS, statutory authority exists under RCW 3.02.045 for the assignment of said unpaid judgments to a
licensed collection agency for collection; and
WHEREAS, the AGENCY is duly licensed and bonded to collect said judgments assigned for collection by the
COURT, THE PARTIES AGREE AND CONTRACT AS FOLLOWS:
1.Term and Termination.
Either party may terminate this contract within thirty (30) days written notice to the other party or otherwise
as the parties may mutually agree. If at any time a party materially defaults on its obligations under this
contract the injured party may, at its option, send a notice thereof to the party in default. If such default is
not remedied within 15 days of delivery of such notice, the party sending the notice may thereafter terminate
this contract. If the AGENCY should become the subject of bankruptcy receivership or insolvency
proceedings, the COURT may elect to terminate this contract. Such election shall be effective immediately
upon mailing written notice of termination to the AGENCY. On termination of this contract, the AGENCY
shall, on request, furnish the COURT with any information obtained with reference to the assigned accounts
and/or consumer obligated thereon.
This contract shall automatically renew annually unless a desire to renegotiate a new contract is given by
either party.
2.Assignment of Judgments.
The AGENCY agrees to accept for collection and the COURT agrees to assign various judgments that the
COURT determines appropriate for collection, upon the terms and conditions set forth herein.
3. Collection Efforts.
The AGENCY shall exercise its best prudent and lawful efforts to secure collections of all accounts referred.
4.Debts Just and Owing.
The COURT certifies that every account referred will contain accurate information and will be just and
owing, and will not be subject to any valid defense, set-off or counterclaim then known to the COURT,
including that such account or the obligor of such account will not be subject to any bankruptcy proceeding,
stay or discharge as of the time of referral. The COURT shall promptly inform the AGENCY, in writing, of

any notice they receive that concerns any bankruptcy filing by any consumer, or of any other circumstance
which is made known to the COURT, which constitutes a defense to a collection action.
5.Compliance with Laws.
Collection activities by the AGENCY shall be in strict compliance with all State and Federal laws existing at
the time of collection activity. These laws include, but are not limited to, Chapter 19.16 RCW (the
Collection Agency Act), Chapter 19.86 RCW (the Consumer Protection Act), RCW 3.02.045 (governing use
of collection agencies by courts of limited jurisdiction), Public Law 95-109 (the Fair Debt Collection
Practices Act) and all applicable laws and regulations of the United States Departments of Postal Services
and the Federal Trade Commission and the Federal Service Member’s Civil Relief Act and any applicable
state iteration thereof.
6.Legal Action & Work to be Performed.
The AGENCY shall do all work and furnish all equipment, labor and materials necessary to collect unpaid
judgments assigned to the AGENCY by the COURT. The judgments assigned will be chosen at the sole
discretion of the COURT.
6.1. The AGENCY will provide a thirty-day notice for the COURT prior to assigning the judgments for
collections. The AGENCY will bear all expenses for the producing of this notice. This final notice will
be designed to meet the approval of the COURT and will reflect that payment is to be made to the
COURT.
6.2. Additional litigation by the AGENCY will be taken only after reasonable collection efforts have been
made. Unless otherwise agreed, legal costs and fees will be paid by the AGENCY and not the COURT,
and will be recoverable from the consumer where allowed by applicable law, out of first monies
recovered.
6.3. In the event that a defendant resides in another state, the judgment assigned from the COURT may be
forwarded to another collection agency with which the AGENCY has a Business Associates Agreement
or the judgment assigned from the COURT may be cancelled as an alternative.
7.Insurance and Surety Requirements.
For the duration of this contract, the AGENCY shall maintain in full force and effect and shall provide
evidence of all insurance required by East Wenatchee Municipal Court, including, but not limited to,
evidence of insurance against personal injury liability, comprehensive general liability, workers
compensation and automobile liability insurance. Available upon request.
Additionally, the AGENCY will provide a fidelity bond in the sum of $1,000,000.00. Available upon
request.
8.Claims Against Client.
Neither the AGENCY, nor the AGENCY’S attorneys shall be responsible for providing the COURT with
legal representation to defend the COURT against any claims, counterclaims or third-party claims asserted
against the COURT, whether asserted in response to a collection lawsuit initiated by the AGENCY or
otherwise.

9.Cancellation of Accounts.
Any judgments referred to the AGENCY may be withdrawn by the COURT at any time, unless legal action
has been commenced by the AGENCY. Notification of withdrawal may be verbal, but shall be verified in
writing prior to the next report date. In the event a judgment is withdrawn by the COURT, no fee will be due
to the AGENCY for collection efforts on said judgment.
10.Uncollectible Accounts.
In the event an account is deemed uncollectible by the AGENCY, it may be returned to the COURT together
with an explanation of why it is uncollectible.
11.Hold Harmless Clause.
The AGENCY agrees to indemnify and hold the Clerk of the Court, East Wenatchee Municipal Court and all
elected officials, employees and agents of the East Wenatchee Municipal Court harmless from and against
any and all claims, demands, liabilities, judgments, losses and expenses, including but not limited to court
costs and reasonable attorney fees occasioned by, arising out of related to, or in connection with any
negligent or willful action or omission of the AGENCY or its employees and agents in the performance of
the herein described. The COURT will indemnify and hold harmless the AGENCY, subsidiary or affiliated
companies and divisions, and their officers, agents, owners, attorneys and employees from any Claims
arising out of or as a result of the negligent acts or omissions of the COURT, its employees or agents; and
specifically agrees to indemnify and hold harmless from and against all Claims resulting from errors in
account information furnished to the AGENCY by the COURT.
12. Agency Compensation.
COURT will receive 100% of the principal amount placed with the AGENCY when judgments are paid in
full.
The AGENCY will leave a $5.00 balance on the judgment principal portion owed until all collection fees,
interest charges and legal costs or fees have been paid in full.
Collection fees shall be added by the COURT onto judgments assigned to the AGENCY at the time of
assignment. The AGENCY shall retain payment for services performed as set out hereafter:
The fee will be based on the assigned judgment amount per RCW 19.16.500. If the amount is $100.00 or
less, the COURT will assign a fee equal to the full amount. Judgments over $100.00 will be assigned a fee
of 50% of the assigned amount. Judgments over $100,000.00 will be assigned a fee of 35% of the assigned
amount.
Partial payments will be split between the COURT and the AGENCY as follows: Payments shall be applied
first to all costs and fees incurred by the AGENCY, including, but not limited to: filing fees, ex parte fees,
attorney fees and mailing and postage fees. Remaining payments shall be applied at a rate of 60% to the
COURT and 40% to the AGENCY.
13.Interest Charges.
Upon assignment to collection, interest shall accrue on all account amounts, including, but not limited to,
court costs and/or collection fees, at the rate of 12% percent per annum. Accrued interest shall be calculated
by the AGENCY, collected by the AGENCY and remitted by the AGENCY as follows: 100% of accrued

interest to the COURT prior to the AGENCY commencing legal action and 100% of interest accrued after
the AGENCY has commenced legal action shall be retained by the AGENCY. The AGENCY reserves the
right to write-off interest balances under $10.00 or to stop charging interest on payroll deductions and post-
dated payment plans.
The COURT must receive full payment in order to close a case. The COURT authorizes the AGENCY to
either waive or reduce interest as a negotiation tool.
14.Change in Law.
Should there be changes in laws or through the COURTS policies which prescribe/allow a different method
for receiving collection fees, the AGENCY shall modify its methods accordingly, upon instruction from the
COURT.
15.Payments to COURT from Other Source.
A payment made on behalf of a consumer directly to the COURT on an assigned account will be promptly
reported to the AGENCY by the COURT.
16.Bankruptcy.
When an account becomes subject to bankruptcy proceedings, the AGENCY will cancel the account back to
the COURT.
17.Reports and Remittance Schedule.
The AGENCY and the COURT agree to the following reports and remittance schedule, subject to mutual
modifications:
17.1. The AGENCY shall furnish the COURT with a computerized acknowledgment of the assigned
judgments within a reasonable period of time following receipt of the same. The acknowledgement
shall include an ALPHA listing by name of judgment consumer, court assigned case number, amount
assigned, total number of judgments and total dollar amounts assigned for collection.
17.2. The AGENCY will remit payment to the COURT monthly.
17.3. The AGENCY will furnish the COURT with a report indicating all judgments currently assigned to the
AGENCY upon request. The COURT will be provided online access to assigned judgments if desired.
18.Compromises.
The AGENCY will not engage in compromise settlement arrangements without the permission from the
COURT on any judgment turned over (with the exception of interest adjustments). The COURT shall have
no responsibility for uncollected costs advanced by the AGENCY.
19.Trust Fund Account.
The AGENCY shall deposit all sums received in payment of assigned judgments in a trust account
maintained at Security State Bank. All such funds shall be held in trust as the sole and exclusive property of
the COURT and shall not be used or available for any use by the AGENCY for any purpose whatsoever; or
in any way co-mingled with the assets of the AGENCY. Such funds will continue to be the funds of the
COURT until remitted or otherwise transferred. The COURT authorizes the AGENCY to endorse cashiers
checks and money orders made payable to the COURT for the purpose of deposit into said trust account.

20. Waiver.
Failure to enforce any provision of this Contract shall not be deemed a waiver of that provision. Waiver of
any right or power arising out of this Contract shall not be deemed waiver of any other right or power.
21. Severability.
In the event any term or condition of this Contract or application thereof to any person or circumstance is
held invalid, such invalidity shall not affect other terms conditions, or applications of this Contract which can
be given effect without the invalid term, condition, or application. To this end the terms and conditions of
this Contract are declared severable.
22. Notices.
All notices, requests, demands, consents and other communications hereunder shall be in writing and shall be
deemed to have been duly given when either (a) personally delivered; or (b) when deposited via certified
mail, return receipt requests, postage prepaid to the intended recipient set forth below:

23. Record Inspection.
The COURT and its staff shall have access to the books, documents, papers and records of the AGENCY;
which are directly pertinent to this Contract. The AGENCY shall allow inspection of such information upon
request from the COURT.
24. Audit.
The AGENCY will permit the COURT to audit court assigned judgments. Audits will be done at the
AGENCY’S office on any accounts pertinent to this agreement. The AGENCY will be notified one week in
advance that the COURT personnel will be conducting an audit and a time set for said procedure that is
convenient for the AGENCY and the COURT.
25. Nondiscrimination.
In doing the work herein described, the AGENCY shall not discriminate on the basis of race, religion, sex,
sexual orientation, age, national origin, disability or any other protected class consideration.

26.Beneficiaries to Contract.
This Contract is entered into for the benefit of the COURT and the AGENCY. No third-party beneficiaries
are intended to be created or are created hereunder and no other party can derive any benefit here from.
27.Entire Contract.
This Contract constitutes the entire understanding between the AGENCY and the COURT regarding
collection services provided to the COURT by the AGENCY, and may not be modified except by written
agreement signed by both parties. This Contract supersedes any prior Contract, unless incorporated herein
by reference.
28.Choice of Law and Venue.
This Contract shall be interpreted according to the laws of the State of Washington. Any judicial action to
resolve disputes arising out of this Contract shall be brought in Lewis County Superior Court.
